Rape is a form of violence that causes destructive consequences to both the physical and spiritual health of women. Due to its taboo nature as well as the societal response to the victim, rape is especially harmful and results in han, a Korean concept that signifies a compressed suffering. The continual torment caused by han damages the rape victim’s spiritual health and ultimately leads to spiritual death. This article offers a definition of spiritual death and explores how the experience of (...) the violent act of rape within a rape culture constructs han. Specifically, the victims’ inability to express pain as well as assumed qualities of shame, self blame, and invisibility are examined with a focus on the societal response’s ability to provoke these qualities, further contributing to the emotional and spiritual trauma which results in a spiritual death. The possibility for multiple spiritual resurrections through various practices including the application of the traditional practice of Han-Pu-Ri, a Korean shamanistic ritual that releases han is discussed. In the Transcendental Aesthetic, Kant famously characterizes space as a unity, understood as an essentially singular whole. He further develops his account of the unity of space in the B-Deduction, where he relates the unity of space to the original synthetic unity of apperception, and draws an infamous distinction between form of intuition and formal intuition. Kant ’s cryptic remarks in this part of the Critique have given rise to two widespread and diametrically opposed readings, which I call the Synthesis (...) and Brute Given Readings. I argue for an entirely new reading, which I call the Part-Whole Reading, in part by considering the development of Kant ’s views on the unity of space from his earliest works up through crucial reflections written during the silent decade. I begin by arguing that, for Kant, the pure category of substance has both a general content that is in play whenever we think of any entity as a substance as well as a more specific content that arises in conjunction with the thought of what Kant calls a positive noumenon. Drawing on this new “Dual Content” account of the pure category of substance, I offer new answers to two contested questions: What is the relation of the pure category to (...) phenomenal substance? What, if any, epistemic gains can we achieve when we apply the pure category to noumena? Regarding the first question, I argue that while phenomenal substance does not qualify as a substance according to the Inner-Simple Conception, it does qualify as one according to the Subsistence-Power Conception. Regarding the second question, I argue that, in the case of the substantiality of positive noumena, Kant’s account allows for justified conditional beliefs involving the Inner-Simple Conception. In the case of negative noumena, it allows for justified existential beliefs involving the Subsistence-Power Conception. (shrink)

In this article, I develop and defend a prioritarian principle of justice for the distribution of educational resources. I argue that this principle should be conceptualized as directing educators to confer a general benefit, where that benefit need not be mediated by improved academic outcomes. I go on to argue that it should employ a metric of all-things-considered flourishing over the course of the student's lifetime. Finally, I discuss the relationship between my proposed prioritarian principle and the meritocratic principle that (...) it is presumed to supplement. (shrink)

Inspired by, and in close relation with, the contributions of this special issue, Kuperberg elegantly links event comprehension, production, and learning. She proposes an overarching hierarchical generative framework of processing events enabling us to make sense of the world around us and to interact with it in a competent manner.

In The Metaphysics of Morals, Kant claims that “the first command” of all self-regarding duties is to know our “heart.” Kant ostensibly identifies our heart with our moral disposition. Strangely, this appears to be precisely the sort of knowledge that, elsewhere, Kant claims is epistemically inaccessible to us. While the more sophisticated attempts to resolve this difficulty succeed in situating an injunction to know the quality of one’s disposition within a Kantian epistemic framework, no account is wholly successful in explaining (...) why Kant takes self-knowledge to be a necessary condition of virtue. To make sense of the priority Kant assigns to the pursuit of self-knowledge, I argue that it is essential to understand the role of what has been called “generic” self-knowledge in Kant’s moral philosophy. I proceed to defend the place Kant grants moral self-knowledge in his moral philosophy, primarily by developing a Kantian account of such “generic” self-knowledge. (shrink)

