The Covid-19 pandemic has affected not only the health of populations but also their everyday social practices, transformed by orienting to risks of contagion and to health prevention discourses. This paper emanates from a project investigating the impact of Covid-19 on human sociality and more particularly the situated and embodied organization of social interactions. It discusses how Covid-19 impacts the design of ordinary actions in social interaction, how this is made publicly accountable by the participants orienting to the pandemic in (...) formatting their actions and in responding to the actions of others. Adopting an ethnomethodological and conversation analytic perspective, the analyses focus on a particular social activity: paying. The organization of payments in shops and services has been affected by the pandemic, not only by official regulations, favoring some modes of payment over others, but also in how sellers and customers situatedly adapt their practices to imperatives of prevention. On the basis of a rich corpus of video-recorded data, which spans from the pandemic’s prodromes to and after its peak, we show how money transfer is methodically achieved – imposed, negotiated, and readjusted – while variously taking into account possible risks of contagion. Thus, we show not only how pandemics affect social interaction, and how prevention is incarnated in social actions, but also how, in turn, situated solutions implemented by people during the pandemic reveal fundamental features of human action. Guillaume d'Ockham fut l'initiateur principal d'une approche sémantique aux phénomènes cognitifs: la pensée, pour lui, est un discours intérieur et il propose de l'analyser systématiquement à travers les catégories de la grammaire et celles — surtout — de la théorie nouvelle des « propriétés des termes » . On examine ici comment cette suggestion fut reçue chez les philosophes anglais du temps d'Ockham, en particulier: Gauthier Chatton, Hugues Lawton, le Pseudo-Campsall, Crathorn, Robert Holkot et Adam Wodeham. Ockham initiated a semantical approach to cognitive phenomena: thought, for him, is a mental discourse and he proposes to analyse this discourse systematically with the help of the categories of grammar and that of the relatively new theory of « the properties of terms » . What is studied here is the reception of this suggestion among English philosophers in Ockham's own time, notably: Walter Chatton, Hugh Lawton, the Pseudo-Campsall, Crathorn, Robert Holcot and Adam Wodeham. Face aux difficultés soulevées par le rapport de l'intellect à la chose intelligée — question qui suscite de nombreux débats aux confins des XIIIe et XIVe siècles —, Guillaume d'Ockham adopte une solution radicale: elle consiste à supprimer tout intermédiate entre l'acte d'intellection et la chose réelle, donnée dans sa présence singulière, ultime cause efficiente du procès d'émergence et d'élaboration de la connaissance. De ce fait, Guillaume d'Ockham rejette tout corrélat de la connaissance qui serait distinct de la (...) chose même. Cela revient à invalider aussi bien l'idée d'intentio in concreto que celle d'esse obiectivum. Sans faire l'unanimité, loin de là, la solution ockhamiste trouve des echos aussi bien chez des anglais tels que Gauthier Chatton ou Robert Holkot, que dans la pensée parisienne à partir de Jean Buridan. L'essentiel, de ce point de vue, est l'exigence de présence de la chose même dans le renvoi sémantique et dans le rapport de connaissance, par conséquent la détermination de l'objet — entendu comme ce qui fait face à l'intellect — à partir de la présence et de l'être donné, l'instauration d'une relation de causalité efficiente entre la chose et la connaissance. La réflexion philosophique, dont l'ouverture à l'univers dans lequel nous nous découvrons - avec une acuité proportionnelle à un étonnement renouvelé - n'a pas de limites, n'en est que plus tributaire des sciences et des techniques, des arts et de multiples activités qui régissent plus ou moins fructueusement notre expérience. Or, au sein des sciences humaines, privilégiées pour éclairer une condition que nous ne saurions cesser d'interpréter, peu d'oeuvres du dernier siècle auront enrichi en le précisant notre être-au-monde, comme la (...) théorie linguistique de Gustave Guillaume, assez solitaire, et les recherches multiformes de Jean Piaget - où la psychologie de l'enfant a souvent occulté la visée épistémologique et son enracinement biologique (cf Biologie et connaissance, 1967) et ses prolongements pédagogiques, voire éthiques. Le Cinquantenaire et le Trentenaire de leur disparition appelaient un hommage d'autant plus impératif qu'ils sont restés marginaux ou ignorés dans les milieux philosophiques, malgré la centralité de leurs élucidations. Leur commune orientation génétique et structurale n'ayant suscité aucun échange, pendant la contemporanéité de publications d'un tiers de siècle (1923-1960), mesurer leur complémentarité s'impose d'autant plus. S'ils peuvent aider à repenser la condition humaine, c'est qu'ils auront contribué à dissiper le "mystère de la pensée". L'un cherchant à habiliter les caractères systématique et cinétique des langues, irremplaçables moyens de penser ; l'autre dans un vis-à-vis cognitif et opératoire de Freud, en relavant sur les plans épistémologique et logique, notamment, l'élan révolutionnaire de la seconde modernité, autour de l'évolutionnisme. Mais les thèmes majeurs du constructivisme, du schème et de la symbolisation - et plus largement du temps et du langage - auront sans doute aidé à spécifier les mutations autorisées par la révolution critique. Entre l'Instant du je parle et un décentrement exigible pratiquement (éthique) comme théoriquement (épistémique), c'est bien la condition humaine dans son ensemble qui est concernée. Si repenser cette Condition s'impose en permanence, il importe de ne pas manquer des oeuvres qui, par-delà toute mode, proposent à notre expérience des fondations résistant à d'inéluctables vicissitudes. Is a rational morality a necessary evil—a mean between what an individual would judge best—bettering his situation at whatever cost to others, and worst—having one's situation worsened at other's pleasure? It would seem that Glaucon's fable of the ring of Gyges may be applied to our account of morality. And indeed, matters may be worse—a contractarian morality such as we have developed may seem to be a tool for the clever and strong to use in domination, using the language of (...) cooperation to conceal the reality of exploitation. If we understand ourselves on the model of economic man, treating all basic motivation as exemplifying asociality and all human relationships as contractual, we may find these conclusions hard to escape. Even though we could understand the rational arguments in support of morality, our feelings would be engaged only by our own concerns, and we would lack any affective capacity for morality. (shrink)

