What kind of moral principle could be sufficiently restrictive to avoid the kind of large-scale risks that have resulted in catastrophe in the past, while at the same time not be so restrictive as to halt desirable progress? Is there such a principle that is not merely a precautionary principle, but one that could be based on firm moral grounds? In this article, I set out to explore a simple idea: might it be the case that reparability could serve as (...) a moral constraint against risky policy decisions? The idea is simple, but comes in two forms. First, that it is morally wrong to impose a risk for harm that is, in principle, irreparable, such that it would bring about a permanent loss of a kind qua kind. Second, that it is morally wrong to impose a risk for a reparable (but not compensable) harm that exceeds what realistically could be repaired. I set out here to do two things. First, I describe the moral problem to be addressed for any principle-guiding decisions about risk. A central claim in this article is that risk decisions are epistemically impaired decisions, and that we must, alongside outcome uncertainty, also take both epistemic uncertainty and moral uncertainty into account. Second, I introduce the idea of reparability as a moral constraint in the form of two versions of the Reparability Principle. Such a principle, I argue, could have some interesting advantages that seem both morally intuitive and that come with some advantages against some of the epistemic challenges posed by risk impositions. Various authors hold that what is wrong with risk imposition is that being at risk diminishes the opportunities available to an agent. Arguably, even when risk does not result in material or psychological damages, it still represents a setback in terms of some legitimate interests. However, it remains to be specified what those interests are. This article argues that risk imposition represents a diminishment of overall freedom. Freedom will be characterized in empirical terms, as the range of unimpeded (...) actions available to an agent. After briefly outlining the main characteristics of overall freedom as defended by Hillel Steiner and Ian Carter, the article shows that this notion is able to capture many of our intuitions about when and how risk imposition disadvantages an agent, without reference to welfare indicators. The article argues that if this non-welfarist perspective can be defended, then it would be easier to approach a number of applied questions about risk, including the questions of when risk imposition is permissible or legitimate, in which ways risk can be an object of distributive justice and how one can be compensated for being subject to a risk. According to Jonathan Quong’s _moral status account_ of liability to defensive harm, an agent is liable to defensive harm only when she mistakenly treats others as if their moral status is diminished (for example, as if they lack a right that they in fact possess). Quong argues that, by the lights of the moral status account, a conscientious driver (Driver) who faultlessly threatens to kill Pedestrian is not liable to defensive harm. Quong argues that Driver’s action is evidence-relative permissible, despite (...) the risks it imposes, because the general practice of prudent driving is permissible. The practice is permissible because (a) its risks do not disproportionately fall on some groups rather than others, (b) the threatened harms are incidental, and (c) the risk that driving imposes is acceptable in light of the benefits everyone derives from driving. Because the correct moral theory tells us that prudent driving is permissible, Pedestrian lacks a right that Driver refrain from driving. Hence, Driver does not, by driving, treat Pedestrian as lacking a right that Pedestrian in fact possesses. Driver is not liable to defensive force. I argue, against Quong, that cost–benefit analyses of types of risky activity cannot justify individual tokens of risk imposition. Actions that risk incidentally harming others must be justified by the prospective benefits of that token action. Hence, Driver’s imposition of risk on Pedestrian cannot be justified by the benefits of the general practice of driving. I argue that the permissibility of Driver’s imposing risk on Pedestrian via prudent driving turns on whether Driver is willing to internalise at least the foreseeable costs of that risky action. One can lack a right that a person refrain from performing a risky action whilst possessing a right not to be harmed by that risky action. Even if Pedestrian cannot reasonably demand that Driver refrain from driving, she can reasonably demand that Driver refrain from forcing her to bear the costs of his driving. (shrink)

Suppose you perform two actions. The first imposes a risk of harm that, on its own, would be excessive; but the second reduces the risk of harm by a corresponding amount. By pairing the two actions together to form a set of actions that is risk-neutral, can you thereby make your overall course of conduct permissible? This question is theoretically interesting, because the answer is apparently: sometimes Yes, sometimes No. It is also practically important, because it bears on the moral (...) status of practices such as offsetting personal greenhouse gas (GHG) emissions. In this article we propose a criterion for distinguishing between cases where pairing risk-increasing and risk-reducing actions makes each action permissible, and those where it does not: the Principle of Aggregate Risk-Imposition. We work towards this by considering a range of examples that illustrate various illegitimate ways of pairing risk-increasing actions with risk-reducing ones, and asking what goes wrong in each case. We then use this criterion to evaluate GHG offsetting. Is offsetting a legitimate way of removing the risk-imposition associated with GHG emissions, or not? Controversially, we argue that this turns out to depend on the form that the offsetting takes. (shrink)

