Relying on a powerful collective narrative through which political, legal and social decision-making is guided in the name of science, the authority of scientific experts reaches beyond the boundaries of their certified knowledge base. Therefore, expertise constitutes and is constituted by transgressive competence. The author argues that (1) changes in the decision-making structure of liberal Western democracies and changes in the knowledge production system diminish the authority of scientific expertise while increasing the context-dependency of expertise - thereby altering the nature (...) of its predictive claims; (2) the societal distribution of expertise, while displaying emancipatory features of empowerment of citizens, also raises issues of quality control; and (3) in order to regain a balance between public and private, i.e. individual-based societally distributed expertise, future expert systems will need to adopt a longer time-perspective. How do we care well for a human being: ourselves or another? Non-Kantian scholars rarely identify the philosophy of Kant as a particularly useful resource with which to understand the full complexity of human care. Kant’s philosophy is often taken to presuppose that a philosophical analysis of good human life needs to attend only to how autonomous, rational agents—sprung up like mushrooms out of nowhere, without a childhood, never sick, always independent—ought to act respectfully, and how they can be forced (...) to interact rightfully. Questions involving aspects of human life captured by what Eva Kittay aptly phrased “the fact of dependency” (1999) —such as our vulnerable, fragile, and embodied social natures, asymmetrical care relations, and deep systemic injustices—are therefore commonly thought to be beyond the grasp of Kant and of Kantian philosophy. Against this historically prominent understanding of Kant’s practical philosophy, below I engage and draw upon recent Kant scholarship which shows both the inadequacy of such rationalist readings and the fruitfulness of using Kant’s practical philosophy to enhance our understanding of human care relations. After situating my approach in the existing, relevant secondary literature on Kant’s human agent, I explore key features of Kant’s accounts of human nature and the highest good. I pay special attention to his proposal that our human nature comprises reflective and unreflective aspects and patterns that we (ought to) strive to develop, transform, and integrate in wise ways through our faculty of desire. In addition, I emphasize the dangers that our ineradicable propensity to do bad things (evil) poses for our projects of self- and other- care. I proceed by outlining how Kant’s account of moral (ethical and legal) responsibility for self and others is developed through his theories of freedom, that is, through his theory of virtue (virtuous internal freedom with its account of perfect and imperfect duties) and his theory of right (rightful external freedom with its account of innate, private, and public right). On the conception I am advancing, we are pretty messy, fragile, and vulnerable beings whose projects of caring are difficult, ongoing, and complex. On the one hand, we (should) strive to care for ourselves (by striving to manage and heal badly functioning parts and by developing, transforming, and integrating immature or distinct parts of ourselves into good wholes) and for others (assisting them in their projects of management and healing and of developing, transforming, and integrating themselves into good wholes) in ways that are both respectful and attentive to the particular people we are—people with lives of our own to live—and the kinds of relationships we share. On the other hand, we should, and can, be forced to interact rightfully, meaning interaction consistent with one another’s basic (innate, private, and public) rights and, hence, contribute to reform projects that improve our inherited, imperfect legal-political systems with regard to care relations. Bringing Kant’s philosophy into dialogue with care theorists, I conclude, advances the insights of both traditions by showing one way to arrive at a multifaceted, yet unified account of human care relations where our embodied, social as well as our rational natures are given due consideration. Few subjects have generated so many newspaper headlines and such heated controversy as the treatment, or non-treatment, of handicapped newborns. In 1982, the case of Baby Doe, a child born with Down's syndrome, stirred up a national debate in the United States, while in Britain a year earlier, Dr. Leonard Arthur stood trial for his decision to allow a baby with Down's syndrome to die. Government intervention and these recent legal battles accentuate the need for a reassessment of the complex (...) issues involved. This volume--by two authorities on medical ethics--presents a philosophical analysis of the subject based on particular case studies. : In this paper, I consider