Within the ethics and science literature surrounding uterus transplantation (UTx), emphasis is often placed on the extent to which UTx might improve upon, or offer additional benefits when compared to, existing ‘treatment options’ for women with absolute uterine factor infertility, such as adoption and gestational surrogacy. Within this literature UTx is often positioned as superior to surrogacy because it can deliver things that surrogacy cannot (such as the experience of gestation). Yet, in addition to claims that UTx is superior in (...) the aforementioned sense it is also often assumed (either implicitly or explicitly) that UTx is less fraught with ethical difficulties and thus should be considered a less morally problematic option. This article seeks to examine this assumption. Given that much UTx research has been performed in Sweden, a country where surrogacy is effectively although not currently explicitly forbidden, we do this through an analysis of the arguments underpinning a 2016 Swedish white paper which considered amending existing policy such that altruistic surrogacy arrangements would be permitted. By applying the white paper’s arguments for a restrictive position on altruistic surrogacy to the case of UTx using living altruistic donors we find that such arguments, if they hold in the case of surrogacy, apply similarly to UTx. We thus suggest that, for reasons of consistency, a similar stance should be taken towards the moral and legal permissibility of these two practices. (shrink)

Analysing ten interviews with women diagnosed with and treated for congenital absence of the vagina, this article theorises the notion of ideal (hetero)relational normality. It explores how women in my case study negotiate, relate to and challenge this notion and examines the normative and bodily work for which it calls. The article specifically underscores the corporeal dimension of (hetero)relational normality. I argue that this notion of normality shapes the bodies of the women through medical interventions, while concurrently being reinforced through (...) the corporeal shapings that the women undergo. These corporeal shapings consolidate enacted norms concerning heterosexuality and form understandings of female and male bodies. The analysis also reveals how these women nevertheless find ways to re-negotiate and question the notion of ideal (hetero)relational normality and its intertwinement with medical practice. The article contributes both to the critical examination of genital surgery and to feminist discussions of how to critically examine heterosexuality without rejecting it. Furthermore, it provides a deeper understanding of how medical interventions designed to create a vagina, or dilate a vagina considered ‘too small’, are made meaningful by the women affected. In 2014, the first child in the world was born after live uterus transplantation and IVF (UTx-IVF). Before and after this event, ethical aspects of UTx-IVF have been discussed in the medical and bioethical debate as well as, with varying intensity, in Swedish media and political fora. This article examines what comes to be identified as important ethical problems and solutions in the media debate of UTx-IVF in Sweden, showing specifically how problems, target groups, goals, benefits, risks and stakes are (...) delineated and positioned. It also demonstrates how specific assumptions, norms and values are expressed and used to underpin specific positions within this debate, and how certain subjects, desires and risks become shrouded or simply omitted from it. This approach—which we label the Ethics of the Societal Entrenchment-approach, inspired by Koch and Stemerding (1994)—allows us to discuss how the identification of something as the problem helps to shape what gets to be described as a solution, and how specific solutions provide frameworks within which problems can be stated and emphasised. We also offer a critical discussion of whether some of these articulations and formations should be seen as ethically troubling, and if so, why. (shrink)

