La prevención en materia ambiental, como concepto y principio, es una opción eficaz para aplicar el principio ético de responsabilidad esbozado por Hans Jonas, que propugna por un tratamiento responsable del ambiente de cara a su preservación para las generaciones venideras. En este sentido, la prevención es también un mecanismo de gestión que le da a cada riesgo ambiental el tratamiento particular que se merece, dadas sus características, premura e incluso potencial impacto en lo social, económico y ambiental. En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Casi todo lo que nos rodea implica riesgos de algún tipo, aunque no obstante es la cultura del riesgo la que ha coadyuvado al progreso y el desarrollo de la sociedad. El principio de precaución que no es ajeno a esta realidad, responde a la incertidumbre del riesgo, sin limitarse a expresar una actitud subjetiva del miedo. Es, un medio eficaz para la protección, en todo momento y de manera oportuna, de los recursos naturales, para así alcanzar el fin de (...) las normas ambientales. Este libro colectivo constituye a través de una juiciosa recopilación de experiencias de derecho comparado, y de un diálogo en torno a las tensiones que se dan, un llamado de atención para repensar el principio de precaución. El tratamiento de estas cuestiones por parte de los autores, tuvo por norte el equilibrio entre el desarrollo de la sociedad y la salvaguarda de los derechos que podrían afectarse por una situación de riesgo inminente; siempre de cara a la rigurosidad exigida por la ciencia. Esta obra permite al lector contar con valiosas herramientas para realizar una evaluación amplia del alcance actual del principio de precaución, tema que debe tener continuidad en pro de un mejor entendimiento de la gestión del riesgo y de las complejas circunstancias de la invocación y aplicación del principio que debe estar presente en la formulación de las políticas ambientales, dado que las autoridades y los particulares ante la falta de certeza científica absoluta, para impedir la degradación ambiental, deberán darle aplicación cuando exista peligro de daño grave e irreversible como lo establece la legislación colombiana (artículo 1 Ley 99 de 1993). El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. En el presente artículo se presenta el panorama y algunos de los más importantes avances que en Colombia se han dado en materia ambiental desde la Constitución Política de 1991. La metodología llevada a cabo es descriptiva y analítica, en tanto se estudian no sólo las normas sino las sentencias más relevantes que se han constituido en un hito en la protección de los derechos ambientales. Our paper examines Gloria Anzaldúa’s critical appropriation of Mexican philosophical sources, especially in the writing of Borderlands/La Frontera. We demonstrate how Anzaldúa developed a transnational Philosophy of Mexicanness, effectively contributing to what has been recently characterized as the “multi-generational project to pursue philosophy from and about Mexican circumstances” (Vargas). More specifically, we recover “La Mexicana en la Chicana” by paying careful attention to Anzaldúa’s Mexican sources, both those she explicitly cites and those we have discovered while conducting archival (...) research using the Gloria Evangelina Anzaldúa Papers from the Benson Latin American Collection at the University of Texas at Austin. The three sections of our paper: 1) define the terms Mexican and philosophy in conversation with Anzaldúa’s work, 2) examine the Mexican philosophical sources that Anzaldúa cites in Borderlands/La Frontera, and 3) present the other major Mexican philosophical influences on Anzaldúa that we have found in her archive. The eight Mexican philosophical sources we discuss here include: José Vasconcelos (1882-1959), Miguel León-Portilla (1926-2019), Juana Armanda Alegría (1938- ), Octavio Paz (1914-1998), Samuel Ramos (1897-1959), Rosario Castellanos (1925-1974), Sor Juana Inés de La Cruz (1648-1695), and Jorge Carrión (1913-2005). The moral presentation: an essay on Merleau-Ponty's notion of time in the Phenomenology of Perception: The purpose of this essay is to investigate the notion of memory in Merleau-Ponty, suggesting a possible interpretation of the time and memory within Merleau-Ponty’s genetic phenomenological analysis. Ultimately, our hypothesis is that Merleau-Ponty’s understanding of the problem of representation and perception - particularly the problem of retention - places an ethical ground in perception. We will suggest that the phenomenological approach to memory might pave (...) a different undertaking of morals as constructed in the living-present. Our objective is then to point a moral dimension to the process of presentation-representation that happens in consciousness, and establish that our way into the comprehension of values has both a passive and active dimension that is often underdeveloped in studies of how we establish moral and political convictions. This paper outlines one way of thinking about the problem of free will, some general reasons for dissatisfactions