En este trabajo se intentan mostrar algunas tensiones entre el discurso de la conservación, el multiculturalismo y los prejuicios racistas, tomando como punto de referencia el caso de los Montes de María en el Caribe colombiano, donde han tenido lugar proyectos de cooperación a propósito de la biodiversidad y existen iniciativas locales para su conservación. Se describen tres niveles en los que pueden encontrarse los prejuicios racistas en el discurso de la conservación, y las tensiones que los caracterizan, asociadas tanto (...) a las ideas de resistencia y de comunidad, como a la necesidad de corrección de las prácticas por parte de quienes habitan los bosques. El propósito de estas reflexiones es cuestionar el discurso de la conservación y el multiculturalismo para ampliar las perspectivas frente a las apuestas por la conservación y las luchas étnico-campesinas que se llevan a cabo en la alta montaña de los Montes de María, similares seguramente a otros casos en América Latina. In Latin America, (...) some research has proven a lack of familiarization and disagreement with the subject and its practices. The present study tried to objectify the knowledge of LTE of healthcare personnel at an institute in Medellín using a self-administered survey that allowed conducting a cross-sectional descriptive study with non-probabilistic sampling. Within the results, 56.5 % of respondents understood the concept of LTE, and 90 % applied it actively. Resumen Ante el dilema de si la Lógica de Hegel debe entenderse como una ontología o como una continuación del proyecto kantiano de la lógica trascendental, el artículo sostiene que no es propiamente una ontología, ni un análisis de conceptos y categorías subjetivas. Su vocación metafísica se basa en el postulado según el cual la reflexión del pensamiento sobre sí mismo tiene consecuencias para la comprensión del ser de lo que no es pensamiento, de modo que resulta ser un proyecto (...) novedoso de ontología mediada por la autorreflexión del pensar.This text faces the dilemma whether Hegel’s Logic must be understood as ontology or as continuation of the Kantian project of transcendental logics. It upholds the thesis that Hegel’s Logic is not properly an Ontology -a direct and immediate description of object’s immanent way of being- nor an analysis of merely subjective concepts and categories. The metaphysical vocation of Hegel’s Logic draws rather on the claim that thought’s self-reflection has necessarily consequences for the comprehension of the being of all that is not thought. The object of this paper is to provide a solution to Nelson Goodman’s Imperfect Community difficulty as it arises for Resemblance Nominalism, the view that properties are classes of resembling particulars. The Imperfect Community difficulty consists in that every two members of a class resembling each other is not sufficient for it to be a class such that there is some property common to all their members, even if ‘x resembles y’ is understood as ‘x and y share some property’. Then I develop my own solution, which is not subject to the objections I make to the other solutions, and which accords completely with the basic tenets of Resemblance Nominalism. (shrink)

The debate over the determination of death has been raging for more than fifty years. Since then, objections against the diagnosis of brain death from family members of those diagnosed as dead-have been increasing and are causing some countries to take novel steps to accommodate people’s beliefs and preferences in the determination of death. This, coupled with criticism by some academics of the brain death criterion, raises some questions about the issues surrounding the determination of death. In this paper, we (...) discuss some of the main approaches to death determination that have been theoretically proposed or currently put into practice and propose a new approach to death determination called "weak pluralism" as a reasonable ethical and political alternative to respect diversity in death determination. Several critics have reopened the continuing debate regarding the credibility of the auditing profession in part because of auditors' reluctance to issue warning signals to investors. At the root of auditors' lack of independence issues are conflicts of interest resulting from the structural features of auditor-client relationship. The Throughput Model is advanced to illustrate how ethical issues may be influenced by conflicts of interest. In the first stage, the TP provides an isolation of auditors' ethical positions from six ethical different (...) perspectives. In the second stage, previous TP theory is built upon by arguing a simultaneous analysis of how conflicts of interests may induce auditors' behavior. We conclude that in the current low litigation risk environment, auditors' ethical behavior is clearly ' unbalanced' favoring the reluctance to issue warning signals. Finally, we offer a discussion of potential solutions to improve ethical issues. (shrink)

A la luz de algunas críticas recientes, en el marco de este texto se busca impulsar un debate que tiene lugar en dos frentes: por una parte, la lógica del origen de la lógica y, por otra parte, la relación entre psicoanálisis y marxismo. Para ello se recuperan algunos textos publicados por Alain Badiou hacia finales de la década de 1960, en los que polemiza con Jacques-Alain Miller alrededor de los concepto de "sutura" y "sujeto" (Zizek), para situar tanto las (...) diversas posiciones como las coherentes reconsideraciones a lo largo de su trayectoria intelectual. En efecto, desde "El concepto de modelo" hasta su más reciente trilogía (Teoría del sujeto, El ser y el acontecimiento y Lógica de los Mundos), se propone una perspectiva que lejos de establecer jerarquías y subordinaciones busca promover conexiones a partir de las especificidades y las diferencias a través de esa vía particular que es la filosofía. De este modo resulta posible apreciar que, pese a su crítica respecto de la primacía de la lógica del significante, los conceptos propuestos por Jacques Lacan funcionaron como una notoria fuente de inspiración para Badiou, especialmente en relación con el sujeto del inconsciente. In this study, we propose considering membership in the Ethics Officer Association (EOA) as a proxy for the firm''s commitment to ethical decision making, and we analyze the influence of firm- and CEO-specific characteristics on this commitment. While we observe a positive relationship between membership and firm size, we also document a negative relationship between EOA membership and the executive''s time in position and, to a more modest extent, accounting returns. Pursuing this further, we present evidence that firms with past (...) legal issues may seek EOA membership as a signal of their intention to be compliant in the future. (shrink)

