In the following paper, Annemiek Richters of the University of Leiden in the Netherlands addresses the dilemmas faced by health professionals who are asked to evaluate and provide supporting documentation for those refugees who seek political asylum in the countries of Europe. It is in the politically charged arena of asylum applications, government regulations, and public policy where bioethics, human rights, and health converge. Despite the 1951 Convention on Refugees, a treaty signed by nations around the world to safeguard the (...) rights of those who are displaced, and other treaties that protect the rights of vulnerable populations, refugee and asylum policies have become increasingly strict in an effort to deter those who would seek safety. This tightening of borders in the countries of the West challenges physicians who find themselves caught between obligations to treat, to advocate, and to challenge policies that make treatment a potentially dangerous proposition. Public health and human rights are complementaryapproaches to protecting and promoting human well-being and dignity. Public health addresses the needs of populations and seeks, through intervention and education, to prevent the spread of disease. Enshrined in international law, human rights describe the obligations of governments to safeguard their citizenry from harm and to create conditions where each individual can achieve his or her full potential. The relation between critical thinking and race prejudice can be made obvious, once we grant that race prejudice cannot be supported by good reasons. For, if, as Harvey Siegel has pointed out, critical thinking is being "appropriately moved by reasons," then holding racially prejudiced beliefs is to believe without being appropriately moved by reasons, thereby being, in this regard at least, an uncritical thinker. A practical corollary of this, for those of us who espouse critical thinking as an educational (...) ideal, is that it is incumbent upon us to speak to the issue of race prejudice, an obvious and glaringly pernicious example of uncritical thought that affects one of, if not the most, central social and ethical issues of our times. Toulmin is famously seen as the progenitor of informal logic and the related theory of argument and is first among many who seek to move the study of argument away from its roots in formal, especially mathematical, logic. Toulmin’s efforts, however, have been substantively criticized by Harvey Siegel, among others, for failing to offer the sort of foundation that, according to Siegel, even Toulmin sees to be required lest the theory of inquiry fall to impotent relativism. What I will (...) attempt to indicate in this paper is, that although Toulmin is correct in rejecting mathematical logic as standardly construed as an adequate theory of argument, and logical empiricist constructions as an adequate basis for the philosophical understanding of science, there is a significant role for metamathematics in the new logic. In particular, I will show how a formal model based on mature physical science rather than arithmetic furnishes crucial support to Toulmin, furnishing philosophical metaphors that afford the foundational support required for normativity and the clarification of key logical concepts required for a robust normative theory of argument in the context of inquiry. We seek to understand how third-party observers respond to allegations of sexual transgressions, whether their responses vary and if so why, how they determine perpetrator sanctions, who is more forgiving of them, and what is the psychological mechanism underlying this preference. We draw on one dimension of Hofstede's theory of cultural orientations—power distance belief, and one dimension of Haidt's work on moral reasoning—moral decoupling. Results from three studies on recent real-life cases—those pertaining to Harvey Weinstein, Brett Kavanaugh, and (...) Peter Martins—reveal interesting, consistent, and dramatic findings pertaining to these research questions. Specifically, compared to observers who endorse a low power distance belief, high PDB observers selectively suspend judgments of culpability and express higher evaluations of the alleged perpetrators, are significantly more forgiving of them, convey a lower preference for naming and shaming them, and consider the alleged transgressions as less serious. These outcomes are predicated on the psychological mechanism of moral decoupling. Both high and low PDB respondents decouple the perpetrators’ competence and morality. However, high PDB observers gauge the actions of the perpetrators by emphasizing competence, while low PDB observers gauge their actions by emphasizing morality. (shrink)

