Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Matthias Joseph Scheeben has been described as one of the greatest and least read theologians of the modern era. This article provides an overview of his theology of predestination, which remains a significant but little-studied aspect of his thought. Section I offers a general sketch of Scheeben's theology of predestination, employing the chapter on this topic in The Mysteries of Christianity as a primary source. Section II takes a deeper look at Scheeben's theology of predestination through an (...) engagement with relevant sections of his untranslated masterwork, the Dogmatik. This section will highlight Scheeben's relationship to both the de auxiliis controversy and the thought of Thomas Aquinas. The phenomenon of twinning in early fetal development has become a popular source for doubt regarding the ascription of moral status to early embryos. In this paper, the possible moral basis for such a line of reasoning is critically analysed with sceptical results. Three different versions of the argument from twinning are considered, all of which are found to rest on confusions between the actual division of embryos involed in twinning and the property of early embryos to be divisible, be (...) based on highly questionable ethical assumptions, or to imply inconsistent claims regarding the moral importance of potentiality and/or the moral status of embryos. This is taken to expose a number of related inconsistencies in the moral basis of pro-life positions. In particular, ascribing moral significance to the property of being (in)divisible is found to be incompatible with the claim that human individuals possess unique values which could underpin an absolute moral ban on murder. The ideal of scientific openness — i.e. the idea that scientific information should be freely accessible to interested parties — is strongly supported throughout the scientific community. At the same time, however, this ideal does not appear to be absolute in the everyday practice of science. In order to get the credit for new scientific advances, scientists often keep information to themselves. Also, it is common practice to withhold information obtained in commissioned research when the scientist has agreed with his (...) or her employer to do so. The secrecy may be intended for ever, as in the military area, but also temporarily until a patent application has been made. The paper explores to what extent such secrecy is undesirable, as seems to be suggested by the ideal of scientific openness. Should this ideal be interpreted as having certain exceptions which make the above-mentioned practices acceptable? Are there, on closer inspection, good arguments for the ideal of scientific openness, and for officially upholding it? Possible versions of the ideal of scientific openness are explored and the issue is found to be rather complex, allowing for wide variations depending on the acting parties, beneficiaries, types of information and moral requirements involved. We conclude that the arguments usually given in favour of this ideal are weaker than what seems to be generally believed, and that, on closer inspection, they leave plenty of room for exceptions to it. These exceptions only partly cover the actual practice of withholding scientific information, and there may still be good reason to advocate, teach and enforce the ideal of scientific openness within the scientific community. The book opens with an article on the chronology and life of St. Thomas, which was written originally in 1920 by the well-known Thomistic scholar, Pierre Mandonnet, for the Revue des sciences philosophiques et théologiques. In a critical study, written in 1932 and reproduced here in its German version, Palémon Glorieux challenges Mandonnet's conclusions with regard to Thomas's Quaestiones disputatae, while in another essay, also appearing in this volume, he advances hypotheses and clarifies certain points about Aquinas's treatise, De regimine (...) Judaeorum. Many penetrating insights into Thomas's life and personality are furnished by Martin Grabmann in his essay on Aquinas's relationship to the civil and religious authorities of his time, while Heribert Scheeben discusses Thomas's sojourn in Cologne and his personal rapport with his master, Albert the Great. I watched Luke destroy the Death Star as a wide-eyed eight-year-old and I relished the downfall of the imperial walkers on the ice planet Hoth. I rejoiced with Luke at seeing his father, Anakin Skywalker (Darth Vader), restored in death to the Good Side of the Force, glowing faintly alongside Obi-wan Kenobi and the Jedi (...) master Yoda. In the 1983 version of The Return of the Jedi,' Anakin's Force ghost looked like the old, wounded, disabled man whose body Luke rescued from the second Death Star about to explode. Hayden Christiansen, who plays Anakin as a young man in the prequels Attack of the Clones and The Revenge of the Sith, was only two years old then; yet the 1983 film has since been edited so that his image is the Force ghost alongside Obi-wan Kenobi and Yoda. I find this troubling—and not just because I am a cantankerous old fan who likes things the way they were.For a theologian with an interest in disability,1 the swap calls to mind the worries of some disability theologians2 about continuity and discontinuity [End Page 993] in the resurrection: if disabilities that marked us or our loved ones in this life are eradicated, how does identity persist? George Lucas explained in an interview that, when Anakin Skywalker was "redeemed," he went back to being the person he was before he was consumed by the Dark Side: the real Anakin ceased to be when he became Darth Vader.3 