Historia, as both a type of critical inquiry and a source of information about nature and the human world, is a key category in Spinoza’s Tractatus theologico-politicus. In this work, the Latin word cannot be simply and invariably translated as “history,” not even if we add the proviso that its meaning wavers inevitably between “history” and “story,” for its semantic range is too broad and complex. At the two ends of the semantic spectrum we have the impartial report, on the (...) one hand, and the creations of sheer fantasy, on the other. Historia may therefore denote the detached observation of nature and the philological analysis of a text, but it can also refer to the free exercise of the imagination in a variety of narrative contexts. While Spinoza denies that the inquiry resulting from historia and its products may have true cognitive value, he acknowledges that historia plays a fundamental role in society and politics. The reason is that historia and the imagination are bound up together by a special relationship. This is apparent at all levels of the historical engagement with reality, but is particularly true in the case of religion, moral norms and belief systems, for in this variegated domain the link between imagination and historia functions as the connective tissue that keeps societies united and functioning. This specific nexus of imagination and historia is Spinoza’s original contribution to the early modern notion of “moral certainty.” More importantly, it is only at this level that Spinoza grants a modicum of intelligibility to the ‘historical’ productions of the imagination, be they signa, revelationes, or even nugae. The fact remains, though, that to a certain extent humans keep having a distorted grasp of reality, indeed hallucinate, even when their ‘historical’ accounts of reality are socially and politically productive. Here the key element is the notion of fictional continuity based on a socially constructed trust in narrative accounts of reality: the imagination turns reality into stories, but in so doing it keeps the otherwise constitutively hallucinatory nature of humans at bay and under control. Perceptibilitas, that is, the ability to provide acceptable cognitive solutions between intelligible knowledge and moral certainty, is ultimately what defines the contribution of the imagination to the human work of knowledge. The debate about the appropriate standards for upstream corporate social responsibility of multinational corporations has been on the public and academic agenda for some three decades. The debate originally focused narrowly on “contract responsibility” of MNCs for monitoring of upstream contractors for “sweatshop” working conditions violating employee rights. The authors argue that the MNC upstream responsibility debate has shifted qualitatively over time to “full producer responsibility” involving an expansion from “contract responsibility” in three distinct dimensions. First, there is an expansion (...) of scope from working conditions to human rights and social and environmental impacts broadly defined. Second, there is expansion in depth of this broader responsibility to the whole upstream supply chain without regard to contracting status. Upstream responsibility now includes all suppliers, including direct contractors and the chain of suppliers to such contractors. Finally, the change in CSR scope and depth has led to an evolution of CSR management practice. (shrink)

This paper describes the Eunomos software, an advanced legal document and knowledge management system, based on legislative XML and ontologies. We describe the challenges of legal research in an increasingly complex, multi-level and multi-lingual world and how the Eunomos software helps users cut through the information overload to get the legal information they need in an organized and structured way and keep track of the state of the relevant law on any given topic. Using NLP tools to semi-automate the lower-skill (...) tasks makes this ambitious project a realistic commercial prospect as it helps keep costs down while at the same time allowing greater coverage. We describe the core system from workflow and technical perspectives, and discuss applications of the system for various user groups. (shrink)

ArgumentThis article investigates the reasons behind the disappearance of Francis Glisson's theory of irritability during the eighteenth century. At a time when natural investigations were becoming increasingly polarized between mind and matter in the attempt to save both man's consciousness and the inert nature of theres extensa, Glisson's notion of a natural perception embedded in matter did not satisfy the new science's basic injunction not to superimpose perceptions and appetites on nature. Knowledgeofnature could not be based on knowledgewithinnature, i.e., on (...) the very knowledge that nature has of itself; or – to look at the same question from the point of view of the human mind – man's consciousness could not be seen as participating in forms of natural selfhood. Albrecht Haller played a key role in this story. Through his experiments, Haller thought he had conclusively demonstrated that the response given by nature when irritated did not betray any natural perceptivity, any inner life, anysentiment interiéur. In doing so, he provided a less bewildering theory of irritability for the rising communities of experimental physiology. (shrink)