objections to advance directives based on the claim that there is a discontinuity of interests, and of personal identity, between the time a person executes an advance directive and the time when the patient has become severely demented. Focusing narrowly on refusals of life-sustaining treatment for severely demented patients, I argue that acceptance of the psychological view of personal identity does not entail that treatment refusals should be overridden. The description has to be plausible. Plausibility comes from the phenomenology (and not the other way around). Partly the task is normative. The normative content also has to be plausible. Plausibility here comes from vindicating the principles that underwrite the possibilities that define human beings’ sexualities and sexual experiences and behaviors lived by human beings and from the philosophical explanations and conclusions that follow. Overall plausibility, then, comes from discursive analysis of alternatives, from a priori argument, and, in the evaluative case, from showing how the Kantian account of a good life fits with reasonable conceptions of goodness consistent with the phenomenology of human lives. Although this exploration leads us, as we will see, to most corners of Kant’s practical philosophy, including his metaethics and metaphysics, the main focus is on an account of human sex, love, and gender explored explicitly with respect to happiness and ethics (virtue) and justice (right). Liberal theories of justice have been rightly criticized for two things by care theorists. First, they have failed to deal with private care relations’ inherent (inter)dependency, asymmetry and particularity. Second, they have been shown unable properly to address the asymmetry and dependency constitutive of care workers’ and care-receivers’ systemic conditions. I apply Kant’s theory of right to show that current care theories unfortunately reproduce similar problems because they also argue on the assumption that good care requires only virtuous private individuals. This paper explores the pragmatic routines that occur in clause 2 chaining. It demonstrates that the tense-aspect dependency markers in Toposa texts not only combine chained clauses with an initial clause, but also guide the audience to understand information in texts as foregrounded. The understanding of which information is foregrounded is achieved through pragmatic routines that cut the comprehension process short because of frequently encountered inferential processes occurring in repeatedly accessed contextual environments. The pragmatic routines are explained as part of (...) the relevance-theoretic comprehension heuristic. It will also be shown how these routines apply to narratives, and procedural texts. (shrink)

As a part of religious discourse, Christian sermons are a “…persuasive discourse par excellence”. This is more pronounced in the Christian Prosperity Gospel, a system of thought and belief in which preachers The word preacher and speaker are used interchangeably in this paper. attempt to convince audiences to donate to their churches with the expectation that God will reward them with health and wealth. Previous research shows that the use of metaphors and metonymies pervade CPG sermons but an explanation on (...) the mechanisms through which they persuade is rarer. With this in mind and viewing CPG sermons from their persuasive angle; this paper sets out to investigate how metaphors and metonymies are used for persuasion purposes in televised sermons presented in the Gĩkũyũ language Gĩkũyũ is the language of the Agĩkũyũ who are largely found in central Kenya as well as in some other parts of the country. It is a Bantu language classified as a Zone E language by Guthrie. According to the 2019, Population and Housing Census, the gĩkũyũ is the largest tribe in Kenya at 8,148,668 individuals. The community has dominated in televangelism but the position is changing due to the proliferation of many vernacular television stations.. The data is drawn from authentic televised sermons. The findings indicate that metaphors and metonymies engender persuasion in sermons by affecting the perceived altruism and trustworthiness of a speaker in a sermon. This is done by means of manipulating various forms of distance suggested in the Media Proximization Approach. Metaphor is found to affect the axiological, epistemic, temporal and emotional distances while metonymy affects the axiological and spatial distances to activate certain pragmatic presuppositions which make them persuasive in a covert way. The word "understand" has various meanings which can be specified according to a certain aspect of the language or the act of speaking itself: One can understand a sentence; one can understand what someone is doing by saying something, etc. Hence, "understand" is a systematic ambiguous word. The philosophers who define the notion of understanding draw their attention to either the one or the other meaning of the word. Hence, they