Economic man seeks to maximize utility. The rationality of economic man is assumed, and is identified with the aim of utility-maximization. But may rational activity correctly be identified with maximizing activity? The object of this essay is to explore, and in part to answer, this question.This is not an issue solely, or perhaps even primarily, about the presuppositions of economics. The two great modern schools of moral and political thought in the English-speaking world, the contractarian and the utilitarian, identify rationality (...) with maximization, and bring morality into their equations as well. To the contractarian, rational man enters civil society to maximize his expectation of well-being, and morality is that system of principles of action which rational men collectively adopt to maximize their well-being. To the utilitarian, the rational and moral individual seeks the maximum happiness of mankind, with which he identifies his own maximum happiness. (shrink)

Law is the expression of public reason. I want to explicate and justify this assertion, which lies at the core of a normative theory of law. Primarily, I want to focus on the concept of public reason, showing what it is, relating it to private or individual reason, and finding its rationale in that relation. I shall then argue that public reason exhausts the normative space where law may be found. Appealing to public reason, I shall show that the authority (...) that law claims over the judgments and actions of citizens must ultimately be grounded in their own rationality. (shrink)

I want to enquire into the relationship between the normative claims of a society and the normative stances of its members. I shall develop a contractarian perspective, as the only one available to persons who may neither expect nor require their fellows to share their own orientation to values and norms. Although I only touch on these matters here, I hope to contribute to an interpretation of the clauses on the establishment and exercise of religion in the First Amendment to (...) the United States constitution, and to suggest guidelines for determining rights and duties in becoming and being a parent. More generally, I offer answers to certain questions about how social practices and institutions may be justified in a democratic society. (shrink)

