Sentience is the capacity to have feelings, such as feelings of pain, pleasure, hunger, thirst, warmth, joy, comfort and excitement. It is not simply the capacity to feel pain, but feelings of pain, distress or harm, broadly understood, have a special significance for animal welfare law. Drawing on over 300 scientific studies, we evaluate the evidence of sentience in two groups of invertebrate animals: the cephalopod molluscs or, for short, cephalopods (including octopods, squid and cuttlefish) and the decapod crustaceans or, (...) for short, decapods (including crabs, lobsters and crayfish). We also evaluate the potential welfare implications of current commercial practices involving these animals. (shrink)

Advances in medical capability should be accompanied by discussion of their ethical implications. In the military medical context there is a growing interest in developing prophylactic interventions that will mitigate the effects of trauma and improve survival. The ethics of this novel capability are currently unexplored. This paper describes the concept of trauma prophylaxis and outlines some of the ethical issues that need to be considered, including within concept development, research and implementation. Trauma prophylaxis can be divided into interventions that (...) do not and those that do have medical enhancement as an unintended side effect of their prophylactic action. We conclude that type 1 interventions have much in common with established military medical prophylaxis, and the potentially enhancing qualities of type 2 interventions raise different issues. The aim of the book is twofold: (1) To develop a comprehensive, contractualist theory of intergenerational ethics; (2) To argue that contractualism's ability to be that comprehensive theory of intergenerational ethics contributes to its plausibility as a moral theory in general. The book's core claim is that contractualism provides us with a comprehensive theory of intergenerational ethics that justifies including future people in the scope of what we owe to each other and tells us how much we owe them. It (...) begins by arguing that contractualism is not susceptible to the non-identity problem and so we must consider what future people could reasonably reject. It then argues that contractualism endorses 'reason-balanced sufficientarianism' and develops a series of moral principles guiding our behaviour towards future generations in terms of resource distribution, procreative decisions, optimal population size, and risk imposition. It concludes by applying these general principles to concrete, real-world individual and policy decisions and considering how the principles can and do interact with each other. (shrink)

When discussing the extinction of humanity, there does not seem to be any clear agreement about what ‘humanity’ really means. One aim of this paper is to show that it is a more slippery concept than it might at first seem. A second aim is to show the relationship between what constitutes or defines humanity and what gives it value. Often, whether and how we ought to prevent human extinction depends on what we take humanity to mean, which in turn (...) depends on what we value about humans. Finally, I will offer a definition of humanity that I argue offers a plausible account of when we might say humanity has gone extinct, and reflects what we value about humans, and relatedly, what many actually care about in terms of why we should be preserved. The paper presents an interpretation of Aristotle's views on natural justice in the Nicomachean Ethics. It focuses, in particular, on Aristotle's understanding of the relationship which exists between natural justice and political justice, or between natural law and positive law. It is suggested that Aristotle's views on this subject are often misunderstood. It is also suggested that, contrary to what some commentators might think, Aristotle's comments on natural justice are actually central for our understanding of his political thought as a (...) whole. It is argued that Aristotle is, therefore, definitely a natural law theorist of some description. However, Aristotle's natural law theory is unconventional in certain respects. In particular, Aristotle does not consider natural law to be a critical standard by means of which positive law might be evaluated. This places Aristotle outside the mainstream of natural law theory as it has been traditionally understood. Aristotle is not, in this sense at least, the forerunner of the Stoic natural law tradition and of the individualistic, liberal natural law theory of the modern era. He is, rather, the founding father of what might best be described as the conservative natural law tradition, the most well known adherents of which in modern times are Montesquieu, Burke and Hegel. This paper argues that there are good reasons to limit the scope of luck egalitarianism to co‐existing people. First, I outline reasons to be sceptical about how “luck” works intergenerationally and therefore the very grounding of luck egalitarianism between non‐overlapping generations. Second, I argue that what Kasper Lippert‐Rasmussen calls the “core luck egalitarian claim” allows significant intergenerational inequality which is a problem for those who object to such inequality. Third, luck egalitarianism cannot accommodate the intuition that it might be required (...) to leave future generations better off than we are, even if it would come at no cost to ourselves. Finally, I argue that following another, broader, version of luck egalitarianism would require us to level down future generations and possibly even ourselves, which is a problem for those persuaded by the levelling‐down objection. This article examines the views of Hegel and Alasdair MacIntyre regarding philosophical disagreements, whether or not they can be resolved and if so how. For both thinkers such a disagreement is thought of as taking place between the advocates of two theoretical positions which are opposed to one another. Each party subscribes to a way of thinking about the issue under discussion which appears to be logically incompatible with the views of the other. We seem therefore to have to make (...) an either-or choice between them. In the case of all philosophical disagreements, therefore, the same questions arise. Is the contradiction in question real, or merely apparent? Can it be resolved? If so, what exactly is involved in such a resolution? Is some form of theoretical compromise, between these two extremes possible? Is there a third-way, a both-and approach, which in some way combines the strengths of each and the weaknesses of neither, or which seeks in some way to balance their respective strengths and weaknesses of each against those of the other? The article suggests that MacIntyre differentiates between two types of philosophical disagreement. In the case of the first, the ideas associated with the two opposed positions are incommensurable. We must, therefore make an either-or choice between them. In the case of disagreements of the second type, the ideas in question are not incommensurable. In these cases, therefore, it is possible for them to be combined or synthesised. The article argues that MacIntyre’s approach to this second type of philosophical disagreement has an obvious affinity with what is often thought to be that of Hegel. In the words of Richard J. Bernstein, it is ‘quasi-Hegelian’. It is therefore fruitful to compare and contrast the views of these two thinkers on this issue. (shrink)

