Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. Are the sources of a combatant's knowledge in war morally relevant? This article argues that privacy is relevant to just war theory in that it draws attention to privacy harms associated with the conduct of war. Since we cannot assume that information is made available to combatants in a morally neutral manner, we must therefore interrogate the relationship between privacy harms and the acts that they enable in war. Here, I argue that there is ample evidence that we cannot discount (...) the analysis of privacy harms in war, and that analysis of such harms requires us to examine social goods. I develop this point to demonstrate the problems that this poses for aspects of revisionist just war theory; namely, reductivism and individualism. In order to evaluate the moral consequences of privacy harms in war, we must understand the unilateral and adversarial character of balancing privacy harms against social goods in the context of war, which, in turn, requires that we consider social goods and social institutions as objects of moral evaluation. Further, concepts drawn from privacy scholarship, such as Helen Nissenbaum's concept of contextual integrity, enable us to identify a range of moral problems associated with contemporary war that deserve further attention from just war theorists. We examine the issues concerning the legality and ethicality of the Second Amendment right to bear arms balanced by the employer's duty to provide a safe workplace for its employees. Two court rulings highlight this balancing act: McDonald et al. v. City of Chicago et al. and District of Columbia v. Heller. “Stand Your Ground” and “Castle Doctrine” laws in the recent Trayvon Martin shooting on February 26, 2012 are also applicable. Various ethical frameworks examine the firearms debate by (...) viewing the Second Amendment from three perspectives. These include a pro‐gun perspective drawing upon libertarianism and fundamental rights; a moderate gun perspective drawing upon consequentialism and stakeholder theory; and finally, an anti‐gun perspective drawing upon a Public Health Ethics and peace ethics approach. We explore the issue of gun control from a business perspective as employers face ethical decisions in responding to legislation that allows guns in the workplace and/or in employer parking lots while still being responsible to provide a safe workplace for their employees. We make recommendations regarding how companies should manage by proactively avoiding legal challenges to employees' rights to own and carry guns into the workplace. This includes emphasis on enhanced security, Human Resource policies and monitoring rapidly changing laws. (shrink)

The aim of this literature review was to compose a narrative review supported by a systematic approach to critically identify and examine concerns about accountability and the allocation of responsibility and legal liability as applied to the clinician and the technologist as applied the use of opaque AI-powered systems in clinical decision making. This review questions if it is permissible for a clinician to use an opaque AI system in clinical decision making and if a patient was harmed as a (...) result of using a clinician using an AIS’s suggestion, how would responsibility and legal liability be allocated? Literature was systematically searched, retrieved, and reviewed from nine databases, which also included items from three clinical professional regulators, as well as relevant grey literature from governmental and non-governmental organisations. This literature was subjected to inclusion/exclusion criteria; those items found relevant to this review underwent data extraction. This review found that there are multiple concerns about opacity, accountability, responsibility and liability when considering the stakeholders of technologists and clinicians in the creation and use of AIS in clinical decision making. Accountability is challenged when the AIS used is opaque, and allocation of responsibility is somewhat unclear. Legal analysis would help stakeholders to understand their obligations and prepare should an undesirable scenario of patient harm eventuate when AIS were used. (shrink)

In an outline of a paper found amongst his philosophical papers and correspondence after his untimely death in 2001—“Nihil Obstat: An Analysis of Ability,” reproduced in this volume—David Lewis sketched a new compatibilist account of abilities, according to which someone is able to A if and only if there is no obstacle to their A-ing, where an obstacle is a ‘robust preventer’ of their A-ing. This article argues in defence of human–robot friendship. I begin by outlining the standard Aristotelian view of friendship, according to which there are certain necessary conditions which x must meet in order to ‘be a friend’. I explain how the current literature typically uses this Aristotelian view to object to human–robot friendships on theoretical and ethical grounds. Theoretically, a robot cannot be our friend because it cannot meet the requisite necessary conditions for friendship. Ethically, human–robot friendships are wrong because they (...) are deceptive, and could also make it more likely that we will favour ‘perfect’ robots, and disrespect, exploit, or exclude other human beings. To argue against the above position, I begin by outlining and assessing current attempts to reject the theoretical argument—that we cannot befriend robots. I argue that the current attempts are problematic, and do little to support the claim that we can be friends with robots now. I then use the standard Aristotelian view as a touchstone to develop a new degrees-of-friendship view. On my view, it is theoretically possible for humans to have some degree of friendship with social robots now. I explain how my view avoids ethical concerns about human–robot friendships being deceptive, and/or leading to the disrespect, exploitation, or exclusion of other human beings. (shrink)

IT WAS an outlandish, ethically questionable experiment, but this was the 1960s after all. Psychiatrist Robert Heath of Tulane University in New Orleans hoped to cure his patients' depression, intractable pain, schizophrenia, suicidal feelings, addiction, and even homosexuality - which in those days was considered a psychiatric disorder - by drowning them out with pleasure, induced by an electrode implanted deep in their brains.