In public political deliberation, people will err and lie in accordance with definite patterns. Such discourse failure results from behavior that is both instrumentally and epistemically rational. The deliberative practices of a liberal democracy cannot be improved so as to overcome the tendency for rational citizens to believe and say things at odds with reliable propositions of social science. The theory has several corollaries. One is that much contemporary political philosophy can be seen as an unsuccessful attempt to vindicate, on (...) symbolic and moral grounds, the forms that discourse failure take on in public political deliberation. Another is that deliberative practices cannot be rescued even on non-epistemic grounds, such as social peace, impartiality, participation, and equality. To alleviate discourse failure, this book proposes to reduce the scope of majoritarian politics and enlarge markets. (shrink)

Le Maux affirme que Ludwig von Mises était le défenseur d’un système de réserves fractionnaires et un précurseur des économistes contemporains partisans des réserves fractionnaires. Nous critiquons la manière dont Le Maux utilise la littérature ancienne dans ce domaine, et nous montrons qu’il n’est pas suffisamment au fait des travaux de Mises et des problèmes qui divisent les défenseurs et les opposants du système de réserves (...) fractionnaires. Les écrits de Ludwig von Mises fournissent la preuve accablante qu’il était, et il le disait lui-même, un économiste qui développait l’approche de la Currency School dans le domaine des problèmes bancaires.This paper takes issue with an article by Laurent Le Maux that recently appeared in this journal. Le Maux claims that Ludwig von Mises was an advocate of fractional-reserve banking and a precursor of presentday economists defending fractional reserves. We criticise Le Maux’s treatment of previous literature in the field, and show that he is insufficiently acquainted with Mises’ work and with the problems that divide advocates and opponents of fractional reserves. Ludwig von Mises’ writings provide overwhelming evidence that he was, and saw himself as, an economist who developed the approach of the Currency School toward problems of banking. (shrink)

Several threads of research towards developing artificial gametes are ongoing in a number of research labs worldwide. The development of a technology that could generate gametes in vitro has significant potential for human reproduction, and raises a lot of interest, as evidenced by the frequent and extensive media coverage of research in this area. We have asked researchers involved in work with artificial gametes, ethicists, and representatives of potential user groups, how they envisioned the use of artificial gametes in human (...) reproduction. In the course of three focus groups, the participants commented on the various aspects involved. The two recurring themes were the strength of the claim of becoming a parent genetically, and the importance of responsible communication of science. The participants concurred that (a) the desire or need to have genetic offspring of one’s own does not warrant the investment of research resources into these technologies, and that (b) given the minefield in terms of moral controversy and sensitivity that characterises the issues involved, how information is communicated and handled is of great importance. The aim of this article is to provide a description, an analysis and an explanation of Mitteleuropa and of other closely related concepts, such as East-Central Europe. The first section briefly addresses the broad historiographical issues. The second addresses the more strictly political and intellectual history of the concept in the period between 1975 and 1989 while the third section will describe the evolution of the concept after the end of the Cold War. This article analyzes process management and its financial impact on industrial companies in Ecuador and Latin America. Through a literature review and case analysis, process management practices, their benefits and challenges, and how these practices influence the financial results of companies are explored. It highlights the key aspects that contribute to improving operational efficiency and profitability, providing recommendations for successfully implementing process management in the industrial sector.

In this paper, I shall discuss the assumption that Kant’s method in the Critique of Pure Reason is a transcendental analysis of experience. In order to do this, I will consider the conception of transcendental analysis that Marburg Neo-Kantianism powerfully introduced into Kant interpretation. I shall first develop a general model of transcendental analysis in the Marburg sense. I shall then ask whether this is a suitable model for the interpretation of the first Critique. Kant’s distinction between the analytic and (...) synthetic method in the Prolegomena seems to contradict this, given that it is a distinction between two different mathematical methods of demonstration. However, I shall argue that any such reading is incompatible with the Critique, and that transcendental analysis is indeed a legitimate interpretative model for understanding Kant. I shall finally turn to Strawson’s conception of descriptive metaphysics, which has strong affinities to Kant and the Marburg school. Most importantly, Strawson helps us to understand three significant aims at which transcendental analysis is directed. Finally, comparing transcendental analysis to dominant conceptions of analysis in philosophy, I shall argue that it constitutes a variety of philosophical analysis sui generis. (shrink)