Current discussion of the normative issues surrounding secession is both helped and hindered by the existence of but one philosophic treatment of these issues sufficiently systematic and comprehensive to qualify as a theory of secession - Allen Buchanan’s. He provides the unique focal point, and so simplifies the task of those who seek to begin from the present state of the art. But in providing the unique focal point, Buchanan complicates the task of those who view, or think they view, (...) secession rather differently than he does. He defends ’a moral right to secede’ but a very qualified right, focusing on state-perpetrated injustice, the preservation of group culture and, in extreme cases, the literal survival of group members. And Buchanan further insists that where preservation of group culture is at stake, ’Neither the state nor any third party has a valid claim to the seceding territory’ -or such a claim is waived so that ’secession in order to preserve a culture is permissible if both parties consent to it’- a condition that he thinks may come to apply to the situation of Quebec. This papers attempts to bridge business ethics to corporate social responsibility including the social and environmental dimensions. The objective of the paper is to suggest an improvement of the most commonly used corporate environmental management tool, the Life Cycle Assessment (LCA). The method includes two stages. First, more phases are added to the life-cycle of a product. Second, social criteria that measure the social performance of a product are introduced. An application of this “extended” LCA tool is given.

Whether it rings unconvincingly in our ears, surely the second does, and it is this which I shall address. The suppos1t1on that moral conventions depend on religious belief has become alien to our way of thinking. Feminist legal scholarship has questioned the usefulness of non-consent as a criterion for rape. Under conditions of generalized sexual oppression, consent may not be an adequate for absence of coercion. I defend this argument and propose that rape law reform can be usefully informed by state protection of workers in the capitalist labor market, where it is assumed that the parties occupy an unequal bargaining position.

Internal logic is the logic of content. The content is here arithmetic and the emphasis is on a constructive logic of arithmetic (arithmetical logic). Kronecker's general arithmetic of forms (polynomials) together with Fermat's infinite descent is put to use in an internal consistency proof. The view is developed in the context of a radical arithmetization of mathematics and logic and covers the many-faceted heritage of Kronecker's work, which includes not only Hilbert, but also Frege, Cantor, Dedekind, Husserl and Brouwer. A partir d'une analyse génétique de la fabrique menant de l'archive enseignante au livre, l'essai fait dialoguer cours et oeuvre, afin de cerner le propre d'une attention constante et inquiète au discours.

While Corporate Social Responsibility (CSR) is often seen to involve voluntary and deliberative approaches such as certification, governments have recently stepped into the picture through national legislation. France’s Law on Duty of Vigilance adopted in 2017 is a landmark case of such legislation. Years of voluntary CSR certification schemes led by Civil Society were replaced by a new philosophy of fighting for mandatory CSR controlled by a judge. We depict the change of mindset and the related change of roles inside (...) the coalition of Civil Society actors represents a Machiavellian Moment. The combination of collective civil society actors’ roles (namely nongovernmental organizations and labor unions) as Machiavellian _Virtue_ with disruptive events as Machiavellian _Fortuna_ made the law’s adoption possible. Based on this case study, we provide an analysis of civil society roles in the development of CSR-related legislation. (shrink)

: The principle of respect for autonomy has come under increasing attack both within health care ethics, specifically, and as part of the more general communitarian challenge to predominantly liberal values. This paper will demonstrate the importance of respect for autonomy for the social practice of assigning moral responsibility and for the development of moral responsibility as a virtue. Guided by this virtue, the responsible exercise of autonomy may provide a much-needed connection between the individual and the community.

Understanding the philosophical foundations of the principle of respect for autonomy is essential for its proper application within medical ethics. The foundations provided by Immanuel Kant's principle of humanity and John Stuart Mill's principle of liberty share substantial areas of agreement including: the grounding of respect for autonomy in the capacity for rational agency, the restriction of this principle to rational agents, and the important distinction between influence and control. Their work helps to clarify the scope and role of the (...) principle of respect for autonomy in health care delivery; its implications for truth telling, informed consent, and confidentiality; and its relationship to other moral principles, such as beneficence and distributive justice. Although the introduction of the modern axiomatic method in physics is attributed to Hilbert, it is only recently that physicists and mathematicians have applied it significantly, i.e. on a basis extensive enough to promise fruitful results. Carnap, for one, stresses the importance of the axiomatic method, yet he considers its application in physics as a task for the future.