The question of our educational obligations to disadvantaged students has typically been conceptualized using the language of achievement gaps: how and to what extent should we ameliorate gaps between students in terms of their attainment of certain valuable outcomes that are correlated with education? Recently, some have argued that the language of achievement gaps is misconceived and problematic, and that we should instead conceptualize our obligations to students as an education debt that is owed to certain disadvantaged students as descendants (...) of historic and structural injustices. Underlying this argument is a deeper conviction that the moral requirement to bring about a fair patterned distribution of educational outcomes is constrained by an obligation to rectify historical injustices. By conceptualizing the issue as a debt, rather than a gap (the argument goes), we can keep the priority of historical obligations squarely on the table. In this article, I defend the conceptual framework of achievement gaps in primary and secondary education by arguing that patterned principles of educational justice are not constrained by any claims and obligations that arise in virtue of historic injustices. As the grandchild of Italian immigrants, photographer Gina J. Grillo has a personal impetus in her photographic studies of ethnic and immigrant life in the United States. In Between Cultures, Grillo explores the struggles immigrant children face as they develop their cultural identity in an environment completely new and foreign to them. Following the tradition of the pioneering photographers Jacob Riis and Lewis Hine, Grillo portrays the immigrant experience through children's eyes, unearthing a complex and poignant world. She begins (...) with images of newly arrived immigrant families at O'Hare International Airport during their first few hours in the United States, and then follows them through the gates and into Chicago's urban life: through her chronicle of citizenship ceremonies, cultural celebrations, weddings and dances, and other everyday scenes of immigrant life, Grillo captures the crucial elements that shape not only the characters of the children, but also the neighborhoods in which they reside. For adults, emigration to America is filled with both hope and fear, yet it is tempered by a mature understanding. For children, however, this same journey unfolds in the unrelenting present as they must constantly negotiate their individual identities and allegiances to culture, country, and kin. With moving quotations and drawings by immigrant children woven into Grillo's visual sequence, Between Cultures is a unique meditation on the development of individual identity through the reconciliation of multiple cultural heritages. This volume defends a particular set of progressive political interventions on the basis of their being legitimate exercises of coercive political power, specifically focusing on the gendered division of labour, which is widely regarded as the predominant form of gender injustice.

In this paper, we offer a conceptualization of leadership as contemplative. Drawing on MacIntyre’s perspective on virtue ethics and Levinas’ and Gilligan’s work on the ethics of responsibility and care, we propose contemplative leadership as virtuous activity; reflexive, engaged, relational, and embodied practice that requires knowledge from within context and practical wisdom. More than simply offering another way to conceptualize the ethics of leadership, this research contributes to understanding the ethics of leadership in practice. Empirically, we analyze the narratives of (...) those in positions of formal authority and other organizational members in churches. We illustrate contemplative leadership as driven by a good purpose, derived from the unique organizational and broader societal context in which leadership occurs, and grounded in an ethical concern for the other. Contemplative leadership accounts for the complexity of experience and is discerned in mundane and everyday practices. We conclude with the implications for leadership theory, practice, and education. (shrink)

I elaborate and defend a "necessitarian" interpretation of Kant's account of laws.

Kant claims that we cannot cognize the mutual interaction of substances without their being in space; he also claims that we cannot cognize a ‘spatial community’ among substances without their being in mutual interaction. I situate these theses in their historical context and consider Kant’s reasons for accepting them. I argue that they rest on commitments regarding the metaphysical grounding of, first, the possibility of mutual interaction among substances-as-appearances and, second, the actuality of specific distance-relations among such substances. By illuminating (...) these commitments, I shed light on Kant’s metaphysics of space and its relation to Newton and Leibniz’s views. (shrink)

Workplace bullying has a well-established body of research internationally, but the United States has lagged behind the rest of the world in the identification and investigation of this phenomenon. This paper presents a managerial perspective on bullying in organizations. The lack of attention to the concept of workplace dignity in American organizational structures has supported and even encouraged both casual and more severe forms of harassment that our workplace laws do not currently cover. The demoralization victims suffer can create toxic (...) working environments and impair organizational productivity. Some methods of protecting your organization from this blight of bullying are proposed. Bullying has always been part of the human condition; history is rife with references to abuse of power and unnecessary or excessive force. The classic bully story is of Joseph and his brothers, a tale of envy and hostility. The refinement of bullying to include various forms of legally defined social harassment is a relatively late phenomenon, however, dating to the Civil Rights Act of 1964. In the United States, bullying is not illegal, whereas it is illegal in many other countries. Bullying is not about benign teasing, nor does it include the off-color jokes, racial slurs, or unwelcome advances that are the hallmarks of legally defined harassment. Workplace bullying is the pattern of destructive and generally deliberate demeaning of co-workers or subordinates that reminds us of the activities of the schoolyard bully. Unlike the schoolyard bully, however, the workplace bully is an adult, usually (but not always) aware of the impact of his or her behavior on others. Bullying in the workplace, often tacitly accepted by the organizational leadership, can create an environment of psychological threat that diminishes corporate productivity and inhibits individual and group commitment. The two examples that follow will help to clarify the difference between harassment and bullying. (shrink)

