Machiavelli, like other Renaissance authors, weaved philosophy into works of fiction, attacking the notion attributed to Plato’s Diotima that love (eros) is philosophy’s partner. Under veiled criticism, presented in four comic texts bound together by the theme of love, Machiavelli delivers his criticism of Diotima’s eros. He joins a long line of astute manipulators, like Numa and Savonarola, who presented difficult ideas to people unlikely to accept them except under cover of divine authority. Franz Brentano’s impact on the philosophy of his time and on 20th-century philosophy is considerable. The “sharp dialectician” (Freud) and “genial master” (Husserl) influenced philosophers of various allegiances, being acknowledged not only as the “grandfather of phenomenology” (Ryle) but also as an analytic philosopher “in the best sense of this term” (Chisholm). The fourteen new essays gathered together in this volume give an insight in three core issues of Brentano’s philosophy: consciousness (sect.1), intentionality (sect. 2) and ontology and metaphysics (sect. (...) 3). Two further sections of the volume deal with the posterity of his philoso¬phy: in section 4, the legacy of his account of sense perception and feeling is discussed, while the history of Brentano’s unpublished manuscripts is discussed in section 5. This section also presents an edition of a manuscript from 1899 on relations, along with the letters from Brentano to Marty which discuss this manuscript. We present here a new method for bioethics: systemic modelling. In this method, the complex phenomenon being studied (e.g. personalized medicine, genetic testing, gene therapy, genetically modified organisms) is modelled as a whole, to shed light on its organization and functioning, and major (bio)ethical issues and solutions for their resolution are then identified. This systemic modelling method is ideal for use in the identification of solutions, rather than their validation, with other methods then used to test the solutions found. We (...) provide a description and reproducible instructions for the application of systemic modelling in bioethics, together with a brief example of the application of this method to the study of the impact of personalized medicine on French society. The practice and development of modern medicine requires large amounts of data, particularly in the domain of cancer. The future of personalized medicine lies neither with “genomic medicine” nor with “precision medicine”, but with “data medicine”. The establishment of this DM has required far-reaching changes, to establish four essential elements connecting patients and doctors: biobanks, databases, bioinformatic platforms and genomic platforms. The “transformation” of scientific research areas, such as genetics, bioinformatics and biostatistics, into clinical specialties has generated a new vision (...) of care. Molecular tumor boards are one response to these changes and are now providing better access to next-generation sequencing and new cancer treatments to patients with inoperable or metastatic cancers, and those for whom the usual treatment has failed. However, MTB face a crucial ethical challenge: maintaining and improving the trust of patients, clinicians, researchers and industry in academic medical centers supported by private or public funding rather than providing genetic data directly to private companies. We believe that, in this era of DM, appropriate modern digital communication networks will be required to maintain this trust and to improve the organization and effectiveness of the system. There is, therefore, a need to reconsider the form and content of informed consent documents at all academic medical centers and to introduce dynamic and electronic informed consent. (shrink)

Psyche and Soma: Physicians and Metaphysicians on the Mind-Body Problem from Antiquity to Enlightenment. New York: Oxford University Press, 2000. Pp. xii + 298. Cloth, $72.00. The mind-body problem has a long history that begins well before Descartes made it extreme by presenting mind as unextended active thinking and (...) matter as unthinking passive extension. This absolute division was motivated in some part by the desire to present the soul as an entity that can survive the death of the body. This is difficult to maintain if the soul is merely the form or the vital force motivating a human body. But the advance of physiology has led more and more to the conclusion that the functions often attributed to the soul are actually carried out by the brain. Thinking may be as natural (and perhaps as determined) a function of the body as is digestion. And if digestion does not survive the death of the body, maybe thinking does not either.This collection of studies provides a detailed introduction to both medical and metaphysical views and theories concerning the relation of mind to body. In particular, the first article by Beate Gundert on Hippocratic Medicine sets the stage by showing that "mind and body in the Hippocratic writings, while distinguished empirically by being related to different types of phenomena, are both ultimately accounted for by the same explanatory model: Human nature (physis), which embraces the totality of bodily structures, physiological processes, and psychic events" (35). T. M. Robinson shows that Plato admits of no solution as to how mind and body interact, and Philip J. van der Eijk argues that "to detach the essence of man completely from his physical make-up would run counter to Aristotle's biological approach to man as a natural living being, the ultimate implication of his view on the divinity of nous is