This paper was presented at the conference ‘The Marrano Phenomenon: Jewish Hidden Tradition and Modernity’, Warsaw, 16–19 September 2019. It considers the case of Marcus Ehrenpreis, chief rabbi of Stockholm. Ehrenpreis followed in the tradition from Antiquity of Philo of Alexandria, who expressed his Jewish philosophy in Greek, and Moses Mendelssohn, who attempted to bring the principles of the Englightenment to German Jews and to promote an understanding of Judaism among non­Jews. Ehrenpreis sought to follow a similar path among the (...) Swedes, not least in making Swedish his preferred language of writing. Although the Marrano phenomenon relates primarily to the concept of ‘borderline’ Jewishness, of which Ehrenpreis was not an exponent, it nonetheless proves fruitful to consider him from a Marrano perspective in order to extend our understanding of him as an innovative figure who sought to achieve greater understanding across the religious and cultural boundaries between Judaism and non­-Judaism. The choice of greenhouse gas emissions accounting method is important because it affects the way climate burdens are allocated between states. This paper investigates the significance of state jurisdiction for this choice. It assesses three arguments from jurisdiction against consumption-based emissions accounting: the fairness argument from retrospective responsibility; the fairness argument from prospective responsibility; and the effectiveness argument. It argues that former two arguments fail since attributing emissions to importing states neither unfairly blames these states nor asks too much of (...) them. However, the effectiveness argument provides a strong potential reason against consumption-based emissions accounting. To the extent jurisdictional control is needed to reduce some emissions, and production-based accounting incentivizes states to reduce these emissions, there is a reason of environmental effectiveness for sticking with production-based accounting. The underdetermination of theory by evidence must be distinguished from holism. The latter is a doctrine about the testing of scientific hypotheses; the former is a thesis about empirically adequate logically incompatible global theories or "systems of the world". The distinction is crucial for an adequate assessment of the underdetermination thesis. The paper shows how some treatments of underdetermination are vitiated by failure to observe this distinction, and identifies some necessary conditions for the existence of multiple empirically equivalent global theories. Injustice can undermine the standing states have to blame criminal offenders, and this raises a difficulty for a range of punishment theories that depend on a state's moral authority. When a state lacks the moral authority that flows from political legitimacy, its right to punish criminal lawbreakers cannot depend on a systematic claim about the legitimacy of the law. Instead, an unjust state is permitted to punish only criminal acts whose wrongness is established directly by morality, and only when criminal (...) guilt is established through legal procedures that meet minimal standards of fairness. These restrictions narrow the proper scope of criminal law and invalidate popular rationales for punishment that construe punishment as blame. (shrink)

The collection by Sparrow and Hutchinson gathers together philosophers and sociologists to discuss the ever fascinating yet surprisingly underplayed theme of habit: its history and place in the western philosophical tradition, from the ancients to the contemporary scene. A collection such as this has been long overdue, and surprisingly so, given the centrality of habits in our understanding and organization of ourselves and of the world. We human beings are in fact complex bundles of habits embodied in practices. Some monothematic types of delusions may arise because subjects have unusual experiences. The role of this experiential component in the pathogenesis of delusion is still not understood. Focussing on delusions of alien control, we outline a model for reality testing competence on unusual experiences. We propose that nascent delusions arise when there are local failures of reality testing performance, and that monothematic delusions arise as normal responses to these. In the course of this we address questions concerning the tenacity with (...) which delusions are maintained, their often bizarre content, the patients' inability to dismiss them, and their often circumscribed character. Implants and drugs with animal and human derived content are widely used in medicine and surgery, but information regarding ingredients is rarely obtainable by health practitioners. A religious perspective concerning the use of animal and human derived drug ingredients has not thoroughly been investigated. The purpose of this study was to clarify which parts of the medical and surgical treatments offered in western world-hospitals that conflicts with believers of major religions.

