In this paper I wish to show that we can give a statement of a restricted form of Gleason's Theorem that is classically equivalent to the standard formulation, but that avoids the counterexample that Hellman gives in "Gleason's Theorem is not Constructively Provable".

Helen Steward argues that determinism is incompatible with agency itself--not only the special human variety of agency, but also powers which can be accorded to animal agents. She offers a distinctive, non-dualistic version of libertarianism, rooted in a conception of what biological forms of organisation might make possible in the way of freedom.

Most people believe that it is sometimes morally permissible for a person to use force to defend herself or others against harm. In Defensive Killing, Helen Frowe offers a detailed exploration of when and why the use of such force is permissible. She begins by considering the use of force between individuals, investigating both the circumstances under which an attacker forfeits her right not to be harmed, and the distinct question of when it is all-things-considered permissible to use force (...) against an attacker. Frowe then extends this enquiry to war, defending the view that we should judge the ethics of killing in war by the moral rules that govern killing between individuals. She argues that this requires us to significantly revise our understanding of the moral status of non-combatants in war. Non-combatants who intentionally contribute to an unjust war forfeit their rights not to be harmed, such that they are morally liable to attack by combatants fighting a just war. (shrink)

The paper argues that the reconciliation of the Causal Theory of Perception with Disjunctivism requires the rejection of causal particularism – the idea that the ontology of causation is always and everywhere an ontology of particulars (e.g., events). The so-called ‘Humean Principle’ that causes must be distinct from their effects is argued to be a genuine barrier to any purported reconciliation, provided causal particularism is retained; but extensive arguments are provided for the rejection of causal particularism. The reductivist view of war holds that the moral rules of killing in war can be reduced to the moral rules that govern killing between individuals. Noam Zohar objects to reductivism on the grounds that the account of individual self-defence that best supports the rules of war will inadvertently sanction terrorist killings of non-combatants. I argue that even an extended account of self-defence—that is, an account that permits killing at least some innocent people to save one's own life—can support a (...) prohibition on terrorism, provided that it distinguishes between direct and indirect threats. What such an account cannot support is the blanket immunity of non-combatants to defensive killing. If a non-combatant is morally responsible for indirectly threatening in an unjust war, she can be liable to defensive killing. However, this gives us reason to revise our account of permissible killing in war, rather than to reject the reductivist account. (shrink)

The practice of nursing involves ongoing interactions between nurses' and clients' lived bodies. Despite this, several scholars have suggested that the “lived body” (Merleau‐Ponty, 1962) has not been given its due place in nursing practice, education or research (Draper, J Adv Nurs, 70, 2014, 2235). With the advent of electronic health records and increased use of technology, face‐to‐face assessment and embodied understanding of clients' lived bodies may be on the decline. Furthermore, staffing levels may not afford the time nurses need (...) to be as “present” with their clients in embodied ways. The failure to attend to the lived body may contribute to missed opportunities for care and decreased quality of life for both clients and healthcare practitioners. In this paper, we undertake an analysis of selected aspects of the work of Maurice Merleau‐Ponty. The aim is to advance understanding of the affordances this work may offer to enhancing client–nurse interactions within the practice of nursing. Merleau‐Ponty's notions of embodiment, intersubjectivity and intercorporeality as articulated in his seminal texts The Phenomenology of Perception (New York, NY: Routledge, 2012) and The Visible and the Invisible (Evanston, IL: Northwestern University Press, 1968) are examined. These three constructs are discussed as they relate to the lived body in client–nurse interactions in nursing practice and education. Finally, implications of how attention to “the lived body” could shape interactions and have the potential to foster increased quality of life of clients and nurses are considered. (shrink)

Care appears prima facie antithetical to punishment. Since the overlaps between care and punishment are greater than we paradigmatically expect, care ethics offers a more accurate account of prisons: recognising and critiquing both dehumanising carceral violence, and the necessity, presence, and inadequacies of penal care, as well as unlocking ways of thinking differently about structural change without losing sight of individual issues. After introducing care ethics and evidencing the presence of caring practices in present prisons, the article considers how we (...) punish, in terms of the amount, method, and manner. Treating people in punishment as moral equals is important for liberal deontological penal theories. Treatment as equals requires context. Context is intrinsic to care‐ethics praxis, which provides methods of and standards for accessing and applying this information. (shrink)

