The author discusses Niklas Luhmann's concept of ethics and morals. Therefore he sketches the main traits of Luhmann's theory of systems (e.g. the terms autopoiesis, system and environment, code and programme). From the system-theoretical point of view, ethics are characterized as the reflexive theory of morals. Morals are described as the communication of regard or disregard. The author shows which consequences follow from this concept by discussing problems concerning several subsystems at the same time. The problems of Luhmann's theory (...) of morals and ethics are demonstrated by analyzing the concepts of risk and responsibility. Justice, equality, and righteousness—these are some of our greatest moral convictions. Yet in times of social conflict, morals can become rigid, making religious war, ethnic cleansing, and political purges possible. Morality, therefore, can be viewed as pathology-a rhetorical, psychological, and social tool that is used and abused as a weapon. An expert on Eastern philosophies and social systems theory, Hans-Georg Moeller questions the perceived goodness of morality and those who claim morality is inherently positive. Critiquing the ethical "fanaticism" of (...) Western moralists, such as Immanuel Kant, Lawrence Kohlberg, John Rawls, and the utilitarians, Moeller points to the absurd fundamentalisms and impracticable prescriptions arising from definitions of good. Instead he advances a theory of "moral foolishness," or moral asceticism, extracted from the "amoral" philosophers of East Asia and such thinkers as Ludwig Wittgenstein and Niklas Luhmann. The moral fool doesn't understand why ethics are necessarily good, and he isn't convinced that the moral perspective is always positive. In this way he is like most people, and Moeller defends this foolishness against ethical pathologies that support the death penalty, just wars, and even Jerry Springer's crude moral theater. In the German intellectual context, the answer to this question could be as laconic (...) as it would be superfluous: it consists in a deictic reference to the name and, implicitly, to the work of Niklas Luhmann. American readers, in contrast, may need some introductory explanation in order to understand the epistemological triangle between contemporary pedagogical thought, Maturana's biology, and Luhmann's philosophy—and, above all, in order to assess and even to appreciate its intellectual potential.Niklas Luhmann is certainly difficult to read, at least for starters, and to those who met him during his lifetime he invariably appeared to be a dead-serious person. But today, more than five years after Luhmann's death, we begin to discover traces of a sometimes uncanny irony—one may want to call it a "practical irony"—in his writing. One of the discursive gestures that characterized Luhmann's texts were references to academic authors who nobody had ever heard of (let alone read), presented with the same seriousness and with the same attitude of intellectual reverence that we normally reserve for the classics: for example, to the logician Gotthart Guenter, the philosopher Fritz Heider, the biologist Humberto Maturana, or the mathematician George Spencer Brown. There is no doubt that, in each case, a specific concept or a specific thought developed by one of these authors had turned out to be truly important within Luhmann's own work, and yet the "effects of authority" that his very serious quotes produced were nothing short of hilarious. For Luhmann's readers, with that self-flagellating attitude in which we academics so like to indulge, quite regularly attributed the experience that they had never heard of those seeming "authorities" to their own lack of intellectual cosmopolitanism. This is why, until the present day, some departments of sociology or philosophy in Germany have Spencer Brown or Guenter specialists on their payrolls, and this also explains why some of those authors have had moments of intense reception [End Page 22] in the world of the humanities and social sciences at German universities. Among them, Humberto Maturana, together with his co-author the late Francisco Varela, seem to be the exception confirming the rule that none of those Luhmann references had the intellectual power to survive Luhmann himself.Now why should one trust Luhmann's trust in Maturana? The debate about the importance of Luhmann's thought (he labeled it a "theory of social systems") in the larger context of contemporary Western philosophy has barely begun to become serious, and we are certainly many years away from a definitive consensual evaluation. But there are two—very different—features about Luhmann's work that make him fascinating at first glance. One lies in the simple fact that, probably, no other thinker since Hegel has managed to develop a restrained set of basic concepts and premises into a systematically coherent philosophical edifice of similar proportions. In this sense, entering the dimension of Luhmann's thought offers the patient reader a possibility to view many familiar positions and questions from sometimes radically different innovative angles. Less obvious, however, and more intriguing is Luhmann's intellectual bet to develop his systemic thought under strict avoidance of notions such as "subject," "subjecthood," or "agency." It was this very bet (about whose existential and political motivations he only left some rather vague remarks) that explains Luhmann's fascination for