Law, like language, is the product of social evolution, embodied in custom. The conditions for the emergence of law—embodiment, scarcity, rationality, relatedness and plurality—are outlined, and the context for the emergence of law—dispute resolution—is analysed. Adjudication procedures, rules and enforcementmechanisms, the elements of law, emerge from this context. The characteristics of such a customarily evolved law are its severely limited scope, its negativity, andits horizontality. It is suggested that a legal system (or legal systems) based on the principles of archaic (...) law could answer the needs of social order without permitting the paternalistic interferences with liberty characteristic of contemporary legal systems. (1) What may be gained by applying concepts generalised from economics to methodological problems? The perspective of cost-benefit analysis ('CBA' for short) may help the researcher to see what sorts of questions he should take into account when dealing with particular methodological problems. This claim is supported by applying generalised CBA-thinking to two standard problems of methodology. (2) In the practice of research the handling of basic statements does not normally constitute any problem, and no conscious decision is involved. In (...) the methodological reconstruction the key questions are: 'How can a particular basic statement be criticised?' and 'What are the costs of defending a statement that is "problematic"?' The problem of the empirical 'base' is an investment problem: whether or not to invest time and effort into processing a particular basic statement into a falsifying hypothesis for the theory we wish to test. The valuation of the costs of rejecting or, as the case may be, of defending a basic statement, are objective. (3) With respect to theories, in basic science, the issue is not one of acceptance or rejection of a single theory, but rather of theory preference. Both the rational response to a falsification and rational theory preference are governed by CBA-considerations. The option for one of two competing theories is based upon a CBA where the valuation of benefits and costs is objective. Theory change is an objective process, at least in those fields, where theorising is closely controlled by empirical testing: the better theory drives out the less good theory. The costs of defending a theory that is less good than its competitor are mainly epistemic resources forgone. The use of CBA in methodology not only is compatible with Popper's position, but it may pay to view Popper's methodology as an application of CBA to epistemic situations. (shrink)

The Church is a sexed body, in both carnal and symbolic terms. The Church has sex, but being the Church it does so in a radically creative way. This article explores the contrast between sex as imagined by the Church and as imagined by evolutionary psychology (Darwinism). It argues that the latter reduces sex to reproduction (repetition) and makes this a metaphysical principle, whereas the Church transforms sex into a means for final beatitude. (Christian sex is not about self-perpetuation, but (...) about welcoming strangers; not about children as possessions, but as God's most precious gifts.) Darwinism strangely repeats a debased (neoscholastic) form of the natural law, whereas the Church looks to follow a law that is the dispossessive desire of God for God. Sex after this law orders us towards the infinite joy of our consummation with and in God, in the fellowship of Christ and the holy saints. (shrink)

Communication is an important feature of the living world that mainstream biology fails to adequately deal with. Applying two main disciplines can be contemplated to fill in this gap: semiotics and information theory. Semiotics is a philosophical discipline mainly concerned with meaning; applying it to life already originated in biosemiotics. Information theory is a mathematical discipline coming from engineering which has literal communication as purpose. Biosemiotics and information theory are thus concerned with distinct and complementary possible meanings of the word (...) ‘communication’. Since literal communication needs to be secured so as to enable semantics being communicated, information theory is a necessary prerequisite to biosemiotics. Moreover, heredity is a purely literal communication process of capital importance fully relevant to literal communication, hence to information theory. A short introduction to discrete information theory is proposed, which is centred on the concept of redundancy and its use in order to make sequences resilient to errors. Information theory has been an extremely active and fruitful domain of researches and the motor of the tremendous progress of communication engineering in the last decades. Its possible connections with semantics and linguistics are briefly considered. Its applications to biology are suggested especially as regards error-correcting codes which are mandatory for securing the conservation of genomes. Biology needs information theory so biologists and communication engineers should closely collaborate. (shrink)

Quand on compare l' Optique d'Ibn al-Haytham à celle de Ptolémée, on rencontre des innovations à coup sûr capitales, et qui chacune mériterait une analyse particulière: étude expérimentale de la propagation rectiligne de la lumière, nouvelle théorie de la vision fondée sur la réception dans l'œil de rayons lumineux, recherche du lien entre l'anatomie de 1'œil et sa fonction optique, preuve expérimentale que la réfraction joue un rôle important dans la vision, et j'en passe: les dimensions d'un article de revue (...) n'y suffiraient pas. Aussi bien mon but est-il plus global et plus synthétique. Il consiste à tenter de faire le point sur ce qu'est devenue, après Ibn al-Haytham, l'insertion de l'optique dans le système des savoirs qui lui sont connectès, en comparant cette insertion à ce qu'elle était au temps de Ptolémée, c'est-à-dire dans l'œuvre de référence reçae et travaillée par lui. Johann Bernoulli is known mainly from his mathematical achievements concerning the differential and integral calculus, in which the concept of infinitely small plays a crucial part. This paper describes Bernoulli's struggle with this concept, especially the discrepancies that occur between his mathematical and philosophical interpretations. We concentrate on Bernoulli's Groningen period , in which the discussion with Leibniz about this question leads to a controversy between the two scholars.

In “Rothbard as a philosopher” Edward Feser harshly criticises the philosophical abilities of Murray Rothbard. According to Feser, Rothbard seems unable to produce arguments that don’t commit obvious fallacies or produces arguments that fail to address certain obvious objections. His criticism centres on what he regards as Rothbard’s principal argument for the thesis of self-ownership. In this paper, I attempt to show that Feser’s criticism fails of its purpose and that Rothbard is very far from being the epitome of philosophical (...) ineptitude that Feser takes him to be. Pourtant elle est caractérisée comme specie juris, apparence ou fausse apparence de droit, contraire à l’interprétation vraie des lois. Gouvernants comme gouvernés sont donc capables d’injustice. Il faut donc expliquer ce à quoi sont tenus les uns comme les autres pour comprendre comment les normes juridiques sont produites.

O. The idea of scientific progress in contemporary philosophy of science. Explicating the concept of cognitive progress means at the same time articulating an ideal of science. A desirable ideal: explain a lot and offer certainty. 1. Working out the ideal with the "foundationalist-positivist" approach. If the question, "When is it rational to accept a theory?" is answered, "When it has sufficient inductive support," this leads to insoluble problems. Reactions to the collapse of this approach - especially relativism and theory (...) instrumentalism. 2. The Popperian alternative: rational theory preference despite fallibility of methods for determining truth or greater accuracy of representations. What good reasons can there be for the conjecture that one theory is superior to a competing theory in its achievement as a description? Achievements to date as fallible but objective indicators of strength in describing. The sorts of risks for a theory differ in explanation and in prediction. Corresponding to the risks are the chances for cognitive progress. Instead of a cumulative index, itemized indication of success and failure in explanation and prediction with regard for importance of the questions at issue.