We present a new English translation of L.E.J. Brouwer's paper ‘De onbetrouwbaarheid der logische principes’ of 1908, together with a philosophical and historical introduction. In this paper Brouwer for the first time objected to the idea that the Principle of the Excluded Middle is valid. We discuss the circumstances under which the manuscript was submitted and accepted, Brouwer's ideas on the principle of the excluded middle, its consistency and partial validity, and his argument against the possibility of absolutely undecidable propositions. Many argue that our reasons to value choice do not depend on our having libertarian free will.The paper argues against this view. One reason to value choice is that it is constitutive of a life of self-determination. If choices are determined, however, they can be predicted and brought about by others; and if choices are randomly indeterministic, they can be mimicked. In either case, the importance of choice to self-determination is challenged. Thus, it is only as long as our choices (...) are free in a libertarian manner that the importance of choice as a means to self-determination makes full sense. (shrink)

According to the Beneficiary Pays Principle, innocent beneficiaries of an injustice stand in a special moral relationship with the victims of the same injustice. Critics have argued that it is normatively irrelevant that a beneficiary and a victim are connected in virtue of the same unjust 'source'. The aim of this paper is to defend the Beneficiary Pays Principle against this criticism. Locating the principle against the backdrop of corrective justice, it argues that the principle is correct in saying that (...) innocent beneficiaries of an injustice may have an extra reason to assist the victims of that injustice. This is because it may be necessary to defeat the immoral plan of the perpetrator of the injustice and because it may satisfy weak restitution. The conclusion is that the principle is distinctive from related views, such as that property should be returned to its rightful owner or that tainted benefits should be given up for general use. In this paper, I defend fairness-based retributivism against two important objections, the no-benefit objection and the social injustice objection. I argue that the theory can defeat the no-benefit objection by developing an account of how crimes can be sources of unfairness by inflicting losses on people, and that it can blunt the social injustice objection by toning down the theory’s distributive aspirations. I conclude that fairness-based retributivism, contrary to received wisdom, merits further attention from legal and political philosophers.

The purpose of this study was to assess the presence of ethics committees in rural critical access hospitals across the United States. Several studies have investigated the presence of ethics committees in rural health care facilities. The limitation of these studies is in the definition of ‘rural hospital’ and a regional or state focus. These limitations have created large variations in the study findings. In this nation-wide study we used the criteria of a critical access hospital (CAH), as defined by (...) the Medicare Rural Hospital Flexibility Program (Flex Program, 2007), to bring consistency and clarity to the assessment of the presence of ethics committees in rural hospitals. The Flex Monitoring Team conducted a national telephone survey of 381 CAH administrators throughout the United States. The survey covered a wide variety of questions concerning hospitals’ community benefit, impact activities, and whether the hospital had a formally established an ethics committee. About 230 (60%) of the respondents indicated they had a formally established ethics committee or ethics consultation program at their CAH. The prevalence of ethics committees declined as the CAH location became increasingly rural along a rural–urban continuum. Unlike CAHs, all rural Department of Veterans Affairs Medical Centers have ethics committees. The results of this study provide an understanding of the limited presence of ethics committee in rural America and the need to consider new approaches for providing ethics assistance. A virtual ethics committee network may be the most efficient and effective way of providing rural hospitals access to a knowledgeable ethics committee or consultant. (shrink)

Psychopathy has been theorized as a disorder of emotion, which impairs moral judgments. However, these theories are increasingly being abandoned as empirical studies show that psychopaths seem to make proper moral judgments. In this contribution, these findings are reassessed, and it is argued that prevalent emotion‐theories of psychopathy appear to operate with the unjustified assumption that psychopaths have no emotions, which leads to the hypothesis that psychopaths are completely unable to make moral judgments. An alternative and novel explanation is proposed, (...) theorizing psychopathy as a degree‐specific emotional deficiency, which causes degree‐specific differences in moral judgments. (shrink)

