It is a constitutional demand for judges to be objective. Ethical codes show that objectivity depends on rules enabling individuals to counter their subjectivity. Yet these codes focus on judges’ general behaviour while methodology strives for objectivity in the judges’ core task of applying the law on a specific case. Various methods are examined whether they guarantee or at least contribute to an objective interpretation of the law within the existing margin of interpretation. Conscious application of methodology is elaborated upon (...) as a demand of a democratic state under the rule of law. While the principle of judicial independence already limits control of the external result of the adjudication process, it is almost impossible to control the internal process of applying the law that takes place only inside the judge’s head. Thus, it is up to each judge to ensure objectivity by internally binding themselves to a conscious application of methods - therefore constituting an ethical demand. (shrink)

Following the successful cloning of genes for mostly rare genetic diseases in the early 1990s, there was a nearly universal enthusiasm that similar approaches could be employed to hunt down genes predisposing people to complex diseases. Around 1996, several well-funded international gene-hunting teams, enticed by the low cost of collecting biological samples and China’s enormous population, and ushered in by some well-connected Chinese intermediaries, came to China to hunt down disease susceptibility genes. This alarmed and, in some cases, enraged many (...) poorly funded Chinese scientists, who perceived them as formidable competitors. Some depicted foreign gene-hunters as greedy pilferers of the vast Chinese genetic gold mine, comparing it to the plundering of national treasures from China by invaders in the past, and called upon the government and their fellow countrymen to rise up and protect China’s genetic gold mine. Media uproar ensued, proclaiming the imminent “gene war of the century.” This article chronicles the key events surrounding this “war” and its aftermath, exposes some inherent complexities in identifying susceptibility genes for complex diseases, highlights some issues obscured or completely overlooked in the passionate and patriotic rhetoric, and debunks some misconceptions embedded in this conflict. In addition, it argues that during the entire course of this “war,” the public’s interest went conspicuously unmentioned. Finally, it articulates several lessons that can be learned from this conflict, and outlines challenges facing human genetics researchers. (shrink)

This research examines the effect of an individual difference variable that reflects the extent to which one desires positive evaluations from others—that is, face consciousness on consumer energy-saving behavior—as well as the mechanism through which the effect occurs and conditions under which it varies. Drawing upon the means-end theory of lifestyles, we propose that face consciousness increases a status-seeking lifestyle and thus decreases energy-saving behavior. Moreover, the negative relationship between status-seeking lifestyle and energy-saving behavior is contingent upon a perceived seriousness (...) of environmental problems and perceived environmental responsibility, such that the indirect and negative effect of such face consciousness is stronger for consumers who perceive less serious environmental problems and less environmental responsibility. Results from an experimental study and a field study using samples of Chinese consumers provide consistent evidence for the hypothesized model. Theoretical and practical implications for energy-saving behavior are also discussed. (shrink)

Public welfare fundraising has been used to collect donations for medical supplies and has played an important role in the fight against the COVID-19 pandemic. This paper studies online crowdfunding donations from the Alumni Association of Wuhan University to North American alumni; donation data are used to investigate how individuals' donation behavior is affected by the previous donation amount and information provided by the fundraising platform. First, our results show that one's donation amount is positively affected by the previous donation (...) amount. Second, the donor's positive sentiment in the message that he or she leaves, as measured by either natural language processing or a manual rating, can affect the subsequent anonymity and messages but not the subsequent donation amount. ObjectiveThe objective of the study was to explore the relationship between social support and fatigue as well as the mediating role of social functioning on that relationship.BackgroundPsychosocial factors such as social support and social functioning may influence patients’ fatigue symptoms. There is limited evidence on the relationship between social support, social functioning, and fatigue in liver transplant recipients.MethodsA total of 210 patients with liver transplants from two tertiary hospitals were enrolled in the current study. Questionnaires used include one for general (...) demographic data, the Perceived Social Support Scale, Social Disability Screening Schedule, and Fatigue Symptom Inventory.ResultsA total of 126 recipients reported fatigue. Gender, residence, BMI, and liver function were the primary factors affecting fatigue. Social support was positively correlated with social functioning and was negatively correlated with fatigue. The effect of social support on fatigue was partially mediated by social functioning.ConclusionThe fatigue of liver transplant recipients should be attended to. The higher the social support, the lower the fatigue of liver transplant recipients. Social support may also reduce fatigue through social functioning. The liver transplant team should help the liver transplant recipient establish a social support system, restore social functioning, and reduce fatigue symptoms. (shrink)