define this notion only partially. Consequently, they often talk past (...) one another in case of a controversy. But in fact the different definitions of the notion of understanding are not in actual competition with one another. There are many 'language games' one can play with the word "understand". - Corresponding to this 'liberal' conception, Continental and Anglo-Saxon philosophy can be brought into contact with one another: The followers of the hermeneutics and of the "geisteswissenschaftliche Psychologie" have provided definitions of the notion of understanding which should by all means be taken into account. Among the most important aesthetic concepts – especially in the 18th century – are those of the beautiful and the sublime. Yet, in the various aesthetic theories these two concepts are employed in conjunction with one another in very different ways. There is one system in which the beautiful is the fundamental aesthetic value and the sublime i. e. the great – including grandeur and dignity – is only one of a number of defining characteristics of the beautiful. There is (...) another system in which the sublime is the highest degree of the beautiful i. e. of the extraordinary precious. The most influential systems are dichotomous classifications of the respective aesthetic qualities. These classifications themselves exhibit differences: The beautiful and the sublime oppose each other as loveliness creating affection on the one hand, and the astonishing-sublime creating a shudder on the other, but which in some cases can be blended with the beautiful. Alternatively, the concepts of the beautiful and the sublime are disjunctive in a way that they exclude each other: The beautiful is limited and gives positive pleasure; the sublime is unlimited, it depresses and uplifts the viewer at the same time and therefore gives a negative pleasure. – The concepts of the beautiful and the sublime are obviously characterized according to the system in which they appear. ABSTRACT If a doctor kills a severely handicapped infant, he commits an act of murder; if he deliberately allows such an infant to die, he is said to engage in the proper practice of medicine. This is the view that emerged at the recent trial of Dr Leonard Arthur over the death of the infant John Pearson. However, the distinction between murder on the one hand and what are regarded as permissible lettings die on the other rests on the Moral (...) Difference Myth, according to which deliberate lettings die in the practice of medicine are not instances of the intentional causation of death. I argue that a doctor who refrains from preventing a handicapped infant's death, causes that infant's death and does so intentionally. He commits an act of murder. But, I suggest, not all instances of the intentional causation of death are morally wrong. To the extent that they are not, killing rather than letting die will often be the preferable option because more economical of suffering. Hence what is required is the abolition of the Moral Difference Myth and legislation to the effect that those doctors who justifiably cause a patient's death—whether by an action or by an omission—commit no offence. This paper shows ways to develop, integrate, and transform Kant’s and Arendt’s theories on political evil into a unified Karendtian theory. Given the deep influence Kant had on Arendt’s thinking, the deep philosophical compatibility between their projects is not surprising. But the results of drawing on the resources left by both is exciting and groundbreaking with regard to both political evil in general and the challenges of modernity and totalitarianism in particular.

This chapter draws attention to some deep points of philosophical connection between Arendt’s Lectures and Kant’s own and contemporary Kantian legal and political writings in the English-speaking world today. The aim is not to convince as such, but to show ways to bridge these historical divisions such that we can utilize these important works left us in the philosophical canon as we strive to improve our understanding of politics generally and the particular political challenges facing us. In this way, this (...) chapter strives to stay in Arendt’s and Kant’s philosophical spirit of thinking of their works as resources we can use as we strive to think and do better, whether we see to do so as Kantians, Arendtians, or Karendtians. Examining the ideas and assumptions behind the sanctity-of-life view, Kuhse argues against the traditional view that allowing someone to die is morally different from killing, and shows that quality-of-life judgments are ubiquitous. Refuting the sanctity-of-life view, she provides a sketch of a quality-of-life ethics based on the belief that there is (...) a profound difference between merely being alive and life being in the patient's interest. Kant’s example of lying to the murderer at the door has been a cherished source of scorn for thinkers with little sympathy for Kant’s