This article investigates the question of why there is emotional resistance to research results such as the theory of evolution and to philosophical naturalism. A depiction of how this emotional resistance expresses itself is followed by a brief account of the core theses of philosophical naturalism. The emotional reactions to research results then are differentiated from reactions to philosophical naturalism and a first overview of the irritant positions of naturalism is given. The article investigates the resources of contractualist moral theory to make sense of the ethics of risk imposition. In some ways, contractualism seems well placed to explain how it can be reasonable to accept exposure to risk of harms whose direct imposition would not be acceptable. However, there are difficulties getting clear about what directness comes to here, especially given the difficulty of adequately motivating traditional views that assign ethical significance to what the agent intends as opposed to (...) merely foreseeing. The article considers two principles which might help the contractualist: the Redistribution Principle, which, while attractive, is perhaps somewhat too restrictive, and the Aim Consistency Principle, which grants ethical significance to the aims with which our actions are in principle consistent whatever our actual intentions may be. The article also considers the relative significance of ex ante and ex post perspectives from which to evaluate actions and principles. In the article “An Argument for Standardized Ethical Directives for Secular Healthcare Services,” Abram L. Brummett and Jamie C. Watson argue that, parallel to the directives of the Roman Catholic Church, secular healthcare ethics consultants (HECs) need substantive standardized ethical guidelines (what they call SEGs) that would constitute a best practice across all HECs in the U.S. Brummett and Watson believe that the absence of such directives constitutes an important deficit in clinical ethics consultation (CEC) that needs to be rectified (...) in order for consultation to achieve the professionalism and universality necessary for legitimacy. In this paper I examine the prospects for a rights-based approach to the morality of pure risk-imposition. In particular, I discuss a practical challenge to proponents of the thesis that we have a right against being imposed a risk of harm. According to an influential criticism, a right against risk-imposition will rule out all ordinary activities. The paper examines two strategies that rights theorists may follow in response to this “Paralysis Problem”. The first strategy introduces a threshold for (...) when a risk-imposition is a rights violation. The second strategy drops the claim that rights are absolute and maintains that all rights infringements generate compensation duties. It is argued that both strategies face significant practical problems of their own and that the Paralysis Problem seems fatal for a right against risk-imposition in the absence of an adequate account of the morally relevant threshold risk. Existing accounts of social insurance tend to treat social risks as given and ask whether it is justified for the state to deal with these risks for its citizens. They ignore that many common risks are in fact imposed on citizens as a byproduct of the institutional choices of the society, which call for justification in the first place. In this paper, I use the Scanlonian contractualist framework to develop an account of just social risk imposition which implies a (...) demand for fair risk sharing by all members of a society. In particular, I defend a compensation principle which requires that compensation be paid to victims of risk materialisation. This duty of paying should be shared by all those who benefit from the imposition of the relevant risk. I suggest that this provides a case for social insurance as a way of fairly sharing the burden of social risks. (shrink)

Where artificial agents are not liable to be ascribed true moral agency and responsibility in their own right, we can understand them as acting as proxies for human agents, as making decisions on their behalf. What I call the ‘Moral Proxy Problem’ arises because it is often not clear for whom a specific artificial agent is acting as a moral proxy. In particular, we need to decide whether artificial agents should be acting as proxies for low-level agents — e.g. individual (...) users of the artificial agents — or whether they should be moral proxies for high-level agents — e.g. designers, distributors or regulators, that is, those who can potentially control the choice behaviour of many artificial agents at once. Who we think an artificial agent is a moral proxy for determines from which agential perspective the choice problems artificial agents will be faced with should be framed: should we frame them like the individual choice scenarios previously faced by individual human agents? Or should we, rather, consider the expected aggregate effects of the many choices made by all the artificial agents of a particular type all at once? This paper looks at how artificial agents should be designed to make risky choices, and argues that the question of risky choice by artificial agents shows the moral proxy problem to be both practically relevant and difficult. We frequently engage in activities that impose a risk of serious harm on innocent others in order to realise trivial benefits for ourselves or third parties. Many moral theories tie the evidence-relative permissibility of engaging in such activities to the size of the risk that an individual agent imposes. I argue that we should move away from such a reliance on quantified individual risks when conceptualising morally permissible risk imposition. Under most circumstances of interest, a conscientious reasoner will identify (...) a gap between the factors they deem potentially relevant to the