Stocks and flows are building blocks of dynamic systems: Stocks change through inflows and outflows, such as our bank balance changing with withdrawals and deposits, or atmospheric CO2 with absorptions and emissions. However, people make systematic errors when trying to infer the behavior of dynamic systems, termed SF failure, whose cognitive explanations are yet unknown. We argue that SF failure appears when people focus on specific system elements, rather than on the system structure and gestalt. Using a standard SF task, (...) SF failure decreased by a global as opposed to local task format; individual global as opposed to local processing styles; and global as opposed to local perceptual priming. These results converge toward local processing as an explanation for SF failure. We discuss theoretical and practical implications on the connections between the scope of attention and understanding of dynamic systems. (shrink)

This paper explores the experiences of infertile women who occupy a liminal space in society, and argues that the fertility clinic served as a space to tolerate women's experiences of liminality. It provided not only rituals aimed at transition to pregnancy, but also a space where women's liminal experiences, which are caused by the existential chaos of infertility, could be tolerated. The British experience seemed to differ from the American one identified in the literature, where self‐management and peer group support (...) are described as strategies used by infertile women to manage infertility. The British women in this study did not appear to draw so much on self‐management or peer group support to deal with their experiences of infertility. They appeared to be isolated in their experience. The clinic thus provided a space in which recognition was given to their intensely private experiences of difference from those in the outside fertile world and allowed them to manage these socially unacceptable, culturally taboo and invisible experiences. However, because of its very limited success rate in enabling women to become pregnant, rather than facilitating the transition of status from infertile to fertile woman, the clinic also served to reinforce the liminal experiences of those women who remained infertile. Inadvertently, the clinic offered a way of being in limbo while at the same time reinforcing the liminal experiences of women. (shrink)

This paper presents empirical data which allow us to examine how ethical aspects influence ethical consumers’ brand choices on technology-based products,such as washing machines, fridge freezers, and cars. Predicted by the literature review, the majority of our interviewees did make their brand choice based onreliability. However, we found that ethical consumers’ concept of reliability includes not only functionality but also ethical values. The results suggest that we have to reconsider whether considerations of companies’ ethical standards are the only indicators of (...) brand choice as a shortcut of the assessment of business ethics or whether various forms of ethical considerations including ethically reconstructed reliability can also a contribute to this. Early twentieth-century Italian poetry experiences a crisis in confidence concerning the expressibility of rhythm. Dino Campana's writings exemplify the processes the poet goes through in order to write rhythm. Rhythm is difficult to deal with because it is both sacred and tired. These two incarnations of rhythm lead Campana to different modes of expression; from more traditional definitions through to more fluid definitions. Two strands of analysis reveal themselves as central to understanding Campana's theoretical stance, namely fluidity and movement. These (...) point to a careful veiling of rhythm which opens up new spaces for the articulation of something that, whilst difficult, remains the essence of poetry. (shrink)

In turning to photography the paper explores ways of conveying historical truth. It seems that contemporary art places itself at the very limit of representation in an attempt to remain faithful to historical eventuality. In fact, one is reminded of the type of historical occurrence which can be grasped only through ‘as-if presentations’, to remember the Kantian term. ‘Fiction’, therefore, is no longer opposed to ‘truth’, but becomes its conductor and ally.