But the replacement of the post–Darth Vader Anakin with the young, pre-Darth Vader Anakin creates enormous problems for thinking about the resurrection, even in the fictional Star Wars universe.4 Anakin seems to lose most of his adult life. Would he remember that he had been Darth Vader, or that he saved Luke's life? If he does not remember the event, how can this Force ghost be the same person that Luke rescued from Death Star 2.0? George Lucas's decision to replace Sebastian Shaw, who played Darth Vader in the original Return of the Jedi, with Hayden Christiansen introduces radical discontinuity into the narrative. The substitution does not give us the "real" Anakin; instead, we are left with neither Anakin nor Darth Vader, but a different person; someone Luke would not have recognized, and who might well not recognize either Luke or himself.In a similar vein, Nancy Eiesland mused that, without her disability, caused by a congenital, degenerative bone disease, she would be "unknown to [herself] and perhaps to God."5 Her perception of resurrection healing was that she would be as different in the resurrection as Hayden Christiansen is to Sebastian Shaw. Drawing on classical Christian teaching from Gregory of Nyssa to Matthias Scheeben,6 I will show in this essay that Eiesland's concern [End Page 994] is misplaced. Considering the way that the resurrection body is often portrayed, however, her concern is understandable. Disability theologians' qualms about the resurrection deserve a retrieval of the classical doctrine that addresses their suspicions about the discontinuity of identity in the resurrection and upholds the full humanity of people with disabilities, even profound intellectual disabilities.IIn one sense, the questions raised by disability theologians are not new.7 First-century Christians argued about the transformation that St. Paul envisaged, which involved continuity and change. In 1 Corinthians, he tells us "a mystery … we shall all be changed, in a moment, in the twinkling of an eye, at the last trumpet. For the trumpet will sound, and the dead will be raised imperishable, and we shall be changed. For this perishable nature must put on the imperishable, and this mortal nature must put on immortality" (15:51–53). Christians debated the nature of the change involved in putting on immortality and in their debates asked questions about the continuity of identity. John Searle''s hypothesis of the Background seems to conflict with his initial representationalism according to which each Intentional state contains a particular content that determines its conditions of satisfaction. In Section I of this essay I expose Searle''s initial theory of Intentionality and relate it to Edmund Husserl''s earlier phenomenology. In Section II I make it clear that Searle''s introduction of the notion of Network, though indispensable, does not, by itself, force us to modify that initial theory. However, a comparison (...) of this notion to the notion of horizon from Husserl''s later phenomenology and an interpretation of Husserl''s conception of the determinable X as providing a solution to the problem of perceptual misidentification lead me to conclude that in his discussion of ''twin examples'' Searle had better modified his initial theory. Finally, I critically examine Searle''s claim that anyone who tries seriously to follow out the threads in the Network will eventually reach a bedrock of non-Intentional capacities. In Section III I show in detail, partly in a rather Husserlian vein, that Searle''s four official arguments for the Background thesis, though containing some very valuable contributions to a theory of linguistic skills, are not convincing at all if they are to be understood as going beyond the scope of Searle''s ''content-cum-Network'' picture of Intentionality. The upshot of these considerations is that the Background thesis should be read as a thesis concerning the causal neurophysiological preconditions of human Intentionality rather than concerning the logical properties of Intentional states in general. Recently Searle himself has come to the same result, but he does not say for which reasons. The present essay makes it clear why Searle just had to arrive at this important result. (shrink)

Could computers ever be conscious? Will they ever have ideas that one could attribute to them and not to the programmer? Will robots be able to 'feel pain', instead of processing bits from sensors informing about danger? Will they have true emotions? These questions may never be answered, but it makes sense to ask whether humans will ever attribute mind to artifacts. This paper suggests introducing a third level of claims regarding artificial intelligence (AI), which is in between 'weak AI' (...) and 'strong AI', the so-called 'attributed AI'. This level requires more than weak AI ('behave as if', which could be said of any desktop calculator), but is less presumptuous than strong AI ('computers that think', a claim that is hard to prove). One of the results of the recent synod is certain to be more attention to deepening our understanding of the church as communion. Robert Kress's fine volume cannot help but be a useful contribution to that discussion. As he succinctly states, "the Church is the communion of believers who exist as the sacrament of Christ, who is the sacrament of God, who is the communion of Father, Son, and Holy Spirit" (p. 59). For Kress any ecclesiology that does not root the church in the triune, perichoretic (a favored word) life of God is a radically truncated one. As a theandric (another favored word) reality, the Church must mirror its ground or source. If that ground is a dynamic, joyous unity-in-diversity, this