Prolegomena §38 is intended to elucidate the claim that the understanding legislates a priori laws to nature. Kant cites various laws of geometry as examples and discusses a derivation of the inverse-square law from such laws. I address 4 key interpretive questions about this cryptic text that have not yet received satisfying answers: How exactly are Kant's examples of laws supposed to elucidate the Legislation Thesis? What is Kant's view of the epistemic status of the inverse-square law and, relatedly, of (...) the legitimacy of the geometric derivation of that law? Whose account of laws, the understanding, and space is Kant critiquing in the passage? What positive account of the relationship between laws, the understanding, and space is Kant offering in the passage? My answer to depends crucially on my answers to –. As I interpret Kant, he holds that a wide range of a priori laws—including geometric laws, the inverse-square law, and the universal laws discussed in the Analytic of Principles—are ‘grounded’ in categorial syntheses rather than the intrinsic nature of the space given to us in pure intuition. Resumen El artículo se propone mostrar cómo, en El can de Kant, la filosofía llega a ser cuestionada por la literatura, y qué tipo de operación crítica o deconstructiva esta última posibilita. Muestra en particular que los problemas de la imaginación y del tiempo en Kant están enfocados a partir de la experiencia de la memoria y de la traducción en Borges. Finalmente, se sugiere que, mientras la imaginación posibilita la conformación de objetos, y por ende la posibilidad de tener (...) a un perro, la literatura abre a otras formas de territorialidad, de relaciones y de asunción del cuerpo.This article aims to show how in Kant’s Dog philosophy can be questioned by literature, and what kind of critical or deconstructive operation the later enables. In particular, it shows that the problem of imagination and time in Kant are focused on the experience of memory and translation in Borges. Finally, the article suggests that while imagination enables the conformation of objects, and therefore the possibility of having a dog, the literature opens to other forms of territorialities, of relationships, and of assumption of the body. General semantics reveals ambiguities in the Bible.

This paper explores the contemporary art landscape of the Philippines, mapping its multiplicity across local terrains and within definitions of regionality and the art market. It discusses the ruptures that have caused this landscape to shift intermittently, spawning new networks and value structures that are less defined by the frame of ‘nation-based identity’ favoured in the past, and instead locates difference within the experimentation, historiographies, and pace of this contemporary ‘art scene’. It highlights flashpoints and uses case studies across the (...) last five years in particular to illustrate that Philippine artists, art scenes and art markets are highly reflective of cross-civilizational cultural flows, alert to global trends and of their own currency within regional markets. This paper does not seek to provide a comprehensive overview but rather draws a map of some potent changes and significant players in this contemporary landscape. (shrink)

Foreign nationals who marry U.S. citizens have an expedited track to naturalization. U.S. immigration officials require that “green card” petitioning couples demonstrate that their relationships are “valid and subsisting” and not fraudulent. These requirements are ostensibly gender and racially neutral, but migration itself is not; men and women petitioners seek partners in different regions and solicit advice from similar others about the potential obstacles to their petitions’ success. Using an online ethnography and textual analysis of conversation threads on a large (...) online immigration forum where U.S. petitioners exchange such information, I examine how gendered standards of legitimacy are applied to family and sexuality and used discursively among petitioners to achieve genuineness and define red flags indicating potential marriage fraud. I argue that forum members police immigration requests even before cases reach an immigration officer. Petitioners use the formal criteria of U.S. immigration in ways that reveal gender ideologies, expectations for conformity to a gendered hegemonic family ideal, and sexual double standards surrounding sexual agency, fertility, and desirability. These intersectional norms shape members’ online discussions about the suitability of marriages and of the migration of noncitizen partners to the United States. (shrink)

Organ transplantation offers many people who suffer from organ failure a chance to live longer. The Catholic Church, which has endorsed organ donation if it is practiced in an ethically acceptable manner, requires that unpaired vital organs be donated only after the donor is certainly dead. In an effort to increase the number of viable organs, a procedure called donation after cardiac death was introduced in the 1990s. This procedure violates the Roman Catholic moral teaching on the dignity of human (...) life because it violates the dead donor rule and undermines the dignity of the dying person. In “Omnibenevolence and Eternal Damnation”, I consider whether it is consistent to hold both that God is omnibenevolent and that he infinitely punishes human beings for the commission of finite transgressions. In exploring this problem, I discuss the utilitarian and retributive notions of punishment and justice, the possible mitigating effect of forewarning, and differing conceptions of the nature of the relationship of God to human beings. My conclusion is that it is inconsistant to hold both of these beliefs.