On October 5th, 2017, the New York Times published an article that would establish the #MeToo movement and help millions of women across the globe to raise their voice and share their stories of sexual harassment, aggression and/or violence. If Harvey Weinstein was the main accused, he was, actually, the epitome of a systemic, as well as an endemic, issue that didn’t stop at the studios’ doors and was made possible thanks to a rather surprising and quite unexpected (...) accomplice. In fact, “Hollywood’s open secret” has been well-guarded by, among other things, the contract and its law. In the eyes of a contract law specialist, whether it be a man or a woman, the major highlight of Jodi Kantor and Megan Twohey’s article rests in their ability to have brought to light contracts—the, now, infamous and highly criticised “NDAs” (non-disclosure agreements)—that ensured Weinstein the freedom to buy his victims’ silence. The first goal of this essay is trying to understand, on the one hand, how could that be possible and, on the other hand, explain to a larger audience how a tool usually used for economic and commercial purposes could have been diverted from its traditional use. It also aims to present measures that have been adopted in the United States to fight these agreements, and imagine what could they be in a country such as France. Although these types of “NDAs” don’t seem to find their equivalent in the French public sphere, it is still helpful to ponder over remedies offered by the new French law of contract shall these contracts ever come to exist… or arise. Robert Aumann presents his Agreement Theorem as the key conditional: “if two people have the same priors and their posteriors for an event A are common knowledge, then these posteriors are equal” (Aumann, 1976, p. 1236). This paper focuses on four assumptions which are used in Aumann’s proof but are not explicit in the key conditional: (1) that agents commonly know, of some prior μ, that it is the common prior; (2) that agents commonly know that each of them updates (...) on the prior by conditionalization; (3) that agents commonly know that if an agent knows a proposition, she knows that she knows that proposition (the “K K” principle); (4) that agents commonly know that they each update only on true propositions. It is shown that natural weakenings of any one of these strong assumptions can lead to countermodels to Aumann’s key conditional. Examples are given in which agents who have a common prior and commonly know what probability they each assign to a proposition nevertheless assign that proposition unequal probabilities. To alter Aumann’s famous slogan: people can “agree to disagree”, even if they share a common prior. The epistemological significance of these examples is presented in terms of their role in a defense of the Uniqueness Thesis: If an agent whose total evidence is E is fully rational in taking doxastic attitude D to P, then necessarily, any subject with total evidence E who takes a different attitude to P is less than fully rational. Whether upheld as heroic or reviled as terrorism, people have been willing to lay down their lives for the sake of their groups throughout history. Why? Previous theories of extreme self-sacrifice have highlighted a range of seemingly disparate factors, such as collective identity, outgroup hostility, and kin psychology. In this paper, I attempt to integrate many of these factors into a single overarching theory based on several decades of collaborative research with a range of special populations, from tribes in Papua (...) New Guinea to Libyan insurgents and from Muslim fundamentalists in Indonesia to Brazilian football hooligans. These studies suggest that extreme self-sacrifice is motivated by identity fusion, a visceral sense of oneness with the group, resulting from intense collective experiences (e.g., painful rituals or the horrors of frontline combat) or from perceptions of shared biology. In ancient foraging societies, fusion would have enabled warlike bands to stand united despite strong temptations to scatter and flee. The fusion mechanism has often been exploited in cultural rituals, not only by tribal societies but also in specialized cells embedded in armies, cults, and terrorist organizations. With the rise of social complexity and the spread of states and empires, fusion has also been extended to much larger groups, including doctrinal religions, ethnicities, and ideological movements. Explaining extreme self-sacrifice is not only a scientific priority but also a practical challenge as we seek a collective response to suicide, terrorism, and other extreme expressions of outgroup hostility that continue to bedevil humanity today. The notion that the metric field in general relativity can be understood as a property of space-time rests on a feature of the theory sometimes called universal coupling—the claim that rods and clocks “measure” the metric in a way that is independent of their constitution. It is pointed out that this feature is not strictly a consequence of the central dynamical tenets of the theory, and argued that the metric field would better be regarded as a field in space-time, rather (...) than as the very fabric of space-time itself. Artificial intelligence (AI) is increasingly relied upon by clinicians for making diagnostic and treatment decisions, playing an important role in imaging, diagnosis, risk analysis, lifestyle monitoring, and health information management. While research has identified biases in healthcare AI systems and proposed technical solutions to address these, we argue that effective solutions require human engagement. Furthermore, there is a lack of research on how to motivate the adoption of these solutions and promote investment in designing AI systems that align with values (...) such as transparency and fairness from the outset. Drawing on insights from psychological theories, we assert the need to understand the values that underlie decisions made by individuals involved in creating and deploying AI systems. We describe how this understanding can be leveraged to increase engagement with de-biasing and fairness-enhancing practices within the AI healthcare industry, ultimately leading to sustained behavioral change via autonomy-supportive communication strategies rooted in motivational and social psychology theories. In developing these pathways to engagement, we consider the norms and needs that govern the AI healthcare domain, and we evaluate incentives for maintaining the status quo against economic, legal, and social incentives for behavior change in line with transparency and fairness values. Beller, Bender, and Medin question the necessity of including social anthropology within the cognitive sciences. We argue that there is great scope for fruitful rapprochement while agreeing that there are obstacles (even if we might wish to debate some of those specifically identified by Beller and colleagues). We frame the general problem differently, however: not in terms of the problem of reconciling disciplines and research cultures, but rather in terms of the prospects for collaborative deployment of expertise (methodological and theoretical) (...) in problem-driven research. Between 1964 and 1990, the notion of nonlocality in Bell's papers underwent a profound change as his nonlocality theorem gradually became detached from quantum mechanics, and referred to wider probabilistic theories involving correlations between separated beables. The proposition that standard quantum mechanics is itself nonlocal became divorced from the Bell theorem per se from 1976 on, although this important point is widely overlooked in the literature. In 1990, the year of his death, Bell would express serious misgivings about the mathematical (...) form of the local causality condition, and leave ill-defined the issue of the consistency between special relativity and violation of the Bell-type inequality. In our view, the significance of the Bell theorem, both in its deterministic and stochastic forms, can only be fully understood by taking into account the fact that a fully Lorentz-covariant version of quantum theory, free of action-at-a-distance, can be articulated in the Everett interpretation. The quantum theory of de Broglie and Bohm solves the measurement problem, but the hypothetical corpuscles play no role in the argument. The solution finds a more natural home in the Everett interpretation.