should be reflected in the life and structures of the ecclesial community. Such is the context in which the author reflects on a variety of themes that are reflective of the post-Vatican II agenda: the relationship among local, regional, and universal churches; the understanding of the church as sacrament; the tension between holiness and office; the meaning of leadership in a community best understood as a perichoretic communion of gifted members. To each of these topics Kress brings a grasp of the BOOK REVIEWS 177 tradition, a wide acquaintance with the relevant theological literature, and a willingness to make provocative judgments ("yes" to the ordination of women; " no " to the new egalitarianism-a church conceived without administrative, pastoral authority.) Kress particularly cherishes the church as "the memory and tradition of Christ." His commitment to this tradition has both rooted him and freed him. He draws knowledgeably on Aquinas and Augustine, Rahner and Heidegger, von Balthasar and the Shepherd of Hermas. Lawrence Cunningham is correct: this book is radically conservative. There is one area where I felt that there was a certain lack. Kress's treatment of the church as sacrament and of the seven sacraments contained much that was valuable: his stress on the sacramentality of ecclesial life as such, his historical analysis of "sacrament", his phenomenolog·y of the nature of Christian worship. Yet all of this seemed strangely abstracted from the liturgical praxis of the Christian community. This lack is especially visible in his admittedly tentative salvation-historical correlation of the sacraments with our sharing in the religious experience of Jesus (pp. 147-148). To make that correlation, especially in the case of Baptism, Confirmation, and Eucharist, without an exp1icit reference to the initiatory, communal dimension of these sacraments is certainly problematic. I would like to make a final comment, not on the substance of the book, but on its editing and proofing. In the climate ethics debate, scholars largely agree that individuals should promote institutions that ensure the reduction of greenhouse gas emissions. This paper aims to establish that there are individual duties beyond compliance with and promotion of institutions. Duties of individuals to reduce their emissions are often objected to by arguing that an individual’s emissions do not make a morally relevant difference. We challenge this argument from inconsequentialism in two ways. We first show why the argument also seems to undermine (...) the case for duties to promote institutions that the arguments’ proponents endorse. Second, we argue that individuals ought to cut emissions if they exceed their fair share of emissions entitlements and, by emitting, contribute to climate-related harm. In response to inconsequentialism, we specify the notion of ‘contribution’ via the so-called NESS theory, according to which an act is causally relevant for and contributes to an outcome if it is a Necessary Element of a Set of conditions that is Sufficient for the outcome. After refuting two objections to our approach, we conclude by discussing how to deal with possible conflicts between duties to promote institutions and to reduce one’s emissions. (shrink)

The standard of proof in criminal trials should require that the evidence presented by the prosecution is robust. This requirement of robustness says that it must be unlikely that additional information would change the probability that the defendant is guilty. Robustness is difficult for a judge to estimate, as it requires the judge to assess the possible effect of information that the he or she does not have. This article is concerned with expert witnesses and proposes a method for reviewing (...) the robustness of expert testimony. According to the proposed method, the robustness of expert testimony is estimated with regard to competence, motivation, external strength, internal strength and relevance. The danger of trusting non-robust expert testimony is illustrated with an analysis of the Thomas Quick Case, a Swedish legal scandal where a patient at a mental institution was wrongfully convicted for eight murders. Cette étude formule l'hypothèse critique d'une opération de remythologisation par une réactualisation théologico-politique de la tragédie chez Heidegger. Cette opération ne saurait simplement coïncider avec une revalorisation " irrationnelle " du mythe, car elle procède d'abord d'une mise en question, non moins problématique, de la dualité supposée entre muthos et logos pour culminer dans ce qu'une note des années 1950 appellera la " mytho-logie de l'événement ". La réélaboration de la notion de mythe s'accomplit à partir du poème de Hölderlin (...) qui doit préfigurer les dieux de l'" autre commencement " post-judéo-chrétien, selon le projet spéculatif d'une " religion " censée relier le peuple à ses dieux nouveaux via l'être comme événement. L'hypothèse d'une remythologisation théologico-politique doit ainsi permettre d'éclairer non seulement le rôle matriciel de Hölderlin pour la pensée de l'être, mais aussi le surinvestissement illusoire du national-socialisme censé donner lieu au " peuple de Hölderlin ". Pour interroger cette réactualisation théologico-politique du mythe, l'étude se concentre sur les cours que Heidegger consacra à Hölderlin, tout en sollicitant l'intégralité du corpus des années 1933-1945, c'est-à-dire les cours fribourgeois, les traités inédits rédigés dans le sillage des Contributions (Beiträge) et les Cahiers noirs (Schwarze Hefte). Humeans about laws maintain that laws of nature are nothing over and above the complete distribution of non-modal, categorical properties in spacetime. ‘Humean compatibilists’ argue that if Humeanism about laws is true, then agents in a deterministic world can do otherwise than they are lawfully determined to do because of the distinctive nature of Humean laws. More specifically, they reject a central premise of the Consequence argument by maintaining that deterministic laws of nature are ‘up to us’. In this paper, (...) we present a new argument for Humean compatibilism. We argue that Humeans about laws indeed have resources for defending compatibilism that non-Humeans lack. Moreover, we show that utilizing these resources does not lead to objectionable consequences. Humeans about laws should thus embrace Humean compatibilism. (shrink)

