Le lezioni riguardano l'organizzazione delle corti di giustizia federale negli Stati Uniti, la forma e il ruolo delle sentenze giudiziarie all'interno di un sistema federale e il rapporto che intrattiene con la pena di morte un giudice a essa decisamente contrario. Secondo Melis queste lezioni restituiscono in maniera straordinariamente viva e precisa la struttura del sistema giudiziario e, (...) al tempo stesso, l'esperienza soggettiva di un giudice. (shrink)

In Italy a specific legislation on administrative management has been belated and its rhetoric showed to be in contradiction with its practical translation. The relationship between management and politics has been characterized either by an excessive distance or by a pathological proximity or else by indifference towards the ends of the policies that the management should have interpreted. The senior civil service has thus self-excluded from the national elites and it has never really mobilized in the decisional spheres of the (...) country. The essay analyzes, through four periodizing dates, the transformations of the senior civil service and its relationship with the political power in the 150 years of history since the unity of Italy. In a posthumous book by F. Meli 1 there are joined two interesting studies in the history of philosophy. The first discusses the religious and political doctrines of Fausto Socino and their developments in the thought of the seventeenth century, and the second the rationalistic mentality of Spinoza. The two themes are essentially related, for in the religious rationalism of Socino the author recognizes one of the currents of thought that were to meet later in Spinoza’s philosophy. The first essay (...) has the merit of greater novelty, because Socinian studies have been neglected up to the present and only touched on indirectly, in their repercussions rather than in their origins. For Meli the historical importance of Fausto Socino lies in the fact that he draws from the religious experience of the Reformation a new conception of religion, clearly affirming the principle that Holy Scripture does not aim at conveying abstract knowledge, a scientific doctrine, but on the contrary, as Galileo confirmed, it aims at increasing in us justice, charity, and the moral sense. According to virtue epistemology, the main aim of education is the development of the cognitive character of students (Pritchard, 2014, 2016). Given the proliferation of technological tools such as ChatGPT and other LLMs for solving cognitive tasks, how should educational practices incorporate the use of such tools without undermining the cognitive character of students? Pritchard (2014, 2016) argues that it is possible to properly solve this ‘technology-education tension’ (TET) by combining the virtue epistemology framework with the theory of extended cognition (...) (EXT) (Clark and Chalmers, 1998). He argues that EXT enables us to consider tools as constitutive parts of the students’ cognitive system, thus preserving their cognitive character from technologically induced cognitive diminishment. The first aim of this paper is to show that this solution is not sufficient to solve the TET. Second, I aim to offer a complementary and more encompassing framework of tool-use to address the TET. Then, I apply it to the educational uses of ChatGPT as the most notable example of LLM, although my arguments can be extended to other generative AI systems. To do so, in Sect. 1.1, I present Pritchard’s framework of cognitive character and virtue epistemology applied in education, to which I am committed in this treatment. In Sects. 2 and 3, I respectively illustrate Pritchard’s (2014) solution to the TET, and I highlight the general limitations of his proposal. Thus, in Sect. 4.1 I characterize ChatGPT as a computational cognitive artifact using Fasoli’s (2017, 2018) taxonomy of cognitive artifacts. In Sect. 4.2, I introduce my proposal, which combines Pritchard’s account of virtue epistemology with Fasoli’s (2017, 2018) taxonomy of cognitive artifacts to address the TET. Finally, in Sect. 5.1, I present some epistemically virtuous uses of ChatGPT in educational contexts. To conclude, I argue in favor of a multidisciplinary approach for analyzing educational activities involving AI technologies such as ChatGPT. (shrink)

Skepticism is both a historical and foundational problem in epistemology. Jonathan Schaffer (2010) has provided a new expression of its threat. The Debasing Demon appears to generate a novel form of radical doubt, one that has gained prominence in recent debates. Instead of targeting the connection between belief and truth, it undercuts the link between belief and evidence (or reasons). This contribution presents the Debasing Demon Problem, analyzing its reach. It will provide an account for explaining how its threat is (...) raised, explore its relationship to classical varieties of skepticism, and assess some of the main objections against it. It will be argued that Schaffer’s Demon institutes a consistent epistemic threat, one that might represent the main variety of skepticism to be tackled in epistemology. Some consequences of this analysis are then presented concerning how to face this open problem. (shrink)