Who was responsible for the murder of Sennacherib? This question fascinated Assyriologists for most of the twentieth century, until a new interpretation of an obscure, fragmentary letter convinced many that a disenfranchised elder son of Sennacherib, Urad-Mullissu, had hatched the conspiracy. Since the publication of this text in 1980 by Simo Parpola, near consensus has developed about these events. In this paper I reexamine the issue and revive the theory that Esarhaddon, Sennacherib’s son and successor, may have been behind the (...) assassination, rather than his elder brother. I do not question the coherence of Parpola’s interpretation, but I suggest that the field may place undue confidence in a single broken, decontextualized letter. More importantly, the evidence implicating Esarhaddon is ample. I extend six arguments that point toward Esarhaddon’s guilt, most of which are derived from Esarhaddon’s own account of events in his famous Nineveh A inscription. I do not propose that we can establish Esarhaddon’s guilt conclusively at this remove, but I conclude that the weight of this evidence equals, if not surpasses, that which points to a plot concocted by Urad-Mullissu. How cautious should regulators be? A standard answer is consequentialist: regulators should be just cautious enough to maximize expected social value. This paper charts the prospects of a nonconsequentialist - and more precautionary - alternative. More specifically, it argues that a contractualism focused on ex ante consent can motivate the following regulatory criterion: regulators should permit a socially beneficial risky activity only if no one can be expected to be made worse off by it. Broadly speaking, there are two strategies (...) regulators can use to help risky activities satisfy this criterion: regulators can mandate strict safety standards that protect those who would otherwise stand to lose, and they can require that some of the benefits of the activity be redirected to them. In developing these themes, the paper aims to provide a theoretical grounding for those who oppose using risk-cost-benefit analysis as the primary regulatory standard, and in particular, for advocates of the precautionary principle. Comparative pride—that is, pride in how one compares to others in some respect—is often thought to be warranted. In this paper, I argue that this common position is mistaken. The paper begins with an analysis of how things seem when a person feels pride. Pride, I claim, presents some aspect of the self with which one identifies as being worthy. Moreover, in some cases, it presents this aspect of the self as something one is responsible for. I then go on (...) to argue that when the focus of one's pride is comparative, things are never as pride makes them seem. The core problem is that if the performance in which one takes pride is really valuable, the fact that it is superior to the performance of others does nothing to contribute to that value. I conclude with a discussion of why so many are inclined to validate comparative pride and a response to those who claim that comparisons are essential to pride because they must be used to set standards of excellence. By "theory" we mean a special project in literary criticism: the attempt to govern interpretations of particular texts by appealing to an account of interpretation in general. The term is sometimes applied to literary subjects with no direct bearing on the interpretation of individual works, such as narratology, stylistics, and prosody. Despite their generality, however, these subjects seem to us essentially empirical, and our argument against theory will not apply to them.Contemporary theory has taken two forms. Some theorists have sought (...) to ground the reading of literary texts in methods designed to guarantee the objectivity and validity of interpretations. Others, impressed by the inability of such procedures to produce agreement among interpreters, have translated that failure into an alternative mode of theory that denies the possibility of correct interpretation. Our aim here is not to choose between these two alternatives but rather to show that both rest on a single mistake, a mistake that is central to the notion of theory per se. The object of our critique is not a particular way of doing theory but the idea of doing theory at all.Theory attempts to solve—or to celebrate the impossibility of solving—a set of familiar problems: the function of authorial intention, the status of literary language, the role of interpretive assumptions, and so on. We will not attempt to solve these problems, nor will we be concerned with tracing their history or surveying the range of arguments they have stimulated. In our view, the mistake on which all critical theory rests has been to imagine that these problems are real. In fact, we will claim such problems only seem real--and theory itself only seems possible or relevant—when theorists fail to recognize the fundamental inseparability of the elements involved.The clearest example of the tendency to generate theoretical problems by splitting apart terms that are in fact inseparable is the persistent debate over the relation between authorial intention and the meaning texts. Some theorists have claimed that valid interpretations can only be obtained through an appeal to authorial intentions. This assumption is shared by theorists who, denying the possibility of recovering authorial intentions, also deny the possibility of valid interpretations. But once it is seen that the meaning of a text is simply identical to the author's intended meaning, the project of grounding meaning in intention becomes incoherent. Since the project itself is incoherent, it can neither succeed nor fail, hence both theoretical attitudes toward intention are irrelevant. The mistake made by theorists has been to imagine the possibility or desirability of moving from one term to a second term , when actually the two terms are the same. One can neither succeed nor fail in deriving one term from the other, since to have one is already to have them both.In the following two sections we will try to show in detail how theoretical accounts of intention always go wrong. In the fourth section we will undertake a similar analysis of an influential account of the role interpretive assumptions or beliefs play in the practice of literary criticism. The issues of belief and intention are, we think, central to the theoretical enterprise; our discussion of them is thus directed not only against specific theoretical arguments but against theory in general. Our examples are meant to represent the central mechanism of all theoretical arguments, and our treatment of them is meant to indicate that all such arguments will fail and fail in the same way. Does the decision to relax by taking a drive rather than by taking a walk cause harm? In particular, do the additional carbon emissions caused by such a decision make anyone worse off? Recently several philosophers have argued that the answer is no, and on this basis have gone on to claim that act-consequentialism cannot provide a moral reason for individuals to voluntarily reduce their emissions. The reasoning typically consists of two steps. First, the effect of individual emissions on the (...) weather is miniscule: the planet’s meteorological system is so large, and the size of individual emissions so tiny, that whatever impact an individual emission has on the weather must be vanishingly small. Second, vanishingly small impacts aren’t morally relevant because no one could possibly tell the difference between such an impact occurring and it not occurring. In this paper, we show why both steps are mistaken, and hence why act-consequentialism implies that each of us has an individual obligation to do what we can to stop damaging the climate, including by refraining from, or perhaps by purchasing offsets against, our own individual luxury carbon emissions. Background: Concern has been expressed about the process of consent to clinical trials, particularly in phase I “first-in-man” trials. Trial participant information sheets are often lengthy and technical. Content-based readability testing of sheets, which is often required to obtain research ethics approval for trials in the USA, is limited and cannot indicate how information will perform. Methods: An independent-groups design was used to study the user-testing performance of the participant information sheet from the phase I TGN1412 trial. Members of the (...) public were asked to read it, then find and demonstrate understanding of 21 key aspects of the trial. The participant information sheet was then rewritten, redesigned and tested on 20 members of the public, using the same 21-item questionnaire. Results: On the original TGN1412 participant information sheet, participants could not find answers and some of the found information was not understood. Six of 21 questions, including those relating to placebo, follow-up visits and the emergency phone number, were found by eight or fewer of 10 participants. The revised information sheet performed better, with the answers to 17 of 21 questions found and understood by all 20 participants. Conclusions: Tests showed that the TGN1412 participant information sheet may not inform participants adequately for consent. Revising its content and design led to significant improvements. Writers of materials for trial participants should take account of good practice in information design. Performance-based user testing may be a useful method to indicate strengths and weaknesses in trial materials. (shrink)