Besides indicating the fundamental themes of the various contributions that come together in this monographic section, the purpose of this introduction is to recall the main features of the Hobbesian concept of power, starting from the belief that Hobbes’ philosophy is above all a phi-losophy of power. Based on a radical materialistic ontology, the Hobbesian semantics of power takes on different variations in the particular discursive fields it crosses, which in turn significantly influence its movement. The double dependence on the (...) authority of the sovereign and on the opinion of the people ultimately highlights the aporetic character of the Hobbesian notion of power. (shrink)

Guido de Ruggiero (1888-1948) was perhaps the greatest Italian intellectual historian in the twentieth century. He was a fierce champion of liberalism, an ardent opponent of Fascism, an insightful critic and interpreter of his contemporaries, and a formidable philosopher in his own right. Idealism & Experience: The Philosophy of Guido de Ruggiero comprises eight new critical essays, as well as English translations of five of de Ruggiero's most important shorter writings, which chart the development of his thought between (...) 1914 and 1946. Taken together, these essays reveal the range, richness and philosophical sophistication of de Ruggiero's ideas, enabling Anglophone readers to appreciate their enduring relevance in our own troubled times. _Brill's Companion to Medieval and Early Platonism_ explores the impact exercised by Platonism on philosophy and many other fields of European culture, and the links it established with Christian, Jewish, Byzantine and Arabic traditions of thought during the Middle Ages and the early modern period.

Relying on works by Plotinus, Galen, Ficino, Cesalpino, Kepler and Harvey, this chapter introduces the notion of ‘plantanimal’ imagination to explore the ways in which early modern philosophers and physicians conceptualized the elusive notion of vegetative perception. According to Plato, this perception was characteristic of plants. By concentrating on a series of interrelated notions that helped shape the category of vegetative perception, I will show how early modern thinkers manifested the need to expand the otherwise too narrow concept of animal (...) and nervous reactivity. The process of nutrition will be at the centre of my argument. I will argue that the authors examined in this chapter laid the groundwork for a new idea of digestive and irritable self, through which living beings, including plants, were supposed to be endowed with a sense of natural discernment, capable of recognizing and altering their surrounding reality without losing any of their own identity. Vico esteve empenhado na emancipação do estudo das manifestações objetivas do espírito por intermédio da reforma do racionalismo cartesiano. A crítica ao iluminismo é feita com a retomada do conceito de barbárie no âmbito da filosofia, contrapondo-o ao conceito de esclarecimento do Século das Luzes.

The changes and general alarm of the current COVID-19 pandemic have amplified the sense of precariousness and vulnerability for family members who, in addition to the emotional trauma of the cancer diagnosis, add the distress and fear of the risks associated with infection. The primary objectives of the present study were to investigate the psychological impact of the COVID-19 pandemic on the parents of pediatric cancer patients, and the level of stress, anxiety, and the child’s quality of life perceived by (...) the parents during the COVID-19 epidemic. The parents of 45 consecutive children with solid and hematological tumors were enrolled. Four questionnaires were administered to the parents at the beginning of the pandemic lockdown. A 75% of parents exhibited remarkable levels of anxiety, with 60 subjects in state scale and 45 subjects in trait scale having scores that reached and exceeded the STAI-Y cut off. The bivariate matrix of correlation found a significant positive correlation between the IES-R and PSS scores. There was a positive correlation between the PSS and PedsQL scale and a negative correlation between IES-R and STAI-Y. The results confirm that parents of pediatric cancer patients have a high psychological risk for post-traumatic symptoms, high stress levels, and the presence of clinically significant levels of anxiety. Of late years, even in Italy, no really new personalities or original orientations of thought have made their appearance in philosophy. The best that has been done in our studies consists in ample work consolidating the mental positions already gained during the prewar period, and in slow but unceasing efforts of philosophic thought to permeate the other strata of our culture. It is not paradoxical to affirm that to-day the best fruits of the renewed philosophic education are to be gathered (...) not in books of philosophy, but in books of literary and artistic criticism, of history, and of political and moral science. All this is not merely fortuitous, but proceeds directly and consciously from the trend of the new Italian philosophic thought, which shrinks from isolating itself in an intellectual and fictitious superworld, preferring on the contrary to be a living methodology of the sciences, and to give to its universals the relief and, I might almost say, the savour, of particular things.