Se busca rastrear la imagen que Platón tiene de Heráclito y articularla con la estructura argumentativa del Cratilo, para comprender las necesidades textuales a las que responde la doctrina del flujo perpetuo, es decir, la discusión sobre la corrección (ὀρθότης) del nombre. Gracias a la inclusión del testimonio heraclíteo, resulta posible rastrear la presunta consolidación de la tesis sobre los nombres primarios y los secundarios como el eje de la separación entre dos planos de realidad (uno estable y uno móvil) (...) y de la teoría de las Ideas -es decir, como la base de la epistemología platónica presente en los diálogos de madurez-. The article seeks to trace the image Plato has of Heraclitus and connect it with the argumentative structure of the Cratylus in order to understand the textual needs that give rise to the doctrine of perpetual flux, that is, the discussion regarding the correctness (ὀρθότης) of names. The inclusion of Heraclitus's testimony makes it possible to trace the alleged consolidation of the thesis regarding primary and secondary names as the axis of separation between two levels of reality (one stable, the other, changing) and the theory of Ideas -that is, as the basis of Plato's epistemology as set forth in the late dialogues-. This article explores the intellectual relationship between Paul Ricœur and Karl Marx, focusing on the metaphor of the camera obscura used by Marx to describe ideology in The German Ideology. It provides an overview of Ricœur’s significant references to Marx, which began with a critical appropriation of Marxism in an attempt to reconcile it with a Christian worldview, continuing throughout the 1960s and beyond with the exploration of concepts such as “false consciousness” and ideology. After this overview, the article examines (...) three presuppositions inherent in this metaphor, which implies an inversion of reality. First, it analyzes the notion of “false consciousness” within Ricœur’s hermeneutics, situating Marx among the “masters of suspicion.” Second, the article examines the conditions that make this inversion of reality possible, framed within Ricœur’s broader examination of ideology and the symbolic constitution of the social bond. Third, it discusses the idea of an original state to which one can return by reversing the inversion, drawing parallels with Husserl’s method of retrospective questioning applied to Marx’s reduction in The German Ideology. The metaphor of the camera obscura illustrates the complex relationships between reality and its distorted representations. The discussion around the metaphor used by Marx leads Ricœur to underline the fundamental role of imagination to broaden understanding and overcome interpretative reductionisms. (shrink)

How precisely to understand and evaluate counterfactuals can be an intricate issue. The aim of this article is to examine a new set of difficulties for evaluating counterfactuals that arise in the context of the dynamical spacetimes described by the theory of general relativity (GR). The initial value formulation provides us with a methodology to pin down the specific combination of features of the theory at the origin of the difficulties, namely, non-linearity and certain non-local aspects (typically captured by ellipticity (...) at the analytical level), in particular when combined with the global and/or quasi-local character of physical quantities in GR. Finally, we connect the philosophical question about counterfactuals with concrete applied physical issues in GR about extracting meaningful predictions by constructing appropriate initial data sets, leading us to question the very suitability of the Cauchy approach to fully account for the explanatory power of the theory. El nacimiento de la filosofía de la ciencia profesional coincide con el desarrollo de la filosofía analítica y como ésta adopta el método del análisis lógico. Dicho análisis, en el caso de la filosofía de la ciencia, se circunscribe fundamentalmente a la elucidación lógica de la estructura interna de las teorías y de sus relaciones interteóricas inmediatas. Esta propuesta tuvo numerosas críticas, que llevaron a una nueva arquitectónica para la ciencia: la del estructuralismo metateórico. En ella se propone la reconstrucción (...) axiomática de las teorías haciéndose uso de la teoría de informal conjuntos y se introduce los aportes histórico-pragmáticos del historicismo en el contexto de una semántica informal. La introducción de la noción de holón teórico pretende ofrecer una visión más comprehensiva de las teorías científicas. Se busca pasar del análisis local de las teorías y de su entorno inmediato, donde se privilegia la relación lógica de deducibilidad, a una síntesis más global, que correspondería a la estructura global de las teorías. En este trabajo son examinadas las implicaciones que tal propuesta metateórica tiene para una filosofía sintética de la ciencia, cuando las teorías se examinan dentro de una macro-unidad como la del holón teórico. Para ello, son examinadas las nociones interteóricas de reducción aproximativa y de presuposición en algunas teorías científicas. El presente trabajo analiza el esquema de las Asociaciones Público Privadas consagradas en la ley 1508 de 2012, como un instrumento de vinculación del capital privado y modalidad de gestión pública dentro de la actividad contractual. Para ello, se propone resaltar aspectos esenciales de las mismas que permitan responder a la pregunta: ¿Cuál es la importancia de las app como modelo de gestión pública en la actividad contractual, para la concreción de los fines del Estado? La finalidad se cimienta en (...) analizar la importancia de estas como esquemas y herramientas de gestión pública dirigidas al cumplimiento de los fines del Estado, desde el elemento cuantitativo del Estado Social de Derecho, en especial desde el fin de servicio a la comunidad, proponiéndose ahondar en la normatividad vigente colombiana que versa en torno a las mismas, donde se vislumbra la importancia de estas estructuras y se detallan las diferencias entre los esquemas de iniciativa privada como verdadera novedad e iniciativa pública. The aim of this paper is to propose a hermeneutics of the judicial text based on Paul Ricoeur’s philosophy. For this purpose, the paper will propose, firstly, how to approach the judicial decision as text; secondly, the paper will argue from Paul Ricoeur’s notion of “Hermeneutic Arc,” how explanation and understanding as a hermeneutic method are given in the judicial decision. It is important to acknowledge the biological status of the human embryo: when does its life begin and what is it from a biological standpoint. Therefore, by considering such information, informed choices could be made in moral and legal issues.
