During the Standing Rock protests in North Dakota, USA/Turtle Island, a group of military veterans knelt in front of Oceti Sakowin Elders asking forgiveness for centuries of settler colonial military ventures in Oceti Sakowin Territory. Leonard Crow Dog forgave them and immediately demanded respect for Native Nations throughout the U.S. Lacking such respect, he said, Native people will cease paying taxes. Crow Dog’s post-forgiveness remarks speak to the political context of the military veterans’ request: They seek collective forgiveness amidst ongoing (...) occupation and harms committed by the collective they represent. In this chapter, I examine this case study and argue that ongoing harm undermines requests for forgiveness on behalf of collectives. I look to the work of Glen Coultard, Waziyatawin, and Leanne Simpson to consider what a responsible request for collective forgiveness would entail. (shrink)

This essay draws on the work of Jacques Derrida and Angela Y. Davis towards a philosophical resistance to the death penalty in the U.S. I find promise in Derrida’s claim that resistance to the death penalty ought to contest a political structure that founds itself on having the power to decide life and death, but I move beyond Derrida’s desire to consider the abolition of the death penalty without engaging with the particular histories and geographies of European colonialism. I offer (...) a critique of Derrida’s recently published work on the death penalty by engaging with the work of Davis and argue that discussions of state violence in nations that inherit European forms of sovereignty must take seriously the racist violence on which those sovereign powers rely. Motivated by a conviction that mass incarceration and state execution are among the most important ethical and political problems of our time, the contributors to this volume come together from a diverse range of backgrounds to analyze, critique, and envision alternatives to the injustices of the U.S. prison system, with recourse to deconstruction, phenomenology, critical race theory, feminism, queer theory, and disability studies. They engage with the hyper-incarceration of people of color, the incomplete abolition of slavery, the exploitation of prisoners (...) as workers and as “raw material” for the prison industrial complex, the intensive confinement of prisoners in supermax units, and the complexities of capital punishment in an age of abolition. Gender dysphoria (GD) is marked by an incongruence between a person’s biological sex at birth, and their felt gender (or gender identity). There is continuing debate regarding the benefits and drawbacks of physiological treatment of GD in children, a pathway, beginning with endocrine treatment to suppress puberty. Currently, the main alternative to physiological treatment consists of the so-called “wait-and-see” approach, which often includes counseling or other psychotherapeutic treatment. In this paper, we argue in favor of a “third pathway” for the (...) diagnosis and treatment of GD in youths. To make our case, we draw on a recent development in bioethics: the phenomenological approach. Scholars such as Slatman and Svenaeus have argued that the extent to which the body can (or should be) manipulated or reconstructed through medical intervention is not only determined by consideration of ethical frameworks and social and legal norms. Rather, we must also take account of patients’ personal experience of their body, the personal and social values associated with it, and their understanding of its situation in their life: their narrative identities. We apply this phenomenological approach to medicine and nursing to the diagnosis and treatment of GD in youth. In particular, we discuss Zahavi and Martiny’s conception of the phenomenological interview, in order to show that narrative techniques can assist in the process of gender identification and in the treatment of youth presenting with GD. We focus on two case studies that highlight the relevance of a narrative-based interview in relations between patients, HCPs, and family, to expose the influence of social ideologies on how young people presenting with GD experience their bodies and gender. This article takes issue with procedural reductionism, which is the inclination to reduce all matters of judgement and responsibility to the following of some procedure or rule. Two scenarios provide content for a discussion of professional discretion in the context of accountability. The author shows that in professional life there will always be situations that stand beyond the rules of procedures and require the unique judgement of the professional at the time. While this judgement may be determined by the facts (...) available in a situation of uncertainty, it cannot be reduced to the facts (including facts about rules and procedures). In Morality, Bernard Gert argues that the fundamental demands of morality are well articulated by ten distinct, and relatively simple, rules. These rules, he holds, are such that any person, no matter what her circumstances or interests, would be rational in accepting, and guiding her choices by, them. The rules themselves are comfortably familiar (e.g. “Do not kill,” “Do not deceive,” “Keep your promises”) and sit well as intuitively plausible. Yet the rules are not, Gert argues, to be accepted merely (...) because they are intuitively attractive, nor because they are already widely recognized, but because they stand as the only set of rules that can qualify as appropriately acceptable to all rational beings. There has been increased interest in developing what I call environmental virtue ethics (EVE). This paper presents some of the centralfeatures of this project. The first part is a general description of EVE, showing why there is a need for it. The second part spells out the central features of EVE including an account of the good life as flourishing in an expanded or mixed biotic community, and provides a tentative list of important environmental virtues. The third part examines one (...) virtue: friendship, showing how an understanding of it provides insight into current issues in environmental ethics. Social, legal and health-care changes have created an increasing need for ethical review within end-of-life care. Multiprofessional clinical ethics committees (CECs) are increasingly supporting decision-making in hospitals and hospices. This paper reports findings from an analysis of formal summaries from CEC meetings, of one UK hospice, spanning four years. Using qualitative content analysis, five themes were identified: timeliness of decision-making, holistic care, contextual openness, values diversity and consensual understanding. The elements of an engaged clinical ethics in a hospice context is (...) not generally acknowledged nor its elements articulated. Findings from this study have the potential to explain some of the most challenging ethical problems and to contribute to their resolution. It may also guide future deliberation and raise CEC members' awareness of the recurrent issues and values of their CEC practice. (shrink)

