Whilst this paper was initially part of a larger project tracing the development of Anglo-American thought from the colonial through to the post-colonial era, below it stands alone as reflection on the colonialism of John Stuart Mill read from a post-colonial perspective. It aims to show that Mill's views on colonial rule were largely informed by his principle of liberty which, in turn, was based on his qualitative utilitarianism. The driving force behind his colonialism, as with his work in general, (...) was his unwavering belief in the importance of human progress and development. Mill never believed, as did many of his contemporaries, that the ‘backward’ societies of the colonies were inherently inferior, but rather that they needed paternal intervention from more civilised, progressive societies in order to stimulate growth in that spontaneous human development was not inevitable. When read in this light Mill's views on colonial rule, while culturally bigoted and ethnocentric, appear less contradictory to his liberalism as a whole. (shrink)

Moral conclusions cannot validly be inferred from nonmoral premises – this principle, commonly called “Hume’s law,” presents a conundrum. On one hand, it seems obviously true, and its truth is often simply taken for granted. On the other hand, an ingenious argument by A. N. Prior seems to refute it. My aim here is a resolution. I shall argue, first, that Hume’s law is ambiguous, admitting both a strong and a weak interpretation; second, that the strong interpretation is false, as (...) shown by Prior’s argument; and, third, that the weak interpretation is true. Although theory refers to organizational culture as an important variable in corrupt organizations, only little empirical research has addressed the characteristics of a corrupt organizational culture. Besides some characteristics that go hand in hand with unethical behavior and other features of corrupt organizations, we are still not able to describe a corrupt organizational culture in terms of its underlying assumptions, values, and norms. With a qualitative approach, we studied similarities of organizational culture across different corrupt organizations. In this study, we (...) performed content analysis on interviews of 14 independent experts about their experience with corrupt organizations. With this approach, we gained insights about different corrupt organizations spanning different branches (e.g., government, foreign trade, pharmacy, sports, building industry). We found that corrupt organizations perceive themselves to fight in a war, which leads to their taken-for-granted assumption that “the end justifies the means”. This assumption inspires many values and norms of the organizational culture. An important value in a corrupt organization is “security”, and an important norm is punishment of deviant (i.e., non-corrupt) behavior. Furthermore, managers and employees differ in their perception of organizational culture. While the management endorses values, such as success, results, and performance, and implements these values in their norms of goal setting, employees make use of rationalization strategies and endorse values of security and team spirit. ABSTRACT Although Kairos in Greek mythology is often depicted as the winged son of Zeus who grants to those who lay hold of his single lock of hair their once-in-a-lifetime opportunity, in traditional African American culture, particularly when it comes to speech, Kairos is essentially family. Given how much African American speakers depend on seizing the moment to invoke spiritual connections, emit laughter, and profess the truth, Kairos, or what we might call CPT (“Colored People’s Time”), can be summoned almost (...) at will. One of the African American discourses this article will use to illustrate this point is Call and Response, a verbal exchange in which speakers and listeners attune to one another and to the timeliness of an event. Martin Luther King Jr.’s “I Have a Dream” speech was such an event, but it wouldn’t have been so were it not for the timely responding of his favorite gospel singer, Mahalia Jackson. (shrink)

Responding to the Special Issue's call for “new thinking” on gender and governance in developing societies, we introduce our research on the social organization of development knowledge and its ethical implications. Our feminist‐based approach, institutional ethnography, analyses the ruling relations of development and the standpoints represented in knowledge about development and its governance. Our paper offers an alternative to what we see as “the institutional standpoint” prevailing, but taken for granted, in business and society scholarship addressing development. Instead of theorizing (...) development relationships between institutions and their “stakeholders,” we illustrate what can be learned about the social relations of development beginning from the experiences of local subjects. Our analysis of an environmental research and development project in Uzbekistan shows that being missed is knowledge about development subjects that could have revealed what is locally relevant and needed. Instead, we discover gender inequality being constituted, unknowingly, within this project's institutionally generated knowledge and the activities it authorizes. (shrink)

Significant differences in perceptions between teachers in primary and secondary grant-maintained schools are reported and analysed. Parents were more frequently involved in promoting opting-out in primary schools, primary teachers had more favourable attitudes to the grant-maintained school policy and, in primary schools, grant-maintained status delivered improvements in classroom conditions, most notably reduced class size and increased para-professional support in classrooms. The findings are discussed in terms of the management of primary schools, of theorising about reputation management in (...) grant-maintained schools, and of the explicit objectives of the grant-maintained policy. It is further suggested that the evidence provided about grant-maintained primary schools could be used to inject new life into a policy faltering in secondary schools. (shrink)