Ali (Ethics and Information Technology 17:267–274, 2015) and McCormick (Ethics and Information Technology 3:277–287, 2001) claim that virtual murders are objectionable when they show inappropriate engagement with the game or bad sportsmanship. McCormick argues that such virtual murders cannot be wrong on Kantian grounds because virtual murders only violate indirect moral duties, and bad sportsmanship is shown across competitive sports in the same way. To condemn virtual murder on grounds of bad sportsmanship, we would need to also condemn other competitive (...) games. I argue, contra McCormick, that virtual murders performed within massively multiplayer online roleplaying games can be wrong on Kantian grounds when they are exploitative. Exploitation occurs when virtual murder treats the player controlling the victim in a way that they have no opportunity to consent to (i.e. as a mere means in Kantian terminology). I argue that some virtual murders involving inappropriate engagement (Ali, Ethics and Information Technology 17:267–274, 2015) and bad sportsmanship (McCormick, Ethics and Information Technology 3:277–287, 2001) are exploitative in this way and therefore also wrong on Kantian grounds. Global ignorance about Africa continues to sustain inappropriate global interventions to resolve public health crises, often with disastrous consequences. To explain why this continues to happen, I marshal two theorems that predict basic statistical properties, called ‘the doctrinal paradox’ and ‘the discursive dilemma’, which underlie scientific consensus formation and evidence-based decision making on a global scale. These mathematical results illuminate the epistemic and material injustices committed by the protocols of medical research conducted at the highest level of global knowledge production (...) in the service of international humanitarian aid for Africans. These social choice theorems reveal that a global scientific consensus projecting claims and proposing policies about Africa’s disease burden is likely to yield a low degree of reliability, in that the probability of its accuracy is less than chance. The solution to this anomaly is to remove from the global scientific agenda the statistically unrealisable demand of satisfying too many multinational corporate and foreign governments’ priorities as equally entitled to benefit from the knowledge produced to improve Africa’s public health sector. Instead, foreign funding targeted to support medical science and policy in Africa should be directed by those specialists in situ who are most familiar with their own national health challenges and potential solutions, rather than relying upon foreign decision makers to interpret Africa’s emergency public health care needs. The growth during the 1990s of a republican movement in Australia has stimulated among other things a feminist examination of both the gendered nature of republicanism and the under-representation of women in senior positions in republican organizations. Feminists have adopted several critical perspectives on Australian republicanism: one involves the claim for the redesign of Australian political institutions in order to maximize the representation of women and women's interests; another suggests that the neglected history of women's involvement in constitutional politics during (...) the last century needs to be understood to throw light on ways in which republicanism can be made more meaningful for women now, while a third argues that republicanism is not essentially a feminist issue and should not be pursued as such. The current international healthcare focus on ensuring the perspectives and needs of individual persons, families or communities are met has led to the core tenet of person‐centred care for all. The nurse–patient relationship is central to the provision of care, and enhancing this relationship to ensure trust and respect supports optimal care outcomes for those accessing healthcare services. Engaging authentically is one of the recognised key approaches in person‐centred practice, and this scoping review of the literature aims to gain an (...) understanding of the role this process plays in developing effective relationships between nurses and the people they care for. A systematic search of databases and grey literature was undertaken, and twenty‐one research papers met the inclusion criteria. A thematic analysis revealed four themes: ‘getting to know the patient as a person’, ‘the complexity of relationship building—it takes time’, ‘the nurse: characteristics and behaviours that support the nurse–patient relationship’ and ‘the patient voice’. Nurses and patients both benefit from effective relationships, feeling valued and experiencing greater satisfaction with care. Key elements of engaging authentically were revealed as a nurse–patient relational process through this literature review; however, further research is needed to gain a greater understanding of this concept. Collectivist accounts of the ethics of war have traditionally dominated just war theory (Kutz 2005; Walzer 1977; Zohar 1993). These state-based accounts have also heavily influenced the parts of international law pertaining to armed conflict. But over the past ten years, reductive individualism has emerged as a powerful rival to this dominant account of the ethics of war. Reductivists believe that the morality of war is reducible to the morality of ordinary life. War is not a special moral sphere with (...) its own special moral rules. Reductivists typically reject a collectivist approach to the morality of war in favor of an individualist view, according to which individuals (rather than states or other collectives) are the proper focus of moral guidance and evaluation. This view holds that the rules governing killing in war are simply the rules governing killing between individuals, most obviously the rules of self-defense and other-defense (Fabre 2009; Frowe 2014; McMahan 2009; Tadros 2014). -/- This chapter defends reductive individualism against the claim that it is unable to sanction wars of national defense that seek to protect non-vital interests. These non-vital interests include political goods such as the defense of sovereignty—that is, of political and territorial integrity. (shrink)