that the fullest realization of what it is to be a human being is to go beyond the limits of corporeality and mortality, and to become, if only temporarily, a god" (77). Heinrich von Staden covers Epicurus, Herophilus, Erasistratus, the Stoics, and Galen, concluding that "The discovery of the nerves entailed the first significant erosion of the vast territory ruled by the soul in Platonic and Aristotelian philosophy, an erosion accompanied by an expansion of the rule of 'nature,' visible not only in medicine, but also in philosophy" (116). Theo K. Heckel discusses Saint Paul's insistence upon the whole person, and Gareth Matthews shows that, prior to Descartes, Augustine presents "a radically new argument for mind-body dualism... an internalist argument... that proceeds from what, allegedly, the mind can know concerning itself to the conclusion that the mind is incorporeal" (145). Emily Michael discusses Pomponazzi's view that we know the immortality of the soul only by faith and the scholastic attempts to show that the soul is a substantial form. Guillaume Lamy, for example, criticized Descartes for having a soul only of thinking, whereas the soul must be of life. Steven Voss shows how at the end of his life, Descartes did discuss in detail how thinking affects the body, particularly in the management of health and the curing of disease. But Descartes does not solve the problem of how this interaction takes place. Thomas Lennon discusses the views of Bayle on Leibniz's monadic forces and Locke's fideism. Patient decision-making autonomy refers to the patients’ ability to freely exert their own choices and make their own decisions, given sufficient resources and information to do so. In pain medicine, it is accepted that appropriate beneficial management aims to propose an individualized treatment plan shared with the patients, as agents, to help them live as autonomously as possible with their pain. However, are patients in chronic pain centers sufficiently autonomous to participate in the therapeutic decisions that concern them? As this (...) question still remains unanswered, a pilot study was set up to that aim. Over a 2-month period, first-time patients within a tertiary multidisciplinary pain center underwent a systematic evaluation of their autonomy using the MacArthur Competence Assessment Tool for Treatment (MacCAT-T), considered the benchmark tool for measuring a patient’s ability to consent to treatment. Demographic data and pain characteristics of the patients were collected and their respective attending pain physicians were asked to clinically assess their patients’ degree of autonomy. Another physician, who had not participated in the initial patient evaluation, subsequently administered the MacCAT-T questionnaire to the same patients. Twenty-seven patients were included during the study period (21 women and 6 men), with an average age of 50 years. The average duration of pain was 8 years. Based on their clinical experience, the 4 different pain physicians in charge of these patients considered that out of 25 assessed patients, 22 of them (89%) had full decision-making capacity, with no deficit in autonomy. According to the MacCAT-T results, only 13 of these 25 patients (48%) had no deficit, while 7 (26%) had a major deficit in autonomy. The only patient characteristic that appeared to be related to autonomy was pain type, specifically nociplastic pain. The average time taken to complete the test was 20 min, and patients were very satisfied with the interview. Results from the present pilot study suggest that patients suffering from chronic pain do not appear to be entirely autonomous in their decision to consent to the proposed treatment plan according to the MacCAT-T questionnaire, and physicians seem to find it difficult to properly assess this competence in a clinical setting. Further studies with larger samples are needed to better evaluate this concept to improve the complex management of these patients. (shrink)

The aim of this paper is to show that we are entitled to see in Schütz’s article “Equality and the Social Meaning Structure” the proposal for a formal analysis of group membership understood as a kind of We-experience irreducible to pure We-relationships. First I argue that such an account defines the experience of group membership as a “situation definition process”. Then I show the relevance of this approach for the description of membership experiences and current debates on Collective Intentionality. Finally, (...) I point to its unclarified conceptual presuppositions—such as the at­tribution of situations to groups—, and propose an interpretative solution by drawing on the notions of “social situation” and community of relevances from The Structures of the Life-World. We show a faithful restriction theorem among infinite chains which implies a reconstructibility conjecture of Halin. This incite us to study the reconstructibility in the sense of Fraïssé and to prove it for orders of cardinality infinite or ≥ 3 and for multirelations of cardinality infinite or ≥ 7, what improves the theory obtained by G. Lopez in the finite case. For this work we had to study the infinite classes of difference which have to be a linear order of (...) type ω, ω* or ω* + ω; this complete the theory made by G. The aim of this paper is to show that the binary notions of reality and negation play an important role in the philosophical agenda of Kant, Maimon and Fichte. The paper has three sections. The first section illustrates the metaphysical significance of Kant’s introduction of the quantitative opposition between reality and negation, which