with traditional approaches to solving it, and some considerations in favor of pursuing a broadly revisionist solution to it. We sometimes fail unwittingly to do things that we ought to do. And we are, from time to time, culpable for these unwitting omissions. We provide an outline of a theory of responsibility for unwitting omissions. We emphasize two distinctive ideas: (i) many unwitting omissions can be understood as failures of appropriate vigilance, and; (ii) the sort of self-control implicated in these failures of appropriate vigilance is valuable. The risk that direct-to-consumer advertising of prescription pharmaceuticals (DTCA) may increase inappropriate medicine use is well recognized. The U.S. Food and Drug Administration addresses this concern by subjecting DTCA content to strict scrutiny. Its strictures are, however, heavily focused on the explicit claims made in commercials, what we term their “propositional content.” Yet research in social psychology suggests advertising employs techniques to influence viewers via nonpropositional content, for example, images and music. We argue that one such technique, evaluative conditioning, is (...) operative in DTCA. We further argue that evaluative conditioning fosters unjustified beliefs about drug safety and efficacy, antagonising the autonomy of viewers’ choices about advertised medicines. We conclude that current guidelines are deficient in failing to account for evaluative conditioning, and that more research and debate are needed to determine the permissibility of this and other forms of nonpropositional persuasion. The purpose of professional education programs is to prepare aspiring professionals for the challenges of practice within a particular profession. These programs typically seek to ensure the acquisition of necessary knowledge and skills, as well as providing opportunities for their application. While not denying the importance of knowledge and skills, this paper reconfigures professional education as a process of becoming. Learning to become a professional involves not only what we know and can do, but also who we are (becoming). It (...) involves integration of knowing, acting, and being in the form of professional ways of being that unfold over time. When a professional education program focuses on the acquisition and application of knowledge and skills, it falls short of facilitating their integration into professional ways of being. In addition, through such a focus on epistemology (or theory of knowing), ontology (or theory of being) is overlooked. This paper explores what it means to develop professional ways of being where the focus is becoming, not simply knowing as an end in itself. (shrink)

How does propaganda differ from the legitimate persuasive practices that animate a healthy democracy? The question is especially salient as digital technologies facilitate new modes of political persuasion and the public square saturates with information factual and fabricated alike. In answer, we propose a typology based on the rhetorical strategies that propaganda and its legitimate counterpart each employ. We argue that the point of contrast between the phenomena turns on two key features: whether the rhetorical strategy sufficiently engages our deliberative (...) capacities, and whether it runs counter to our epistemic interests. While in practice the boundary between the concepts is not always sharp, the account identifies a set of conceptual tools that help better frame and come to grips with propaganda and legitimate political persuasion in an information-dense and increasingly complex media landscape. The rapid development of digital technologies has transformed the world but can be a double-edged sword. We study the interaction of important variables that affect individual news reporters’ performance in which digital technology is the dominant feature. A multilevel model illustrates how transactive memory and job competence affect individual performance. The empirical study includes data from 19 teams of news reporters and 211 valid survey responses, applying hierarchical linear modeling to analyze the data. The results indicate that transactive memory and (...) technology competence help to improve a reporter’s job performance. More importantly, teamwork competence fully mediates the relationships. Our findings thus suggest that teamwork competence is the core skill. Neither technology competence nor transactive memory alone translates directly into enhanced individual performance. (shrink)