This article discusses how cross-sector partnerships (CSPs) for sustainability manage the paradoxical tension between stakeholder inclusiveness and administrative efficiency. Drawing on qualitative data from a case study of a CSP focused on urban sustainability, we show how the inclusiveness–efficiency paradox unfolded throughout the studied collaboration. We discuss how the paradox reemerged in a different guise within each phase of the partnership and how three practices of paradox management helped actors to cope with the tension: “customized inviting” (during the formation phase), (...) “sequential including” (during the preparation phase), and “tailored instructing” (during the implementation phase). On the basis of these findings, we argue that (a) the paradox reoccurred throughout the phases of the CSP because the three paradox management practices accentuated boundaries, thereby helping to resolve the paradox temporarily while at the same time creating grounds for the paradox to resurface, and (b) that the three paradox management practices can be theorized as a special type of boundary work that “plays up” relevant differences between actor groups and thereby ensures collaboration. The aim of the article is to outline several valuable elements of Mead’s pragmatist theory of perception in action developed in his The Philosophy of the Act, in order to strengthen the pragmatist legacy of the enactivist approach. In particular, Mead’s theory of perception in action turns out to be a forerunner of sensorimotor enactivist theory. Unlike the latter, however, Mead explicitly refers to imagery as an essential capacity for agency. Nonetheless, the article argues that the ways in which Mead (...) refers to this capacity do not necessarily place it in opposition to enactivist non-representationalism. On the contrary, as a synthetic process of re-presenting of present and past sensorimotor elements, imagery can be seen as the hallmark of a pragmatically inspired sensorimotor enactivist approach that bypasses the opposition between representationalists and non-representationalists. An outstanding problem in so-called modal interpretations of quantum mechanics has been the specification of a dynamics for the properties introduced in such interpretations. We develop a general framework (in the context of the theory of stochastic processes) for specifying a dynamics for interpretations in this class, focusing on the modal interpretation by Vermaas and Dieks. This framework admits many empirically equivalent dynamics. We give some examples, and discuss some of the properties of one of them. This approach is applicable (...) to a wider class of theories, in particular, those using (discrete) strict effective—as in decoherence theory—superselection rules. (shrink)

According to predictive processing, an increasingly influential paradigm in cognitive science, the function of the brain is to minimize the prediction error of its sensory input. Conceptual engineering is the practice of assessing and changing concepts or word meanings. We contribute to both strands of research by proposing the first cognitive account of conceptual engineering, using the predictive processing framework. Our model reveals a new kind of implementation problem as prediction errors are only minimized if enough agents embrace conceptual changes. (...) Given the explanatory stalemate between ‘embedded’ (EMB) and ‘extended’ (EXT) cognition, various authors have proposed normative and moral arguments in favour of EXT. According to what we call the “extended cognition moral narrative” (EXT-MN) (Cassinadri, 2022), we should embrace EXT and dismiss EMB, because the former leads to morally preferable consequences with respect to the latter. In this article we argue that two arguments following the EXT moral narrative are flawed. In Sect. 2.1 and 2.2, we present respectively King (2016) (...) and Vold’s (2018) ‘argument from assessment of capacities’ (AAC) and Clowes (2013), Farina and Lavazza’s (2022a) ‘cognitive diminishment argument’ (CDA). The AAC states that we should embrace EXT over EMB since the former is better at attributing cognitive credit to individuals with learning disabilities who use assistive tools to complete their learning tasks, thus avoiding their marginalisation. The CDA states that EMB implies a morally undesirable picture of the agent in terms of cognitive diminishment. In Sect. 3, we clarify and criticise the underlying assumptions of the AAC and CDA: the “cognitive credit assumption”, the “marginalisation assumption” and, more generally, an ableist conception of disabled agency. In Sect. 3.1, we discuss the role of moto-perceptual skills and metacognitive credit involved in complex cases of tool-use, to demonstrate that the EXT-MN is uninformative in addressing these cases. To conclude, in Sect. 4 we argue that AAC and CDA fail to present EXT as descriptively and normatively superior to EMB. (shrink)

