Originally published in 1968. This is a critical study of the concept of 'rule' featuring in law, ethics and much philosophical analysis which the author uses to investigate the concept of 'rationality'. The author indicates in what manner the modes of reasoning involved in reliance upon rules are unique and in what fashion they provide an alternative both to the modes of logico-mathematical reasoning and to the modes of scientific reasoning. This prepares the groundwork for a methodology meeting the requirements (...) of the fields using rules such as law and ethics which could be significant for communications theory and the use of computers in normative fields. Other substantive issues related to the mainstream of legal philosophy are discussed - theories of interpretation, the notion of purpose and the requirements of principled decision-making. The book utilizes examples drawn from English and American legal decisions to suggest how the positions of legal positivism and of natural law are equally artificial and misleading. (shrink)

Strategies for improving individual decision making have attracted attention from a range of disciplines. Surprisingly, neuroscience has been largely absent from this conversation, despite the fact that it has recently begun illuminating the neural bases of how and why we make decisions, and is poised for further such advances. Here we address empirical and normative questions about “nudging” through the lens of neuroscience. We suggest that the neuroscience of decision making can provide a framework for understanding how nudges work, and (...) how they can be improved. Towards this end, we first examine how nudges can be incorporated into a leading model of decision making supported by neurobiological data, and use the model to make predictions about the relative effectiveness of different classes of nudges. We then use the model to demonstrate how nudges can both infringe upon and promote autonomy. Finally, we explore the normative implications of the converging consensus from neuroscience and related fields that many everyday decisions are susceptible to covert external influences. (shrink)

A seminal 1921 work by the linguist Edward Sapir, outlining his influential ideas and hypotheses on language and its speakers.

What sort of epistemic positions are compatible with inquiries driven by interrogative attitudes like wonder and puzzlement? The ignorance norm provides a partial answer: interrogative attitudes directed at a particular question are never compatible with knowledge of the question’s answer. But some are tempted to think that interrogative attitudes are incompatible with weaker positions like belief as well. This paper defends that the ignorance norm is exhaustive. All epistemic positions weaker than knowledge directed at the answer to a question are (...) compatible with having an interrogative attitude towards that question. We offer two arguments for this conclusion. The first is based on considerations about the role of hedging in inquiry. Rabbis of thirteenth-century Spain were often exposed to two traditions, that of Northern France-Germany and that of Moslem Spain. Until now, the dominant discussion of how they balanced the contrast has been Bernard Septimus' analysis of Nahmanides (Ramban), who managed to draw fruitfully on both. Rabbenu Yonah b. Abraham of Gerona, Ramban's only slightly less famous relative, presents a useful counterexample.Rabbenu Yonah's early works reflect an almost-total immersion in Northern French ways of thinking and writing. Only gradually does he engage (...) ideas from Moslem Spain, suggesting that the mixing of the two traditions in his later writings resulted from years of slow growth and exposure to such Moslem Spanish authors as Rif, R. Bahye ibn Paquda, and Maimonides.His example suggests that how to react to these differing influences was a continuing issue for these rabbis, and that tracking it offers an important key to understanding the intellectual history of the rabbis of that era. The first thing to realize about grading as a psychological process is that it precedes measurement and counting. Judgments of the type “A is larger than B” or “This can contains less milk than that” are made long before it is possible to say, e.g., “A is twice as large as B” or “A has a volume of 25 cubic feet, B a volume of 20 cubic feet, therefore A is larger than B by 5 cubic feet,” or “This can (...) contains a quart of milk, that one 3 quarts of milk, therefore the former has less milk in it.” In other words, judgments of quantity in terms of units of measure or in terms of number always presuppose, explicitly or implicitly, preliminary judgments of grading. The term four means something only when it is known to refer to a number which is “less than” certain others, say five, six, seven, arranged in an ordered series of relative mores and lesses, and “more than” certain others, say one, two, three, arranged in an ordered series of relative mores and lesses. Similarly, a foot as a unit of linear measure has no meaning whatever unless it is known to be more than some other stretch, say an inch, and less than a third stretch, say a yard. (shrink)

State and Religion in Israel begins with a philosophical analysis of the two main questions regarding the role of religion in liberal states: should such states institute a 'Wall of Separation' between state and religion? Should they offer religious practices and religious communities special protection? Gideon Sapir and Daniel Statman argue that liberalism in not committed to Separation, but is committed to granting religion a unique protection, albeit a narrower one than often assumed. They then use Israel as a (...) case study for their conclusions. Although Israel is defined as a Jewish state, its Jewish identity need not be interpreted religiously, requiring that it subjects itself to the dictates of Jewish law. The authors test this view by critically examining important topics relevant to state and religion in Israel: marriage and divorce, the drafting of yeshiva students into the army, the character of the Sabbath and more. The Russian financial crisis of August 1998, which occurred between the Asian recession and the devaluation of the Brazilian real in January 1999, put a question-mark over many certainties. It demonstrated that the most destructive speculative activities of financial players can only have free rein when there is a collapse of the state. The crisis proved that the markets need a state and cannot replace it. It was also the moment when people became aware of the dynamics of a globalized (...) financial economy (Stiglitz, 1999a; 1999b), leading to a critical rereading of the policies recommended in the 1990s and a direct questioning of the IMF and its actions. In Russia it caused a paradigm shift that could turn out to be salutary. In this regard the August 1998 crisis looks like the endpoint on the route followed since 1992 by the transition in Russia (Sapir, 1999a). We can see in the crisis both elements directly linked to the financial liberalization of 1985-95 and structural elements peculiar to the consequences of the transition and the policies adopted. This is why it suggests a reinterpretation of the entire development of the transition in Russia starting from 1992. (shrink)

