Cost-effectiveness analysis is the standard analytical tool for evaluating the aggregate health benefits of treatments, interventions, or health programs. It works by comparing the ratio of costs and benefits of different alternatives. The lower the ratio, the more effective the treatment, intervention, or program. The use of cost-effectiveness analysis can ensure that scarce health care resources are allocated in a way that maximizes the satisfaction of health needs. This review of Randall Kennedy's book--Race, Crime, and the Law--argues that Kennedy provides useful evidence to indict the prevalence of racism at the turn of the 21st Century but that Kennedy's definition of racism, which relies on explicit discriminatory intent, is too narrow to account for the value of statistical approaches that he presents. A logic of disparate impact is necessary to diagnose and remedy the systematic oppressions of racism. This paper seeks to address the question of schooling for democracy by, first, identifying at least one form of social character, dependent, after Marcuse, on the historical emergence of a “new sensibility.” It then explores one pedagogical thread related to the emergence of this form of subjectivity over the course of the last two centuries in the west, and traces its influence in the educational counter-tradition associated with philosophical anarchism, which is based on principles of dialogue and social reconstruction as (...) opposed to monologue and reproduction. The idea of a dialogical school has been made possible by a historical shift in adult views of child as interlocutor rather than “othered” object of adult formation—a shift that can be observed in an historical process of “closer approaches” between adult and child and a recognition of childhood and adulthood as forms of subjectivity that lie on a synchronous rather than a diachronic lifespan continuum. Finally the author identifies an archetype of “school” understood as a specific type of intentional community—an experimental zone in which participants are allowed and encouraged, through explicitly dialogical practice, to develop the personal and relational habits that make authentic democracy possible—a communal form that gives practical meaning to Dewey’s notion of school as “embryonic society”: a utopian space where natality is recognized as a fundamental cultural force, and where the evolutionary possibilities inherent in neoteny are taken as normative. We are pluralists about logical consequence [1]. We hold that there is more than one sense in which arguments may be deductively valid, that these senses are equally good, and equally deserving of the name deductive validity. Our pluralism starts with our analysis of consequence. This analysis of consequence is not idiosyncratic. We agree with Richard Jeffrey, and with many other philosophers of logic about how logical consequence is to be defined. To quote Jeffrey.

Different natural deduction proof systems for intuitionistic and classical logic —and related logical systems—differ in fundamental properties while sharing significant family resemblances. These differences become quite stark when it comes to the structural rules of contraction and weakening. In this paper, I show how Gentzen and Jaśkowski’s natural deduction systems differ in fine structure. I also motivate directed proof nets as another natural deduction system which shares some of the design features of Genzen and Jaśkowski’s systems, but which differs again (...) in its treatment of the structural rules, and has a range of virtues absent from traditional natural deduction systems. This paper concerns a key point of decision in Donald Davidson's early work in philosophy of language — a fateful decision that set him and the discourse in the area on the path of truth-theoretic semantics. The decision of moment is the one Davidson makes when, in the face of a certain barrier, he gives up on the idea of constructing an explicit meaning theory that would parallel Tarski's recursive way with truth theory. For Davidson there was little choice: he (...) tells us he does not see how to deal with the difficulty except in the radical way he proposes. But there is a way to give such a meaning theory — a meaning theory proper which, using classical logic only, meets a meaning-theoretic analogue of Convention T, satisfies Davidson’s three key desiderata for a theory of meaning, reflects linguistic competence, and avoids quantifying over meanings. The meaning theory sketched here uses Tarskian strategies, as Davidson proposed, but differs from Davidson's approach in not going by way of a truth theory for the target language. (shrink)

According to a currently popular approach to the analysis of phenomenal character, the phenomenal character of an experience is entirely determined by, and is in fact identical with, the experience's representational content. Two underlying assumptions motivate this approach to phenomenal character: (1) that conscious experiences are diaphanous or transparent, in the sense that it is impossible to discern, via introspection, any intrinsic features of an experience of x that are not experienced as features of x, and (2) that the immediate (...) objects of consciousness are not objects per se, but rather properties. This paper explores these assumptions, advancing the thesis that each is rejectable on phenomenological grounds. (shrink)