much theoretical thinking emerging from biological research, above all for Humberto Maturana's work. For from a biological perspective, subjecthood and agency are highly marginal attributes in the realm of living organisms. I believe that this (almost hidden) component in Luhmann's thinking can explain the particularly strong affinity of contemporary pedagogical thought in Germany with his work. This article discusses New Confucian views on individuality and related philosophical problems. Special emphasis is given to the position of Tu Wei-Ming, a foremost living New Confucian thinker. It is pointed out that many New Confucian philosophers share a vision of a Confucian 'ideal' individuality or selfhood based on social integration - as opposed to a Western type of individuality sometimes portrayed as an individuality by isolation. These patterns of individuality are further examined on the basis of Niklas Luhmann's (...) historical analysis of the semantics of individuality and his categories of 'individuality by inclusion' and 'individuality by exclusion'. Finally, some parallels and differences between Confucian and the Luhmannian viewpoints are pointed out, and a suggestion on how a Luhmannian perspective might contribute to reformulations of New Confucian thought is attempted. In a first retrospective of Niklas Luhmann's work, it is surprising to see that concepts regarding time and temporality received comparatively little attention. This article starts with the hypothesis that, over the years, Luhmann tended to subsume and deal with topics regarding time under the notion of `contingency'. Identified as the central ` Eigenwert' of modern societies, Luhmann seems to suggest that contingency ended up modifying the three classical time dimensions. In the case of the future dimension, the question (...) arises of what effect a modification of contingency through contingency as social Eigenwert might yield. The answer proposed is that this effect lies in our contemporary tendency to see the future as a field of risk-calculation. (shrink)

Niklas Luhmann (1927-1998) was a German sociologist and system theorist who wrote on law, economics, politics, art, religion, ecology, mass media, and love. Luhmann advocated a radical constructivism and antihumanism, or "grand theory," to explain society within a universal theoretical framework. Nevertheless, despite being an iconoclast, Luhmann is viewed as a political conservative. Hans-Georg Moeller challenges this legacy, repositioning Luhmann as an explosive thinker critical of Western humanism. Moeller focuses on Luhmann's shift from philosophy to theory, which introduced (...) new perspectives on the contemporary world. For centuries, the task of philosophy meant transforming contingency into necessity, in the sense that philosophy enabled an understanding of the necessity of everything that appeared contingent. Luhmann pursued the opposite--the transformation of necessity into contingency. Boldly breaking with the heritage of Western thought, Luhmann denied the central role of humans in social theory, particularly the possibility of autonomous agency. In this way, after Copernicus's cosmological, Darwin's biological, and Freud's psychological deconstructions of anthropocentrism, he added a sociological "fourth insult" to human vanity. A theoretical shift toward complex system-environment relations helped Luhmann "accidentally" solve one of Western philosophy's primary problems: mind-body dualism. By pulling communication into the mix, Luhmann rendered the Platonic dualist heritage obsolete. Moeller's clarity opens such formulations to general understanding and directly relates Luhmannian theory to contemporary social issues. He also captures for the first time a Luhmannian attitude toward society and life, defined through the cultivation of modesty, irony, and equanimity. (shrink)

I give an account of Max Weber's views concerning the basis of the objectivity of the cultural sciences. In this connection, I offer a critical discussion of his distinction between different "value spheres," each with its own "intrinsic logic." I then consider parallels between Weber's "value spheres" and central elements of Bourdieu's field theory and Luhmann's systems theory, and try to show to what extent Bourdieu's and Luhmann's problems, and the solutions they suggest, can be seen as similar to Weber's. In whichever specific ways this concept has been defined (and we all know how confusing (...) the range of those proposals has become), 1 it always ends up referring to the modalities in which an "Observer-Subject" can refer to what (s)he is observing as the "World of Objects." "Making sense," then, may be described as the selection, performed by an observer, of a specific object of reference among all the objects of which the world is believed to consist; or as the drawing of a line by which (s)he makes a distinction, at every given moment, between those parts of the world that (s)he is observing and those that (s)he is not observing; or as the positioning of a chosen topic within a preexisting context of possible associations. All these different descriptions can be turned into definitions of "sense making" as long as they point to the awareness that whatever has been chosen, divided, or contextualized could have been chosen, divided, or contextualized differently. Another way of evoking the same type of relation between what remains "potential" and what