Psychiatric inpatients with capacity may be treated paternalistically under the Mental Health Act 1983. This violates bodily autonomy and causes potentially significant harm to health and moral status, both of which may be long-lasting. I suggest that such harms may extend to killing moral persons through the impact of psychotropic drugs on psychological connectedness. Unsurprisingly, existing legislation is overwhelmingly disliked by psychiatric inpatients, the majority of whom have capacity. I present four arguments for involuntary treatment: individual safety, public safety, authentic (...) wishes and protection of autonomy. I explore these through a case study: a patient with schizophrenia admitted to a psychiatric hospital under the Mental Health Act 1983 after an episode of self-poisoning. Through its discussion of preventative detention, the public safety argument articulates the (un)ethical underpinnings of the current position in English law. Ultimately, none of the four arguments are cogent—all fail to justify the current legal discrimination faced by psychiatric inpatients. I conclude against any use of involuntary treatment in psychiatric inpatients with capacity, endorsing the fusion approach where only psychiatric patients lacking capacity may be treated involuntarily. Maung argues that an externalist understanding of mental disorder exposes how, if society was more just for the most deprived, patterns of access to assisted dying might be different. I counter that reducing inequality lacks relevance to the immediate permissibility of assisted dying for mental disorder, owing to the need for solutions for those in distress. I suggest that the question of assistance in death for mental disorders is one of pragmatic politics, not for obfuscatory philosophy.

The rapid rise of international collaborative science has enabled access to genomic data. In this article, it is argued that to move beyond mapping genomic variation to understanding its role in complex disease aetiology and treatment will require extending data sharing for the purposes of clinical research translation and implementation.

In a recent paper, I argued that an externalist understanding of mental disorder from the philosophy of psychiatry presents an ethical challenge to the practice of medical assistance in dying (MAiD) for psychiatric illness, because it highlights the ways in which the suffering associated with psychiatric illness is sustained by features of the external environment wherein the person is embedded, including social barriers and injustices. In a response to my paper, Harry Hudson argues that addressing social inequality lacks (...) relevance to the immediate permissibility of psychiatric MAiD and that the issue of psychiatric MAiD should be informed by ‘pragmatic politics’ rather than by ‘obfuscatory philosophy’. Herein, I contend that Hudson’s response misconstrues my position and ascribes to me views I neither express nor endorse. My paper does not claim that psychiatric MAiD should be denied to people who are presently in intolerable distress. Rather, it suggests that the provision of psychiatric MAiD comes along with social responsibilities of the state to attend to the barriers and injustices that sustain and exacerbate psychiatric illness, as well as ethical responsibilities of clinicians to consider a wider range of presently available psychological and social interventions which may have been neglected under a traditional internalist approach. Abstract:Work on stakeholder theory has proceeded on a variety of fronts; as Donaldson and Preston (1995) have noted, such work can be parsed into descriptive, instrumental, and normative research streams. In a normative vein, Phillips (1997) has made an argument for a principle of fairness as a means of identifying and adjudicating among stakeholders. In this essay, I propose that a reconstructed principle of fairness can be combined with the idea of consent as outlined in integrative social contract theory (ISCT) (...) to bring about a more normative stakeholder theory that also has ramifications for corporate governance. In this paper I distinguish two kinds of predictivism, 'timeless' and 'historicized'. The former is the conventional understanding of predictivism. However, I argue that its defense in the works of John Worrall and Patrick Maher is wanting. Alternatively, I promote an historicized predictivism, and briefly defend such a predictivism at the end of the paper.

Although not always termed “organizational justice,” the fairness of organizations has been a consistent concern of management thinkers. A review of the 1900–1965 time period indicates that management theorists primarily conceptualized organizational justice in utilitarian terms, although each theory emphasized distributive and procedural justice to different degrees. There is clearly a need for contemporary scholars to consider non-economic rationales for organizational justice, but the willingness of earlier scholars to make utilitarian arguments about organizational justice and productive efficiency helped legitimize the (...) idea of fairness in organizations as an arbiter of value. Further, each theory tempered absolute managerial autonomy with some inherent check thereon. Researchers interested in organizational justice should therefore take a historical perspective in considering how management theory includes consideration of justice-related concerns. (shrink)