riskiness of an agent’s behaviour, and the factors they are reasonably able to quantify. This then leads a conscientious reasoner to conclude that they cannot, in good faith, come up with a quantitative risk estimate that is genuinely tailored to the agent’s particular situation. Based on this, I argue that principles of morally permissible risk imposition fail to provide us with practical guidance if they ask us to take into account our agent-specific risks in a quantified manner. I also argue that principles of permissible risk imposition which appeal to quantified individual risks implausibly imply that it is frequently indeterminate whether engaging in some risky activity is morally permissible. For both of these reasons, I contend that principles of morally permissible risk imposition should make no reference to quantified individual risks. They should instead acknowledge that any quantitative estimates that an agent might usefully be able to consider will likely not be tailored to the agent’s idiosyncratic situation. (shrink)

One of the issues covered by Muʿtazila’s idea of justice is the subject of the imposition of moral obligation (taklīf). The concept of the obligation (taklīf), which expresses that God imposes some difficult acts on His servants and asks them to fulfill them, is important because it explains God’s justice for His servants and His wisdom in creating them. For this reason, the main emphasis in the matter of imposition has been on the veneration of the servants and (...) rendering benefits to them in return for imposition. As a matter of fact, God offers His servants such a reward that it is not possible to achieve with anything other than obligation. This article presents examples of hypothetical obligations emphasizing the same issue. Al-taklīf al-zāid is an additional imposition period meaning that God does not end the life that he determines for the morally obliged (mukallaf), but prolongs the life of the servant in such a way that changes the result of his imposition. In Muʿtazilite thought, the issue of the additional imposition basically takes place in the form of two separate discussions about unbeliever and believer. While the additional imposition of the unbeliever deals with the situation of the unbeliever who is known to believe when his imposition (or life) is prolonged; the additional imposition of believer deals with the situation of the believer who is known to disbelieve when his imposition (or life) is prolonged. Abū ʿAli thinks that it is obligatory (wajib) for God to keep this unbeliever alive when it is known that he would come to believe if He did not kill him and his imposition had been prolonged. His argument in this regard is his thought that the additional imposition is a favour (lutf) for the unbeliever to believe. Abū Hāshim, on the other hand, says that it is not obligatory for God to prolong the imposition of unbeliever in such a situation, and that it would be good (hasan) to kill the unbeliever, even though it is known that he would have believed if his imposition had been prolonged. Because, according to Abū Hāshim, God already gave the unbeliever the opportunity to attain rewards in his first imposition. The unbeliever reached this end because he made a wrong choice in his imposition and it cannot be obligatory for God to re-present the circumstances that will change this outcome. According to him, the additional imposition of an unbeliever is not a favour (lutf), but it is like the enabling to act (tamkīn) and is not obligatory. As for the additional imposition of a believer, Abū ʿAli, Abū Hāshim and the Bahshamites agree that it is good to prolong the imposition of the believer who is known to be an unbeliever if his imposition was prolonged. The reason for their view is that God has endowed the servant with a reward, which would otherwise be unattainable, in return for the prolonged imposition. However, the Husaynites believe that prolonging the imposition of believer in this situation would not be good. Because the believer deserves a reward for his first imposition and in this case, his additional imposition will be a corruption (mafsada) for him. As a result of these different views, when we look generally, it is seen that the main concern in Muʿtazilite thought is to make the most appropriate decision for the benefit of the servant in all the impositions that God has imposed and is likely to impose. The Bahshamites have always prioritized offering more rewards to the servant. However, Abū ʿAli regarding the additional imposition of the unbeliever, and the Husaynites regarding the additional imposition of believer, prioritized the imposition’s resulting in belief, and they thought that it was more suitable for the benefit of the servant. Since the purpose of the imposition in Muʿtazilite thought is to provide the opportunity to attain the degrees that it could never been reached in any other way, regardless of the outcome, it should be said that the views of the Bahshamites on both additional obligations are more consistent within the general system of Muʿtazila. There is a clear need for interventions that reduce moral distress among healthcare providers (HCPs), given the high prevalence of moral distress and the far-ranging negative consequences it has for them. Healthcare ethics consultants are frequently called upon to manage moral distress, especially among nursing staff. Recently, researchers have both broadened the definition of moral distress and demarcated subcategories of the phenomenon with the intent of creating more targeted and effective interventions. One of the most frequently occurring subcategories of moral (...) distress in this new taxonomy has been labeled “moral-constraint distress,” though scholars have argued that not all constraints on HCPs’ moral agency are inappropriate given the often-competing healthcare values of patients, families, and clinical staff. To attempt to reduce the instances of moral distress in cases in which the constraints on HCPs’ moral agency are justified, we propose an intervention that focuses on shifting the HCPs’ “frame of reference” on moral-constraint distress, teaching HCPs how to distinguish unjustified and justified constraints on their moral agency. The anchors of this blueprint for reducing moral-constraint distress are the philosophical concepts of “values pluralism” and “values imposition.” The rationale for this intervention is that, in situations where the constraint on moral agency is justified but the experience of moral distress could nevertheless be severe, the emphasis needs to be on helping the HCP to “think differently” rather than “act differently.”