Individuality and collectivity are central concepts in sociological inquiry. Incorporating cultural history, social theory, urban and economic sociology, Borch proposes an innovative rethinking of these key terms and their interconnections via the concept of the social avalanche. Drawing on classical sociology, he argues that while individuality embodies a tension between the collective and individual autonomy, certain situations, such as crowds and other moments of group behaviour, can subsume the individual entirely within the collective. These events, or social avalanches, produce an (...) experience of being swept away suddenly and losing one's sense of self. Cities are often on the verge of social avalanches, their urban inhabitants torn between de-individualising external pressure and autonomous self-presentation. Similarly, Borch argues that present-day financial markets, dominated by computerised trading, abound with social avalanches and the tensional interplay of mimesis and autonomous decision-making. Borch argues that it is no longer humans but fully automated algorithms that avalanche in these markets. (shrink)

Expertise is often ascribed to persons who are considered exceptionally competent in a particular subject matter. In contrast to this traditional approach, the present paper introduces a contextual understanding of expertise ascriptions. More precisely, this paper introduces two different kinds of contextuality by advancing and advocating the thesis that expertise ascriptions are true if and only if their content within their context of use is true against standards in the context of assessment. This means that expertise ascriptions have indexical content (...) and are also assessment-sensitive. On this basis, a definition of expertise will be developed which outlines a series of conditions for what it takes to be an expert. (shrink)

This theory breaks down the symmetry between producers and consumers and gives more importance to reproduction rather than scarcity. In his analysis of multiple-product systems, Bidard focuses on the notion of an all-engaging system which elucidates the link with von Neumann's theory; examines the notions of sector and (...) vertical integration which make possible an elegant treatment of fixed capital; clarifies the status of the internal rate of return; proposes a general theory of rent. In the discussion of capital theory and marginal equalities or, more specifically, the treatment of exhaustible resources, Bidard compares different readings of Sraffa's work and revisits the question of relationships between classical theory and the general equilibrium theory. When someone is poised to fail to fulfil a moral duty, we can respond in a variety of ways. We might remind them of their duty, or seek to persuade them through argument. Or we might intervene forcibly to ensure that they act in accordance with their duty. Some duties appear to be such that the duty-bearer can be liable to forcible interference when this is necessary to ensure that they comply with them. We’ll call duties that carry such liabilities (...) enforcement-apt. Not all duties seem to be enforcement-apt. Some, for example, accept that a person in a monogamous marriage has a moral duty to refrain from infidelity, but deny that a spouse can be compelled to comply with their duty to be faithful without transgressing her rights. More controversially, some think that our duties to assist others in severe need are not enforcement-apt. What could explain the contrast between duties that are enforcement-apt while and those that are not? We’ll call this the puzzle of enforceability and our paper considers three broad strategies for responding to it. The first strategy takes the form of identifying some substantive feature or features that are necessary and/or sufficient for a duty to possess some enforcement status. We consider a range of candidate explanations of this sort but find that none are plausible. The second strategy rejects the idea that there are genuinely enforcement-inapt duties and instead seeks to explain why there can nonetheless be marked differences amongst duties concerning how they can be enforced and who can enforce them. We find that this strategy too is largely unsuccessful. The third strategy offered seeks an explanation of differences in enforcement status by appeal to the broader social costs of enforcing certain kinds of duties. We find that this approach holds some promise but note that it requires adopting a controversial set of moral commitments. We conclude by considering our options in the absence of a solution to our puzzle. (shrink)