This paper describes the Eunomos software, an advanced legal document and knowledge management system, based on legislative XML and ontologies. We describe the challenges of legal research in an increasingly complex, multi-level and multi-lingual world and how the Eunomos software helps users cut through the information overload to get the legal information they need in an organized and structured way and keep track of the state of the relevant law on any given topic. Using NLP tools to semi-automate the lower-skill (...) tasks makes this ambitious project a realistic commercial prospect as it helps keep costs down while at the same time allowing greater coverage. We describe the core system from workflow and technical perspectives, and discuss applications of the system for various user groups. (shrink)

In public political deliberation, people will err and lie in accordance with definite patterns. Such discourse failure results from behavior that is both instrumentally and epistemically rational. The deliberative practices of a liberal democracy cannot be improved so as to overcome the tendency for rational citizens to believe and say things at odds with reliable propositions of social science. The theory has several corollaries. One is that much contemporary political philosophy can be seen as an unsuccessful attempt to vindicate, on (...) symbolic and moral grounds, the forms that discourse failure take on in public political deliberation. Another is that deliberative practices cannot be rescued even on non-epistemic grounds, such as social peace, impartiality, participation, and equality. To alleviate discourse failure, this book proposes to reduce the scope of majoritarian politics and enlarge markets. (shrink)

This paper investigates under what conditions a good corporate social responsibility (CSR) can compensate for a relatively poor corporate ability (CA) (quality), and vice versa. The authors conducted an experiment among business administration students, in which information about a financial services company’s CA and CSR was provided. Participants indicated their preferences for the company’s products, stocks, and jobs. The results show that for stock and job preferences, a poor CA can be compensated by a good CSR. For product preferences, a (...) poor CA could not be compensated by a good CSR, at least when people thought that CA is personally relevant to them. Furthermore, a poor CSR could be compensated by a good CA for product, stocks, and job preferences. (shrink)

The article investigates what happens when philosophy meets and begins to establish connections with two formal research methods such as game theory and network science. We use citation analysis to identify, among the articles published in Synthese and Philosophy of Science between 1985 and 2021, those that cite the specialistic literature in game theory and network science. Then, we investigate the structure of the two corpora thus identified by bibliographic coupling and divide them into clusters of related papers by automatic (...) community detection. Lastly, we construct by the same bibliometric techniques a reference map of philosophy, on which we overlay our corpora to map the diffusion of game theory and network science in the various sub-areas of recent philosophy. Three main results derive from this study. Philosophers are interested not only in using and investigating game theory as a formal method belonging to applied mathematics and sharing many relevant features with social choice theory, but also in considering its applications in more empirically oriented disciplines such as social psychology, cognitive science, or biology. Philosophers focus on networks in two research contexts and in two different ways: in the debate on causality and scientific explanation, they consider the results of network science; in social epistemology, they employ network science as a formal tool. In the reference map, logic—whose use in philosophy dates back to a much earlier period—is distributed in a more uniform way than recently encountered disciplines such as game theory and network science. We conclude by discussing some methodological limitations of our bibliometric approach, especially with reference to the problem of field delineation. (shrink)