philosophy and a source of deep puzzlement for those more favorably inclined. The problem is that Kant seems to say that it’s always wrong to lie – even if necessary to prevent a murderer from reaching his victim – and that if one does lie, one becomes partially responsible for the killing of the victim. If this (...) is correct, then Kant’s account seems not only to require us to respect the murderer more than the victim, but also that we somehow can become responsible for the consequences that ultimately result from someone else’s wrongdoing. After World War II our spontaneous negative reaction to this apparently absurd line of argument is brought out even more starkly by making the murderer at the door a Nazi officer looking for Jews hidden in people’s homes. This paper argues that Kant’s discussion of lying to the murderer at the door has been seriously misinterpreted. The suggested root of the problem is that the Doctrine of Right has been given insufficient attention in Kant interpretation. It is in this work we find many of the arguments needed to understand Kant’s analysis of lying to the murderer in “On a Supposed Right to Lie from Philanthropy”. When we interpret this essay in light of Kant’s discussion in the Doctrine of Right, we can make sense of why lying to the murderer isn’t to wrong the murderer, why we nevertheless become responsible for the consequences of the lie and why choosing to lie to do wrong ‘in the highest degree’. Finally, the Doctrine of Right account of rightful relations makes it possible for us to analyze the example when we make the murderer at the door a Nazi officer. (shrink)

The association of women with caring dispositions and thinking has become a persistent theme in recent feminist writing. There are a number of reasons for this. One reason is the impetus that has been provided by the empirical work of Carol Gilligan on women’s moral development. The fact that this association is not merely an ideologically or philosophically postulated one, but is argued for on empirical grounds, tends to add to its credibility. Another reason for the resilience of the association (...) is the existence of an increasingly prominent theme in feminist thought and action that focuses on the importance of women’s difference from men, both as a fact and as a goal. Within this theme, there are various views on what the relevant differences are between women and men, and why the differences ought to be emphasized and properly respected. Women’s caring, as will be seen, turns out to have a firm presence in all of these views, and as a result, many women argue that caring should form the basis of a distinctive feminist ethic. On these views, women’s approaches to understanding moral situations, defining selfconceptions, choosing goals and roles, and guiding behaviour, should all be informed by and based upon dispositions of caring. However, if this idea of a feminist ethic of care is to be plausible, it will need to be reconciled with another strong theme in feminism, according to which in fundamental moral respects women ought not be considered or treated differently from men. We will examine the standing of a feminist ethic of care in the context of this tension between the difference theme and the sameness theme in feminism. The discussion begins by re-characterizing the justice and care debate in terms of impartialist and partialist ethical perspectives, and it then goes on to indicate the various ways in which women’s presumed disposition to caring and partialism finds prominence within the difference theme. The central focus of the discussion, however, will be the question of how to reconcile the conflict that exists between impartialist, justice-based moral thinking, and a partialist, caring approach to morality.. Although he struggles to bring his considered view of women into focus, a sympathetic reading shows it not to be anti-feminist and to contain important arguments regarding human nature. Kant believes the traditional male-female distinction is unlikely to disappear, but he never proposes the traditional gender ideal as the moral ideal; he rejects the idea that such considerations of philosophical anthropology can set the framework for morality. Contrary to much Kant interpretation, this article argues that Kant's moral philosophy, including his account of charity, is irrelevant to justifying the state's right to redistribute material resources to secure the rights of dependents (the poor, children, and the impaired). The article also rejects the popular view that Kant either does not or cannot justify anything remotely similar to the liberal welfare state. A closer look at Kant's account of dependency relations in “The Doctrine of Right” reveals an argumentative structure (...) sufficient for a public institutional protection of dependents and evidence that Kant identifies concerns of economic justice as lying at the heart of the state's legitimacy. Short lexicon entry on the Rawls-Nozick discussions.