becomes "actual" would be to say that the concept of "sense" always refers to cases of entropy transformed into structure—under the condition that alternative patterns of transforming entropy into structure remain available. What we call the Subject's consciousness (Bewusstsein) is the place where these selections take place and where their alternatives are held available.If we consider the Subject/Object paradigm as the core element of that style of philosophizing which has been called (sometimes from a purely descriptive and sometimes from a critical angle) "Western metaphysics," then it is a both true and trivial conclusion to say that, within Western metaphysics, sense making is inevitable (that is, that Subjects cannot help producing sense and, also, that there can be no effects of sense without pointing to a Subject). An interesting case that proves the point of this implicational relationship is Niklas Luhmann's systems theory. This paper discusses the meaning of the concept of ‘second-order observation’ used by Niklas Luhmann (1927–1998). Luhmann identifies second-order observation as a defining characteristic of modern world society. According to Luhmann, all social systems construct a social reality on the basis of the observation of observations. Rating agencies in the economy or the peer-review process in the academic system are examples of social mechanisms manifesting second-order observation. Social media also represent organized second-order observation. The paper suggests that in a (...) society based on second-order observation, ‘genuine pretending’ is an adequate mode of existence. This notion is derived from the Daoist text Zhuangzi. It indicates a disassociation from social roles which allows their performers to exercise these roles with ease and, at the same time, maintain a state of sanity. (shrink)

This essay attempts to provide a preliminary outline of a theory of identity. The first section addresses what the sociologist Niklas Luhmann has called ‘the problem of identity’, or, in other words, the mind–society (rather than the mind–body) problem: In how far can the internal (psychological) self and the external (social) persona be integrated into a unit? The second section of the essay briefly defines a basic vocabulary of a theory of identity. ‘Identity’ is understood as the existentially necessary (...) formation of a coherence between the ‘self’ (the ‘I’ as it is experienced in thoughts and feelings), its body and its social ‘persona’ (the individual person with its social attributes). Three different major paradigms of identity formation are distinguished from one another: a sincere identity is constructed through a firm commitment of the self to its social roles; an authentic identity is constructed through the creation of a social persona on the basis of one’s unique and original self; a ‘profilic’ identity, as we call it, is shaped by successfully presenting a personal profile under conditions of second-order observation as they prevail, for instance, in the social media, but also in other contemporary social systems. In the third section of the essay, we present a sketch of the historical sequence of these three paradigms of identity. Although these paradigms are not mutually exclusive and can coexist, it seems that sincerity flourished in pre-modern society, while authenticity came to prominence along with the functional differentiation of modern society and is now, along with the increased significance of second-order observation, gradually overshadowed by the influence of profilicity. This review essay brings together five books on various aspects of Nietzsche’s thinking and writing from the last four years, from different cultural and political contexts, but also spanning a wide methodological range. The general question of how to orient ourselves in Nietzsche-scholarship is inspired by the title of Werner Stegmaier’s book which invites the reader to compare Nietzsche and Niklas Luhmann. It also invites us to contemplate the more general question of how to bring Nietzsche’s thinking into a (...) dialogue with the human and social sciences. A central question concerns the temporality of Nietzsche’s thinking: is Nietzsche’s thinking a thing of the past that primarily necessitates a historical interpretation, or can it still open up ways toward the future. As this review highlights, many contemporary readers of Nietzsche continue to see themselves as working to “save” his texts from fateful misinterpretations. The last part of the review focuses on the new textual, or “poesiological” approach and the importance of seeing Nietzsche not primarily as someone professing a doctrine, but as the creator of uniquely multilayered texts. Dass Edmund Husserl am Problem der Intersubjektivität gescheitert ist, gilt als ausgemacht - und ebenso, welche Konsequenzen daraus zu ziehen sind. Entgegen dem allenthalben pauschal erklärten `Abschied vom Subjekt' spricht aber vieles dafür, dass es in der gegenwärtigen Sozialtheorie eher um eine Reformulierung transzendentaler Subjektivität geht. Diese Interpretationsthese wirft ein neues Licht auf den sozialtheoretischen Diskurs, der im deutschen Sprachraum in den vergangenen dreissig Jahren vom Gegensatz von Jürgen Habermas' und Niklas Luhmanns Theorien bestimmt war: `Diskurs' und `System' erscheinen (...) als gegensätzliche Versuche, `Subjektivität' und `Interität' in ein theoretisch befriedigendes Verhältnis zu setzen. Wenn