Pathological archival tissue has been used as a source of research material for many years. The advancement in molecular techniques led to an escalated interest in genetic research on archival tissue. Research on archival tissue has been used without obtaining consents from patients, although the ethical justification for such a practice is unlikely to apply for genetic research that involves whole genome sequencing, for instance. Issues of confidentiality and patients’ autonomy are being raised as institutions consider when approval for this (...) type of research should be granted. In addition, patients’ advocate is mandating some of these changes. In the context of the United Arab Emirates, this paper makes clear the current uncertainties arising from the use of archival tissue in genetic research, as it could be highly invasive of privacy interests and also fails to respect autonomous choice. It further explains what needs to change in order to support such research that is directed at promoting public good, but in a way that is not detrimental to the welfare of patients as research participants. Virgil, in his description of the establishment of a new city by Aeneas for those Trojans who wished to remain in Sicily, is thinking of the Roman practice of colonial foundation: ‘Meanwhile Aeneas marked out the city with the plough and allocated the houses ’. We may note the personal role of the founder, the ploughing of the ritual first furrow, the organized grants to the settlers and the equality of treatment implied in the use of lot . Virgil was (...) writing at the end of the first century B.C. at a time of great activity in land distribution, but the Romans had been founding colonies from the mid fourth century. Each colony involved the creation of an urban area and the settlement of people on the surrounding agricultural land, and so perpetuated the city state, which was central to ancient life and culture. Indeed a colony was a smaller image of Rome itself. In the early Republic, colonies, either of Latins or of Roman citizens, were established on the periphery of Roman territory, largely for military and strategic reasons. Between 200 and 173 B.C. more than 40,000 may have received plots of land, amounting to about 1,000 square miles of territory. Later, the motives for colonial foundations became more complex, being closely connected with increasing economic and political problems. There can have been few more important aspects in the development of colonies than the need to find land for discharged troops. These in the main were rank and file soldiers who would expect equal shares in land allocations. (shrink)

Neil Levy mounts two arguments against Robert Kane’s influential libertarian theory. According to the first, because Kanean self-forming actions are undetermined, there can be no contrastive explanation for why agents choose as they do rather than otherwise, in which case how they choose appears to be a matter of luck. According to the second, if one grants Kane the claim that agents are responsible for their undetermined choices in virtue of the fact that they made efforts of will to choose (...) them, the fact that agents engage in dual efforts of will leads to an implausible doubling of the agent’s responsibility. We defend Kane from both objections. We argue against the first by clarifying the nature of contrastive explanation in the context of Kane’s theory and we argue against the second by showing that the kind of doubling of responsibility implied by an agent’s dual efforts of will is, in fact, innocuous. When Congress passed the 19th Amendment in 1919 granting women voting rights, 13 western states had already adopted woman suffrage. Only 2 states outside the West had done so. Using event history analysis, the authors investigate why woman suffrage came early to the western states. Alan Grimes's hypotheses, that native-born, western men were willing to give women the vote to remedy western social problems and to increase the number of women in the region, receive little support in our analysis. Rather, (...) this study finds that woman suffrage came to the West because of the mobilization of the western suffrage movements and because of political and gendered opportunities existing in that region. The Republic of Ireland has some of the most restrictive abortion legislation in the world which grants to the ‘unborn’ an equal right to life to that of the pregnant woman. This article outlines recent developments in the public discourse on abortion in Ireland and explains the particular cultural and religious context that informs the ethical case for access to abortion services. Our perspective rests on respect for two very familiar moral principles – autonomy and justice – which are at (...) the centre of social and democratic societies around the world. This article explains the context for the deployment of these concepts in order to support the claim that the current legislation and its operationalisation in clinical practice poses serious risks to the health, lives and well-being of pregnant women, tramples on their autonomy rights and requires of them a self-sacrifice that is unreasonable and unjust. Background Several jurisdictions, including Singapore, Australia, New Zealand and most recently Ireland, have a public interest or public good criterion for granting waivers of consent in biomedical research using secondary health data or tissue. However, the concept of the public interest is not well defined in this context, which creates difficulties for institutions, institutional review boards and regulators trying to implement the criterion. Main text This paper clarifies how the public interest criterion can be defensibly deployed. We first explain the (...) ethical basis for requiring waivers to only be granted to studies meeting the public interest criterion, then explore how further criteria may be set to determine the extent to which a given study can legitimately claim to be in the public interest. We propose an approach that does not attempt to measure magnitude of benefit directly, but rather takes into account metrics that are more straightforward to apply. To ensure consistent and justifiable interpretation, research institutions and IRBs should also incorporate procedural features such as transparency and public engagement in determining which studies satisfy the public interest requirement. Conclusion The requirement of public interest for consent waivers in secondary biomedical research should be guided by well-defined criteria for systematic evaluation. Such a criteria and its application need to be periodically subject to intra-committee and intra-institution review, reflection, deliberation and amendment. (shrink)

In “A Short Refutation of Ethical Egoism,” Richmond Campbell purports to refute “the view that everyone ought to do what benefits him the most in a given situation.” This is the theory which is “sometimes called impersonal ethical egoism ” [249). Campbell takes the following proposition as fundamental to his refutation of IEE.I. If an agent ought to do something in a given situation and another agent ought to do something in the same situation, then it is not (...) logically impossible for them to do these things in that situation [250].Granted proposition I, Campbell's refutation would require only:II. How does thought latch onto reality? Our minds have the ability to reach out and refer to items in the external world. I can think about the tree outside my study window, say, or about Margaret Thatcher, or about solar neutrinos. But how is the trick done? How can my thoughts refer to things beyond themselves? We tend to take the mind's referential powers for granted, but they are enormously difficult to explain. Andreas Schmidt argues that ethicists have misplaced moral qualms about nudges insofar as their worries are about whether nudges treat us as rational agents, because nudges can enhance our rational agency. I think that Schmidt is right that nudges often enhance our rational agency; in fact, we can carry his conclusion further: nudges often enhance our self-governing agency, too. But this does not alleviate our worries that nudges fail to treat us as rational. This is shown by disambiguating two conceptions (...) of treating-as-rational. The more plausible conception of treating-as-rational undermines Schmidt’s case that nudges often treat us as rational. (shrink)