In my response to Andrew Webster's examples I point to certain limitations, while fully supporting the thrust of his argument for a re-engagement of science and technology studies with policy making. When analyzing the policy implications of knowledge, the larger context must be considered. New criteria, like transparency, have arisen and the tendency for evidence-based policy making has become widespread. The managerial side of policy making emphasizes that "only what can be measured, can be managed." The crucial question is how (...) well prepared-and how willing-the STS community is to tackle policy making in this new guise. In the end, what is needed are institutions that are capable of developing their own reflexivity-a task to which STS can certainly contribute, but the road to be taken may be less direct than Andrew Webster suggests. Der Unterricht in Medizinethik soll Medizinstudierenden die Grundlagen dafür vermitteln, in ihrer zukünftigen ärztlichen Tätigkeit gute Entscheidungen treffen zu können. Im Rahmen einer Panelstudie wird derzeit die Entwicklung moralischer Positionen, medizinethischer Kenntnisse und Motivationen von Medizinstudierenden der Ludwig-Maximilians-Universität München über den Verlauf des Studiums untersucht. Für die Datenerhebung wurde ein Fragebogen entwickelt, der medizinethische Positionen und Kenntnisse sowie Motivationen erfasst. Im Wintersemester 2009/10 wurde die erste Querschnittsuntersuchung mit Studierenden im 1., 3. und 8. Semester sowie im Praktischen Jahr durchgeführt. Die (...) Mehrzahl der Befragten verfügte über einen geringen Kenntnisstand in verschiedenen Themenbereichen des Unterrichtsfachs GTE. Rechtliche Grundlagen und praktische Umsetzung von Therapiebegrenzungsmaßnahmen waren bis ins PJ-Semester vielen Studierenden nicht bekannt. Im Verlauf des Studiums veränderten sich die Motivationen weg von der Motivation, Menschen helfen zu wollen, hin zu Wissenserwerb und dem Ergreifen eines sicheren Berufs. Obwohl viele Befragte ein hohes Interesse an medizinethischen Fragestellungen und Unterricht im Bereich GTE angaben, zeigte sich kein nachhaltiger Zuwachs an medizinethischen Kenntnissen im Laufe des Studiums. In der Zusammenschau werfen die Ergebnisse die Frage auf, inwieweit verschiedene Ausbildungskonzepte Einfluss auf die individuelle ethische Entwicklung Medizinstudierender nehmen können. Eine Untersuchung dieser Fragestellung bleibt Gegenstand weitergehender Forschung. (shrink)

Die Wissensvermittlung in Gesundheitsethik ermöglicht es Auszubildenden der Pflege, sich in ihrer zukünftigen Tätigkeit bei Entscheidungsprozessen des Behandlungsteams hinsichtlich pflegeethischer Fragestellungen einzubringen. Vor diesem Hintergrund wurde anhand der vorliegenden Studie die Entwicklung moralischer Positionen sowie pflegeethischer Kenntnisse von Pflegeauszubildenden sichtbar gemacht. An zwei Krankenpflegeschulen (Berlin und Fürth) wurden im Rahmen einer Panelstudie von August 2010 bis März 2011 Daten einer ersten Querschnittserhebung von Auszubildenden in der Pflege erhoben. Für die Studie wurde ein strukturierter Fragebogen verwendet. Die Studienteilnahme erfolgte freiwillig. Alle (...) Auszubildenden hatten vor der Befragung in unterschiedlichem Umfang Unterricht in Gesundheitsethik erhalten. An beiden Standorten zeigten die Teilnehmenden einen Zuwachs an pflegeethischen Kenntnissen. Auszubildende, die bislang keine praktische Erfahrung mit Sterbehilfe gemacht hatten, zeigten Schwierigkeiten in der theoretischen Handhabung dieser Maßnahmen. Für alle Auszubildenden zeigte sich ein allgemeiner Trend zu einer Befürwortung des partizipativen Interaktionsmodells und damit zu einer Förderung der Patientenselbstbestimmung. Zugleich schätzten die Studienteilnehmenden die Fähigkeiten von Patienten, medizinisch richtige Therapieentscheidungen zu treffen, als gering ein. Die Ausbildung in Gesundheitsethik besitzt ein großes Potential, Kenntnisse zu vermitteln und dadurch die ethische Kompetenzentwicklung zu befördern. Unsere Ergebnisse werfen die Frage auf, inwieweit es einer Integration praktischer Erfahrungen mit Fragestellungen der Gesundheitsethik bedarf, um eine praxisrelevante und wissenschaftlich fundierte Wissensvermittlung zu gewährleisten. At first sight the interrelation between the two main themes of this paper, time structuring and time measurement, seems to be simple enough. Time is something that we measure and that we measure with. But what is it that we measure and how is it constructed that we come to think of it as being measurable? As Leach has pointed out, in any society the prevailing ideas about the nature of time and space are closely linked up with the kinds (...) of measuring scales which are thought to be appropriate. If we alter the scales and dimensions with which we measure, we seem to alter the nature of that which is being measured, as well. (shrink)

