The so-called 'Dutroux-case'- the revelation of the kidnapping and the murder of four underaged girls and the apparent malfunctions of the judiciary and the police forces, was the most important issue on the 1997 political agenda. Unanimously, the Chamber of Representatives agreed upon the recommendations of a parliamentary inquiry into the bungled police investigation. Yet the unanimity disappeared quickly when the recommendations on the reorganisation of the police forces had to be implemented.New revelations of the Dassault-case, and the involvement of (...) both socialist parties, put the government underpressure. The events themselves, and the discontent they caused in some majority parties, urged the government to revise the governmental programme. Guy Spitaels, chairman of the Walloon parliament resigned. Guy Coëme, former minister of Defence, alleged ofpassive corruption in the Dassault-case, was referred to the Supreme Court of Appeal by decision of the Chamber of Representatives. (shrink)

This paper examines perfectionist attempts to explain the prudential badness of pain (its badness for those who experience it). It starts by considering simple perfectionist explanations, finding them wanting, before considering the most sophisticated perfectionist attempt to explain prudential badness: Gwen Bradford’s tripartite perfectionism. The paper argues that Bradford’s view, though an improvement on earlier perfectionist proposals, still does not satisfactorily explain the full set of prudentially bad pains. It ends by showing how this provides grounds for a general kind (...) of pessimism about perfectionism and the badness of pain and how this case undermines a general purported advantage of perfectionism over the objective list theory. Noradrenergic pathways are involved in mediating the central and peripheral effects of physiological arousal. The aim of the present study was to investigate the role of noradrenergic transmission in moral decision-making. We studied the effects in healthy volunteers of propranolol (a noradrenergic beta-adrenoceptor antagonist) on moral judgement in a set of moral dilemmas pitting utilitarian outcomes (e.g., saving five lives) against highly aversive harmful actions (e.g., killing an innocent person) in a double-blind, placebo-controlled, parallel group design. Propranolol (40 mg orally) (...) significantly reduced heart rate, but had no effect on self-reported mood. Importantly, propranolol made participants more likely to judge harmful actions as morally unacceptable, but only in dilemmas where harms were ‘up close and personal’. In addition, longer response times for such personal dilemmas were only found for the placebo group. Finally, judgments in personal dilemmas by the propranolol group were more decisive. These findings indicate that noradrenergic pathways play a role in responses to moral dilemmas, in line with recent work implicating emotion in moral decision-making. However, contrary to current theorising, these findings also suggest that aversion to harming is not driven by emotional arousal. Our findings are also of significant practical interest given that propranolol is a widely used drug in different settings, and is currently being considered as a potential treatment for post-traumatic stress disorder in military and rescue service personnel. The scientific worldview is often claimed to reveal a universe chillingly indifferent to human suffering. But it’s unclear what it means to describe the universe as indifferent, or what a non- indifferent universe would be like. I suggest that the relevant contrast isn’t simply that between God and His absence, nor is the complaint about indifference focused on the lack of a kind of cosmic concern. At its heart is the idea of a mismatch between world and value. Although the (...) causal forces governing our world are ‘blind’, they nevertheless do partly align with value. Still, our world is so arranged that senseless suffering is depressingly common, and the rosy non- indifferent counterfactual won’t contain such evil. I argue, however, that it is a mistake to long for such an alternative: it must either involve an upside- down moral order, or would be a world from which we, and those who senselessly suffer, will be absent. Self-harm within immigration detention centres has been a widely documented phenomenon, occurring at far higher rates than the wider community. Evidence suggests that factors such as the conditions of detention and uncertainty about refugee status are among the most prominent precipitators of self-harm. While important in explaining self-harm, this is not the entire story. In this paper, we argue for a more overtly political interpretation of detainee self-harm as resistance and assess the ethical implications of this view, drawing on interviews (...) with detainees from Australia’s offshore system. Self-harm by detainees is not only a medical ‘condition’ arising in response to oppression but a form of political action to lessen or contest it. We first establish how self-harm could be conceptualised as resistance. We then discuss its political purpose, noting it serves at least three functions: intrinsic, instrumental and disruptive or coercive. Viewing detainee self-harm as political resistance is a supplement to (rather than a substitute for) a medical approach. However, conceptualising self-harm this way has several advantages, namely, moving away from the idea