As one of the key technologies for accelerating the construction of the ubiquitous Internet of Things, demand response not only guides users to participate in power market operations but also increases the randomness of grid operations and the difficulty of load forecasting. In order to solve the problem of rough feature engineering processing and low prediction accuracy, a short-term load forecasting model of LSTM neural network considering demand response is proposed. First of all, in view of the strong randomness and (...) complexity of input features, the weighted method is used to process multiple input features to strengthen the contribution of effective features and tap the potential value of features. Secondly, an improved genetic algorithm is used to obtain the best LSTM parameters; finally, the special gate structure of the LSTM model is used to selectively control the influence of input variables on the model parameters and perform load forecasting. The experimental results show that the research has high prediction accuracy and application value and provides a new way for the development of power load forecasting. (shrink)

With the rapid expansion of parameters in large language models (LLMs) and the application of Reinforcement Learning with Human Feedback (RLHF), there has been a noticeable growth in the moral competence of LLMs. However, several questions warrant further exploration: Is it really possible for LLMs to fully align with human values through RLHF? How can the current moral growth be philosophically contextualized? We identify similarities between LLMs’ moral growth and Deweyan ethics in terms of the discourse of human moral development. (...) We then attempt to use Dewey’s theory on an experimental basis to examine and further explain the extent to which the current alignment pathway enables the development of LLMs. A beating experiment serves as the foundational case for analyzing LLMs’ moral competence across various parameters and stages, including basic moral cognition, moral dilemma judgment, and moral behavior. The results demonstrate that the moral competence of the GPT series has seen a significant improvement, and Dewey’s Impulse-Habit-Character theory of moral development can be used to explain this: the moral competence of LLMs has been enhanced through experience-based learning, supported by human feedback. Nevertheless, LLMs’ moral development through RLHF remains constrained and does not reach the character stage described by Dewey, possibly due to their lack of self-consciousness. This fundamental difference between humans and LLMs underscores both the limitations of LLMs’ moral growth and the challenges of applying RLHF for AI alignment. Comparative syllogism is a type of scientific reasoning widely used, explicitly or implicitly, for inferences from observations to conclusions about effectiveness, but its philosophical significance has not been fully elaborated or appreciated. In its simplest form, the comparative syllogism derives a conclusion about the effectiveness of a factor (e.g. a treatment or an exposure) on a certain property via an experiment design using a test (experimental) group and a comparison (control) group. Our objective is to show that the comparative syllogism (...) can be understood as encoding a simulation view of counterfactuals, in that counterfactual situations are conceptual constructs that can be correctly simulated by homogeneous comparison groups. In this simulation view, the empirical data from the comparison groups play an evidential role in the evaluation of counterfactuals and in obtaining counterfactual knowledge. We further indicate how successful experimental designs can help us to obtain correct simulations, and thus to bring us to scientifically-empirically based counterfactual knowledge. (shrink)

While substantial progress has been made in the field known as artificial consciousness, at the present time there is no generally accepted phenomenally conscious machine, nor even a clear route to how one might be produced should we decide to try. Here, we take the position that, from our computer science perspective, a major reason for this is a computational explanatory gap: our inability to understand/explain the implementation of high-level cognitive algorithms in terms of neurocomputational processing. We explain how addressing (...) the computational explanatory gap can identify computational correlates of consciousness. We suggest that bridging this gap is not only critical to further progress in the area of machine consciousness, but would also inform the search for neurobiological correlates of consciousness and would, with high probability, contribute to demystifying the “hard problem” of understanding the mind–brain relationship. We compile a listing of previously proposed computational correlates of consciousness and, based on the results of recent computational modeling, suggest that the gating mechanisms associated with top-down cognitive control of working memory should be added to this list. We conclude that developing neurocognitive architectures that contribute to bridging the computational explanatory gap provides a credible and achievable roadmap to understanding the ultimate prospects for a conscious machine, and to a better understanding of the mind–brain problem in general. In this essay we explore extensive modes of enactive engagement among humans, physical and computational media richer than the modes represented by classical notions of interaction and relation. We make use of a radically material and a potential-theoretic account of event to re-conceive ad hoc, non-pre-schematized activity in responsive environments. We can regard such activity as sense-making via dehomogenization of material that co-articulates subjects and objects.