This paper provides an entrance into central discussions regarding Kant’s account of property. The first section shows how Kant engages and transforms important, related proposals from Hobbes and Locke as well as how the ‘libertarian’ and ‘liberal republican’ interpretive traditions differ in their readings on these points. Since Kantian theories for a long time didn’t focus on Kant’s Doctrine of Right but instead followed Rawls’s lead by developing Kantian theories grounded on Kant’s (meta-) ethical writings, the second section focuses on (...) property discussions found in the Rawlsian tradition. The final section shows how important contemporary work in the Kantian tradition goes beyond Rawlsian, libertarian, and liberal republican concerns of distributive justice among free and equal citizens, to include questions central to, for example, the philosophy of care, feminist philosophy, philosophy of race, philosophy of sex and love, and environmental philosophy. According to a contemporary school of thought there is a specific female approach to ethics which is based not on abstract “male” ethical principles or rules, but on “care”. Nurses have taken a keen interest in these female approaches to ethics. Drawing on the views expounded by Carol Gilligan and Nel Noddings, nurses claim that a female “ethics of care” better captures their moral experiences than a traditional male “ethics of justice”. This paper argues that “care” is best understood in (...) a dispositional sense, that is, as sensitivity and responsiveness to the particularities of a situation and the needs of “concrete” others. While “care”, in this sense, is necessary for ethics, it is not sufficient. Ethics needs “justice” as well as “care”. If women and nurses excessively devalue principles and norms, they will be left without the theoretical tools to condemn some actions or practices, and to defend others. This paper presents and defends Kant’s non-voluntarist conception of political obligations. I argue that civil society is not primarily a prudential requirement for justice; it is not merely a necessary evil or moral response to combat our corrupting nature or our tendency to act viciously, thoughtlessly or in a biased manner. Rather, civil society is constitutive of rightful relations because only in civil society can we interact in ways reconcilable with each person’s innate right to freedom. _ _ _Unsanctifying Human Life_ offers a collection of Singer's best and most challenging articles from 1971 to the present. The book includes early critiques of various approaches to philosophy and the role of philosophers, followed by controversial works on the moral status of animals, infanticide, euthanasia, the allocation of scarce health care resources, embryo experimentation, environmental responsibility, and reflections on how we should live.

Contrary to the received view, I argue that Kant, in the “Doctrine of Right”, outlines a third, republican alternative to absolutist and voluntarist conceptions of political legitimacy. According to this republican alternative, a state must meet certain institutional requirements before political obligations arise. An important result of this interpretation is not only that there are institutional restraints on a legitimate state's use of coercion, but also that the rights of the state (‘public right’) are not in principle reducible to the (...) rights of individuals (‘private right’). Thus, for Kant, political obligations are intimately linked to the existence of a certain kind of republican institutional framework. (shrink)

This paper defends a legal and political conception of sexual relations grounded in Kant’s Doctrine of Right. First, I argue that only a lack of consent can make a sexual deed wrong in the legal sense. Second, I demonstrate why all other legal constraints on sexual practices in a just society are legal constraints on seemingly unrelated public institutions. I explain the way in which the just state acts as a civil guardian for domestic relations and as a civil guarantor (...) for private property and contract relations—and thereby enables the existence of legally enforceable claims. Throughout the aim is to demonstrate that Kant’s relational conception of justice entails that legally enforceable claims regarding sexual deeds are fully justifiable only insofar as they are determined and enforced by a public authority that we may refer to as a liberal democratic welfare state.