. A particular amount of punishment is justified if and only if that amount of punishment is deserved and the desert claim is not overridden. In the case of some multiple murderers or people who perform serious violent acts in addition to murder, the deserved punishment must involve torture. I argue that this legitimate desert claim is not overridden by objections based on notions of brutality and inhumanity, the Kantian concern that persons be treated as ends, the intuitive distaste that many (...) persons have for torture, the negative consequences of institutionalized torture, the concern for bias in the imposition of punishment, and the need for accuracy in measuring harms. Can a disastrous policy of illegally invading and occupying a distant country without a legitimate casus belli nevertheless have some good as its unintended consequence? Yes, but one should not generally count on it.

The COVID-19 global pandemic has shone a light on several important ethical questions, ranging from fairness in resource allocation to the ethical justification of government mandates. In addition to these institutional issues, there are also several ethical questions that arise at the interpersonal level. This essay focuses on several of these issues. In particular, I argue that, despite the insistence in public health messaging that avoiding infecting others constitutes ‘saving lives’, virus transmission that results in death constitutes an act of (...) killing. Whether this killing is wrongful depends on several factors. I consider one intuitively plausible view—namely, that in many cases, killing via unintentional transmission is not wrongful, because the parties in question have implicitly waived their rights against this harm, often via reciprocal risk imposition. I argue that this view is mistaken, but that its central insight can be better captured by identifying the appropriate standards of blame that we ought to apply during a pandemic. I conclude by showing how these conclusions can be fruitfully applied to certain institutional questions, such as helping to justify restricting government mandates. (shrink)

This paper examines whether an agent becomes liable to defensive harm by engaging in a morally permissible but foreseeably risk-imposing activity that subsequently threatens objectively unjustified harm. It first clarifies the notion of a foreseeably risk-imposing activity by proposing that an activity should count as foreseeably risk-imposing if an agent may morally permissibly perform it only if she abides by certain duties of care. Those who argue that engaging in such an activity can render an agent liable to defensive harm (...) ground this liability in the luck egalitarian thought that we may justly hold individuals responsible for the consequences of their voluntary choices. Against this, I argue that a luck egalitarian commitment to holding people responsible cannot, by itself, ground liability to defensive harm. It can help ground such liability only against the backdrop of a distributively just society, and only if further considerations speak morally in favour of attaching certain well-defined costs to individuals’ risk-imposing choices. I conclude by suggesting that if an account of liability applies robustly across distributively just and unjust contexts alike, then what grounds an agent’s liability is plausibly not her responsibility for threatening objectively unjustified harm, but her culpability for doing so. In his book Making the Social World, John Searle gives voice to an aspiration that is very popular in social ontology. This aspiration consists in the notion that social objects can be reduced to physical objects. From this perspective, social objects are nothing more than physical objects on which we impose functions that are merely subjective and therefore external to them. Now, my paper has two objectives. In the first part, I want to show that Searle’s account entails some sort (...) of interpretationism that gets into difficulties once we reflect on his essential notion of imposition. In the second part of my paper, I want to sketch a Wittgensteinian point of view that allows us to describe our relation to social objects without being committed to the flawed model of interpretationism and to its metaphysical assumptions. Journal of International Political Theory, Ahead of Print. The contemporary international regime of law and politics regarding human migration largely follows Immanuel Kant’s contradictory approach, supporting the cosmopolitical rights of humans to move and expect hospitality while privileging the rights of sovereign states to assert territorial security against movement. International Relations scholars informed by Jacques Derrida’s ethical theory argue that one may press this tension to positive dynamics through affirmation of the aporia that a secured home is a requirement for (...) the possibility of the hospitality that might undo conflict between migrants and emplaced citizens. Yet, the attraction of Derrida’s critical Kantianism and this revival of hospitality depends on asserting the primacy of habitation to how citizen subjects stand with respect to foreigners who move. It depends on neglecting how any assumption of home is not based on a given home but, rather, on movements to impose the boundaries and bounty of a home. No one faces the movement of others who seek to make home from the position of home but only also in movements of homemaking. Both the citizen and the migrant move in forms of imposition. And it is only in a politics of imposition that rights to move can be affirmed and gain respect. (shrink)