While Karen Warren offers an ecofeminist ethic that is pluralistic, contextualist, and challenges Cartesian dualism, one area that remains underdeveloped in her theory is embodiment. I will examine Merleau-Ponty’s notion of embodied subjectivity and show that it would fit consistently with her theory. I will also explore some other areas in which the two theories supplement each other.

Experiments show that psi differs from known physical processes in a variety of ways, and these differences are described herein. Because of these, psi cannot be accounted for in terms of presently known physical laws. A number of theories, of which we review a sampling, suggest ways in which known physical laws might be expanded in order to account for psi. However, there is no agreement on which of these theories, if any, will ultimately provide a general explanation. A further (...) problem in studying psi is that it is elusive, i.e., methods are not presently known by which it can be reliably produced. However, if psi is real, its study can open the door to a new frontier of knowledge and contribute to our understanding of consciousness. (shrink)

Edith Stein is considered a leading figure in the early phenomenological movement and the disciple who performed in the best way the phenomenological method proposed by Husserl, and yet her relationship to phenomenology remains unclear in the literature. This article seeks to add clarity to her relationship to phenomenology while considering three inescapably related questions. (1) What did Stein conceive phenomenology to be? (2) How should we understand Husserl’s influence on Stein? (3) Was Stein an original phenomenological thinker? I argue (...) that Stein conceives of phenomenology as an epistemological critique that aims to clarify the essential foundations of knowledge. It involves intentional analysis that proceeds by way of essential-seeing (Wesensschau), which can be brought about through the method of free imaginative variation, and its intentional analysis involves close attention to the relationship between meaning-intention and meaning-fulfillment. I argue that the primary influence Husserl exerts on Stein is in the development of phenomenology as conceived in his Logical Investigations. Finally, I offer an understanding of how Stein conceived of her differences with Husserl on the issue of idealism in order to argue that Stein’s phenomenological writings in On the Problem of Empathy and “Sentient Causality” offer us a novel phenomenological account of the human being that begins with the ego but escapes being a mere egology. This paper discusses the significance of the concept of a social formation for historical materialism. It argues that the concept is wrongly thought to be associated uniquely with the writings of Louis Althusser and with structuralist Marxism. It can be found in the writings of Marx himself, as well as those of Lenin, and is central to an adequate understanding of classical Marxism. To illustrate its importance the paper shows how the concept may be used to shed new light on (...) the debate around the transition from feudalism to capitalism. (shrink)

This paper outlines, from a sociological and social psychological perspective, a theoretical framework with which to define and analyse consciousness, emphasizing the importance of language, collective representations, conceptions of self, and self-reflectivity in understanding human consciousness. It argues that the shape and feel of consciousness is heavily social, and this is no less true of our experience of collective consciousness than it is of our experience of individual consciousness. The paper is divided into two parts. Part One argues that the (...) problem of consciousness can be approached fruitfully by beginning with human group and collective phenomena: community, language, language-based communication, institutional and cultural arrangements, collective representations, self-conceptions, and self-referentiality. A collective is understood as a group or population of individuals that possesses or develops collective representations of itself: its values and goals, its structure and modes of operating, its strategies, developments, strengths and weaknesses, etc. Collective reflectivity emerges as a function of an organization or group producing and making use of collective representations of the self in its discussions, critical reflections, and planning. A collective monitors its activities, achievements and failures, and reflects on itself as a defined and on-going collective being. In this perspective, human consciousness is understood as a type of reflective activity: observing, monitoring, judging and re-orienting and re-organizing self; considering what characterizes the self, what self perceives, judges, could do, should do . The reflectivity is encoded in language and developed in conversations about collective selves. Part Two of the paper applies the framework to analysing the individual experience of consciousness, self-representation, self-reference, self-reflectivity and self-development. (shrink)

