The article offers a critical assessment of an article on "Corporate Legitimacy as Deliberation" by Guido Palazzo and Andreas Scherer in this journal. We share the concern about the precarious legitimacy of globally active corporations, infringing on the legitimacy of democracy at large. There is no quarrel with Palazzo/Scherer's diagnosis, which focuses on the consequences of globalization and ensuing challenges for corporate social responsibilities. However, we disagree with the "solutions" offered by them. In a first step we refute the idea (...) of a legitimacy of morals, maintaining that morality is a premodern mode of creating legitimacy. Even worse, moral is becoming a dangerous commodity under conditions of fundamental global disagreements and antagonisms. We secondly refute the concept of the "politicized corporation", maintaining that Palazzo/Scherer disregard the consequences of functional differentiation of modern societies and, in particular, disregard the wisdom of political restraint and constitutional guarantees for the autonomy of different spheres of society. Finally, we refute a seemingly romantic notion of deliberation, maintaining that deliberation and deliberative democracy is a worthy idea, which, however, has no place in the real world of globalized contexts. On the other hand, we also find enough common ground and common concern with Palazzo/Scherer to validate a fruitful discourse. (shrink)

Default logic is one of the most popular and successful formalisms for non-monotonic reasoning. In 2002, Bonatti and Olivetti introduced several sequent calculi for credulous and skeptical reasoning in propositional default logic. In this paper we examine these calculi from a proof-complexity perspective. In particular, we show that the calculus for credulous reasoning obeys almost the same bounds on the proof size as Gentzen’s system LK. Hence proving lower bounds for credulous reasoning will be as hard as proving lower bounds (...) for LK. On the other hand, we show an exponential lower bound to the proof size in Bonatti and Olivetti’s enhanced calculus for skeptical default reasoning. (shrink)

This book explores the question of how international law is applied by domestic courts. Through case studies and analysis the contributors consider how traditions and diversity affect the interpretation of international law, from a mixture of doctrinal, practical, and theoretical approaches.

Are indices a purely linguistic, textual phenomenon or are linguistic indices a special case of a more general type of indexical signs? In comparing Carlo Ginzburg's restrictive view of indices and traces in particular with Peirce's general approach to indexical signs, this paper argues that Peirce's account of indexicality makes it possible to connect the sciences and the humanities by a flexible relational concept of the epistemic function of an identification that indexical experiences allows for. In this way Peirce's flexible (...) concept of indexicality allows us to connect e.g. the experience of a condensation trace of an electron in a cloud chamber with that of the trace of a deer in the snow. A textual analysis of Plato's Laws reveals that a change has taken place in the concept of reason that Plato earlier displayed in the Politeia. This change is suggested by the importance Plato ascribes in the Laws to musical and religious education. In the Laws, Plato describes a concept of reason that is made up of sensibility, intellectuality, and spirituality.

This essay will inform the reader about Kant’s views on mathematics and aesthetics. It will also critically discuss these views and offer further suggestions and personal opinions from the author’s side. Kant (1724-1804) was not a mathematician, nor was he an artist. One must even admit that he had little understanding of higher mathematics and that he did not have much of a theory that could be called a “philosophy of mathematics” either. But he formulated a very influential aesthetic theory (...) that is contained in his “Critique of the Power of Aesthetic Judgment” (1790), and his views on mathematics, especially those that compare it with philosophy, are distinctive and worthy of our attention. Hence, combining mathematics and aesthetics, asking whether mathematics can be beautiful and why and how it can or cannot be so called, according to Kant’s theory, will be particularly interesting. This essay has three parts: it discusses mathematics, aesthetics, and the aesthetics of mathematics, primarily in Kantian perspectives but also in ways that critically evaluate those perspectives. The book "Wer hat das Wissen in der Wissenschaft versteckt?" [Who had hidden knowledge in science?] is about the organisational character of science - "science" as understood in continental Europa as social & natural sciences. The reason for this interest is that, as it is the case with other things, human beings undertake scientific enquiries because they, as individuals, have certain interests related to the content of their activities, they want to know certain things. Then, when an activity is organised, (...) the organisation (or organisational structure) itself develops own interests and imposes them on the individuals. Soon, the individuals do not follow anymore (so much) their own interests but the interests of the organisation. This phenomenon is exemplarified by an analysis of the foreword of Wilhelm Schmid's book: "Philosophie der Lebenskunst" (1998) [Philosophy of the art of living], his habilitation at the University of Erfurt: The analysis shows how Schmid in this foreword is trying hard to present the art of living (which is first and foremost useful for the individual human person) as something which is useful for society because this is what science, represented by the academic environment in which we are socialized requires. In total, the book comprises 12 individual studies of which the analysis of the foreword of Schmid's "Philosophie der Lebenskunst" is one. The other 11 studies analyse texts by: Jeanne Marie Gagnebin, Sandra Beaufays, andreas Hütig, Carl Djerassi, Monika Wogrolly, Friedericke Hassauer, Michel Foucault, John Stuart Mill, Erich Visotschnig & Siegfried Schrotta, Gordon A. Frutschnigg, and Oliver Sacks. One important aspect of the book is the relationship between philosophy and science, analysed e.g. with the help of Gordon A. Frutschnigg's diploma theses on the diploma theses completed at the Institute of Philosophy of the University of Vienna between 2005 and 2007: Can philosophy, which primarily serves for the orientation of the individual in life be scientific in the sense of the organisational character of science (which tries to exclude individual interests as best as it can for they are deemed to bring subjectivity into science striving for objective truth). The choice of the books/texts which are analyzed in this study was partly (admittedly) random; however, they bear a common characteristic which is: these are texts which show/make visible the organisational character of science. The character of the studies in this book is phenomenological because they provide a close look at 12 texts/books and their use of language, supported by extensive quotes. (shrink)

The A to Z of Kant and Kantianism provides a comprehensive dictionary that will aid not only students but also teachers and the general public, since it contains hundreds of entries describing Kant's life and works and explaining his concepts as well as the contributions of his followers . Furthermore, much of the writings of the Neokantians, as well as the literature dealing with this movement, are not available in English, thus, this book provides an introduction to this phenomenon to (...) the English-language reader. Etablir l'art de l'interprétation comme science, tel est l'objectif de l'Essai de G. Fr. Meier, publié à Halle en 1757. Il s'agit du traité systématique d'herméneutique le plus abouti du rationalisme des Lumières dans son effort pour dégager des principes généraux de l'interprétation, dont le principe d'équité est le coeur. Les règles méthodologiques dégagées permettent de justifier la prétention de l'interprétation à être une connaissance, favorisant ainsi tant la culture que la lutte contre la superstition. La traduction de l'Essai (...) en français permet d'introduire l'herméneutique des Lumières, sa prétention à l'objectivité, son rapport avec la logique et la théorie du langage, dans un paysage marqué par la philosophie herméneutique de Heidegger et Gadamer.