that such behaviour is ‘maladaptive’, recognising detainees as political agents, combatting government claims of ‘manipulation’ and ‘blackmail’ and clarifying the duties of healthcare workers who work in detention. We review an argument that bipartite "PR-box" correlations, though designed to respect relativistic causality, in fact violate relativistic causality in the classical limit. As a test of this argument, we consider Greenberger-Horne-Zeilinger (GHZ) correlations as a tripartite version of PR-box correlations, and ask whether the argument extends to GHZ correlations. If it does-i.e., if it shows that GHZ correlations violate relativistic causality in the classical limit-then the argument must be incorrect (since GHZ correlations do respect relativistic causality in the classical (...) limit.) However, we find that the argument does not extend to GHZ correlations. We also show that both PR-box correlations and GHZ correlations can be retrocausal, but the retrocausality of PR-box correlations leads to self-contradictory causal loops, while the retrocausality of GHZ correlations does not. Much of the research on teachers’ personal epistemology concerns their learning. Surprisingly little research has looked at how personal epistemologies are related to teachers’ teaching and other aspects of their interactions with students. In this chapter we investigate teachers’ personal epistemologies and the extent to which they predict autonomy-supporting behaviors. Such behaviors have been found to predict positive educational outcomes. 600 students in 21 grade 7 and 8 classrooms were administered surveys regarding two aspects of autonomy support: the extent to (...) which their teachers tried to take their perspective and provided them with rationales for prosocial behavior. At the same time, their teachers’ personal epistemologies were assessed. Students of teachers scored as having advanced personal epistemologies reported that their teachers were more likely to take their perspective. We conclude that teacher education in personal epistemology and autonomy supportive practices should have positive effects both for the teachers and their students. (shrink)

Son judaïsme est la voix singulière d’un recommencement. Dans sa jeunesse talmudique à Vilna, il a été à l'école d'une si haute pensée de la grandeur excessive de Dieu qu'elle échappe à nos représentations et décourage la philosophie de s'en faire l'interprète. Arrivé en France, s'adonnant avec émerveillement à la phénoménologie, il apprend d'elle (...) que l'esprit n'est rien que liaison au dehors, échange avec le monde et ouverture à autrui. Pour elle, le monde repose fondamentalement sur l'expérience empirique de la rencontre de l'homme, non directement sur la relation à Dieu. Mais dans l'exploration de son domaine propre, celui de l'existence finie, la raison se heurte à des limites – la mort, le visage d'autrui – où surgit une altérité exigeante, qui se refuse aux réductions et aux accaparements dont la transcendance divine est l'objet dans les religions même révélées et qui dénonce les violences infligées aux hommes au nom du divin. Ainsi transformée par son écoute de l'illimité, la raison phénoménologique déplace la notion de révélation. L'homme en perte d'identité se découvre orienté par un souffle de transcendance, non vers une vérité absolue, mais vers un Dieu absent qui s'est retiré dans son incognito.The Jewish tradition impregnates the philosophical discourse of Levinas to such an extent that one suspects it to be a theology of transcendence in disguise. The ambiguity is only apparent. His Judaism is a unique voice of a new beginning. In his Talmudic youth in Vilna, Levinas was at a school with such a high idea of the excessive greatness of God that it escapes our representations and discourages philosophy to be its interpreter. When he arrived in France he gave himself up to the wonder of phenomenology. From it he learned that the spirit is nothing other than liaison to the outside, interchange with the world, and openness to the other. The world is fundamentally based on the empirical experience of man’s encounter, not directly on relation to God. But reason, in the exploration of its own domain, finite existence, meets its limits – death, the visage of the other– where a demanding alterity arises. This latter refuses reductions and monopolizations whose object is divine transcendence, even in revealed religions, and denounces violence inflicted on men in the name of the divine. Thus transformed by listening to the limitless, phenomenological reason displaces the notion of revelation. In the visage is revealed the holiness of the person, with the absolute justice that is due him ; in Holy Scripture we find the supreme responsibility of each one toward the other. Man, in losing his identity, finds himself oriented by a breath of transcendence, not towards an absolute truth, but towards an absent God who has drawn back into its incognito. (shrink)