This paper critically examines I.I. Rubin's Essays on Marx's Theory of Value and argues that two different approaches to value theory can be found in that book: a more 'production-centred' value-form theory uneasily co-exists with a 'circulationist' perspective. This unresolved tension, the authors claim, reflects a more general theoretical shortcoming in Rubin's work, namely, a problematic conceptualisation of the inner connection between materiality and social form that eventually leads to a formalist perspective on the value-form. Furthermore, the paper argues that (...) all those antinomies are an expression of the historical and political context underlying Rubin's work, in which Marxism was being codified as state ideology. The political implications of Rubin's formalism are explored through the critical examination of its consequences for the comprehension of the social determinations of the revolutionary subjectivity of the working class. This paper provides a thorough analysis of two often informally stated claims. First, successful argumentation in the sense of persuasive argumentation requires agreement between the interlocutors about the rationality of arguments. Second, a general agreement about rationality of arguments cannot itself be established via argumentation, since such an attempt leads to an infinite meta‐regress. Hence, agreement about the rationality of arguments is a precondition for successful argumentation. As the paper argues, these plausible claims hold under the assumption that interlocutors are (...) subjectively rational and follow their own standards of rationality when engaging in argumentation. The proof paradox results from conflicting intuitions concerning different types of fallible evidence in a court of law. We accept fallible individual evidence but reject fallible statistical evidence even when the conditional probability that the defendant is guilty given the evidence is the same, a seeming inconsistency. This paper defends a solution to the proof paradox, building on a sensitivity account of checking and settling a question. The proposed sensitivity account of legal proof not only requires sensitivity simpliciter but sensitivity (...) of each relevant step of the proof procedure and/or sensitivity concerning all relevant alternatives. This account avoids problems that have been identified for other sensitivity views of legal proof. Moreover, it is argued that sensitivity, rather than safety, is the crucial modal condition for legal proof. It is, finally, shown that the provided account can fruitfully support very different existing views on the relationship between knowledge and legal proof. (shrink)

Questions surrounding deep disagreement have gained significant attention in recent years. One of the central debates is metaphysical, focusing on the features that make a disagreement deep. Proposals for what makes disagreements deep include theories about hinge propositions and first epistemic principles. In this paper, I criticize this metaphysical discussion by arguing that it is methodologically flawed. Deep disagreement is a technical or semi-technical term, but the metaphysical discussion mistakenly treats it as a common-sense concept to be analyzed and captured (...) by our pre-theoretical intuitions. Since the literature on deep disagreement is subject to this fundamental confusion and deep disagreement is not a helpful umbrella term either, I propose eliminating the notion of deep disagreement from the philosophical discourse. Instead of analyzing the nature of deep disagreement, we should develop theories about different forms of disagreement, including disagreement about hinge propositions and disagreement about epistemic principles, and, in particular, a theory of rationally irresolvable disagreement. The Heisenberg microscope and its analysis by Weizsäcker are used by Grete Hermann in her 1935 essay on the foundations of quantum mechanics to argue her claims about causality in quantum mechanics. In this chapter, I wish to draw a comparison between Hermann’s use of the Heisenberg microscope and another famous use of a very similar thought experiment : Bohr’s analysis of the suspended single slit in his reply to EPR. I shall argue that Hermann’s use of different aspects of (...) the classical pictures in the treatment of the Heisenberg microscope makes her treatment closer to Bohr’s discussion of the suspended slit than to Heisenberg’s own treatment of the microscope. This suggests that Hermann, who equally gave an extensive analysis of complementarity in her 1935 essay, may be an especially acute interpreter of Bohr’s views. I conclude by looking at Hermann’s approach in the context of more general examples of measurement and at possible limitations of the approach. (shrink)

ABSTRACTThe paper compares Mead’s and Quine’s behaviouristic theories of meaning and language, focusing in particular on Mead’s notion of sympathy and Quine’s notion of empathy. On the one hand, Quine seems to resort to an explanation similar to Mead’s notion of sympathy, referring to ‘empathy’ in order to justify the human ability to project ourselves into the witness’s position; on the other hand, Quine’s reference to the notion of empathy paves the way to a more insightful comparison between Mead’s behaviourism (...) and an explanation of the emergence of the linguistic from pre-linguistic communication based on empathic identification processes. However, Mead is less ambiguous than Quine in his use of the notion of sympathy finds a fecund parallel in the current neuroscientific and neuro-phenomenological hypothesis on ‘empathy’. The article contends that the ambiguity in Quine’s account of empathy is due to the exigency of trying to elucidate the link between the rules of language in a cultural context and... (shrink)