Some physicians, in their care of patients at risk of misusing opioids, use machine learning (ML)-based prediction drug monitoring programmes (PDMPs) to guide their decision making in the prescription of opioids. This can cause a conflict: a PDMP Score can indicate a patient is at a high risk of opioid abuse while a patient expressly reports oppositely. The prescriber is then left to balance the credibility and trust of the patient with the PDMP Score. Pozzi1 argues that a prescriber who (...) downgrades the credibility of a patient’s testimony based on a low PDMP Score is epistemically and morally unjustified and contributes to a form of testimonial injustice. This results in patients being silenced, excluded from decision-making processes and subjected to structural injustices. Additionally, the use of ML systems in medical practices raises concerns about perpetuating existing inequalities, overestimating their capabilities and displacing human authority. However, almost the very same critiques apply to human-based systems. Formalisation, ML systems included, should instead be viewed positively,2 and precisely as a powerful means to begin eroding these and other problems in ethically sensitive domains. In this case, the epistemic virtues of formalisation include promoting transparency, consistency and replicability in decision making. Rigorous ML systems can also help ensure that models …. It is more than a platitude to admit that we are always dying. It is a recognition of the fundamental finitude that marks our existence as human persons. It says something essential about the human condition. We are all born. We all die. And the very living of life is, leaving aside for the moment religious considerations, oriented toward death. Phenomenologists make much of this observation, perhaps none more so than Martin Heidegger who argues that our being-toward-death permits the ontological (...) grasping of Da-sein as a whole. Indeed for him, the“existential and ontological concept of death” is “the own most nonrelational, certain, and, as such, indefinite and not to be bypassed possibility of Da-sein.” However, if one spends much time around those who are very close to death it can begin to sound disingenuous to talk about death as one’s own most possibility. It is easy to think these patients are dying—not me. Still, the phenomenologist might claim that, vis-à-vis our being-toward-death, the difference between me and the terminally ill patient is a matter of degree and not kind. But, is this so? One may be excused for thinking not. There appears to be an important difference in the kinds of possible experiences open to us. I may experience healing if I become ill; on the other hand, the very condition of the patient with a terminal illness is defined by the impossibility of her experiencing healing. The primary aim of this paper is to argue that the terminally ill patient can, in fact, experience healing at the end of her life and in the face of impending death. I will not argue that the possibility of experiencing healing at the end of life means leaving room for divine intervention, though neither do I intend to preclude such a possibility. Rather, I will argue that healing is something that we experience quite apart from what happens to our biological make-up. While healing is often correlated with a change in the state of our bodies, it need not be. (shrink)

Dombrowski and Murdoch offer versions of the ontological argument which aim to avoid two types of objection – those concerned with the nature of the divine, and those concerned with the move from an abstract concept to a mind-independent reality. For both, the nature of the concept of God/Good entails its instantiation, and both supply a supporting argument from experience. It is only Murdoch who successfully negotiates the transition from an abstract concept to the instantiation of that concept, however, and (...) this is achieved by means of an ontological argument from moral experience which, in a reversal of the Kantian doctrine, depends ultimately on a form of the cosmological argument. The espousal of organizational values with an expectation of primarily positive consequences in leadership, employee performance and organizational change has often been recognized as overly simplistic, but giving a more complete and critical account of the interrelations between values and behaviour has proven challenging. This article describes a balanced and integrated positive, ambivalent and negative (PAN) approach. The use of this PAN approach is described in the case of a health care organization. Evidence is given from a survey of 96 (...) staff perceptions of their current organizational values, staff evaluations of their colleagues’ demonstration of the organization’s espoused values and content analysis of 35 ‘memorable moments’ regarding what staff had experienced. Using the PAN framework in this case suggests a picture of staff reporting experiences as 50–30–20, respectively, for the PAN approach. The implications of this framework for leadership, employee performance and organizational change are discussed. (shrink)