David Chalmers argues that consciousness -- authentic, first-person, conscious consciousness -- cannot be reduced to brain events or to any physical event, and that efforts to find a workable mind-body identity theory are, therefore, doomed in principle. But for Chalmers and non-reductionist in general consciousness consists exclusively, or at least paradigmatically, of phenomenal or qualia-consciousness. This results in a seriously inadequate understanding both of consciousness and of the “hard problem.” I describe other, higher-order cognitional events which must be conscious if (...) the “hard problem” is to be solved -- in any sense of ‘solve’ which would make us any the wiser about it -- but whose consciousness is quite different from the qualia and phenomena usually inventoried. In the distribution of resources, persons must be respected, or so many philosophers contend. Unfortunately, they often leave it unclear why a certain allocation would respect persons, while another would not. In this paper, we explore what it means to respect persons in the distribution of scarce, life-saving resources. We begin by presenting two kinds of cases. In different age cases, we have a drug that we must use either to save a young person who would live for many more (...) years or an old person who would only live for a few. In different numbers cases, we must save either one person or many persons from certain death. We argue that two familiar accounts of respect for persons―an equal worth account, suggested by Jeff McMahan, and a Kantian account, inspired by the Formula of Humanity―have implausible implications in such cases. We develop a new, “three-tiered” account: one that, we claim, generates results in such cases that accord better with many people’s considered judgments than those produced by its rivals. (shrink)

Analysing Jonathan Glazer’s Under the Skin (2013), this article provides an overview of the importation of suture theory from psychoanalysis into film theory and Žižek’s revisiting of this theory, then bringing about a rapprochement between the concepts of suture and Malabou’s destructive plasticity, as expounded in her work The New Wounded. The forms of wounded subjectivity we find there are unable to stitch themselves into the illusory narratives needed to enable them to access a fixed sense of individual or shared (...) identity and enclose them in a subjectivity separated off from all else around. Here, on the contrary, alterity, the alien, is situated within. It is such a form of subjectivity, I argue, that we find in Glazer’s Under the Skin where this narrative plays out not only diegetically, as we witness the alien that has sutured itself inside a human envelope attempt and fail to articulate itself to an external narrative that remains inaccessible to it, but infratextually also. Indeed, ultimately this article suggests that Under the Skin can be read as a commentary on the viewing subject required by (and forms of subjectivity produced by) post-cinematic media forms that at first seem to operate according to a different logic to the cinematic syntax of classical cinema, but which may in fact require us to reconsider some of our assumptions with regard to all forms of cinematic subjectivity produced in the relations between spectator and screen. Alfred Schütz is often credited with providing sociology with a firm ground derived from phenomenology of science and justifying it as a science operating within natural attitude. Although his project of social science draws extensively on Edmund Husserl’s theory of attitudes, it would be incorrect to assume that Schütz shares with the founder of phenomenology his conception of science. This paper compares Husserl’s and Schütz’s views on the structure and meaning of science and traces the roots of their radical divergence. (...) Whereas Husserl increasingly emphasises the importance of phenomenological reduction for the genuine human science, Schütz eventually rejects reduction and restricts the social science to a specific system of relevancies within the reality of the lifeworld. This paper presents the argument that Schütz’s conception eliminates the possibility of a phenomenological justification of social science, as it implies that there are no rationally justifiable grounds to pursue science. In this way, Schütz’s views substantially differ from the phenomenological theory of science and become open to the phenomenological critique of naivety. (shrink)

Opponents of genetic enhancement technologies often argue that the pursuit of these technologies will lead to self-defeating collective outcomes, massive social inequalities, or other forms of collective harm. They assume that these harms will outweigh individual benefits. Defenders of genetic enhancement technologies counter that individual benefits will outweigh collective harms and there will be no conflict between individual and collective interests. The present contribution tries to advance the debate by providing a more detailed discussion of the conditions under which individual (...) and collective interests may conflict.It presents a simple model that clarifies the conditions in which the use of genetic enhancement technologies may lead to self-defeating collective outcomes and social inequalities. It argues that given current inequalities, these conditions might indeed obtain as new genetic knowledge leads to a transition in population health. If they do, then genetic enhancement will steepen the social gradient in health. Thus, regulating access to enhancement technologies should be a matter of social justice. (shrink)

I propose a justification of empirical (and other beliefs) based on the work of B. Lonergan.