Given the current popularization of computer programming and the trends of informatization and digitization, colleges have actively responded by making programming lessons compulsory for students of all disciplines. However, students from different ethnic groups often have different learning responses to such lessons due to their respective cultural backgrounds, the environment in which they grew up, and their consideration for future employment. In this study, an AI-assisted programming module was developed and used to compare the differences between multi-ethnic college students in (...) terms of their theoretical and actual learning expectancy, motivation, and effectiveness. The module conducted analysis through the deep learning network and examined the relevant processes that the students underwent during programming lessons, as well as the types of errors they had committed. Their learning motivation for and actual learning performance in programming were then examined based on the cognitive learning theory. The results of the experiment, which involved 96 multi-ethnic college students, indicated that the two groups had dissimilar theoretical performance in terms of their expectancy and motivation for learning programming. The indigenous students’ main concern was whether programming would affect their families or tribes, and this concern affected and was reflected in their learning outcomes. In contrast, the learning motivation and goals of Han Chinese students were driven by the cognition of the value of programming to themselves. The research findings can contribute toward the cognition and understanding of multi-ethnic students when learning computer programming and development of the appropriate teaching methods, and serve as a reference for subsequent research on integrating multiculturalism into computer programming lessons. Despite intensive debates regarding action imitation and sentence imitation, few studies have examined their relationship. In this paper, we argue that the mechanism of action imitation is necessary and in some cases sufficient to describe sentence imitation. We first develop a framework for action imitation in which key ideas of Hurley’s shared circuits model are integrated with Wolpert et al.’s motor selection mechanism and its extensions. We then explain how this action-based framework clarifies sentence imitation without a language-specific faculty. The aim of this study was to investigate the use of a newly developed design game called BLOCKS to stimulate awareness of ethical responsibilities amongst engineering students. The design game was played by seventeen teams of chemical engineering students, with each team having to arrange pieces of colored paper to produce two letters each. Before the end of the game, additional constraints were introduced to the teams such that they faced similar ambiguity in the technical facts that the engineers involved (...) in the Challenger disaster had faced prior to the space shuttle launch. At this stage, the teams had to decide whether to continue with their original design or to develop alternative solutions. After the teams had made their decisions, a video of the Challenger explosion was shown followed by a post-game discussion. The students’ opinion on five Statements on ethics was tracked via a Five-Item Likert survey which was administered three times, before and after the ethical scenario was introduced, and after the video and post-game discussion. The results from this study indicated that the combination of the game and the real-life incident from the video had generally strengthened the students’ opinions of the Statements. (shrink)

Extant studies on private regulation have not reached a sufficient understanding about the interplay between private and public regulations, due to underdeveloped theoretical framework and the lack of large-sample empirical investigations. Leveraging ISO 14001 adoption among Chinese firms as the research context, the current research draws on the institutional theory to examine how firm’s adoption of ISO 14001 standard, as a specific form of private regulation, affects the incidence of public environmental inspections. To test our arguments, we conduct two empirical (...) studies. Study 1 uses the first-hand data of a corporate social responsibility survey on Chinese manufacturing firms, whereas Study 2 deploys the second-hand longitudinal archival data of the government environmental inspections on Chinese listed firms. Both of the two studies reveal consistent findings that ISO 14001 adoption decreases the incidence of government environmental inspections, and that the effect of ISO 14001 adoption becomes stronger in state-owned enterprises and firms with top management team’s political ties. Our findings are suggestive of a complementary relationship between private and public regulations, in a sense that private regulations can compensate for the weaknesses of public regulations by offering faster, more flexible and cost-efficient means of enforcement, which allows the public authorities to economize on the deployment of public resources to monitor the rest non-compliant firms. This paper investigates the applicability of reliabilism to scientific knowledge, and especially focuses on two doubts about the applicability: one about its difficulty in accounting for the epistemological role of scientific instruments, and the other about scientific theories. To respond to the two doubts, we extend virtue reliabilism, a reliabilist-based virtue epistemology, with a distinction of two types of epistemic virtues and the extended mind thesis from Clark and Chalmers (Analysis 58:7–19, 1998 ). We also present a case study on (...) the quantitative research methodology of social sciences to show that the methodology is actually an extended virtue reliabilism on how social science instruments and theories contribute to the formation of social scientific knowledge. The logical intuition hypothesis proposes a difference in the strength between logical and heuristic intuitions. The labels of logical and heuristic intuitions are exclusive to conventional reasoning research. This paper reports the result of testing intuition strength using the dot-probe methodology in a novel multiplication paradigm. Here, “logical intuition” and “heuristic intuition” were relabeled as “weaker intuition” (-1 × 5 = 5) and “stronger intuition” (1 × 5 = 5), respectively, to assess the assumptions about the difference in the strength (...) of “Chinese multiplication mnemonics” intuitions. The dot-probe paradigm was utilized in the following experiments to measure attentional bias. This was assessed by calculating the difference in reaction time between incongruent (the target location is opposite to the probe location) and congruent (the target location is the same as the probe location) conditions. Experiment 1 found attentional bias directed attention to the correct answer for both weaker and stronger intuitions. Experiment 2 replicated and extended Experiment 1 with a secondary task to manipulate high and low cognitive loads. Consequently, stronger intuitions were unaffected by cognitive load and participants were biased toward the correct answer, whereas attentional bias for weaker intuitions only occurred in low load conditions. These results revealed that although both intuitions can guide attention, stronger intuition may guide attention bias in a high-load situation due to its robust automation. Our findings extend the logical intuition hypothesis that proposes a difference in the automated strengths of intuitions to mathematical and analytic thinking. (shrink)

