Nursing, a scientific and practical discipline, faces continuing challenges of finding new direction in order to decipher its core values and develop current ethical codes for nursing practice. In 2009–10, 28 nurses were purposely selected and interviewed using a semi-structured format in focus groups and individually. Thematic Content Analysis helped explore the perception of Iranian nurses on ethical values in patient care. Seven major themes emerged: respect for dignity, professional integrity, professional commitment, developing human relationships, justice, honesty, and promoting individuals (...) and the nursing profession. Iranian nurses revealed a unique and culture-based set of ethical values. This study found that Iranian nurses place a greater emphasis on preserving the dignity of those accompanying the patient and in showing regard for patients' religious beliefs in a gender appropriate environment. In one of the earlier influential papers in the field of experimental philosophy titled Normativity and Epistemic Intuitions published in 2001, Jonathan M. Weinberg, Shaun Nichols and Stephen Stich reported that respondents answered Gettier type questions differently depending on their ethnic background as well as socioeconomic status. There is currently a debate going on, on the significance of the results of Weinberg et al. (2001) and its implications for philosophical methodology in general and epistemology in specific. Despite the debates, however, (...) to our knowledge, there has not been a replication attempt of the experiments of the original paper. We collected data from four different sources (two on-line and two in-person) to replicate the experiments. Despite several different data sets and in various cases larger sample sizes and hence greater power to detect differences, we failed to detect significant differences between the above-mentioned ethnic and socioeconomic groups. Our results suggest that epistemic intuitions are more robust across ethnic and socioeconomic groups than Weinberg et al. (2001) indicates. Given our data, we believe that the notion of differences in epistemic intuitions among different ethnic and socioeconomic groups that follows from Weinberg et al. (2001) needs to be corrected. The basing relation is a relation that obtains between a belief and the evidence or reason for which it is held. It is a highly controversial question in epistemology how such a relation should be characterized. Almost all epistemologists believe that causation must play a role in articulating the notion of the basing relation. The causal account however faces the serious problem of the deviant causal chains. In this paper, I will be particularly looking at the philosophers’ appeal to the (...) notion of disposition as a way of excluding deviant chains. Having argued against such accounts, it will be suggested that, since the obtaining of the basing relation is what distinguishes propositional from doxastic justification, we may have a better grasp of this notion if we could clearly see how those two species of justification are related to one another. Drawing on earlier work, a dispositional account of propositional and doxastic justification is subsequently defended. It will be argued that such a view has the resources to resolve the problem of causal deviance, thus, providing an acceptable account of the notion of the basing relation. (shrink)

In their paper titled “Gender and philosophical intuition,” Buckwalter and Stich argue that the intuitions of women and men differ significantly on various types of philosophical questions. Furthermore, men's intuitions, so the authors claim, are more in line with traditionally accepted solutions of classical problems. This inherent bias, so the argument goes, is one of the factors that leads more men than women to pursue degrees and careers in philosophy. These findings have received a considerable amount of attention and the (...) paper is to appear in the second edition of Experimental Philosophy edited by Knobe and Nichols , which itself is an influential outlet. Given the exposure of these results, we attempted to replicate three of the classes of questions that Buckwalter and Stich review in their paper and for which they report significant differences. One of the new topics that has attracted the attention of researchers in recent years is neuro-marketing. The purpose of the present study is to achieve an insight into the progress of studies on neuro-marketing through review of scientific articles in this field with methodology text-mining. A total of 394 articles were selected between 2005 and 2017 using the search for “neuro-marketing” in valid databases. By reviewing the title, abstract, and keywords at various stages of screening, the researchers selected 311 (...) articles related to the neuro-marketing topic in order to carry out the text mining process. Then, pre-processing of data was performed and using cluster analysis, 6 optimal clusters were obtained according to Davis Bouldin index. Using the multi-attribute decision-making technique, the most important roots were ranked in each cluster. The results showed that interest in research on neuro-marketing has increased in recent years and clusters created around topics such as marketing strategies, advertising and video ads, ethical issues, advertising message components, neuroscience in marketing, economics and consumer behavior, and decision making and brand selection. The study shows that the researchers’ attention is moving from the concepts and principles of the use of neuroscience in marketing, economics and consumer behavior to design and develop marketing strategies using neuroscience. In this study, we solve analytically the Schrödinger equation for a macroscopic quantum oscillator as a central system coupled to two environmental micro-oscillating particles. Then, the double-slit interference patterns are investigated in two limiting cases, considering the limits of uncertainty in the position probability distribution. Moreover, we analyze the interference patterns based on a recent proposal called stochastic electrodynamics with spin. Our results show that when the quantum character of the macro-system is decreased, the diffraction pattern becomes more similar to (...) a classical one. We also show that, depending on the size of the slits, the predictions of quantum approach could be apparently different with those of the aforementioned stochastic description. (shrink)