aber - so die kritische These dieses Buches - weder die Reformulierung von Subjektivität als `Interität' noch die Reformulierung von Subjektivität ohne `Interität' das Problem der Intersubjektivität überzeugend löst, ist dies ein Grund, neuerlich in eine direkte Auseinandersetzung mit Husserls Theorie transzendentaler Subjektivität einzutreten. Dabei stellt sich heraus, dass Husserls vielkritisierter und -skandalisierter Versuch, den Sinn `Anderer' im `Eigenen' zu fundieren, in der transzendentalphänomenologischen Subjekttheorie durch ein umgekehrtes Begründungsverhältnis konterkariert wird. Bei aller Problematik dieser Theorieanlage - welche nur in Gegenwendung zu den Gewohnheiten der Husserl-Interpretation, vor allem aber auch zu Husserls Selbstinterpretation in den Blick kommt - zeigt sich, dass der phänomenologische Begriff des transzendentalen Subjekts seinen Reformulierungen als Diskurs und als System in mancher Hinsicht überlegen ist. Philosophy is presented in a wide range of forms, none of which can be convincingly claimed to be the “genuine” one. Historically speaking, there is not one “proper” way of doing philosophy, evidencing what may be called the social contingency of philosophy. This paper aims to provide a “critical” philosophy of today, in the Kantian sense of a philosophy that reflects on the conditions of its possibility, and thereby acknowledges the limitations they impose. Conceptually, our approach is grounded in (...) class='Hi'>Niklas Luhmann’s social systems theory, in which “functional differentiation” and “second-order observation” are two crucial characteristics of modern society. The paper discusses how presentations of philosophy align themselves with the second-order observation mechanisms of the specific social systems in which they are “hosted.” This paper deals in particular with two such systems: academics and social media. Dass sich jegliches Geschehen der operativ geschlossenen Verknüpfung von Ereignissen verdankt, ist sicherlich die theorieästhetische Provokation der Moderne. Die Dynamik der Geschlossenheit wird als eine Theoriefigur ins Spiel gebracht, welche die sich seit der Neuzeit entwickelnde Idee der Selbstbezüglichkeit radikalisiert und jegliche Beobachtung von einem Absoluten entlastet. Aus der theorieästhetischen Perspektive wird auch die kultur-phänomenologische Anthropologie Hans Blumenbergs unter dem Signum der operativen Geschlossenheit entfaltet. The phrase 'beyond historicism' is usually associated with Bielefeld historians like Hans Ulrich Wehler and Jürgen Kocka, who attempted to turn the study of history into a social science, but a better candidate would be the sociologist Niklas Luhmann, who happened to teach as well in Bielefeld during the 1970's and 1980's. Luhmann had little affinity with the project of his colleagues from the history department. He took the opposite view that the social sciences suffered from a naive (...) enlightenment view and should become more history minded. Like the historicists of the early nineteenth century Luhmann was indirectly inspired by the philosophy of Leibniz. Although Luhmann's theory of social systems may seem miles away from the daily interests of most historians, it can be interpreted as an Aufhebung of historicism. This will be demonstrated for two important concepts, the autopoietic system which incorporates the historicist notion of individuality and the concept of second order observation which can be read as an abstract redescription of what historicists meant by the historical method. Gehlen's core idea in Man is that humans have unique properties which distinguish them from all other species: 1. world-openness, a concept originally coined by Max Scheler, which describes the ability of humans to adapt to various environments (as contrasted with animals, which can only survive in environments which match their evolutionary specialisation). This gives us 2. the ability to shape our environment according to our intentions, and it comprises a view of language as a way of acting (Gehlen was (...) one of the first proponents of speech act theory), Human beings are also marked 3. by an excess of impulses and by 4. the ability of self-control. These properties allow us (again in contrast to all other animals) 5. to create our own (for example cultural) environments. Gehlen's philosophy has influenced many contemporary German thinkers in a range of disciplines, including Peter L. Berger, Thomas Luckmann and Niklas Luhmann in sociology, and Hans Blumenberg in philosophy. (shrink)

What I intend to show is that the Leibnizian language studies—the formal ones as well as those on natural languages—from his early plans for academies and language societies on up to his studies of etymology and to his interest in foreign languages and in logical, geometrical, arithmetical, and other formal calculi, has to be seen as an important contribution to the idea of enlightenment. Their importance was such that Christian Wolff was able to transform the Leibnizian ideas into the mighty (...) movement of Leibniz-Wolffian metaphysics, a movement paralleled to the tradition of Thomasius. It is interesting to note how knowledge, at least since Aristotle, could be understood as a desire, as a mental craving, so to speak. When understood as a desire, knowledge necessarily goes along with a certain absence, a lack. Those who crave for knowledge are not yet fully in its possession, they are still on the search.