The American Medical Association has provided a list of patient responsibilities, said to be derived from patient autonomy, without providing any justification for this derivation. In this article, the virtue of moral responsibility is proposed as a way to justify these kinds of limits on respect for individual autonomy. The need for such limits is explained by examining the traditional principles of health care ethics. What is missing in health care decision making, and can be provided by the virtue of (...) moral responsibility, is a careful consideration of the impact of individual decisions on particular others and the community, as a whole. The concept of moral responsibility as a virtue is then developed and examples of its application to health care decision making are provided. Finally, the roles of both physicians and health care ethicists in promoting the morally responsible exercise of individual autonomy are explored. (shrink)

Although Wilhelm Dilthey and Franz Brentano apparently were pursuing roughly the same objective—to offer a description of our mental functions and of their relations to objects—and both called their respective research programs ‘descriptive psychology’, they seem to have used the term to refer to two different methods of psychological research. In this article, I compare analyses of these differences. Against the reading of Orth but also against a possible application of recent relativist accounts of the epistemology of peer disagreement to (...) this case, I argue that their apparent shared objective is not enough to support an understanding of their views as two alternatives within a given historical or scientific context, or as a mutual peer disagreement. I show that the impression of a shared objective can be explained away as stemming from the influence of their teacher Adolf Trendelenburg, and I stress that the case of introspection strongly suggests that an account in terms of peer disagreement is not plausible. Finally, I conclude that the opposition between two traditions, Austrian philosophy and historicism, might be better suited to account for the dispute and its apparent common historical context. How do we individuate the senses, what exactly do we do when we do so, and why does it matter? In the following article, I propose a general answer to these related questions based on Franz Brentano's views on the senses. After a short survey of various answers offered in the recent literature on the senses, I distinguish between two major ways of answering this question, causally and descriptively, arguing that only answers giving priority to description and to the classification (...) involved in it are on the right track for a general answer to the related questions. In the second part of the article, I argue that Brentano's descriptive psychology is an attractive candidate for such an answer. His descriptive psychology provides a plausible account of the classification involved in description, in particular regarding the classification of sensory qualities. I close the article by briefly explaining how Brentano spells out the priority of descriptive answers over causal ones. (shrink)

Guillaume Collett questions to what extent we can locate Deleuze within the Lacanian School during the late-1960s, prior to Guattari. In so doing, he offers a new, integrated reading of Deleuze's The Logic of Sense by understanding it as a 'psychoanalysis of sense', and gives a new interpretation of Deleuze's conception of philosophy itself. The Psychoanalysis of Sense shows that Deleuze was not merely aware of the debates animating the Lacanian School during the 1960s: he sought to contribute to (...) them. Emphasising his appropriation of the work of post-Lacanian Serge Leclaire, Collett explains how Deleuze constructed a more singular and immanent theory of the linguistic structure of the unconscious - granting the erogenous body a larger structuring role. 1. The portrait and the man – each is unique. “Here is the only portrait of a man, painted exactly from nature and completely true to it.” And this man, “it will be myself…. Myself alone…. I am different.” And yet this unique portrait of this unique man, “may be used as the first comparative work in the study of man, which is certainly yet to be begun.”.

We propose a reflection on the construction of scientific knowledge and in so doing an image of this knowledge. This will allow us to develop a comparative analysis of some of the main principles underpinning the constitution of the different sciences. We will highlight the role of critical thought in science, or even “negative results,” which pose limits and hence open new trajectories. In particular, we will address a misleading point of view, based on some informal concepts taken from computer (...) science, which dominates the biological imaginary. An “ethics of knowledge” will follow, as a critical and open perspective, capable of taking on the well-intentioned responsibility of proposing universal, though not absolute, principles of knowledge.