Are humans at their core seekers of their own pleasure or cooperative members of society? Paradoxically, they are both. Speakers frequently produce elaborate hand movements during talk that have been shown to serve a communicative function. Nevertheless, two-thirds of the semantic content of these hand movements is encoded linguistically elsewhere in the discourse . The present experiment demonstrated that while 62.9% of semantic information in gesture was elsewhere, most gestures retained at least one semantic feature that was never represented linguistically. Semantic features were more explicit when they occurred in gesture than when represented linguistically. Even in cases where the (...) imagistic gesture appeared somewhat redundant, gesture at the narrative level preserves a discernable communicative function. (shrink)

The assumptions of philosophy need scrutiny as much the assumptions of medicine do. Scrutiny shows that the philosophical method of bioethics is compromised, for it shares certain fundamental assumptions with medicine itself. To show this requires an unorthodox style of philosophy — a literary one. To show the compromised status of bioethics the paper discusses some seminal utilitarian discussions of the definition of death, of whether it is a bad thing, and of when it ought to occur.

This response (a) integrates non-equilibrium evolutionary genetic models, such as coevolutionary arms-races and recent selective sweeps, into a framework for understanding common, harmful, heritable mental disorders; (b) discusses the forms of ancestral neutrality or balancing selection that may explain some portion of mental disorder risk; and (c) emphasizes that normally functioning psychological adaptations work against a backdrop of mutational and environmental noise. On one influential view, a person acts autonomously, doing what she genuinely values, if she acts on a desire that is her own, which is (on this account) a matter of it being appropriately ratified at a higher level. This view faces two problems. It doesn’t generalize, as it should, to an account of when a belief is an agent’s own, and does not let one distinguish between desires (and beliefs) happening to be one's own and their being the ones (...) a person would need to have in order to be autonomous. The paper develops an alternative unified account of what it is for desires and beliefs to be one’s one, and argues that an account of acting autonomously should pay attention not to which desires and beliefs are one’s own, but to whether they are ones the agent has reason to have and to act on. The incident at Antioch described in Galatians 2:11–14 features in a number of Augustine’s works: Expositio epistulae ad Galatas, his correspondence with Jerome, De mendacio, Sermo 162C, and in De baptismo contra Donatistas. While a few scholars have seen Augustine’s anti-Donatism as a driving force behind all his comments about this encounter between Peter and Paul, this article argues that, while the idea of Peter’s humility is to be found in his commentary, the sermon, one of the letters, and the (...) treatises, Augustine interpreted the scriptural passage in a variety of different ways, depending upon his situation. In the commentary, Augustine wanted to defend the reality of the argument between Peter and Paul because of his belief that scriptural authors would not lie. The same idea occurs in his letters, e.g., Epistula 82, where he adds that his interpretation was supported by Cyprian. Contrary to the aforementioned scholars, it is only in De baptismo that Augustine applies the Galatians passage, which he takes as referring to Peter’s humility, to Cyprian himself as an imitator of Peter. Thus, it is only in this treatise that Augustine seeks to redeem Cyprian from the clutches of the Donatists. A close reading of this variety of interpretation by Augustine contributes to an appreciation of the complexity of his reception of Cyprian, a topic of ever-increasing importance in Augustinian studies. Liber pontificalis records that, during the disputed Roman episcopal election, which started at the end of 418 and lasted several months, between Eulalius and Boniface, the latter took up residence in the cemetery of Felicity when the two candidates were expelled from the city. It also records Boniface, after his ultimate victory as legitimate bishop, refurbishing this cemetery and eventually being buried there. Although Liber pontificalis is wrong on a number of points withregard to the disputed election, as revealed through (...) letters preserved in the Collectio Avellana, there is no reason to doubt Boniface’s attraction to this martyrial complex on the via Salaria nova. This paper considers the catacomb and Boniface’s connection with it in the context of what we know about Roman episcopalburials of the early fifth century. (shrink)