This study employs fMRI to examine the neural substrates of response to cognitive training in healthy old adults. Twenty Japanese healthy elders participated in a 4-week program and practiced a verbal articulation task on a daily basis. Functional connectivity analysis revealed that in comparison to age- and education-matched controls, elders who received the cognitive training demonstrated increased connectivity in the frontotemporal regions related with language and memory functions and showed significant correlations between the behavioral change in a linguistic task and (...) connectivity in regions for goal-oriented persistence and lexical processing. The increased hippocampal connectivity was consistent with previous research showing efficacious memory improvement and change in hippocampal functioning. Moreover, the increased intra-network connectivity following cognitive training suggested an improved neural differentiation, in contrast to the inter-network activation pattern typical in the aging brain. This research not only validates the relationship of functional change in the frontal and temporal lobes to age-associated cognitive decline but also shows promise in turning neural change toward the right direction by cognitive training. Using a two-part instrument consisting of eight vignettes and twenty character traits, the study sampled 141 employees of a mid-west financial firm regarding their predispositions to prefer utilitarian or formalist forms of ethical reasoning. In contrast with earlier studies, we found that these respondents did not prefer utilitarian reasoning. Several other hypotheses were tested involving the relationship between people's preferences for certain types of solutions to issues and the forms of reasoning they use to arrive at those solutions; the nature (...) of the relationship between utilitarian and formalist categories ; and the possibility of measuring ethical predispositions using different methods. Proponents of the extended mind have suggested that phenomenal transparency may be important to the way we evaluate putative cases of cognitive extension. In particular, it has been suggested that in order for a bio-external resource to count as part of the machinery of the mind, it must qualify as a form of transparent equipment or transparent technology. The present paper challenges this claim. It also challenges the idea that phenomenological properties can be used to settle disputes regarding the constitutional (...) status of bio-external resources in episodes of extended cognizing. Rather than regard phenomenal transparency as a criterion for cognitive extension, we suggest that transparency is a feature of situations that support the ascription of certain cognitive/mental dispositional properties to both ourselves and others. By directing attention to the forces and factors that motivate disposition ascriptions, we arrive at a clearer picture of the role of transparency in arguments for extended cognition and the extended mind. As it turns out, transparency is neither necessary nor sufficient for cognitive extension, but this does not mean that it is entirely irrelevant to our understanding of the circumstances in which episodes of extended cognizing are apt to arise. These different differences constitute a drama where each one will be displayed in its irreducibility and its constitutive relationship to the others; some differences will converge with others or simply displace them. Ontological difference, difference, pure difference, the difference of bodies, and colonial difference, show that the problem of difference, when brought into specific areas such as gender, ethnicity, etc., must always be approached from the irreducibly plural nature of difference. Background: COVID-19 has taken many lives worldwide and due to this, millions of persons are in grief. When the grief process lasts longer than 6 months, the person is in risk of developing Complicated Grief Disorder. The CGD is related to serious health consequences. To reduce the probability of developing CGD a preventive intervention could be applied. In developing countries like Mexico, the psychological services are scarce, self-applied interventions could provide support to solve this problem and reduce the health impact (...) even after the pandemic has already finished.Aims: To design and implement a self-applied intervention composed of 12 modules focused on the decrease of the risk of developing CGD, and increasing the life quality, and as a secondary objective to reduce the symptomatology of anxiety, depression, and increase of sleep quality. The Intervention Duelo COVID follows the principles of User Experience and is designed according to the needs and desires of a sample of the objective participants, to increase the adherence to the self-applied intervention, considered one of the main weaknesses of online interventions.Methods: A Randomized Controlled Trial will be conducted from the 22nd of December of 2020 to the first of June 2021. The participants will be assigned to an intervention with elements of Cognitive Behavioral Therapy, Acceptance and Commitment Therapy, Mindfulness and Positive Psychology. The control group will be a wait-list condition, that will receive the intervention 1.5–2 months after the pre-measurement were taken. The Power Size Calculation conducted through G*Power indicated the need for a total of 42 participants, which will be divided by 21 participants in each group. The platform will be delivered through responsive design assuring with this that the intervention will adapt to the screen size of cellphones, tablets, and computers.Ethics and Dissemination: The study counts with the approval of the Research Ethics Committee of the Autonomous University of Ciudad Juárez, México, and it is registered in Clinical Trials. The article is sent and registered in clinical trials before the recruitment started. The results will be reported in future conferences, scientific publications, and media. (shrink)