The Confidentiality Advisory Group is a specialised body that advises the Health Research Authority and the Secretary of State for Health on requests for access to confidential information, in the absence of informed consent from its owners. Its primary role is to oversee the safe use of such information and to counsel the governing bodies mentioned above as to whether such use is appropriate or inappropriate. Researchers who seek access to England or Wales-based confidential data, for medical purposes that are (...) in the interest of the public, are typically required to submit an application to this body. However, it is not always clear to researchers whether requests for access to patient data fit within the remit of the CAG or a Trust’s local information governance team. This commentary will, therefore, explore the role of the CAG and reflect on how best to support researchers with this question. (shrink)

Roger Kennedy has written a masterful investigation into the concept of evil. He begins with a general view of the subject before moving into more detailed analysis. First is a review of the science of evil, including evidence from neuroscience and social psychology. This is followed by psychoanalytical studies of the individual and groups before presenting an overview of the philosophy of evil. Also included are historical and social studies which inform an understanding of evil in action. Kennedy (...) goes on to examine the nature of genocide using a main focus on the Holocaust and of slavery. Both of these "journeys to evil" remain relevant for understanding contemporary society and issues. The Nazi past continues to disturb and resonate decades on. The politics and social fabric of Western society was reliant on slavery as a foundation of economic wealth and is haunted by its inability to process the harsh reality of slavery and its continuing after-effects. Kennedy moves from there to a discussion on the genius of Shakespeare and his encapsulation of the essential features of how evil can develop and take over a person's inner world. The book concludes with a summary of the main themes and a look at those who have resisted evil and what we can learn from them if we are to build a society that can resist the forces of evil. The book is informed by a psychoanalytic approach, with its emphasis on the power and influence of unconscious processes underlying human actions, and on the role of inner conflicting and elemental fears and anxieties often driving individual and group behaviours. This article explores briefly the practical as well as theoretical issues that arise when Amartya Sen’s evaluation of justice through the capabilities afforded citizens in a society is applied to postcolonies like Jamaica and South Africa. It argues that the application of the capabilities approach to the circumstances of the postcolony gives rise to the need for an expansion of its purview as the informational focus of Sen’s theory of justice. This is so because of the manner in which domestic (...) as well as external forces and interests function so as to limit in particular the material conditions necessary for freedom and self-actualization in the postcolony. As examples the article engages briefly with the way in which multinationals and multilateral lending agencies in pursuit of their interests have adverse impact upon capabilities in Jamaica and South Africa, affecting in turn the quality of material life, as well as that of democratic governance in both states. In doing so it broaches the important issue of the failure to engage thoroughly with the reality of the limited maneuverability, both at the domestic and also the international levels, that issues from the role of the developing state in the global political economy , which I think haunts the utilization of the capabilities approach to understanding justice and development in the postcolony. It is an important subject and one in which everyone is interested. Being for human subject protection is like being for Mom. However, we all know that Mom sometimes can (...) be a handful! So I shall quickly review how we got to where we are, what is being done, and who is doing it. The table at the end of this article provides an additional summary of the current state of human subject protections. How We Got Here The current system of human subject protection was built 30 years ago with Institutional Review Boards (IRBs) as the cornerstone. Some well-publicized system failures in the last decade prompted evaluations that identified increasing volume and research complexity as primary threats to the system's effectiveness. In response, the Department of Health and Human Services (DHHS) Office of Inspector General (OIG 1998), and the National Bioethics Advisory Commission (NBAC 2001) issued recommendations calling for education and reform. Since then, initiatives in pursuit of these objectives have been rolling out non-stop. What Is Being Done The Office of Human Research Protections (OHRP) is leading the effort for DHHS, holding noncompliant research organizations accountable, while expanding the government's capacity for oversight, monitoring, and educating the research community. OHRP already has leveraged resources by: (1) implementing a unified federal registration system for all IRBs that identifies where IRBs are, how they are constituted, what kinds of research they are reviewing, and what volume of work they handle; (2) implementing a streamlined assurance process allowing all federal agencies to recognize a single, common assurance and avoid redundancy. The assurance is a commitment from any entity that receives federal funds for research to follow federal rules for protection of research subjects; and (3) redeploying resources from the process of negotiating assurances to supporting [End Page 215] quality improvement, including increasing the number site visits and providing IRBs with tools for self assessment and guidance for improvement.The goal is to prevent problems before they occur, and positive reinforcement and supportive training are the preferred themes. OHRP does wield a big stick and can shut down clinical studies in response to lax oversight, but it also has developed a big carrot by creating a national awards program to recognize excellence in protection of human research subjects—e.g., best practices, innovations in protecting research volunteers, and lifetime achievement for outstanding protection activities.Dr. Greg Koski, Director of OHRP, also is working with other government agencies to consolidate and build a comprehensive program. OHRP has four goals for a new oversight framework: Simplicity, Uniformity, Efficiency and Effectiveness. Selecting representatives from throughout the federal government, Dr. Koski has created the "SUEE" task force to identify and eliminate inefficiencies between the various agencies' human testing regulatory approaches.