In the 1760s, the international debate on the solution to determining longitude at sea is at its acme. Two solutions emerge, the mechanical and the astronomical ones. The Portuguese mathematician and astronomer José Monteiro da Rocha (1734–1819) is well aware of that debate. For him, Harrison’s No. 4 marine timekeeper cannot be seen as a solution. The desirable solution could only be astronomical. In a manuscript from c. 1765, which unfortunately he fails to publish, Monteiro da Rocha is very critical (...) of Lacaille's lunar-distance method (1759) and proposes another one. In this paper, we intend to analyse Monteiro da Rocha’s criticisms and proposals, trying to understand how this manuscript fits into the international longitude debate and the Portuguese scientific scenario at the time. Concurrently, we will re-examine the classical historiography around the English vs. French priority proposal of the lunar-distance method, purging it from its mythologies to shift it towards a more open, less linear history. Discrete choice experiments—selecting the best and/or worst from a set of options—are increasingly used to provide more efficient and valid measurement of attitudes or preferences than conventional methods such as Likert scales. Discrete choice data have traditionally been analyzed with random utility models that have good measurement properties but provide limited insight into cognitive processes. We extend a well-established cognitive model, which has successfully explained both choices and response times for simple decision tasks, to complex, multi-attribute discrete choice data. The (...) fits, and parameters, of the extended model for two sets of choice data (involving patient preferences for dermatology appointments, and consumer attitudes toward mobile phones) agree with those of standard choice models. The extended model also accounts for choice and response time data in a perceptual judgment task designed in a manner analogous to best–worst discrete choice experiments. We conclude that several research fields might benefit from discrete choice experiments, and that the particular accumulator-based models of decision making used in response time research can also provide process-level instantiations for random utility models. The thesis analyses the relation between Rousseau’s musical writings and elements of his moral, social and linguistic philosophy. In particular, I am concerned to demonstrate: (i.) how the core of Rousseau’s theory of musical imitation is grounded in the same analysis of the nature of man which governs his moral and social philosophy; (ii.) how this grounding does not extend to the stylistic prescriptions the justification of which Rousseau intended his musical writings to offer. The central argument draws on Rousseau’s (...) analysis of the origin of man as distinctively human. This origin extends to the awareness of moral and aesthetic value, and to communication in speech and song. Rousseau’s moral analyses of social and political life usually take the form of relating contemporary practice to the original structure in which man’s awareness of his own good is commensurate with that of the good of others. The analysis of music follows a similar model: music is to be considered good in so far as it replicates, or faithfully reflects, the original model of communication. The value of music is thereby understood to extend to moral as well as aesthetic goodness. Given the subtlety of Rousseau’s understanding of the ‘origin’, I argue that this analysis of music’s aesthetic value is powerful and far‐ reaching in its relevance for contemporary musical aesthetics. However, I also argue that while the analysis in general is good in this way, it does not entail the specific kind of musical‐stylistic preferences which Rousseau sought to use it to advance. Charles Péguy (1873–1914) was a French religious poet, philosophical essayist, publisher, social activist, Dreyfusard, and Catholic convert. There has recently been a renewed recognition of Péguy in France as a thinker of unique significance, a reconsideration inspired in large part by Gilles Deleuze’s Différence et répétition, which ranked him with Nietzsche and Kierkegaard. In the English-speaking world, however, access to Péguy has been hindered by a scarcity of translations of his work. This first complete translation of one of his most (...) important prose works, with accompanying interpretive introduction and notes, will introduce English-speaking readers to a new voice, which speaks in a powerful and original way to a modern West in a condition of cultural and spiritual crisis. The immediate circumstance of the writing of this last prose essay, unfinished at the time of Péguy’s early death, was the placing of Henri Bergson’s philosophical works on the Catholic Index, and Péguy’s undertaking to defend his former teacher from his critics, both Catholic and secular. But the subject of Bergson is also a springboard for the exploration of the perennial themes—philosophical, theological, and literary—most central to Péguy’s thought. (shrink)

Guy Jobin | : L’objet de cet article est l’identification de quelques linéaments d’une éthique de la parole croyante dans l’espace public des sociétés démocratiques. Cette éthique sera élaborée à partir de la notion de style, notion qui résulte de récentes recherches sur l’herméneutique du concile Vatican II. Nous proposons une démarche en trois parties sur un objet bien précis, soit la parole des évêques catholiques proposée dans le cadre de débats moraux. Le premier temps de notre démarche sera consacré (...) à la réflexion d’André Naud sur l’éthique de la parole épiscopale. Cette réflexion tardive dans la production théologique de Naud n’a pas été, à notre connaissance, l’objet d’une étude approfondie. Sans prétendre offrir une analyse complète et définitive de ce travail, mais tout en soulignant son caractère