This paper presents and evaluates the Brentanian theory of association of ideas. The topic of association usually brings to mind British Empiricism, which is often thought to have a monopoly on the matter. Brentano, however, adopts an original, alternative account of association. He argues that all cases of association can be placed under a single general law, that of “habit”. His explicit account of the topic is rather brief; however, his most faithful pupil, Anton Marty, thoroughly developed his master’s views. (...) Marty presents Brentano’s account of association in detail, and endeavours to defend it against rival theories, notably those which hold that the laws of “similarity”, or of what is called “redintegration”, are able to explain all cases of association. First, the paper presents the information found in Brentano himself on association of ideas. Then, it turns to Marty to analyze his developments of the Brentanian view. Fronto-parietal activity has been frequently observed in fMRI and PET studies of attention, working memory, and episodic memory retrieval. Several recent fMRI studies have also reported fronto-parietal activity during conscious visual perception. A major goal of this review was to assess the degree of anatomical overlap among activation patterns associated with these four functions. A second goal was to shed light on the possible cognitive relationship of processes that relate to common brain activity across functions. For all reviewed functions we (...) observed a consistent and overlapping pattern of brain activity. The overlap was most pronounced for the bilateral parietal cortex , and dorsolateral prefrontal cortex . Developmental processes in complex animals are directed by a hardwired genomic regulatory code, the ultimate function of which is to set up a progression of transcriptional regulatory states in space and time. The code specifies the gene regulatory networks (GRNs) that underlie all major developmental events. Models of GRNs are required for analysis, for experimental manipulation and, most fundamentally, for comprehension of how GRNs work. To model GRNs requires knowledge of both their overall structure, which depends upon linkage amongst regulatory (...) genes, and the modular building blocks of which GRNs are heirarchically constructed. The building blocks consist of basic transcriptional control processes executed by one or a few functionally linked genes. We show how the functions of several such building blocks can be considered in mathematical terms, and discuss resolution of GRNs by both “top down” and “bottom up” approaches. In the present study, we analyze and study the role of whole banks, commercial banks and specialized banks between 2002 and 2012 in Isfahan, based on the growth of value added approach in the industrial sector. In order to investigate this matter, we have estimated three extinction panels for the whole banking (...) system, specialized banks and commercial banks in Eviews 9. Based on the results it can be argued that in the panels of whole banks and specialized banks, payment facilities have a positive and meaningful impact on the growth of value added in all three sectors of the economy, but in the panel of commercial banks, only banking facilities on a 10 percent level have a positive and meaningful impact on the growth of value added in the industrial sector. As a result, we can conclude that specializing the bank's activities can have a positive effect on the growth of value added in various sectors of the economy. ]]>. (shrink)

The unsettling fear of COVID-19 infections has caused a new trend in consumer behavior in the food and beverage industry. The unprecedented COVID-19 pandemic has shifted consumers’ preferences from eat-in to online delivery. This research aims to measure the impact of consumers’ motivation to protect themselves from contracting COVID-19, which explains why people switch from eat-in to online food delivery. We adopted the theory of protection motivation to explain consumer switching behavior during the COVID-19 pandemic. The present study investigated the (...) mediating effect of switching intention on the relationship between vulnerability, altruistic fear, anticipated regret, and switching behavior. Simultaneously, we examined the role of brand awareness as a moderator of behavioral choices of consumers switching from eat-in to online delivery. We collected data from 681 eatery consumers in Kuala Terengganu, Malaysia, using scenario-based survey questionnaires. Then, the data were analyzed using structural equation modeling. This new generation analysis was conducted using the analysis of moment structure and the statistical package for social science. The results indicated that consumer vulnerability, altruistic fear, and anticipated regret of COVID-19 increased consumers’ propensity to shift from eat-in to online food delivery. Allegedly, consumer behavioral control and intention of switching toward online delivery were pointedly affected by switching behavior. The results indicated that consumer vulnerability, altruistic fear, and anticipated regret of COVID-19 increased the shifting of restaurant dine-in patterns and made the intention to switch to online delivery. Consumers’ alleged behavioral control and their intention of switching toward online delivery were pointedly affected by switching behavior. We also found that brand awareness moderately affects switching behavior toward restaurant settings. The present research contributes to developing the consumer behavior model of switching from eat-in to online delivery. This study also provides eatery customers and the business community with a safer and healthier proposition of shifting to online food delivery during the pandemic. (shrink)