Experientialism in aesthetics is the view that the artistic merit or the aesthetic value of something is determined by the final value of certain experiences of it. These are usually specified as experiences of it with understanding and appreciation. Until recently, experientialism was the dominant view. Not anymore. Experientialists are now subject to a barrage of objections, many of which they have not answered. Here I argue that all of these objections fail. I develop a new form of experientialism that (...) is immune to them. It also has an independent rationale. It incorporates an account of the value of art appreciation that is plausible in its own right. And it endorses many of the core insights of anti-experientialists, especially concerning the final value of good art. Those of us unconvinced by experientialism need to take this form of it seriously. I conclude by identifying some genuine problems it faces. Even these aren’t clearly insoluble. (shrink)

The so-called Disability Paradox arises from the apparent tension between the popular view that disability leads to low well-being and the relatively high life-satisfaction reports of disabled people. Our aim in this essay is to make some progress toward dissolving this alleged paradox by exploring the relationship between disability and various “goods of life”—that is, components of a life that typically make a person’s life go better for her. We focus on four widely recognized goods of life (happiness, rewarding relationships, (...) knowledge, achievement) and four common types of disability (sensory, mobility, intellectual, and social) and systematically examine the extent to which the four disability types are in principle compatible with obtaining the four goods of life. Our findings suggest that that there is a high degree of compatibility. This undermines the widespread view that disabilities, by their very nature, substantially limit a person’s ability to access the goods of life, and it provides some guidance on how to dissolve the Disability Paradox. The traditional doctrine of God's universal causality holds that God directly causes all entities distinct from himself, including all creaturely actions. But can our actions be free in the strong, libertarian sense if they are directly caused by God? W. Matthews Grant argues that free creaturely acts have dual sources, God and the free creaturely agent, and are ultimately up to both in a way that leaves all the standard conditions for libertarian freedom satisfied. Offering a comprehensive alternative to (...) existing approaches for combining theism and libertarian freedom, he proposes new solutions for reconciling libertarian freedom with robust accounts of God's providence, grace, and predestination. He also addresses the problem of moral evil without the commonly employed Free Will Defense. Written for analytic philosophers and theologians, Grant's approach can be characterized as “neo-scholastic” as well as “analytic,” since many of the positions defended are inspired by, consonant with, and develop resources drawn from the scholastic tradition, especially Aquinas. We defend the view that we are not identical to organisms against the objection that it implies that there are two subjects of every conscious state one experiences: oneself and one’s organism. We then criticize animalism —the view that each of us is identical to a human organism—by showing that it has unacceptable implications for a range of actual and hypothetical cases of conjoined twinning : dicephalus, craniopagus parasiticus, and cephalopagus.

Psychopaths are often regarded as a scourge of contemporary society and, as such, are the focus of much public vilification and outrage. But, arguably, psychopaths are both sinned against as well as sinners. If that is true, then their status as the victims of abusive subcultures partially mitigates their moral responsibility for the harms they cause. We argue, from the neuroethics of psychopathy and antisocial personality disorder (ASPD), that communities have a moral obligation to psychopaths as well as a case (...) against them. A reflection on the genesis and developmental epidemiology of psychopathy reveals an individualist, attribution-type error evident in much Western psychological and legal thinking—an error that obscures important moral truths about psychopaths. The resulting analysis makes us reconsider the distinction between disorders and moral failings and the ethical significance of the biological or neurocognitive mechanisms underpinning psychopathy. We claim that casting aside the deficit model (based on the presupposition that psychopaths are intrinsically unlike the rest of us) in favor of a relational and holistic view of personality potentiates a more informed and inclusive set of ethical, forensic, and therapeutic attitudes. His books Psychedelic Drugs Reconsidered and Cocaine: A Drug and Its Social Evolution are standards in the field. Dr. Grinspoon received his M.D. from Harvard Medical School and currently is associate professor emeritus at Harvard Medical School. Describing him as the "complete medical scholar," his citation for the Lindesmith Award for Achievement in the Field of Scholarship also notes, "Lester Grinspoon represents all those scholars who report the results of their research truthfully, despite the political consequences of this unwelcomed honesty.". Two studies examined the link between social dominance and male waist-to-hip ratio (WHR). Groups of four men interacted in a leaderless group discussion. In both studies, men with higher WHRs (associated with current and long-term health status) were rated by other group members as behaving more leader-like when an observer was present, and rated themselves as being more assertive. In Study 2, men with higher WHRs were rated by independent observers as behaving more dominantly, but only when the evaluator was (...) present.