ObjectivesIndividuals with irregular physical activity participation are defined as fluctuators. This study aimed to comprehend how fluctuators’ perceived barriers and motivators in their subjective theories are exhibited and cognitively represented in relation to their everyday PA practices and lapses.MethodsThe design of “Research Program Subjective Theories” was used to explore and present fluctuators’ cognition concerning PA participation. Thirty fluctuators were invited to a semi-structured interview. By inductive and deductive coding, fluctuators’ verbal data were converted into word categories for extracting commonalities and (...) comparing differences. By retaining the remaining word categories of high frequency and exploring the interrelationships among the remained word categories using statistical analyses, a superstructure including fluctuators’ main PA motivators, barriers, and behavioral outcomes was compiled.ResultsFluctuators face common motivators as barriers, such as lack of time, lack of willpower, lack of social support, and physical reasons. Fluctuators’ subjective theories primarily differed in motivational configurations. The physically motivated fluctuators were more linked with low PA level, while the mixed motivated fluctuators were more likely associated with moderate PA level. The exemplars of the three typical fluctuators were also demonstrated to reveal their real experiences and situations in the daily life context.ConclusionDue to the fact that fluctuation research is still in its infancy, this study represents a significant opportunity to promote knowledge growth in this area. Future studies are recommended to convert findings of the present study into interventions that benefit fluctuators in overcoming perceived barriers and enhancing motivations to eventually participate in regular PA. In recent years, somatosensory interaction technology, represented by Microsoft’s Kinect hardware platform, has been widely used in various fields, such as entertainment, education, and medicine. Kinect technology can easily capture and record behavioral data, which provides new opportunities for behavioral and psychological correlation analysis research. In this paper, an automatic decision-style recognition method is proposed. Experiments involving 240 subjects were conducted to obtain face data and individual decision-making style score. The face data was obtained using the Kinect camera, and the (...) decision-style score were obtained via a questionnaire. To realize automatic recognition of an individual decision-making style, machine learning was employed to establish the mapping relationship between the face data and a scaled evaluation of the decision-making style score. This study adopts a variety of classical machine learning algorithms, including Linear regression, Support vector machine regression, Ridge regression, and Bayesian ridge regression. The experimental results show that the linear regression model returns the best results. The correlation coefficient between the linear regression model evaluation results and the scale evaluation results was 0.6, which represents a medium and higher correlation. The results verify the feasibility of automatic decision-making style recognition method based on facial analysis. (shrink)

This study applies the concept of reported speech advanced by the renowned Russian literary scholar Mikhail Bakhtin to compare the argumentative styles of Mainland China and Taiwan. These societies in question are considered by many scholars as sharing the same argumentative style. The study reports that the Mainland debaters more frequently than the Taiwanese debaters maintained the authenticity of the quotations cited from ancient Confucian sources, whereas Taiwanese debaters paraphrased more frequently. On the other hand, this difference cannot be found (...) when debaters quoted from sources other than Ancient Confucians. The findings, according to Bakhtin, imply a contrast of monologic and dialogic tendencies toward authority, which results in a style difference between Mainland and Taiwan argumentation. (shrink)