This article examines a changing global reality that manifests itself in new forms of social activism. The struggle of the multitude challenges political representation and contemporary art seems to corroborate this observation. Becoming a form of social intervention, it turns into an active force and leaves behind the need to double action with representation, representational practices being the hallmark of classical art. A new theory of the image would have to incorporate this dynamic: it would have to treat and develop (...) the basic categories of action and relation. There are few philosophies of the act, and the existing semiotic models mostly deal with dual structures (signifier/signified; sign/meaning; image/referent, and so on). It is necessary to sketch out a dynamic theory of the image that would: (1) reveal the limitations of the concept of representation; (2) conceive of the image as a set of multiple changing relations. The image would thus be seen as a necessary part of the relations governing the world in its entirety, that is, as part of the movement of matter itself. Which is another way of saying that those relations are actualized, or expressed, in the image. (shrink)

Arma uirumque cano… ‘Je chante les armes et l'homme …’ ainsi commence l’Énéide, ainsi devrait commencer toute poésie.It is far from an overstatement to make the claim that in the surviving corpus of Latin poetry no phrase is more immediately identifiable than the pronouncement of the Virgilian narrator on the ‘arms and the man’ of his subject matter. The presence ofarma uirumquein a particular formation cannot fail to put us in mind of theAeneidand its concomitant ideological associations. A consequence of (...) the epic's centrality as a canonical text was the emergence in antiquity ofarma uirumqueas a synecdochic quotation for the work as a whole and, as such, for the figure of the poet himself. This transformation was further actuated by the ancient practice of ascribing titular authority to a poem's incipit, ensuring that arms and the man took on especial resonance. Even within theAeneid, self-referential intratextual play with the Virgilian utterance can be detected. Furthermore, in post-Augustan verse, Fowler argues thatarmaalone is always loaded in a metaliterary fashion, serving as an identifying marker for Virgil's epic or, more broadly, for epic in general. This was so marked a phenomenon that the opening word of the poem was recycled and reworked by Ovid around a decade after the compositional beginnings of theAeneid, in the first book of theAmores, in what formed an announcement of the redeployment of epicarmainto the elegiac world ofmilitia amoris(Am. 1.1–2). As we know, Merleau-Ponty was struggling with a dynamic shift in his thinking at the premature end of his life. In those last notes he raises the question of how to elaborate a phenomenology of “’the other world’, as the limit of a phenomenology of the imaginary and the ‘hidden’”—a phenomenology that would open onto an invisible life, community, other and culture (VI, Jan. 1960). In her essay on “Eye and Mind”, “To Paint the Invisible”, Luce Irigaray shows why Merleau-Ponty (...) was not yet ready to address this question, why he was not yet ready to engage the limits of his vision posed by the presence of an other. Against Merleau-Ponty’s assertion that the artist has no other task than to bring to appearance the world in the way he corporeally encounters it employing no “other technique than what his eyes and hands discover in seeing and painting”, Irigaray argues that the painter as phenomenologist then appropriates what is other to his vision without reflecting upon a limit to vision, as well as the limit provided by the invisible of an other, an other world. This is not to say that there are no intertwinings with this other, for there are other metabolisms with which we engage the world. Moreover, the sharing of vision with an other can alter the ways I see, challenging cultural complicity, rather than providing evidence that we share the same world. Irigaray is of course not the first to challenge a phenomenological approach to art and to vision—and here I turn specifically to Gilles Deleuze—who is critical of the phenomenological tendency to take on a world given to us by others. His artist, Francis Bacon, focuses on the sensation, which remains unmediated by narration or the feelings of others. Finally, the artworks of abstract expressionist artist Joan Mitchell are considered in the ways that they open up a different time-space; they suggest an other world with which we intertwine without appropriation. Her works, I argue, defy reduction to essences, but also do not rely merely on sensation—for this reason they point in the direction of how to think phenomenology anew. For I do think Merleau-Ponty would be open to these conversations, to these other worlds and other visions. (shrink)

The Remember–Know paradigm is commonly used to examine experiential states during recognition. In this paradigm, whether a Know response is defined as a high-confidence state of certainty or a low-confidence state based on familiarity varies across researchers, and differences in definitions and instructions have been shown to influence participants’ responding. Using a novel approach, in three internet-based questionnaires participants were placed in the role of ‘memory expert’ and classified others’ justifications of recognition decisions. Results demonstrated that participants reliably differentiated between (...) others’ memory experiences – both in terms of confidence and other inherent differences in the justifications. Furthermore, under certain conditions, manipulations of confidence were found to shift how items were assigned to subjective experience categories . Findings are discussed in relation to the relationship between subjective experience and confidence, and the separation of Know and Familiar response categories within the Remember–Know paradigm. Wodehouse treats the text as a 'psychological preface to metaphysics', and splits her examination into three sections: knowledge as resulting from judgements in the actual world; the philosophical problem of fallible knowledge; and the question of imagination and 'the variousness of reality'. He concludes in the first chapter that motion must be eternal; the remainder of Physics VIII resolves three objections to this conclusion.