The Remember–Know paradigm is commonly used to examine experiential states during recognition. In this paradigm, whether a Know response is defined as a high-confidence state of certainty or a low-confidence state based on familiarity varies across researchers, and differences in definitions and instructions have been shown to influence participants’ responding. Using a novel approach, in three internet-based questionnaires participants were placed in the role of ‘memory expert’ and classified others’ justifications of recognition decisions. Results demonstrated that participants reliably differentiated between (...) others’ memory experiences – both in terms of confidence and other inherent differences in the justifications. Furthermore, under certain conditions, manipulations of confidence were found to shift how items were assigned to subjective experience categories . Findings are discussed in relation to the relationship between subjective experience and confidence, and the separation of Know and Familiar response categories within the Remember–Know paradigm. Moral Foundations research offers rich promise, opening up key questions about how affect and cognition are integrated in moral response, and exploring how different moral discourses may supply meaning and valence to moral experience. Haidt and his colleagues also associate different discourses with different political positions. However I address three problematic areas. First to what extent Haidt has succeeded in transcending the traditional dichotomy of affect and cognition, and created an integrative model of how moral intuitions actually work. Second, the (...) analysis of cultural processes is too limited; moral responses are discursive, contextualized and constructed. Third, the political spectrum is complex and diverse; to be truly useful, the research on Moral Foundations must avoid parochial US political concerns and models. (shrink)

During the 16-year civil war in Mozambique thousands of children were separated from their families as a direct or indirect result of conflict and displacement. International organizations lent support to a national family tracing and reunification programme coordinated by the government Department for Social Action. Drawing on the findings of an empirical study of the sustainability of substitute family care, this article describes the tensions associated with the involvement of international organizations during the emergency conditions of the war, in post-war (...) rehabilitation and in longer term development. It explores the ethical dimensions of social welfare interventions across borders and continents and concludes by arguing a case for international humanitarian agencies to base their interventions to ?help? separated children on deeper knowledges of the social and political history, and the values, beliefs and normative practices of the populations with whom they work. What can an analysis of power in local communities contribute to debates on women’s legal empowerment and the role of paralegals in Africa? Drawing upon theories of power and rights, and research on legal empowerment in African plural legal systems, this article explores the challenges for paralegals in facilitating women’s access to justice in Tanzania, which gave statutory recognition to paralegals in the Legal Aid Act 2017. Land conflicts represent the single-biggest source of local legal disputes in Tanzania and are (...) often embedded in gendered land tenure relations. This article argues that paralegals can be effective actors in women’s legal empowerment where they are able to work as leaders, negotiating power relations and resisting the forms of violence that women encounter as obstacles to justice. Paralegals’ authority will be realised when their role is situated within community leadership structures, confirming their authority while preserving their independence. (shrink)

This study explored over 100 Year 6 children's feelings towards, and behaviour within, literacy lessons across an academic year. This study revealed that the majority of dissatisfied children concealed their feelings from their teacher, defined within this article as 'dissatisfaction behind a veil of compliance'. Through progressive sampling, where children were observed in a range of subjects, the effort placed in this concealment is explored, together with the role of the teacher and external forces in potentially encouraging it. The article (...) concludes by discussing the possibility of applying the implications of the findings to practice, especially in terms of providing a more open environment, where teachers and pupils can express their views, openly and constructively.