This article develops and defends an account of prudential value that is inspired by ideas found in Thoreau’s Walden. The core claim is that prudential value consists in responding appropriately to those things that make the world better, and avoiding those things that make it worse. The core argument is that this is our aim in so far as we are evaluative creatures, and that our evaluative nature is essential to us in the context of inquiring into our good. I (...) also illustrate how the account can be developed to inform an intuitively plausible theory of well-being, and conclude by discussing its virtues relative to some contemporary alternatives. Chrisoula Andreou argues that even if our happiness is determined by our material standard of living, our standard of living could be lowered without lowering our happiness. In this response, I show how this claim can be challenged on both conceptual and empirical grounds. Conceptually, how justified we are in believing her claim depends on how we conceive of the 'we' it refers to. Empirically, there is economic evidence in tension with each of the several interpretations her position admits of. (...) I conclude that Andreou has not provided an argument that can reasonably persuade committed materialists that reducing their standard of living will not reduce their happiness. And I suggest that the search for such an argument ought to include attempts to articulate and defend a theory of well-being that shows how tenuous the connection between material luxury and quality of life really is. Since materially opulent lifestyles are a significant cause of environmental degradation, environmentalists often call for us to live more simply. This call is typically focused on consumption. But our environmental footprint is a function of our paid work as well as our purchases. Consequently, environmentalists should also urge us to work less. Defending this claim is the project of this paper. Reducing our economic productivity, I argue, can often be expected to make both the world and our characters better. New and experienced psychotherapists alike can find themselves overwhelmed by an ethical quandary where there doesn't seem to be an easy solution. This book presents positive ethics as a means to overcome such ethical challenges. Envy of others' material possessions is a potent motivator of consumerism. This makes it a prudentially and morally hazardous emotional response. After outlining these hazards, I present an analysis of the emotion of envy. Envy, I argue, presents things in the following way: the envier lacks some good that her rival possesses; this difference between them is bad for the envier; this difference reflects poorly on the envier's worth; and this difference is undeserved. I then discuss the conditions under which (...) these presentations can be satisfied by differences in material possessions. My conclusion is that no difference in material possessions can simultaneously be all the ways envy presents it as being. Consequently, economic envy is systematically irrational: it is never a warranted response to the distribution of material wealth. Recognising this bolsters the prudential and moral case for reducing the degree to which we feel it and for resisting the inclinations it gives rise to when we do. (shrink)