He explores non-theistic reasons in the first chapter and theistic ones towards the end; in the intervening sections he inquires into a variety of puzzles in the metaphysics of material objects that are either generated by the hypothesis of hyperspace or else informed by it, with discussions of receptacles, boundaries, contact, occupation, and superluminal motion. The central question of the Euthyphro is “Is the pious loved by the gods because it is pious, or pious because it is loved?” A baseball analogy explains this to students: “Does the umpire say ‘Out’ because the runner is out, or is the runner out because the umpire says ‘Out’?” The former makes the relevant knowledge public, making Socrates the appropriate secular moral authority, while the latter makes it religious, invoking Euthyphro’s expertise. Foucault’s aphorism that power is knowledge illuminates (...) how the aristocracy stands behind Euthyphro, while Socrates empowers the democracy. Most basic research on cancer concerns genetic changes in benign and malignant tumors. Yet evidence indicates that the majority of the mutations in tumors occur in the preneoplastic field stage of their development. That early stage is represented by grossly invisible, broad regions of “field cancerization” which have not, heretofore, been operationally analyzed in cell culture. Conditions are described for quantitating preneoplasia by increased saturation density followed by progression to transformation. These parameters are driven by Darwinian selection of spontaneously occurring, (...) cumulative mutations, in accordance with recent genomic analyses of human cancer, just as it is in the evolution of species. The cell culture model will allow correlation of the preneoplastic increases in saturation density with genetic changes, and development of methods for demarcating fields during surgery so that they can be excised along with the tumor, thereby reducing the possibility of recurrence at the site. In her book, Method and politics in Plato’s Statesman, Melissa Lane discusses the relationship between political authority and time. Namely, she asks what the source of political authority could be when, in the Statesman, the Stranger tells us that law cannot be applicable in all situations, for all people, in all times. In this paper I agree with Lane that the apparent contradiction in the dialogue between, on the one hand, the temporal laws and, on the other hand, the contingency (...) of everyday situations can be explained only in coming to understand the statesman as a master of kairos, or “right timing”. A mastery of kairos, I suggest, does not mean simply that one is able to recognize when it is the right time to do or say something, but rather it must mean that one is able to create the right time, which involves foreknowledge of universal truth and proficiency in the art of putting things together. Solutions to Russell’s paradox of propositions and to Kaplan’s paradox are proposed based on an extension of von Neumann’s method of avoiding paradox. It is shown that Russell’s ‘anti-Cantorian’ mappings can be preserved using this method, but Kaplan’s mapping cannot. In addition, several versions of the Epimenides paradox are discussed in light of von Neumann’s method.

Thought experiments and normative case studies can play different and complementary roles in moral and political philosophizing. Thought experiments help us to sculpt and refine normative concepts and alert us to contradictions between intuitive judgments and basic principles, or among intuitive judgments, thus informing our reflective equilibrium about what fundamentally matters. Normative case studies assist us in judging how to trade off conflicting values in specified circumstances. Engaging with a sufficient number of well-wrought normative case studies can thus inform our (...) ultimate judgments about the relative weights of different values. (shrink)

Three Dimensionalists and Four Dimensionalists are engaged in a debate on the topics of persistence and mereology. In this paper, I explore implications of Four Dimensionalism for the formulation of the criterion of personhood and on the question of which individuals satisfy that criterion. In my discussion I argue that the Four Dimensionalist has reason to identify a human person with a proper part of a human organism, and that the Four Dimensionalist has reason to believe that if there is (...) something morally wrong with human abortion or infanticide, it cannot be grounded in claims about the moral status of persons. The author claims to have developed interactional expertise in gravitational wave physics without engaging with the mathematical or quantitative aspects of the subject. Is this possible? In other words, is it possible to understand the physical world at a high enough level to argue and make judgments about it without the corresponding mathematics? This question is empirically approached in three ways: anecdotes about non-mathematical physicists are presented; the author undertakes a reflective reading of a passage of physics, first without going (...) through the maths and then after engaging with it and discusses the difference between the experiences; the aforementioned exercise gives rise to a table of Levels of Understanding of mathematics, and physicists are asked about the level mathematical understanding they applied when they last read a paper. Each phase of empirical research suggests that mathematics is not as central to gaining an understanding of physics as it is often said to be. This does not mean that mathematics is not central to physics, merely that it is not essential for every physicist to be an accomplished mathematician, and that a division of labour model is adequate. This, in turn, suggests that a stream of undergraduate physics education with fewer mathematical hurdles should be developed, making it easier to train wider groups of people in physical science comprehension.Keywords: Physics; Mathematics; Interactional expertise; Physics education; Mathematical literacy; Scientific literacy. ABSTRACT This article discusses a particular problem with the race relations legislation: the fact that to show that discrimination has taken place one must prove not only that a person was unfavourably treated but that this was on the grounds of race. The article considers first whether grounds should be interpreted subjectively or objectively, and argues for an objective interpretation, partly to make proof easier, partly because no obvious injustice is done. Then it considers the kinds of evidence relevant to (...) such a proof, and argues that in many cases, although not all, it is in fact available, at least for the level of proof on the balance of the probabilities, required for civil, as opposed to criminal, proceedings. It is concluded that difficult cases remain, but not as many, or as difficult, as might appear at first sight. (shrink)