This book sheds new light on the history of the philosophically crucial notion of intentionality, which accounts for one of the most distinctive aspects of our mental life: the fact that our thoughts are about objects. Intentionality is often described as a certain kind of relation. Focusing on Franz Brentano, who introduced the notion into contemporary philosophy, and on the Aristotelian tradition, which was Brentano’s main source of inspiration, the book reveals a rich history of debate on precisely the relational (...) nature of intentionality. It shows that Brentano and the Aristotelian authors from which he drew not only addressed the question whether intentionality is a relation, but also devoted extensive discussions to what kind of relation it is, if any. The book aims to show that Brentano distinguishes the intentional relation from two other relations with which it might be confused, namely, causality and reference, which also hold between thoughts and their objects. Intentionality accounts for the aboutness of a thought; causality, by contrast, explains how the thought is generated, and reference, understood as a sort of similarity, occurs when the object towards which the thought is directed exists. Brentano claims to find some anticipation of his views in Aristotle. This book argues that, whether or not Brentano’s interpretation of Aristotle is correct, his claim is true of the Aristotelian tradition as a whole, since followers of Aristotle more or less explicitly made some or all of Brentano’s distinctions. This is demonstrated through examination of some major figures of the Aristotelian tradition (broadly understood), including Alexander of Aphrodisias, the Neoplatonic commentators, Thomas Aquinas, Duns Scotus, and Francisco Suárez. This book combines a longue durée approach – focusing on the long-term evolution of philosophical concepts rather than restricting itself to a specific author or period – with systematic analysis in the history of philosophy. By studying Brentano and the Aristotelian authors with theoretical sensitivity, it also aims to contribute to our understanding of intentionality and cognate features of the mind. (shrink)

This paper addresses the issue of how to best account for the diversity of our (synchronic) mental activities. The discussion starts with Mark Textor’s mental monism. According to mental monism, our mental life is constituted by just one simple mental act, in which different sub-acts can be conceptually distinguished. Textor grounds this view in the work of the early Brentano and contrasts it with the theory of the later Brentano, who introduces a mental substance into his philosophy. According to Textor, (...) Brentano needs a substance because he is unable to explain how mental monism can account for the separability of our mental activities, e.g. the fact that I can stop hearing F while still seeing blue. Textor argues, however, that mental monism can solve this problem. I address two issues regarding Textor’s view. First, I challenge his interpretation of Brentano by arguing that the early Brentano imports ontological complexity into our mental life; I defend Brentano’s view against possible criticisms, and I address some objections to mental monism. Second, I oppose Textor’s narrative about the mental substance. I argue that Brentano needs a substance not to explain separability, but rather to individuate our mental acts. I still argue, however, that Brentano’s earlier view (understood in my sense) is better than the substance account for dividing the mind. (shrink)

Transcendental arguments have been described as disclosing the necessary conditions of the possibility of phenomena as diverse as experience, self-knowledge and language. Although many theorists saw them as powerful means to combat varieties of skepticism, this optimism gradually waned as many such arguments turned out, on examination, to deliver much less than was originally thought. In this paper, I distinguish between two species of transcendental arguments claiming that they do not actually constitute distinct forms of reasoning by showing how they (...) collapse into more familiar inferences. I then turn to the question of their epistemic potentials which I argue to be a function of both their types as well as their targets. Finally, these claims are reinforced by uncovering links between certain recent claims about the efficacy of transcendental arguments and the so-called Moore’s paradox. (shrink)

A large body of evidence supports the idea that a common fronto-parietal network is activated across a range of diverse cognitive functions. Jung & Haier's (J&H's) review demonstrates a very similar pattern of activity, which correlates with individual differences in intelligence. We propose that these converging lines of evidence are best interpreted as a general role of the fronto-parietal network in integration and control.