Out of a concern for keeping suicidal patients alive, some psychotherapists may use hard persuasion or coercion to keep them in treatment. However, more recent evidence-supported interventions have made respect for patient autonomy a cornerstone, showing that the effective interventions that promote the wellbeing of suicidal patients also prioritize respect for patient autonomy. This article details how psychotherapists can incorporate respect for patient autonomy in the effective treatment of suicidal patients by listening to them, explaining treatments to them, involving them (...) in decisions, and inviting evaluations from them on the process and progress of their treatment. It also describes how processes that respect patient autonomy can supplement interventions that directly address some of the drivers of suicide. (shrink)

Furthermore, it follows the changes the triad of ‘race-class-gender’ undergoes on its transatlantic route from the United States to a German-speaking context and it outlines (...) the theoretical challenges connected to an intersectional perspective that aims to overcome a theoretical stagnation that itself finds symptomatic expression in the ritual citing of ‘race-class-gender’. Contemporary moral egalitarians hold that all people have equal moral standing and that we deserve this standing in virtue of satisfying some descriptive criterion. These two claims appear to be in tension, however, as none of the proposed criteria are attributes that all people possess equally. Many egalitarians have hoped to eliminate this tension by holding that the descriptive criterion of moral standing is a "range property" – that is, a property one either possesses fully or not at all. I (...) argue that the prospects of this strategy succeeding are not good. The problems I raise stem from the vagueness of the egalitarians’ descriptive criteria. Appealing to what I call the moral ideal of proportionality, I show that this vagueness forces us to allow that moral standing can be possessed to finely differentiated degrees. But once this is granted, it is difficult to see how the claim that all people are moral equals can be justified. (shrink)

By analyzing cases in which we must choose between options whose values are not precisely comparable, this paper presents the case for the existence of a previously unrecognized class of practical reasons – reasons that arise from how the value of an option compares to the values of the alternatives. Several implications of these comparative value-based reasons are discussed – including the context-dependence of one option’s being ‘rationally preferable to’ an alternative, and the fact that, even when the values of (...) an agent’s alternatives fail to be precisely comparable, practical reason will always be able to determine that the choice of at least one option is justified. This paper aims to investigate some important elements of the thought of George Bernard Shaw, more commonly known as one of the most famous playwrights of the twentieth century. Shaw’s philosophy dwells on the relationship between man and nature and especially the concept of freedom. Among all his works, it was decided here to analyse Saint Joan. In re-imagining the historical Joan as a heroine in a play of ideas, Shaw made use of the known facts about Joan of Arc (...) and Joan’s statements at her trial. Nonetheless, he made changes to emphasize her personal dignity and independence by contrast with the tyranny of institutions. Although he departed from the historical background, whitewashed her adversaries, and condensed episodes in Joan’s biography, he sought to be true to her confidence, courage, integrity, and common sense. His theatrical presentation is, in some respects, at odds with the Preface that accompanies the published play. (shrink)