pionnier, nous en cernerons les limites pour notre réflexion. Le deuxième temps de la démarche montrera la pertinence du paradigme éthique de la responsabilité pour réfléchir à l’éthique de la parole épiscopale dans l’espace public. Enfin, penser l’éthique de la parole publique des croyants en l’inscrivant dans le paradigme de la responsabilité est un geste théologique, certes, mais il s’appuie sur une pratique, soit celle de la prise de parole à Vatican II. Plus précisément, c’est dans la Constitution pastorale Gaudium et Spes qu’une « pratique » de la responsabilité s’est manifestée. Cette pratique est en fait une pragmatique que nous mettrons en lumière, dans la troisième partie de l’article, par une analyse rhétorique de l’énonciation qui a prévalu dans la rédaction de la Constitution pastorale. | : The object of this article is the identification of some lineaments of an ethics of the believing word in the public space of our democracies. This ethics will be elaborated starting with the notion of style, a notion resulting from recent researches on the hermeneutics of the Vatican II Council. We propose a three-part approach on quite a precise object, namely the word of Catholic bishops uttered within the framework of moral debates. The first part of our approach will dwell on André Naud’s reflection upon the ethics of the episcopal word. This later reflection within Naud’s theological production has not so far been, to our knowledge, the object of a thorough study. Without pretending to offer a complete and definitive analysis of that work, but nevertheless underscoring its pioneer character, we will identify its limits for our reflection. The second part of the approach will show the relevance of the ethical paradigm of responsibility in order to reflect on the ethics of the episcopal word in the public space. Finally, to think out the ethics of the public word of believers while setting it within the paradigm of responsibility is a theological gesture, to be sure, but it is based on a practice, namely that of speaking at Vatican II. More precisely, it is in the Pastoral Constitution Gaudium et Spes that a “practice” of responsibility was manifested. That practice is in fact a pragmatic which, in the third part of the article, we will shed light on through a rhetorical analysis of the enunciation that prevailed in the wording of the Pastoral Constitution. Issues: We present key aspects of our paper, commissioned by UNAIDS in 2005, entitled, “Revisiting the ethics of HIV prevention research in developing countries.” In 2004 and 2005 we witnessed the closure or suspension of three international clinical trials testing tenofovir in the prevention of HIV infection in high risk groups due to the failure to provide free treatment to those who seroconvert during the conduct of the study. We examine critically moral claims for the provision of treatment to those (...) who seroconvert in HIV prevention trials and ask whether it is a matter of moral obligation or moral negotiation?Description: Using the tools of philosophical and regulatory analysis we examine the moral foundations of research ethics, international regulation, and the contemporary literature in search of valid arguments in support of a moral obligation to treat. Arguments supporting the obligation to provide such treatment are found in a wide variety of documents. These claims are variously rooted in the demand to compensate for research-related injury, maximization of research benefit, justice as reciprocity, and justice as equality.Lessons learned: Our analysis reveals that there is as of yet no robust moral argument supporting a moral obligation to provide treatment to participants in HIV prevention trials who seroconvert. We argue that moral negotiation offers distinct advantages over moral obligation. Moral negotiation finds support in the principle of respect for communities that holds researchers responsible to respect communal values, protect and empower social institutions and abide by the decisions of accepted communal authorities.Recommendations: Moral negotiation, rather than moral obligation, reduces the chance of polarization of positions by inviting trial participants, sponsors, researchers and all other involved parties to the table for discussion. Moral negotiation favors middle ground solutions that fit the specific health needs and priorities of the community in question. (shrink)

For decisions between many alternatives, the benchmark result is Hick's Law: that response time increases log-linearly with the number of choice alternatives. Even when Hick's Law is observed for response times, divergent results have been observed for error rates—sometimes error rates increase with the number of choice alternatives, and sometimes they are constant. We provide evidence from two experiments that error rates are mostly independent of the number of choice alternatives, unless context effects induce participants to trade speed for accuracy (...) across conditions. Error rate data have previously been used to discriminate between competing theoretical accounts of Hick's Law, and our results question the validity of those conclusions. We show that a previously dismissed optimal observer model might provide a parsimonious account of both response time and error rate data. The model suggests that people approximate Bayesian inference in multi-alternative choice, except for some perceptual limitations. (shrink)