The problem that will be dealt with in this paper is al-Ghazālī’saccount of causality in the observed phenomenal world where he denies thenecessity of that causation. This denial brought about Ibn Rushd’s accusationon the denial of knowledge, arguing that knowledge is based on causalityin the phenomenal words. However, detailed perusal of al-Ghazālī’s workssuggests that Ibn Rushd’s accusation is not the case. al-Ghazālī differentiatesbetween knowledge of the fact and knowledge of reasoned fact, or in otherwords he distinguished ontological causality from logical (...) causality. Inaddition, al-Ghazālī’s denial of causal necessity is supported by his ownlogic, where the knowledge attainment becomes possible when it is examinedfrom demonstrative sciences, especially from empirically tested premises. According to the thesis of epistemic conservatism it would be unreasonable to change one's beliefs in the absence of any good reasons. Although it is claimed that epistemic conservatism has informed and resolved a number of positions and problems in epistemology, it is difficult to identify a single representative view of the thesis. This has resulted in advancing a series of disparate and largely unconnected arguments to establish conservatism. In this paper, I begin by casting doubt on the claim of (...) widespread and genuine applications of the conservative policy. I then distinguish between three main varieties of epistemic conservatism, namely, differential, perseverance and generation conservatism Having evaluated various arguments that have been offered or may be considered on behalf of the conservative thesis, I close by concluding that those versions of the thesis that survive critical scrutiny fail to live up to the aspirations of the thesis as a substantive canon of rationality, that to the extent that principles of conservatism are epistemically promising, they are not plausible. This paper examines the account of ordinary language semantics developed by Franz Brentano and his pupil Anton Marty. Long before the interest in ordinary language in the analytic tradition, Brentanian philosophers were exploring our everyday use of words, as opposed to the scientific use of language. Brentano and Marty were especially interested in the semantics of (common) names in ordinary language. They claimed that these names are vague, and that this is due to the structure of the concepts that constitute (...) their meaning: concepts expressed by such names are themselves vague, based on typicality, and have more or less similar items within their extension. After presenting the views of Brentano and Marty, this paper compares them to later accounts of meaning and concepts, notably Wittgenstein’s theory of family resemblances and the prototype theory of concepts, and emphasizes the originality of the Brentanian position. It is not difficult to make sense of the idea that beliefs may derive their justification from other beliefs. Difficulties surface when, as in certain epistemological theories, one appeals to sensory experiences to give an account of the structure of justification. This gives rise to the so-called problem of ‘nondoxastic justification’, namely, the problem of seeing how sensory experiences can confer justification on the beliefs they give rise to. In this paper, I begin by criticizing a number of theories that (...) are currently on offer. Finding them all wanting, I shall then offer a diagnosis of why they fail while gesturing towards a promising way of resolving the dispute. It will be argued that what makes the problem of nondoxastic justification a hard one is the difficulty of striking the right balance between a notion of normative justification that is content-sensitive and truth conducive and the possibility of error while acknowledging the fact that our experiences can justify our beliefs in cases we are hallucinating. This essay examines Wolff’s science of teleology, which has historically been dismissed as a crude physico-theology resting on a simple confusion between uses and purposes. Focusing especially on his two German volumes (German Teleology, 1723, and German Physiology, 1725), I argue that, first, Wolff never intended teleology to be a self-standing theology; and second, that teleology, as a part of physics, is primarily an applied or practical discipline. In its theological function, teleology presupposes the ontological and cosmological arguments for the (...) being and attributes of God rendered in rational theology. As a part of physics, meanwhile, teleology presupposes the inert-mechanical view of nature which had emerged in the seventeenth century, and builds upon mechanistic physics by providing a perspective on nature as consisting of relations of benefit and advantage. The physiological part of teleology, or the study of plant and animal bodies, occupies a special place, for which Wolff deploys notions of health and sickness consistent with the mechanistic physics he accepts. With this in view, I argue that Wolff’s teleology could not be the proper target of Kant’s critique of physico-theology. Yet, there remain deeper differences between Wolff and Kant on the topic, which have to do with the sources and limits of teleological reasoning in general. (shrink)

Belief is generally thought to be the primary cognitive state representing the world as being a certain way, regulating our behavior and guiding us around the world. It is thus regarded as being constitutively linked with the truth of its content. This feature of belief has been famously captured in the thesis that believing is a purposive state aiming at truth. It has however proved to be notoriously difficult to explain what the thesis really involves. In this paper, I begin (...) by critically examining a number of recent attempts to unpack the metaphor. I shall then proceed to highlight an error that seems to cripple most of these attempts. This involves the confusion between, what I call, doxastic and epistemic goals. Finally, having offered my own positive account of the aim-of-belief thesis, I shall underline its deflationary nature by distinguishing between aiming at truth and hitting that target (truth). I end by comparing the account with certain prominent inflationary theories of the nature of belief. (shrink)

In the spirit of Von Neumann and Morgenstern (Theory of games and economic behavior, Princeton University Press, Princeton, 1944), we introduce a notion of network stability. We study the structure of stable economic networks and their associated stable payoff allocations by analyzing the conditions under which complete networks and star networks (both with desirable property of inclusiveness) are stable. We also address conditions for existence and uniqueness of stable set of networks.