That bootstrapping and Moorean reasoning fail to instantiate persuasive argumentation is an often informally presented but not systematically developed view. In this paper, I will argue that this unpersuasiveness is not determined by principles of justification transmission but by two straightforward principles of rationality, understood as a concept of internal coherence. First, it is rational for S to believe the conclusion of an argument because of the argument, only if S believes sufficiently many premises of the argument. Second, if S (...) doubts that a source _O_ is reliable and believes that information _i_ is delivered by _O_, then S rationally suspends judgment about the truth of _i_. This paper aims to accomplish two tasks. First, it provides a thorough analysis of why bootstrapping argumentation is not an instance of rational persuasion. Second, it contains a more general theory about preconditions and limits of persuasive argumentation. (shrink)

In his logical treatises, John Mair develops a method and a set of rules for the verification of modal propositions, which is in the spirit of his predecessors Ockham and Buridan, but ultimately goes beyond them. He calls this method positio de inesse. It is also by this method that the truth conditions for divided modal propositions are set out. There is a standard interpretation of it as a form of reductionist method, and scholars have been tempted to think that (...) it was motivated by an implicit rejection of de re modal properties shared by Mair and other sixteenth- century nominalists. After presenting the background to Mair’s writings on the semantics of modal propositions, in this paper we revisit Mair's version of the method of positio de inesse. We argue that it is based on some basic semantic rules and contend that this procedure analyzes divided modal propositions into singular de re sentences referring to possible objects. Consequently, we conclude that this method does not reflect a reductionist approach to modal discourse. We instead provide an alternative interpretation. (shrink)

The celebrated Dreimännerarbeit by Born, Heisenberg and Jordan contains a matrix-mechanical derivation by Jordan of Planck’s formula for blackbody fluctuations. Jordan appears to have considered this to be one of his finest contributions to quantum theory, but the status of his derivation is puzzling. In our Dreimenschenarbeit, we show how to understand what Jordan was doing in the double context of a Boltzmannian approach to statistical mechanics and of the early ‘statistical interpretation’ of matrix mechanics.

Decision making often takes place in social environments where other actors influence individuals' decisions. The present article examines how advice affects individual learning. Five social learning models combining advice and individual learning‐four based on reinforcement learning and one on Bayesian learning‐and one individual learning model are tested against each other. In two experiments, some participants received good or bad advice prior to a repeated multioption choice task. Receivers of advice adhered to the advice, so that good advice improved performance. The (...) social learning models described the observed learning processes better than the individual learning model. Of the models tested, the best social learning model assumes that outcomes from recommended options are more positively evaluated than outcomes from nonrecommended options. This model correctly predicted that receivers first adhere to advice, then explore other options, and finally return to the recommended option. The model also predicted accurately that good advice has a stronger impact on learning than bad advice. One‐time advice can have a long‐lasting influence on learning by changing the subjective evaluation of outcomes of recommended options. (shrink)

I present a very general and simple argument—based on the no-signalling theorem—showing that within the framework of the unitary Schrödinger equation it is impossible to reproduce the phenomenological description of quantum mechanical measurements (in particular the collapse of the state of the measured system) by assuming a suitable mixed initial state of the apparatus. The thrust of the argument is thus similar to that of the ‘insolubility theorems’ for the measurement problem of quantum mechanics (which, however, focus on the impossibility (...) of reproducing the macroscopic measurement results). Although I believe this form of the argument is new, I argue it is essentially a variant of Einstein’s reasoning in the context of the EPR paradox—which is thereby illuminated from a new angle. In this paper I generalize the new approach to nonmonotonicreasoning that was presented in [6]. This generalization results in the inconsistency-adaptive logic PRL . I give proof theory, semantics, mention interesting properties,and comment on the reconstruction and amelioration of other nonmonotoniclogics and mechanisms.