How does match-fixing, or other unfair manipulation of matches, that involves under-performance by players, or refereeing and umpiring that prevents fair competition, be thought of in ethical terms? In this article, I outline the different forms that match-fixing can take and seek to comprehend these disparate scenarios within Kantian, Hegelian and contractualist ethical frameworks. I tentatively suggest that, by developing an ethical opposition to match-fixing in sport, we can give much greater substance to popular phrases such as ‘respect for the (...) game’, encompassing the value of sport itself and respect for other players, fans, sponsors and organisers. Arguing that match-fixing denies recognition to these ‘others’ demonstrates how fundamentally match-fixing ‘hollows out’ sport because a fixed match is of no worth: the whole value of the game has literally been evacuated. An examination of crucial questions about the relationship between rationality and femininity.

This article considers the way beneficence was treated in an important journal toward the end of the Old Regime. It finds that the Journal de Paris during the years 1783 and 1784 not only publicized acts of beneficence, but also mediated between members of the public who, on their own initiative, contributed to those in need and officials and organizations which in practice cared for the disadvantaged, especially a committee that freed prisoners for debts to wet nurses and the Société (...) philanthropique of Paris. While the notion of beneficence has sometimes been found to offer a secularized version of the traditional value of charity, this article finds that in practice religious and secular people worked together to support those they deemed worthy of aid. The relation of beneficence to self-interest is also considered, and it is suggested that the initiatives of the better-off members of civil society rather than government opened the way toward something approaching a welfare state. Atran & Norenzayan (A&N) survey a substantial body of theory and evidence on which there is broad agreement in the cognitive science of religion. Some parts of their argument (for instance, concerning the causes of costly commitment to religious beliefs) are more speculative and remain a focus of lively debate and further research.

Jesse Bering's theory of the “folk psychology of souls” is brilliantly elucidated and warrants further empirical investigation. While additional experimental research is certainly required, we also need to interrogate the evidence on reasoning about dead agents in a wide range of real-world settings.

We highlight and resolve what we take to be three common misconceptions in general relativity, relating to the interpretation of the weak equivalence principle and the relationship between gravity and inertia; the connection between gravitational redshift results and spacetime curvature; and the strong equivalence principle and the local recovery of special relativity in curved, dynamical spacetime.

The ability of trees to suck water from roots to leaves, sometimes to heights of over a hundred meters, is remarkable given the absence of any mechanical pump. This study deals with a number of issues, of both an historical and conceptual nature, in the orthodox ``Cohesion-Tension'' theory of the ascent of sap in trees. The theory relies chiefly on the exceptional cohesive and adhesive properties of water, the structural properties of trees, and the role of evaporation from leaves. But (...) it is not the whole story. Plant scientists have been aware since the inception of the theory in the late 19th century that further processes are at work in order to “prime” the trees, the main such process -- growth itself -- being so obvious to them that it is often omitted from the story. Other factors depend largely on the type of tree, and are not always fully understood. For physicists, in particular, it may be helpful to see the fuller picture, which is what this study attempts to provide in non-technical terms. (shrink)