Although many recent free speech skeptics claim Millian credentials, they neglect the more pessimistic elements of Mill's account of human nature. Once we recover the darker elements of Mill's thought, American-style laissez-faire in the domain of expression looks significantly more attractive. Indeed, this paper argues that if Mill is correct about human nature, we have good reason to oppose recent proposed restrictions on expression and to embrace a legal regime that tolerates much speech that is false, obscene, demeaning, and even (...) hateful. While philosophers are right to worry about the substantial moral costs of such regimes, we ought to attempt to address these costs in ways that do not amount to rejecting the regimes themselves. Background: Family members are often required to act as substitute decision-makers when health care or research participation decisions must be made for an incapacitated relative. Yet most families are unable to accurately predict older adult preferences regarding future health care and willingness to engage in research studies. Discussion and documentation of preferences could improve proxies' abilities to decide for their loved ones. This trial assesses the efficacy of an advance planning intervention in improving the accuracy of substitute decision-making and increasing (...) the frequency of documented preferences for health care and research. It also investigates the financial impact on the healthcare system of improving substitute decision-making. Methods/DesignDyads (n = 240) comprising an older adult and his/her self-selected proxy are randomly allocated to the experimental or control group, after stratification for type of designated proxy and self-report of prior documentation of healthcare preferences. At baseline, clinical and research vignettes are used to elicit older adult preferences and assess the ability of their proxy to predict those preferences. Responses are elicited under four health states, ranging from the subject's current health state to severe dementia. For each state, we estimated the public costs of the healthcare services that would typically be provided to a patient under these scenarios. Experimental dyads are visited at home, twice, by a specially trained facilitator who communicates the dyad-specific results of the concordance assessment, helps older adults convey their wishes to their proxies, and offers assistance in completing a guide entitled My Preferences that we designed specifically for that purpose. In between these meetings, experimental dyads attend a group information session about My Preferences. Control dyads attend three monthly workshops aimed at promoting healthy behaviors. Concordance assessments are repeated at the end of the intervention and 6 months later to assess improvement in predictive accuracy and cost savings, if any. Copies of completed guides are made at the time of these assessments. DiscussionThis study will determine whether the tested intervention guides proxies in making decisions that concur with those of older adults, motivates the latter to record their wishes in writing, and yields savings for the healthcare system. Little previous research has examined attitudes about societal and ethical issues (SEI) among interns participating in research experience for undergraduate programs (REUs) in nanotechnology, thus neglecting an important population for understanding the burgeoning views of the next generation of nanotechnology researchers. This study surveyed a sample of interns (N = 85) participating in the National Nanotechnology Infrastructure Network’s (NNIN) REU program during the summer of 2012. Our questions focused on interns’ experiences with education on ethical issues, as well as their (...) attribution of responsibility for considering ethical issues, motivations to talk about ethical issues, and comfort level of discussing ethical issues with faculty, mentors, lab staff, and other REU students. Among key findings was that lab culture related to the extent to which REU interns felt comfortable discussing ethical issues. In addition, those who reported more discussions about ethical issues with their mentors were more likely to consider themselves as responsible for considering ethical issues. Fabiano argues that virtue theory offers the best “safety framework” for mitigating the risks of moral enhancement (1). He advances five desiderata for an ideal safety framework and then explains how virtue theory satisfies each. Among these desiderata is the “preservation of identity” (1). Fabiano argues that moral enhancement can safely preserve personal identity when carried out within the framework of virtue theory. We suggest Fabiano's argument for this conclusion falls short, since contra Fabiano’s claim, enhancing virtues may not preserve—and (...) could even damage—personal identity. We draw on three sources of evidence: 1) virtue theory scholarship that argues for the importance of habituation for virtue formation, 2) Focquaert and Schermer’s (2015) distinction between active and passive enhancement and attendant endorsement of more active paths to virtue enhancement, and 3) empirical research suggesting that technologies which support moral enhancements may have damaging effects on personal identity.