Any theory of epistemic justification must address the question of what its aim is and why we value it. The almost general consensus among epistemologists is that there is an intimate link between justification and truth. However, the standard formu- lation of this connection (as the truth-directed goal of maximizing true belief and minimizing false belief) has been increasingly challenged in recent times on the ground that it leaves no room for justified false beliefs and unjustified true beliefs. In this (...) paper, I shall argue for a diachronic version of the truth-directed goal in the face of the objections raised against it. To provide further support for this conclusion, I criticize Foley’s synchronic account of the truth-directed goal by showing how it is undermined by certain consequences of his egocentric theory of epistemic rationality. This paper aims to present and evaluate Brentano’s account of the individuation of mental acts. In his early works, Brentano assimilated mental acts to tropes; however, he encountered difficulties in explaining their individuation, since the usual solutions for the individuation of tropes were not readily applicable to his theory of mental acts. In a later period, Brentano introduced into his psychology what he called the “soul”, and this allowed him to explain the individuation of mental acts. Finally, after his “reistic” (...) turn, he excluded mental acts from his ontology, for he rejected abstracta of any kind, including abstract particulars, and admitted only things, or res (in Latin), that is, concrete particulars; in his late philosophy, there are no “thinkings”, but only “thinkers”. However, he still needed to explain what individuates different thinkers, and this was again the soul. This article studies the academic context in which Cartesianism was absorbed in Germany in the mid-seventeenth century. It focuses on the role of Johann Clauberg (1622-1665), first rector of the new University of Duisburg, in adjusting scholastic tradition to accommodate Descartes’ philosophy, thereby making the latter suitable for teaching in universities. It highlights contextual motivations behind Clauberg’s synthesis of Cartesianism with the existing framework such as a pedagogical interest in Descartes as offering a simpler method, and a systematic concern to (...) disentangle philosophy from theological disputes. These motivations are brought into view by situating Clauberg in the closely-linked contexts of Protestant educational reforms in the seventeenth century, and debates around the proper relation between philosophy and theology. In this background, it argues that Clauberg nevertheless retains an Aristotelian conception of ontology for purely philosophical reasons, specifically, to give objective foundations to Descartes’s metaphysics of substance. In conclusion, Clauberg should not be assimilated either to Aristotelianism or to Cartesianism or, indeed, to syncretic labels such as ‘Cartesian Scholastic’. Instead, he should be read as transforming both schools by drawing on a variety of elements in order to address issues local to the academic milieu of his time. (shrink)

Background: Education is considered the first function and mission of the university, and observing educational ethics guarantees the health of the teaching–learning process in the university. Aim: The aim of this study was to explore ethical values in nursing education from the perspective of Iranian nursing students and educators. Research design: This qualitative study was conducted using the Thematic Content Analyses method. The data were collected from seven semi-structured individual interviews and three focus group discussions from July to November 2015. (...) Participants and research context: The participants were faculty educators of nursing and nursing students in Tehran, capital of Iran, who were selected through purposive sampling. They were recruited gradually. Sampling was continued until data saturation when no new codes were extracted. Ethical committee: This study was conducted after obtaining the approval of Shahid Beheshti University of Medical Sciences Ethics Committee, and informed consent were ensured before conducting the research. The principles of voluntariness, confidentiality, and anonymity were respected during the research process. Findings: Seven major themes emerged: human dignity, constructive human relations, educational justice, competency enhancement, excellence view, wisdom, and commitment and accountability. Conclusion: The results of this study indicated that although many of the values, as universal values, were similar to those of other countries—which can be a reflection of the globalization process in the nursing profession and the presence of humanistic and spiritual approaches at the roots of the discipline, some differences could be found in the content of values due to factors such as the people’s beliefs, culture, and religion. Iranian nursing students and educators revealed a unique and culture-based set of ethical values. (shrink)