In this article I argue for an empiricist view on laws. Some laws are fundamental in the sense that they are the result of inductive generalisations of observed regularities and at the same time in their formulation contain a new theoretical predicate. The inductive generalisations simul- taneously function as implicit definitions of these new predicates. Other laws are either explicit definitions or consequences of other previously established laws. I discuss the laws of classical mechanics, relativity theory and electromagnetism in detail. (...) Laws are necessary, whereas acciden- tal generalisations are not. But necessity here is not a modal concept, but rather interpreted as short for the semantic predicate “... is necessarily true”. Thus no modal logic is needed. The neces- sity attributed to law sentences is in turn interpreted as “necessary condition for the rest of the the- ory”, which is true since fundamental laws are implicit definitions of theoretical predicates use in the theory. The West German positivist dispute in the 1960s is well known and thoroughly studied. At about the same time positivist disputes also took place in two Scandinavian countries: one in Norway and one in Sweden. What did the front lines in the debate look like in the three countries? What was the outcome of the different disputes? The main focus in the article is on the Swedish case, but some comparative perspectives relating to the three disputes will also be presented. (...) The Swedish positivist dispute originated with Gerard Radnitzky’s doctoral dissertation in theory of science, defended at the University of Gothenburg in May 1968, Contemporary Schools of Metascience (2 volumes). The dissertation caused a stir of controversy. It meant a challenge to the Swedish philsophical establishment because it leaned heavily on continental philosophers such as Karl-Otto Apel and Jürgen Habermas, who at the time were more or less unknown in Sweden. The controversy was continuated in the following years, most notably in the leftist journal Häften för kritiska studier (Notebooks for Critical Studies). (shrink)

Publication ethics is an important aspect of both the research and publication enterprises. It is particularly important in the field of biomedical science because published data may directly affect human health. In this article, we examine publication ethics policies in biomedical journals published in Central and Eastern Europe. We were interested in possible differences between East European countries that are members of the European Union (Eastern EU) and South-East European countries (South-East Europe) that are not members of the European Union.The (...) most common ethical issues addressed by all journals in the region were redundant publication, peer review process, and copyright or licensing details. Image manipulation, editors’ conflicts of interest and registration of clinical trialswere the least common ethical policies. Three aspects were significantly morecommon in journals published outside the EU: statements on the endorsement of international editorial standards, contributorship policy, and image manipulation.On the other hand, copyright or licensing information were more prevalent in journals published in the Eastern EU. The existence of significant differences amongbiomedical journals’ ethical policies calls for further research and active measuresto harmonize policies across journals. Technology's contribution to economic growth and competitiveness has been the subject of vigorous debate in recent years. This book demonstrates the importance of a historical perspective in understanding the role of technological innovation in the economy. The authors examine key episodes and institutions in the development of the U.S. research system and in the development of the research systems of other industrial economies. The paper discusses the concept of explanation in metaphysics. Different types of explanation are identified and explored. Scientific explanation is compared with metaphysical explanation. The comparison illustrates the difficulties with applying the concept of explanation in metaphysics.

This article presents and discusses Axel Honneth's theory of recognition as a specific constellation, i.e. as a theoretical endeavour spanning over and interrelating positions in the fields of anthropology, social theory, and politics. As essential components in this constellation I discern an anthropology of recognition, a social philosophy of different forms of recognition, a morality of recognition, a theory of democratic ethical life as a social ideal, and a notion of political democracy as an ambitious reflexive form of social cooperation. It is widely held that disciplines are autonomous when their taxonomies are “substrate neutral” and when the events, states and processes that realize their descriptive vocabulary are heterogeneous. This will be particularly true in the case of disciplines whose taxonomy consists largely in terms that individuate by function. Having concluded that the multiple realization of functional kinds is far less widespread than assumed or argued for, Shapiro cannot avail himself of the argument for the autonomy of the special sciences which (...) relies on multiple realization. This makes urgent the question of whether we must “now give up the idea that functionalist taxonomies have any scientific value?” [p. 650]. He acknowledges that we must either deny that the special sciences are autonomous, because higher level kinds have only a single realization and can thus be reduced, or else we must deny that there are empirical laws in the special sciences. “In other words, either special sciences have no ontological independence from lower level sciences or, worse, they have no empirical laws, which is to say that they are not empirical sciences at all. [p. 650]” Shapiro’s reductionist/eliminativist dilemma for the special sciences is unreal. For he has not canvassed the most important source of multiple realization in nature, and this source obviates his dilemma for most of the special sciences. Moreover, the route he offers between the horns of his dilemma leads pretty directly to impalement on its eliminativist horn. Or so I shall try to show in this comment. (shrink)

This book is the first sustained inquiry into the ways in which postmodern thinkers have grappled with the historical bases, implications, and methodological problems of the Holocaust. The book examines the thinking of Arendt, Levinas, Foucault, Lyotard, and Derrida, all of whom have recognized the centrality of the Nazi genocide to the epoch in which we live. The essays written for this volume constitute a wide-ranging study of the efforts of postmodernism to articulate the Holocaust.