Der Tod ist seit jeher und über alle Grenzen hinweg ein Grundthema der Philosophien gewesen - und nicht nur der Philosophien, sondern natürlich ebenso der Religionen, der Literaturen, der Künste. Die Sorgen, die der Tod bereitet, sind nicht allein mehr oder weniger universal oder existentiell, sie sind auch unauflösbar: Mit dem Tod wird man nicht fertig, bis er kommt. Und auch dann wird der Tod bekanntlich eher fertig mit uns als wir mit ihm. Keiner Philosophie oder Religion oder Kunst ist (...) es "endgültig " gelungen ,,durch die Auseinandersetzung mit dem Tod die Besorgnis ihm gegenüber auszulöschen. Dementsprechend versucht der vorliegende Band keinesfalls Antworten - und schon gar nicht "die" Antwort - auf die Fragen des Todes zu geben. Er führt vielmehr eine Reihe von Standpunkten, Einstellungen oder Vorstellungen zum bzw. vom Tode vor und wird für keine(n) Leser(in) das Todesproblem lösen können. Er kann nur an einem eindrucksvollen und tatsächlich jedem(r) nahegehenden Beispiel zeigen, wie man sinnvoll über etwas sprechen, schreiben und denken kann, ohne dabei darüber wirklich schlauer werden zu können. Ein solches Ergebnis ist nun keinesfalls entmutigend, es ist vielmehr eine Einsicht, bei der sich ansonsten so unterschiedliche Denkweisen wie der altchinesische Daoismus und Konfuzianismus einerseits und eine nachkantianische Philosophie des Zeichens andererseits treffen. Seit jeher treibt das Lachen als anthropologische Grundkonstante Philosophen, Wissenschaftler und Kunstler um. Obwohl sich der Mensch im Lachen nonverbal verstandigt, bleibt diese soziale Geste hochst komplex, da in ihr Limitation sowie Transgression, Einschliessung wie Ausgrenzung stecken. Lachen wurde in der Geschichte teils als wahnsinnig, blasphemisch oder destruktiv, ebenso haufig aber auch als gutmutig, heilig und heilend konnotiert; Lachen ist ein paradoxes Phanomen. Geneticists investigate anatomical characters, never anatomical constructions, which are capable of reorganization when the biological-morphological equilibrium of the organism has been disturbed. The anatomy of Opisthocomus cristatus and Stringops habroptilus demonstrate that three successive disturbances in the bio-morphological equilibrium are reacted to purposively by anatomical reconstruction. These reactions are no accidental mutations, but are anatomical reactions, related to, and affecting, the organism (...) as a whole. In sharp contrast to such anatomical reaction, resulting, during phylogeny, in reorganization, are the “technics” [i.e., mechanistic bases] of individual development. The hereditary process is, like every physiological or embryological process, a fixed mechanism, which remains constant until an active reaction leads to reconstruction and at the same time an appropriate change of the mechanisms. Résumé Partant d’un ouvrage collectif qui pose un regard critique sur les projets qui ont mené à la fondation de l’Université de Bielefeld à la fin des années soixante, l’article revient sur les conditions d’émergence de la première Reformuniversität dans l’Allemagne fédérale. Conçue comme un ensemble transdisciplinaire d’enseignement et de recherche selon le modèle esquissé par Wilhelm von Humboldt, l’université de Bielefeld va devoir très vite s’adapter au pragmatisme dominant dans les années 1970, se soumettre à une modernisation adaptative et (...) de ce fait subir un échec par rapport à la conception initiale. Un secteur cependant échappe à ce que l’on a appelé le ‘Bielefelder Syndrom’ : celui des Sciences sociales et historiques et son centre interdisciplinaire de recherches (ZiF) constituant l’ ‘Ecole de Bielefeld’ autour de figures marquantes, diverses mais complémentaires, comme les historiens Reinhart Koselleck, Hans-Ulrich Wehler, Jürgen Kocka et des sociologues comme Niklas Luhmann.