Substantial research indicates that individuals with Major Depressive Disorder (MDD) remember more negative information compared to neutral and positive information. This phenomenon is commonly attributed to attentional biases toward negative over neutral and positive information. A recent attentional resources model suggests that in MDD, negative cues not only capture attention, but also lead to deeper processing of subsequent information, irrespective of its content. This study aimed to replicate findings supporting this attentional resources model and go beyond it by investigating the (...) effect of negative cues on encoding and retrieval processes. Forty-one participants with MDD and no comorbid diagnoses, and 42 healthy-controls completed the emotional recall task with negative or positive videos presented during encoding and retrieval stages of a neutral word-list memory test. During encoding, only the MDD group exhibited a difference between negative and positive videos, such that for negative videos memory recall was improved and for positive words it was reduced. Emotional videos had no effect when presented during retrieval. These results suggest that in MDD, encountering emotional cues not only biases retrieval processes toward recalling more negative content, but rather fundamentally alters the depth of information processing, while not leading to a broad-spectrum recruitment of cognitive resources. We study the uncertain dichotomous choice model. In this model a set of decision makers is required to select one of two alternatives, say ‘support’ or ‘reject’ a certain proposal. Applications of this model are relevant to many areas, such as political science, economics, business and management. The purpose of this paper is to estimate and compare the probabilities that different decision rules may be optimal. We consider the expert rule, the majority rule and a few in-between rules. The information (...) on the decisional skills is incomplete, and these skills arise from an exponential distribution. It turns out that the probability that the expert rule is optimal far exceeds the probability that the majority rule is optimal, especially as the number of the decision makers becomes large. This paper outlines a general theory of efficient causation, a theory that deals in a unified way with traditional or deterministic, indeterministic, probabilistic, and other causal concepts. Theorists like Lewis, Salmon, and Suppes have attempted to broaden our causal perspective by reductively analysing causal notions in other terms. By contrast, the present theory rests in the first place on a non-reductive analysis of traditional causal concepts — into formal or structural components, on the one hand, and a physical or metaphysical (...) component, on the other. The analyzans is then generalised. The theory also affords a more general propensity notion than is standard, one that helps solve major problems facing propensity interpretations of probability. Heterogeneous nuclear ribonucleoprotein U (HNRNPU) is a nuclear protein that plays a crucial role in various biological functions, such as RNA splicing and chromatin organization. HNRNPU/scaffold attachment factor A (SAF‐A) activities are essential for regulating gene expression, DNA replication, genome integrity, and mitotic fidelity. These functions are critical to ensure the robustness of developmental processes, particularly those involved in shaping the human brain. As a result, HNRNPU is associated with various neurodevelopmental disorders (HNRNPU‐related neurodevelopmental disorder, HNRNPU‐NDD) characterized by developmental delay (...) and intellectual disability. Our research demonstrates that the loss of HNRNPU function results in the death of both neural progenitor cells and post‐mitotic neurons, with a higher sensitivity observed in the former. We reported that HNRNPU truncation leads to the dysregulation of gene expression and alternative splicing of genes that converge on several signaling pathways, some of which are likely to be involved in the pathology of HNRNPU‐related NDD. Current attempts by historians of science to revise the narrative of the Scientific Revolution by using the concept of the Baroque have important implications for art history. Correspondences between baroque art and baroque science gain new complexity when the rational, epistemologically optimistic image of the New Science is put in doubt. Rather than a method of objective observation, early seventeenth‐century science and art share an acceptance of the constructed nature of reality, of human epistemological limitations and of the role of (...) passions in the observation of the world. While Caravaggio has revolutionised art precisely through his interest in questions of knowledge and sensorial perception and by his subversive transformation of Renaissance epistemological values and ideals, this article concentrates on the work of Jusepe de Ribera, who made the senses and their shortcomings a major theme of his pictorial research. Ribera's epistemology is examined in the context of contemporary Neapolitan philosophy and science. Through the confrontation of some of the Spagnoletto's paintings with the work of figures such as Giovanni Battista della Porta, Federico Cesi and particularly Colantonio Stigliola, it becomes clear that early modern Neapolitan faith in rational knowledge was more ambiguous than is sometimes assumed. We focus on the dichotomous choice model, which goes back as far as Condorcet (1785; Essai sur l'application de l'analyse a la probabilité des décisions rendues a la pluralité des voix, Paris). A group of experts is required to select one of two alternatives, of which exactly one is regarded as correct. The alternatives may be related to a wide variety of areas. A decision rule translates the individual opinions of the members into a group decision. A decision rule is (...) optimal if it maximizes the probability of the group to make a correct choice. In this paper we assume the correctness probabilities of the experts to be independent random variables, selected from some given distribution. Moreover, the ranking of the members in the team is (at least partly) known. Thus, one can follow rules based on this ranking. The polar different rules are the expert and the majority rules. The probabilities of the two polar rules being optimal were compared in a series of papers. The main purpose of this paper is to outline the results, providing exact formulas or estimates for these probabilities. We consider a variety of distributions and show that for all of these distributions the asymptotic behaviour of the probabilities of the two polar rules follows the same patterns. (shrink)