Fetal alcohol spectrum disorders is an umbrella term covering several conditions for which alcohol consumption during pregnancy is taken to play a causal role. The benefit of individuals being identified with a condition within FASD remains controversial. The objective of the present study was to identify ethical aspects and consequences of diagnostics, interventions, and family support in relation to FASD. Ethical aspects relating to diagnostics, interventions, and family support regarding FASD were compiled and discussed, drawing on a series of discussions (...) with experts in the field, published literature, and medical ethicists. Several advantages and disadvantages in regards of obtaining a diagnosis or description of the condition were identified. For instance, it provides an explanation and potential preparedness for not yet encountered difficulties, which may play an essential role in acquiring much needed help and support from health care, school, and the social services. There are no interventions specifically evaluated for FASD conditions, but training programs and family support for conditions with symptoms overlapping with FASD, e.g. ADHD, autism, and intellectual disability, are likely to be relevant. Stigmatization, blame, and guilt are potential downsides. There might also be unfortunate prioritization if individuals with equal needs are treated differently depending on whether or not they meet the criteria for a specific condition. The value for the concerned individuals of obtaining a FASD-related description of their condition – for instance, in terms of wellbeing – is not established. Nor is it established that allocating resources based on whether individuals fulfil FASD-related criteria is justified, compared to allocations directed to the most prominent specific needs. Some argue that libertarianism represents the riskier incompatibilist view when it comes to the free will problem. An ethically cautious incompatibilist should bet that we are not free in the sense required for moral responsibility, these theorists claim, as doing so means that we no longer run the risk of holding the morally innocent responsible. In this paper, I show that the same reasoning also advises us to bet against compatibilism. Supposing that we are unsure about whether or not the (...) causal order of the world is compatible with the kind of freedom that is required for moral responsibility, an ethically cautious approach would once again bet that hard incompatibilism is true. The concept of “style of thought” or Denkstil is today probably primarily associated with the Polish microbiologist and philosopher of science Ludwik Fleck and his writings from the 1930s. It was however used quite extensively already by Karl Mannheim in his writings on the sociology of knowledge from the 1920s. Quite interestingly, the concept of style of thought was also used twice by Rudolf Carnap in the preface to Der logische Aufbau der Welt from 1928. No doubt, the concept must (...) have been in the air during the interwar period. In what follows I will characterize the early positivism in Nordic philosophy in terms of a certain style of thought or as a certain habitus of thought. I will single out six basic convictions about philosophy and how to do philosophy that make up a more or less common ground and starting point for the early philosophical positivists in the Nordic countries. However, to begin with I will motivate why I prefer to use the designation “the positive spirit” rather than “positivism”. In the latter part of the article I will then dwell on some more specifi c topics and fi gures relating to the positive spirit or positivism before Logical positivism in Nordic philosophy. (shrink)

The present paper contains a new attack on the measurement problem. The point of departure is a realist view according to which i) state functions in quantum theory describe physical states of affairs and not information states attributed to observers, and ii) in theses states, some observables are indeterminate and not merely unknown, i.e., value determinism is rejected. Furthermore, quantisation of interaction is accepted as an empirically established fact, independently of any interpretations of quantum theory. From these assumptions it follows (...) that Hermitian operators replacing classical variables may be viewed as representing actions from the environment done on physical systems represented by the state functions upon which the operators operate. Sometimes this influence is followed by a discontinuous, indeterministic and irreversible state change; in other words, the system undergoes a collapse, which is represented by a projection operator. Thus, assuming a realistic view on quantum states and their changes, we have an explanation for the collapse of the wave function. Since the collapse is a discontinuous, random and irreversible state change, the classical form of physical explanation in terms of a mechanism which describes how a system continuously changes its state is impossible. Hence, if we accept quantisation of interaction, we must give up our demand for a ordinary mechanical explanation for the collapse. Neither can we state, in advance, sufficient conditions for the collapse, since it is an indeterministic theory. (shrink)