Discovering high-utility itemsets (HUIs) consists of finding sets of items that yield a high profit in customer transaction databases. An important limitation of traditional high-utility itemset mining (HUIM) is that only the utility measure is used for assessing the interestingness of patterns. This leads to finding several itemsets that have a high profit but contain items that are weakly correlated. To address this issue, this paper proposes to integrate the concept of correlation in HUIM to find profitable itemsets that are (...) highly correlated, using the all-confidence and bond measures. An efficient algorithm named FCHM (fast correlated high-utility itemset miner) is proposed to efficiently discover correlated high-utility itemsets (CHIs). Two versions of the algorithm are proposed: FCHM|$_{all\text{-}confidence}$| and FCHM|$_{bond}$|⁠, which are based on the all-confidence and bond measures, respectively. An experimental evaluation was done using four real-life benchmark datasets from the HUIM literature: mushroom, retail, kosarak and foodmart. Results show that FCHM is efficient and can prune a huge amount of weakly CHIs. (shrink)

Since the 1980s, psychoanalysis and psychotherapy have attracted great interest in Chinese society, and in parallel, the psychotherapist as a character has emerged in Chinese literature. Through four novels by three Chinese authors, namely, Xu Xiaobin 徐小斌, Ke Yunlu 柯云路, and Bi Shumin 毕淑敏, this article studies the evolution of the image of the psychotherapist in contemporary Chinese literature, which reflects the reception of psychoanalysis as well as the development of psychotherapy in China. In Xu Xiaobin’s novel, two psychology students (...) attempt to cure a psychotic patient through “transference therapy” based on a complete misunderstanding of the notion; Ke Yunlu features a “life counselor” who, like typical good counselors in Chinese classical novels, simply gives advice without caring about the patients’ needs and desires; and the two novels by Bi Shumin show a significant change in the writer’s understanding of the profession and therapeutic methods, as well as the current, unregulated situation of psychotherapy in China. With the popularization of mobile Internet and smart terminals, mobile reading with diversity and mobility has become a hot issue in the industry and academia. This article comes up with a hypothetical model of mobile reading user acceptance behavior based on the technology acceptance model and unified theory of acceptance and use of technology and conducts an analysis of the reliability and validity of questionnaire data. Based on this, the model fitness is analyzed as well as the path hypotheses testing. (...) We find that user-perceived ease of use greatly influences perceived usefulness, and user attitude and behavioral intention are significantly impacted by perceived usefulness. The impact of social influence on user attitude toward using mobile reading is significant, but the influence of perceived payment is not obvious. The moderating effect of living habit is not obvious because the absolute value of the critical ratio is under 2.58 with a significance level of 0.01. (shrink)

The existing fuzzy rough set models all believe that the decision attribute divides the sample set into several “clear” decision classes, and this data processing method makes the model sensitive to noise information when conducting feature selection. To solve this problem, this paper proposes a robust fuzzy rough set model based on representative samples. Firstly, the fuzzy membership degree of the samples is defined to reflect its fuzziness and uncertainty, and RS-FRS model is constructed to reduce the influence of the (...) noise samples. RS-FRS model does not need to set parameters for the model in advance and can effectively reduce the complexity of the model and human intervention. On this basis, the related properties of RS-FRS model are studied, and the sample pair selection algorithm based on RS-FRS is used for feature selection. In this paper, RS-FRS is tested and analysed on the open 12 datasets. The experimental results show that RS-FRS model proposed can effectively select the most relevant features and has certain robustness to the noise information. The proposed model has a good applicability for data processing and can effectively improve the performance of feature selection. (shrink)

About 20 years ago, the ecology of media art practices proliferated in two domains: those that attached themselves to high technology labs or companies like Xerox PARC, and those that took advantage of personal computing to form collectives only loosely coupled to academic institutions or disciplines. In this essay, I closely examine the diverse epistemic cultures and diverse technical, political, and generational interests in such “cyber-anarchist” networks. I sketch the economy of knowledge in recent media arts and technology communities of (...) practice in the wake of Open Source. I use as my lens the experience of creating a responsive media space called the TGarden, with a collective that gathered more than 26 artists and engineers from 11 institutions and 7 nations. (shrink)