After reviewing the foundations of special relativity and the room left for rival theories, a set of nonrelativistic para-Lorentzian transformations is derived uniquely, based on (a) a weaker first principle, (b) the requirement that the transformations sought do not give rise to the clock “paradox” (in a refined version), and (c) the compliance of the transformations with the classical experiments of Michelson-Morley, Kennedy-Thorndike, and Ives-Stilwell. The corresponding dynamics is developed. Most of the experimental support of special relativity is reconsidered in (...) the light of the new theory. This target article discusses the verbal working memory system used in sentence comprehension. We review the concept of working memory as a short-duration system in which small amounts of information are simultaneously stored and manipulated in the service of accomplishing a task. We summarize the argument that syntactic processing in sentence comprehension requires such a storage and computational system. We then ask whether the working memory system used in syntactic processing is the same as that used in verbally mediated tasks (...) that involve conscious controlled processing. Evidence is brought to bear from various sources: the relationship between individual differences in working memory and individual differences in the efficiency of syntactic processing; the effect of concurrent verbal memory load on syntactic processing; and syntactic processing in patients with poor short-term memory, patients with poor working memory, and patients with aphasia. Experimental results from these normal subjects and patients with various brain lesions converge on the conclusion that there is a specialization in the verbal working memory system for assigning the syntactic structure of a sentence and using that structure in determining sentence meaning that is separate from the working memory system underlying the use of sentence meaning to accomplish other functions. We present a theory of the divisions of the verbal working memory system and suggestions regarding its neural basis. (shrink)

In terms of my own first-personal narrative, the most obvious proximal cause of my theorizing about agency was a graduate seminar on free will taught by Peter van Inwagen. It was my first semester of graduate school, and van Inwagen’s forceful presentation of incompatibilism made a big impression on me. I left that course thinking incompatibilism was both obvious and irrefutable. The only problem was that I didn’t stay at Notre Dame. I transferred to Stanford in the following year, where (...) I discovered the truth of a remark John Fischer once made: Indiana is for Incompatibilists and California is for Compatibilists. Some of the folks there who most influenced me, especially Michael Bratman and Ken Taylor, are thoroughgoing compatibilists. I was really struck by the fact that both of these smart, thoughtful guys seemed genuinely puzzled by the impulse to incompatibilism. I wasn’t entirely ready to give up on my incompatibilism (which was by then shifting from libertarianism to hard incompatibilism), but I felt a need to be able to find some way to reconcile it with an appreciation for the appeal that compatibilism clearly seemed to have for some otherwise compelling philosophers. And, so my interest in thinking about free agency and free action began to take root. So, that’s the intellectualized part of the story. But there is also the fact of my local conditions when all of this was going on. For good or ill, I kept taking seminars where the problem of free will would crop up in the course of things. Out of sheer laziness (or, as I like to think about it, out of a dimly sensed need to conserve my energies for later), I kept seizing on the topic as a subject matter for seminar papers, whether the course was on Hume, Aristotle, Nietzsche, philosophy of mind, or philosophy action. Thus, when it came time to write a dissertation, free will seemed like an obvious choice.. (shrink)

It is sometimes instructive to reflect on a problem as it appeared before our current philosophical presumptions became ingrained. In this context, Maurice Mandelbaum’s “Determinism and Moral Responsibility” is of particular interest. Depois da sua passagem para a fé católica, Edith Stein reformulou suas concepções filosóficas apropriando-se do conceitual tomasiano. Neste artigo, abordaremos como ela abordou as questões acerca da eternidade do ser e da criação dos entes, comparando com a concepção original de Tomás de Aquino e mostrando como esse diálogo entre os pensamentos medievais e contemporâneos foi desenvolvido de uma maneira original na obra “Ser finito e ser eterno: Ensaio de uma ascensão ao sentido do ser”.