Distributed cognition refers to processes which are (i) cognitive and (ii) distributed across multiple agents or devices rather than performed by a single agent. Distributed cognition has attracted interest in several fields ranging from sociology and law to computer science and the philosophy of science. In this paper, I discuss distributed cognition from a social-choice-theoretic perspective. Drawing on models of judgment aggregation, I address two questions. First, how can we model a group of individuals as a distributed cognitive system? Second, (...) can a group acting as a distributed cognitive system be ‘rational’ and ‘track the truth’ in the outputs it produces? I argue that a group’s performance as a distributed cognitive system depends on its ‘aggregation procedure’ – its mechanism for aggregating the group members’ inputs into collective outputs – and I investigate the properties of an aggregation procedure that matter. Before crystallizing into works, music as a field of sensible organization of sound poses a problem: how is it possible that something audible is set apart from the acoustic world to constitute a distinct sphere of sense, holding people′s attention in an unparalleled way? To deal with this question, the text proceeds in three steps: using a concept from art theory, Boehm′s “iconic difference”, music is conceptualized as an ongoing differentiation within the audible; the means that accomplish this differentiation, namely (...) musical tone and the tonal system, are investigated; and finally the gestural element in music is introduced as the form these means take on in the musical process. Throughout, the text draws on classical philosophical resources such as Hegelian dialectics, current research in parallel fields like language development, psychological insights into the structure of perception in early infancy, and various examples from contemporary music and art. What if popular discourses of recognition and identity tend to rely, in whole or in part, on underlying conceptions of reproduction -- specifically, the desire to reproduce one's own self-consciousness in the beliefs and behaviors of others? I argue for the importance of diagnosing a recognition/reproduction paradigm in which foreground discourses of recognition obfuscate an underlying evangelical desire for reproduction of one's own self-image. To do so, I revisit G.W.F. Hegel's allegory of the lord/bondsman, arguably the decisive source of modem (...) and contemporary conceptions of recognition. I show that scholars typically mislabel and misunderstand the logic behind Hegel's descriptions of recognition, and I then argue that what theorists typically interpret as recognition we should instead interpret as a paradigm of recognition co-valent with reproduction. More relevant to contemporary activists and scholars, I then illustrate how the desire for reproduction likely remains the dominant, normative paradigm in problematic forms of liberal identity politics and international relations in an era of neoliberal globalization. As a hermeneutical intervention, treating the desire for recognition as co-valent with a desire reproduction may help to distinguish hegemonic uses of identity from liberatory, perhaps even dignifying, forms of mutualism and regard. This is a response paper to Daniel Russell's paper in the same volume. I raise some challenges to Russell's model of virtue acquisition which draws extensively on the CAPS model in psychology and on parallels between virtues and skills.

Monitoring the environment for visual events while performing a concurrent task requires adjustment of visual processing priorities. By use of Bundesen's (1990) Theory of Visual Attention (TVA), we investigated how monitoring for an object-based brief event affected distinct components of visual attention in a concurrent task. The perceptual salience of the event was varied. Monitoring reduced the processing speed in the concurrent task, and the reduction was stronger when the event was less salient. The monitoring task neither affected the temporal (...) threshold of conscious perception nor the storage capacity of visual short-term memory nor the efficiency of top-down controlled attentional selection. Predictivism asserts that novel confirmations carry special probative weight. Epistemic pluralism asserts that the judgments of agents (about, e.g., the probabilities of theories) carry epistemic import. In this paper, I propose a new theory of predictivism that is tailored to pluralistic evaluators of theories. I replace the orthodox notion of use-novelty with a notion of endorsement-novelty, and argue that the intuition that predictivism is true has two roots. I provide a detailed Bayesian rendering of this theory and argue that pluralistic (...) theory evaluation pervades scientific practice. I compare my account of predictivism with those of Maher and Worrall. Cet article analyse la manière dont l'engagement moral individuel est traité dans la théorie de la justice de John Rawls. En partant de la distinctionclé entre rationnel et raisonnable, la notion de « conformité » est décomposée en plusieurs strates. A une forme minimale de la conformité s'ajoutent des notions d'adhésion faible et d'adhésion forte. Diverses maximes de comportement individuel sont discutées, qui correspondent à différents degrés d'exigence morale. L'article s'achève sur une réflexion plus large sur le lien entre engagement (...) individuel et tolérance dans la société rawlsienne. This article analyzes the way in which individual moral commitment is treated in John Rawls's theory of justice. It starts with the central distinction between rational and reasonable and divides the notion of « compliance » into several components. Next to a minimal form of compliance, there is a weak form of adhesion and a strong one. Various maxims for individual behavior are discussed, corresponding to various degrees of moral demandingness. The article closes with a broader reflection on the link between moral commitment and tolerance in the Rawlsian society. (shrink)