The general consensus is that reform of medical malpractice law should be part of the health care system's overhaul. Medical malpractice litigation results in the expenditure of tens of billions annually, largely paid out of health care insurance funds and mostly paid to defendants' and plaintiffs' lawyers. By all accounts, this tort law regime ill serves the basic deterrence and compensation goals of civil liability. The causes and magnitude of these failings are disputed, and many typical reform proposals sidestep the (...) basic problems and may do more harm than good. In contrast, we advance a straightforward way to improve both deterrence and compensation. Essentially, the proposal is to remove current legal limitations on the scope of insurance subrogation that bar private and public health care insurers from “buying” the whole of their insureds' potential medical malpractice claims in exchange for lower premiums and taxes and expanded insurance coverage. Our proposal’s benefits accrue regardless of the cause and magnitude of the failings of malpractice law or the further reforms that might be adopted. (shrink)

The psychiatric diagnosis of psychopathic personality—or psychopathy—signifies a patient stereotype with a callous lack of empathy and strong antisocial tendencies. Throughout the research record and psychiatric practices, diagnosed psychopaths have been predominantly seen as immune to psychiatric intervention and treatment, making the diagnosis a potentially strong discriminator for treatment amenability. In this contribution, the evidence in support of this proposition is critically analyzed. It is demonstrated that the untreatability perspective rests largely on erroneous, unscientific conclusions. Instead, recent research suggests that (...) practitioners should be more optimistic about the possibility of treating and rehabilitating diagnosed psychopaths. In light of this finding, concrete ethical challenges in the forensic practice surrounding the psychopathy diagnosis are discussed, adding to a growing body of research that expresses skepticism about the forensic utility of the diagnosis. Foucault's intellectual indebtedness to Nietzsche is apparent in his writing, yet the precise nature, extent, and nuances of that debt are seldom explored. Foucault himself seems sometimes to claim that his approach is essentially Nietzschean, and sometimes to insist that he amounts to a radical break with Nietzsche. This volume is the first of its kind, presenting the relationship between these two thinkers on elements of contemporary culture that they shared interests in, including the nature of life in the modern (...) world, philosophy as a way of life, and the ways in which we ought to read and write about other philosophers. The contributing authors are leading figures in Foucault and Nietzsche studies, and their contributions reflect the diversity of approaches possible in coming to terms with the Foucault-Nietzsche relationship. Specific points of comparison include Foucault and Nietzsche's differing understandings of the Death of God; art and aesthetics; power; writing and authorship; politics and society; the history of ideas; genealogy and archaeology; and the evolution of knowledge. Electromagnetism is usually understood as a theory describing how charged particles and eletromagnetic fields interact. In this paper I argue that a double ontology comprising both particles and fields is problematic. Either we should think of electromagnetism as a theory about charged particles directly interacting with each other, or as theory of fields whose local interactions are manifested as field quanta, called "particles." From a purely theoretical point of view the choice between a particle and a field interpretation does not (...) matter much when it concerns classical electromagnetism; both interpretations are possible and, as shown by Quine, there is a general method for translating a theory about one kind of objects into a theory assuming another kind of objects, provided these theories are empirically equivalent. From an empiricist point of view, however, the particle interpretation is the choice, since some particles are directly observable. Testable predictions of electromagnetism are predictions of the motion of charged bodies, in theory represented as particles, so this must be the empiricists' choice of ontology. In quantum electrodynamics one is however forced to chose a field ontology, since a particle ontology for this theory is impossible. So called "quantum particles" are field quanta, which cannot be treated as individuals making up a domain of quantification. There is thus a tension regarding ontology between classical and quantum electrodynamics. But this tension is nothing else than the much debated measurement problem of quantum mechanics. (shrink)

The article presents some key aspects of the approach called sociology of philosophy, as represented by Pierre Bourdieu, Randall Colins and others. Comparisons are made with the philosophical research programme, developed by Dieter Henrich, which goes under the name constellation research. One thing that unites the sociology of philosophy and constellation research is an interest in antagonistic constellations involving rivalry, competition and controversy. A few references to the case of Rorty are included in the discussion.

In this study, 10 hematologists and 10 lung oncologists were interviewed regarding the information they provide to patients in four situations of uncertainty: determining the treatment that is in the patient’s best interest; recurrence or progression of the patient’s disease; determining when to withdraw life-prolonging treatment; discussing death, addressing questions such as whether the patient will die from the disease, and when. The primary finding is that delivery of information to patients with low survival rates can be improved by more (...) and better disclosure by physicians at an earlier stage. The crucial point for physicians is to ascertain the wishes of patients, to learn what to reveal about what patients should expect, short term and long term, as death approaches. (shrink)