This paper discusses the thesis defended by Edith Stein that certain acts can be attributed to the State. According to Stein, the State is a social structure characterized by sovereignty. As such, it is responsible for the production, interpretation, and application of law. These tasks require the performance of acts, most of which are what Stein calls “social acts” like enactments and orders. For Stein, the acts in question are made by the organs of the State, but in the name (...) of the State, and are thus attributed to the State via a relation of representation. In the first section, the paper presents Stein’s thesis that the sovereignty of the State entails a series of legal prerogatives, which in turn result in various social acts being ascribed to the State through its representatives. In the second section, the paper critically discusses Stein’s views, notably her theory of representation, and her account of the nature of the State, while emphasizing its most interesting aspects, namely, its fine-grained analyses of the various acts that are attributed to the State. This paper argues for an interpretation of Leibniz’s claim that physics requires both mechanical and teleological principles as a view regarding the interpretation of physical theories. Granting that Leibniz’s fundamental ontology remains non-physical, or mentalistic, it argues that teleological principles nevertheless ground a realist commitment about mechanical descriptions of phenomena. The empirical results of the new sciences, according to Leibniz, have genuine truth conditions: there is a fact of the matter about the regularities observed in experience. Taking this stance, however, (...) requires bringing non-empirical reasons to bear upon mechanical causal claims. This paper first evaluates extant interpretations of Leibniz’s thesis that there are two realms in physics as describing parallel, self-sufficient sets of laws. It then examines Leibniz’s use of teleological principles to interpret scientific results in the context of his interventions in debates in seventeenth-century kinematic theory, and in the teaching of Copernicanism. Leibniz’s use of the principle of continuity and the principle of simplicity, for instance, reveal an underlying commitment to the truth-aptness, or approximate truth-aptness, of the new natural sciences. The paper concludes with a brief remark on the relation between metaphysics, theology, and physics in Leibniz. (shrink)

Background: Moral distress has been experienced by about 67% of critical care nurses which causes many complications such as job dissatisfaction, loss of capacity for caring, and turnover for nurses and poor quality of care for patients as well as health system. Objective: The purpose of this research was to provide a moral empowerment program to nursing directors, school of nursing, and the heads of hospitals to reduce moral distress in nurses and improve the quality of care. Methods: This research (...) was a randomized clinical trial conducted in two groups and three stages before, after 2 weeks, and 1 month after the intervention in order to evaluate the changes in moral distress of 60 nurses working in adults’ intensive care unit wards of Al-Zahra teaching hospital of Isfahan University of Medical Sciences. Data were collected using the standard Hamric’s Moral Distress Scale (2012) and analyzed using SPSS software version 22. Ethical considerations: This study was approved by the Ethics Committee of Isfahan University of Medical Sciences, Isfahan, Iran. Results: Results showed that in the three stages, there was no significant difference between the mean score of moral distress before (4.12 ± 2.70), 2 weeks after (4.23 ± 2.70), and 1 month after the intervention (4.04 ± 2.54) in the control group (p > 0.05), while in the experimental group, there was a significant difference between the three stages (p 0.05). However, this score significantly decreased 1 month after the intervention (2.64 ± 2.23; p < 0.05). Conclusion: In this research, it was observed that moral empowerment program has been effective in reducing the mean score of moral distress. Therefore, it is recommended that nursing managers and hospital directors implement empowerment program, in order to reduce the moral distress of nurses and improve the quality of care. (shrink)

The legal-ethical dynamism in Islamic law which allows it to respond to the challenges of modernity is said to reside in the institution of ijtihād (independent legal thinking and hermeneutics). However, jurists like Mohsen Kadivar and Ayatollah Faḍlalla have argued that the “traditional ijtihād” paradigm has reached its limits of flexibility as it allows for only minor adaptations and lacks a rigorous methodology because of its reliance on vague and highly subjective juridical devices such as public welfare (maṣlaḥa), imperative necessity (...) (ḍarūra), emergency (iḍtirār), need (ḥāja), averting difficulty (‘usr) and distress (ḥaraj), hardship (mashaqqa), and harm (ḍarar) without interrogating the fundamentals (uṣūl) of ijtihād. In contrast, in the “foundational ijtihād” model theology, ethics, intellect, epistemology, linguistics, hermeneutics, modern sciences, history, cosmology, anthropology, and the sources of Islamic legal theory (uṣūl al-fiqh) interact with one another to obtain resolutions that are just and non-discriminatory.