informs the phenomena-noumena distinction and the attribution of intensive magnitude. The second section argues that Maimon’s speculative appropriation of differentials took up Kant’s conception of real opposition between (...) reality and negation but fundamentally revised the theory of space and time to dissolve the problem of applicability in Kant, leading to the consequence of obliterating the pure categories. The third section shows how Fichte inherited the Kantian-Maimonian quantitative opposition of reality and negation in his characterization of the interdetermination between the I and the Not-I and how he developed an immanent account of the relational categories such as causality and substantiality on that basis. Or, au sein des sciences humaines, privilégiées pour éclairer une condition que nous ne saurions cesser d'interpréter, peu d'oeuvres du dernier siècle auront enrichi en le précisant notre être-au-monde, comme la (...) théorie linguistique de Gustave Guillaume, assez solitaire, et les recherches multiformes de Jean Piaget - où la psychologie de l'enfant a souvent occulté la visée épistémologique et son enracinement biologique (cf Biologie et connaissance, 1967) et ses prolongements pédagogiques, voire éthiques. Le Cinquantenaire et le Trentenaire de leur disparition appelaient un hommage d'autant plus impératif qu'ils sont restés marginaux ou ignorés dans les milieux philosophiques, malgré la centralité de leurs élucidations. Leur commune orientation génétique et structurale n'ayant suscité aucun échange, pendant la contemporanéité de publications d'un tiers de siècle (1923-1960), mesurer leur complémentarité s'impose d'autant plus. S'ils peuvent aider à repenser la condition humaine, c'est qu'ils auront contribué à dissiper le "mystère de la pensée". L'un cherchant à habiliter les caractères systématique et cinétique des langues, irremplaçables moyens de penser ; l'autre dans un vis-à-vis cognitif et opératoire de Freud, en relavant sur les plans épistémologique et logique, notamment, l'élan révolutionnaire de la seconde modernité, autour de l'évolutionnisme. Mais les thèmes majeurs du constructivisme, du schème et de la symbolisation - et plus largement du temps et du langage - auront sans doute aidé à spécifier les mutations autorisées par la révolution critique. Entre l'Instant du je parle et un décentrement exigible pratiquement (éthique) comme théoriquement (épistémique), c'est bien la condition humaine dans son ensemble qui est concernée. Si repenser cette Condition s'impose en permanence, il importe de ne pas manquer des oeuvres qui, par-delà toute mode, proposent à notre expérience des fondations résistant à d'inéluctables vicissitudes. In update logic as studied by Baltag, Moss, Solecki and van Benthem, little attention is paid to the interpretation of an action by an agent, which is just assumed to depend on the situation. This is actually a complex issue that nevertheless complies to some logical dynamics. In this paper, we tackle this topic. We also deal with actions that change propositional facts of the situation. In parallel, we propose a formalism to accurately represent an agent's epistemic state based on (...) hyperreal numbers. In that respect, we use infinitesimals to express what would surprise the agents (and by how much) by contradicting their beliefs. We also use a subjective probability to model the notion of belief. It turns out that our probabilistic update mechanism satisfies the AGM postulates of belief revision. (shrink)

Corporate codes of ethics, which have spread in the last decades, have shown a limited ability to foster ethical behaviors. For instance, they have been criticized for relying too much on formal compliance, rather than taking into account sufficiently agents and their moral development, or promoting self-reflexive behaviors. We aim here at showing that a code of ethics in fact has meaning and enables ethical progress when it is interpreted and appropriated with practical wisdom. We explore a model that represents (...) an uncommon organizational code of ethics: the monastic Rule of St. Benedict, written in the sixth century and still used today. Our empirical study—conducted in several monasteries living under this rule—shows that organization members interpret this rule, both hermeneutically and ethically, to adapt it to situations. They also appropriate this rule as a way of life and treat it as a dynamic framework that helps them to follow their purpose within their organization. This exceptional code actually offers an alternative model for practicing codes of ethics, in a virtue-ethical manner, beyond mere compliance with the text. The way in which reflexive and active agents practice the code, both individually and collectively, shapes their organizational experience and fosters their moral development. (shrink)

In Plato's Ion & Meno, Socrates questions Ion, an actor who just won a major prize, about his ability to interpret the epic poetry of Homer. As the dialogue proceeds, the nature of human creativity emerges as a mysterious process and an unsolved puzzle. A similar discussion between Socrates and Meno probes the subject of ethics. Can goodness be taught? If it can, then we should be able to find teachers capable of instructing others about what is good and (...) bad, right and wrong, or just and unjust. Socrates and Meno are unable to identify teachers of ethics, and we are left wondering how such knowledge could be acquired. The text is presented in an updated version of the Jowett translation, which helps to bring the work to life for students and non-academic audiences. (shrink)