-/- In the Summa Theologiae ‘simplicity’ is treated as pre–eminent among the terms which may properly be used to describe the divine nature. The Question in which Thomas demonstrates that God must be ‘totally and in every way simple’ (1.3.7) immediately follows the five proofs of God's existence, preceding the treatment of His other perfections, and being frequently used as the basis for proving them. Then in Question 13 ‘univocal predication' is held to be ‘impossible between God and creatures’ so (...) that at best ‘some things are said of God and creatures analogically’ because of the necessity of using ‘various and multiplied conceptions’ derived from our knowledge of created beings to refer to what in God is simple for ‘the perfections flowing from God to creatures… pre–exist in God unitedly and simply, whereas in creatures they are received divided and multiplied’ (1.13.5). In line with this, in the De Potentia Dei the treatment of analogical predication is integrated into that of ‘the Simplicity of the Divine Essence’ (Q 7). Moreover, it lies at the root of Thomas's rejection of any possibility of a Trinitarian natural theology such as, for instance, St Anselm or Richard of St Victor had attempted to develop, on the grounds that ‘it is impossible to attain to the knowledge of the Trinity by natural reason’ since ‘we can know what belongs to the unity of the essence, but not what belongs to the distinction of the persons’ (1.32.1). Even modern minds sympathetic to Thomas have clearly found it difficult to understand his concern for the divine simplicity: in his Aquinas Lecture Plantinga speaks for many in stating that it is ‘a mysterious doctrine’ which is ‘exceedingly hard to grasp or construe’ and ‘it is difficult to see why anyone should be inclined to accept it’. Not surprisingly, therefore, some of the most widely read twentieth–century commentators on Aquinas have paid little attention to it. Increased interest has recently been shown in it, but a number of discussions pay insufficient attention to the historical context out of which Thomas's interest in the doctrine emerged, and consequently tend to misconstrue its nature. Recent models of consciousness are reviewed which explore the relationship of consciousness to physical laws; many of these also explore the relationship of consciousness to biological findings. Issues investigated by these models are discussed, with the issues framed in a general way in order to provide a comparison between the models. In Part II the issues discussed include: Does all of the information content of consciousness correspond to neural coding in the brain? Does consciousness follow the brain passively, or can (...) it act independently? Is independent processing by consciousness compatible with the second law of thermodynamics? (shrink)

Although ethics education within the business curriculum has been receiving attention, much is unknown about the effectiveness of such education, particularly when it is integrated into the curriculum. This study looks at selected short-term effects produced by one form of integrated ethics instruction in an introductory marketing course in a graduate business MBA program in the United States. Specifically, students were introduced to an examination of consumer culture as a unifying framework to explore the ethics of decision making. As a (...) consequence of taking the course, students are hypothesized to hold less favorable attitudes toward consumer culture (love of money, materialism, possession satisfaction index, prestige sensitivity) relative to the attitudes held at the start of the course. Interestingly, few attitudinal changes are observed. Where changes in attitudes are observed, the relationships are in the opposite direction to that hypothesized. (shrink)

Already known for his penetrating, and sometimes idiosyncratic, interpretations of the later Wittgenstein, John Hunter, of University College, Toronto, now offers eight essays on independent topics. Each of the essays stands on its own, but they are clearly the work of a single mind and together constitute a sustained contribution to current discussion of that area of metaphysics sometimes called philosophy of mind. Although the debts to, and the insight into, Wittgenstein are substantial, I do not wish to document them.

Hume, despite his disapproval of societies which enslave women, admits females to 'the rights and privileges of society' only from 'humanity' and on the strength of their 'charms'. It is argued that hume's understanding of this inequality is based on the doctrine that different virtues–physical, moral and intellectual–are appropriate to the different sexes, and that in general it is males who are and deserve to be the proprietors of families.

This companion is both an introduction to and a guide through Edith Stein's On the Problem of Empathy. The opening essays demonstrate the work's historical significance and its relevance for contemporary philosophical discussions, while the subsequent chapters provide a clear and detailed summary of each section of Empathy.

It is shown that if mental influence can change a position or momentum coordinate within the limits of the uncertainty principle, such change, when magnified by a single interaction, is sufficient to order the direction of traveling molecules. Mental influence could initiate an action potential in the brain through this process by using the impact of ordered molecules to open the gates of sodium channels in neuronal membranes. It is shown that about 80 ordered molecules, traveling at thermal velocity in (...) the intercellular medium in the brain, can break an ionic or covalent bond, and that the number needed to initiate an action potential is relatively small. If mental influence can act within the brain, it is reasonable to suppose it can act to some extent outside of it. If mental influence could not only order the direction of individual molecules, but coordinate this effect to produce a longitudinal pressure wave which is reasonably coherent across a macroscopic surface, only 10^4 molecules need be simultaneously affected to produce a detectible sound wave. Such an effect is not ordinarily observed, which suggests that if mental influence acts by ordering the direction of molecules, it acts at the level of individual molecules, but does not coordinate their motion.