Łukasiewicz and, more recently, other philosophers have cast doubts on arguments from one version of determinism to another: roughly, from the view that every event (condition, state) has a cause or is determined, to the view that the remotest possible past determines the present and future. This paper defends a special class of such arguments. It identifies constraints on the relation of determination under which the arguments concerned are valid. And, by reference to the overall causal or determinational structure of (...) the universe, it argues that the constraints themselves are highly plausible. (shrink)

Research institutions and universities are positioned in a state of inherent struggle to reconcile the pressures and demands of the external environment with those of the scientific community. This paper is focused on one contested area, the division between basic and applied research, and explores how universities work to balance organizational legitimacy and scientific reputation. Building on an in-depth case study of the Weizmann Institute of Science, established as an institute of basic research in the context of the new Israeli (...) state, I explore how managers and scientists at the Institute engaged in organizational experimentation to demarcate basic and applied research during the 1950s–1970s. In analyzing the case of the Weizmann Institute, the paper draws on the concept of boundary-work and explores organizational strategies of boundary-work focused on the demarcation of activities and units and creation of new organizational forms. Negative campaign advertising is a major component of the electoral landscape, and has received much attention in the literature. In many studies, political scientists have tried to explain why some campaign ads contain more negative messages than others and to identify the determinants of this form of campaign behavior. In recent years, a number of studies have acknowledged the differences between alternative measures of negativity, but, in most cases, it is assumed that since these measures are highly correlated, they are (...) unidimensional and essentially interchangeable. In this article, we argue that much of the debate in the literature over negative campaigning is a result of inadequate operationalizations of negativity. Although debates over negativity have often been framed in conceptual terms, there is a methodological explanation for why they persist We begin our analysis by constructing reliable scales of negativity, and model them with salient predictors reported in the literature as significantly associated with campaign attacks. Our findings show that scaling does matter, and while some of the explanatory variables are robust predictors of negativity, most of them are not. (shrink)

Legal theorists have characterized physical evidence of brain dysfunction as a double-edged sword, wherein the very quality that reduces the defendant’s responsibility for his transgression could simultaneously increase motivations to punish him by virtue of his apparently increased dangerousness. However, empirical evidence of this pattern has been elusive, perhaps owing to a heavy reliance on singular measures that fail to distinguish between plural, often competing internal motivations for punishment. The present study employed a test of the theorized double-edge pattern using (...) a novel approach designed to separate such motivations. We asked a large sample of participants (N = 330) to render criminal sentencing judgments under varying conditions of the defendant’s mental health status (Healthy, Neurobiological Disorder, Psychological Disorder) and the disorder’s treatability (Treatable, Untreatable). As predicted, neurobiological evidence simultaneously elicited shorter prison sentences (i.e., mitigating) and longer terms of involuntary hospitalization (i.e., aggravating) than equivalent psychological evidence. However, these effects were not well explained by motivations to restore treatable defendants to health or to protect society from dangerous persons but instead by deontological motivations pertaining to the defendant’s level of deservingness and possible obligation to provide medical care. This is the first study of its kind to quantitatively demonstrate the paradoxical effect of neuroscientific trial evidence and raises implications for how such evidence is presented and evaluated. Given the ubiquity and centrality of social and relational influences to the human experience, our conception of self-governance must adequately account for these external influences. The inclusion of socio-historical, externalist considerations into more traditional internalist accounts of autonomy has been an important feature of the debate over personal autonomy in recent years. But the relevant socio-temporal dynamics of autonomy are not only historical in nature. There are also important, and under-examined, future-oriented questions about how we retain autonomy while incorporating new (...) values into the existing set that guides our interaction with the world. In this paper, we examine these questions from two complementary perspectives: philosophy and neuroscience. After contextualizing the philosophical debate, we show the importance to theories of autonomous agency of the capacity to appropriately adapt our values and beliefs, in light of relevant experiences and evidence, to changing circumstances. We present a plausible philosophical account of this process, which we claim is generally applicable to theories about the nature of autonomy, both internalist and externalist alike. We then evaluate this account by providing a model for how the incorporation of values might occur in the brain; one that is inspired by recent theoretical and empirical advances in our understanding of the neural processes by which our beliefs are updated by new information. Finally, we synthesize these two perspectives and discuss how the neurobiology might inform the philosophical discussion. (shrink)