I want to show that Leibnizian mode to thinking is based in a kind of logic of concepts. As an example, his first attempt to sum infinite series is analyzed. The question concerning the justification of the Leibnizian syllogism leads to the analysis of the fundamental definition. A conclusion obtained by “real-definitions” (“Realdefinitionen”) is logically justified. It is classified as a "Vernunftwahrheit". A conclusion obtained by paradoxical definitions (paradoxe Definitionen) is classified as a “Tatsachenwahrheit”. According to Leibniz it has validity (...) by contingency. A conclusion obtained by “impossible definitions” is logically unjustified. (shrink)

In seinem grossen Spätwerk »Auch eine Geschichte der Philosophie« rekonstruiert Jürgen Habermas den Diskurs über Glauben und Wissen, aus dem nicht zuletzt die säkulare Welt resultiert. Ob und wie dieser Diskurs weitergehen kann, um die Moderne vor Entgleisungen zu bewahren, ist allerdings fraglich. Der Band setzt sich aus theologischer Perspektive kritisch und nach vorne gerichtet mit dem Werk auseinander. In einem eigenen Text antwortet Jürgen Habermas auf die Beiträge.

Durch die Akademieausgabe von Leibniz' Schriften werden nach und nach viele Dokumente allgemein zugänglich, die bisher in der Leibniz-Forschung wenig Berücksichtigung fanden. Dazu gehören insbesondere auch die naturwissenschaftlichen, medizinischen und technischen Schriften, die in der Reihe VIII der Edition präsentiert werden. Ein erster Teilband, der die Jahre 1668 bis 1676 umfasst, wurde 2009 veröffentlicht. Hierin sind auch die Dokumente enthalten, in denen sich Leibniz mit den 1672 erschienenen Experimenta Nova Magdeburgica Otto von Guerickes auseinandersetzt. Da Guerickes Werk nicht nur die (...) berühmten Vakuumexperimente umfasst, sondern sich ausgehend von den Experimenten als großangelegtes Kompendium zur zeitgenössischen Astronomie versteht, werden in dem hier erstmalig in deutscher Übersetzung präsentierten Exzerpt viele seinerzeit aktuelle physikalische Fragen berührt. Die Übersetzung wird ergänzt durch textkritische und inhaltliche Anmerkungen, eine ausführliche Einleitung und den Briefwechsel zwischen Guericke und Leibniz. (shrink)

This paper begins with a description of common grading practices at universities in the U.S., and analyzes the unfairness, injustice, and harm they produce. It then proposes a solution to these problems in the form of an alternative grading system: institutions should adopt a grading system that assesses students’ performance relative to the performance of their peers. That is, institutions should abolish the practice of attempting to assign grades that correspond to an absolute standard of intrinsic merit. Instead, our evaluation (...) should simply communicate how the quality of a student’s work compares to the work submitted by other students in the class. (shrink)

Understanding disgustingness is philosophically important partly because claims about disgustingness play a prominent role in moral discourse and practice. It is also important because disgustingness has been used to illustrate the promise of "neo-sentimentalism." Recently developed by moral philosophers such as David Wiggins, John McDowell, Simon Blackburn, Justin D'Arms and Dan Jacobson, neo-sentimentalism holds that for a thing to be disgusting is for it to be "appropriate" to respond to it with disgust. In this paper, I argue that from what (...) we currently know about the disgust response, these accounts are mistaken. Instead, disgustingness is best understood as a descriptive property: fundamentally, things that are disgusting-for-S are things that possess triggers for S's disgust mechanism. Theoretically, my account puts pressure on neo-sentimentalists to show that the responses they appeal to can anchor normative properties. Practically, my account shows that we must abandon authoritative claims that certain things really are--or are not--disgusting. (shrink)