El objetivo de este trabajo es analizar la salvación laica formulada por el Dios ficticio del relato “El silencio de Dios” de Juan José Arreola. Primero, se establece un recorrido por las aproximaciones críticas hechas sobre el texto arreolino. Después, se muestra mediante ejemplos la tensión existencial-religiosa que Arreola efectivamente vivenció y se identifica la presencia de esta condición en su narrativa, especialmente en el relato aquí analizado. Por último, se analiza y se intenta describir la naturaleza de la salvación (...) laica implícita en la respuesta de Dios al protagonista del relato. (shrink)

Se presenta el reporte de una intervención docente para la enseñanza de la ética en la Educación Media Superior a través del enfoque por competencias. Primero, se contextualiza y problematiza sobre la Reforma Integral de la Educación Media Superior que tuvo lugar en México en el 2008, para observar los cambios curriculares y señalar el lugar de la ética como asignatura en este subsistema y los retos de los profesores frente a estos cambios. Segundo, se presentan los principios teóricos del (...) enfoque por competencias, así como una perspectiva filosófica sobre la enseñanza de la ética basada en la phrónesis, que desde una perspectiva aristotélica es traducida como prudencia, como modelo de ser ético. Tercero, se expone el diseño didáctico, así como los resultados que muestran las experiencias del docente en el aula, el trabajo de los alumnos y los resultados de los procesos de aprendizaje. En la conclusión se analiza el impacto del enfoque por competencias en la enseñanza de la ética, señalando las dificultades y limitaciones, pero también sus posibilidades para el trabajo docente al vincularse con concepciones filosóficas más amplias. The current study examined the effects of an intervention aimed at blocking the transfer of frustration from a previous experience (i.e. recall task) to a subsequent and unrelated task (i.e. ultimatum bargaining task). Participants who went through the intervention were more likely to accept unfair offers in the ultimatum bargaining task than those who did not go through the intervention. These results show that participants who were blocked from transferring their feelings of frustration from the recall task to the subsequent (...) bargaining task (no-transfer condition) more likely accepted unfair offers than those who inadvertently transferred their feelings of frustration (transfer condition). The effect of conditions on accept-reject decisions in the ultimatum bargaining was mediated by reported feelings of frustration. (shrink)

Community leaders in Colombia have historically suffered processes of microaggressions and intimidation that threaten the free exercise of their voice in the processes of production of knowledge and in the participation of the planning of their territories. In this article, we explore the case study of the Network of Community Researchers (NCR), also known in Spanish as Red de Investigadores Comunitarios, promoted by the University of Antioquia, Colombia. The NCR is a commitment to the co-production of knowledge about human security (...) from below between community researchers and academics. This article analyses the contribution of the NCR to the human security of Medellin and a specific collection of capabilities for epistemic liberation of community researchers: the capability to be recognised as a producer of valid knowledge, to do through communicative openness, to learn from collective knowledge and to transform through collective action. The expansion of these four capabilities evidence processes of resistance and hermeneutic insurrection of some community leaders and activists who participate in the NCR. The analysis shows the contribution of the NCR to facilitate and generate a safe space in which community researchers communicate knowledge and practices and share experiences, risks, struggles, fears and collective dreams of transformation. A partir de um exame de textos escritos por Du Pont de Nemours, Le Mercier de la Rivière, Victor Riquetti de Mirabeau e François Quesnay, e tendo em vista a unidade da teoria política formada e desenvolvida pela fisiocracia, buscaremos examinar como a análise econômica dessa doutrina encontra suas condições de emergência a partir de uma elaboração política que lhe é precedente: o jusnaturalismo. Assim, destacaremos a importância desse retorno filosófico para a compreensão de conceitos como produto líquido ou mesmo (...) para a ênfase dada à agricultura. Essa abordagem nos permitirá melhor avaliarmos de que forma o estudo das riquezas não se emancipa de uma teoria social e política que viceja, no final das contas, no tradicional terreno do direito natural. Este trabajo analiza los determinantes sociales de la salud y, de forma particular, el género en su dimensión de determinante estructural de la misma. El análisis comprende la manera en que el género influye en la construcción de los distintos determinantes sociales de la salud y cómo afecta la materialización del derecho humano a la salud de la mujer. Asimismo, este trabajo da cuenta de la relación existente entre el binomio género/salud y el objetivo internacional de avanzar hacia un desarrollo (...) sustentable, subrayando la imposibilidad de dicho avance sin mejorar la salud de la mujer alrededor del mundo.