The paper seeks to show the potentialities of a wider perspective concerning human economic behavior and decision-making processes intertwining Mead’s and Sen’s ideas on self-identity and social context. Emerging developments of my findings strengthen, at once, the principled commitment to freedom of choice, revealing from a “Mead-Sen” perspective the instrumental role of social behavioral patterns and socio-cultural environment (social group, community, nationality, race, sex, and now social media) in the orientation of persons’ (economic) behaviors. In particular, a Mead-Sen approach would (...) help clarify how people develop their attitudes and dispositions to think and behave, namely examining the habits at the basis of everyday processes of evaluation and choice as manifestations of practical judgment. In the following pages I shall sketch some thoughts on Veblen’s implicit and explicit references to pragmatism and functional psychology, arguing that, besides Peirce and James, the functionalist theories and psychological experiments of the research group led by Dewey and Mead at the University of Chicago set the scene for Veblen’s intellectual revolution. More precisely, whilst Veblen did not mention it explicitly, it is possible to find in his writings of the years 1896-1900 references to Dewey’s notion of the “organic (...) circuit” and to Dewey’s and Mead’s theory of emotion.* This paper has three parts and three aims. In the first part, I outline Veblen’s criticism of economic science and his proposal for a new evolutionary economics, paying particular attention to Veblen’s implicit reference to Peirce’s logic. In the second part, I single out Veblen’s reference to Dewey’s and Mead’s works on functional psychology. In the third part, I will compare Mead’s hypothesis of the genesis of social interests in emotions with the evolutionary economic theory sketched by Veblen.* Tilman (1996: Ch 3) argued over pragmatic influences upon Veblen’s ideas concerning the human mind. James and Dewey’s functional psychology offered a psychological basis for his social theory. In my opinion, however, Veblen has been influenced by the Chicago School of functionalism more than by James’ functionalism, in particular by Dewey’s and Mead’s ideas. Moreover, even if Tilman (1998) points out Dewey’s intellectual debt to Veblen’s idea, his references consist normally in a period later than that considered here. (shrink)

The concept underlying Prigogine's ideas is the asymmetric "lifetime" he introduces into thermodynamics in addition to the symmetric time parameter. By identifying processes by means of causal chains of genidentical events, we examine the intrinsic order of lifetime adopting Grunbaum's symmetric time order. Further, we define the physical meaning and the actuality of the processes under consideration. We conclude that Prigogine's microscopic temporal irreversibility is tacitly assumed at macroscopic level. Moreover, his "new" complementarity lacks any scientific foundation. In this paper we consider the relation between beliefs and goals in agent theory. Beliefs play three roles in reasoning about goals: they play a role in the generation of unconditional desires from conditional ones, they play a role in adoption of desires as goals, and they play a role in the selection of plans to achieve goals. In this paper we consider the role of goals in reasoning about beliefs. Though we assume that goals do not play a role (...) in the belief generation problem, we argue that they play a role in the belief selection problem. We show the rationality of the use of goals in belief selection, in the sense that there are cases in which agents that take their goals into account in selecting a belief set from a set of alternatives outperform agents that do not do so. We also formally distinguish between the rational role of goals in belief selection and irrational wishful thinking. (shrink)

It is often stated that joint actions are linked to so-called _directed duties_. It is not just that we should “do our part” in a joint action simply because it is the right thing to do or because it is in our best interest. Instead, we “owe” it to the other participants. Despite its _prima facie_ plausibility, this claim is not well understood. Is it true that duties in joint action are directed? Which notion of directedness is relevant to understanding (...) the normativity of joint action? I first argue that we can characterize the notion of directed duties in joint action in terms of a network of inferentially related normative relations and practices. I apply this analysis to show that duties in joint action _are_ directed. This analysis supports the view that the normativity in joint action is special as it involves what Stephen Darwall calls “individual authority” without entailing “representative authority”. A perhaps surprising conclusion derived from this account is that actions in joint action are owed to everyone involved in the group equally. This supports Margaret Gilbert’s joint commitment account of joint intention. (shrink)