Research in the fields of pragmatics has highlighted important differences in speech act realisation strategies and the perception of contextual variables across lingua-cultures. This particularly applies for requests, which are potentially face-threating acts and important expressions of cultural behaviour, as their performance is influenced by culturally-embedded perspectives on rights and obligations. Although some languages have been widely investigated in terms of request realisation, such as English, little research has been done on Italian. This study examines request realisation strategies in Italian, (...) in terms of Head Acts and request perspective, and the impact of the sociopragmatic factors of social distance and weight of imposition of the request on strategy choice amongst eight Italian speakers, by means of open-ended roleplays. The data was analysed by using a coding scheme based on Blum-Kulka and Olshtain and revealed that the Italian speakers where more influenced by social distance, which in turn impacted on the choice of request perspective. They were shown to prefer using hearer-orientation, which reflected in the verb conjugation of the Head Acts, since this perspective allows them to do relational work with the hearer, by either addressing the recipient with the familiar tu or with the formal lei. In this article, I argue for a distinct and novel right-based account of risks and I call it the Sophisticated High-risk Thesis. I argue that there is a distinction between rights-infringing risk impositions and no-rights-infringing risk impositions. An action imposing a high risk of harm infringes rights, whereas an act imposing a low risk of harm does not. I also suggest three principles that govern the permissibility of highly risky actions. If a highly risky action meets the conditions specified by (...) any of these three principles, it can be justified. These principles are the consent principle*, the prevent disaster principle* and the reciprocity principle**. I show that the Sophisticated High-risk Thesis is, in general, better than the alternative Risk Thesis defended by McCarthy. (shrink)

Postcolonial theoretical examinations on the translation of the Bible in Africa have revealed the systematic process of domination and restructuring of the worldview of Africans. The colonial agenda that coloured the missiological thrust influenced the choice of words and concepts used to translate the Scriptures. By examining the word Elohim in Psalm 82, this article highlights how this development is realised in the translation of the Asante Twi Bible. For instance, in Psalm 82, the plural Elohim has been translated as (...) anyame in the Asante Twi Bible, a translation that is not only inappropriate but alters the religious worldview of the Asante people. As a mission agenda, the term anyame was coined to redefine the religion of the Akan people as polytheism. This redefinition has had a profound and longstanding impact on the language and religious thinking of the people. At the least, this article recommends a constructive reading of Psalm 82 in the Asante Twi Bible in order to decolonise it from colonial impositions that sought to wrongly qualify the life and thought of the people. At the most, the article calls on African biblical scholars to pay more attention to the impact of colonialism in their interpretation of the Bible in order to draw attention to changes in structure of the indigenous language and thought patterns, and to look for creative ways to redeem traditions of the African people.Contribution: The study demonstrates the continuous need to decolonise the Bible in Africa in order to help recover some of Africa’s religio-cultural identity lost during the missionary drive. Stereotypes of social construction suggest that the existence of social constructs is accidental and that such constructs have arbitrary and subjective features. In this paper, I explore a conception of social construction according to which it consists in the collective imposition of function onto reality and show that, according to this conception, these stereotypes are incorrect. In particular, I argue that the collective imposition of function onto reality is typically non-accidental and that the products of such imposition (...) frequently have non-arbitrary and objective features. These conclusions are interesting in and of themselves since they debunk important aspects of our socially constructed conception of social construction. Yet, additionally, they have important implications for the viability of mathematical social constructivism since resistance to such constructivism is frequently grounded in the observation that mathematics is non-accidental, non-arbitrary, and objective. This paper surveys the current philosophical discussion of the ethics of risk imposition, placing it in the context of relevant work in psychology, economics and social theory. The central philosophical problem starts from the observation that it is not practically possible to assign people individual rights not to be exposed to risk, as virtually all activity imposes some risk on others. This is the ‘problem of paralysis’. However, the obvious alternative theory that exposure to risk is justified when its (...) total benefits exceed its total costs faces the standard distributional challenges of consequentialism. Forms of contractualism have been proposed as a solution, but how exactly such theories can be formulated remains problematic, especially when confronted with the difficult cases of mass, novel, risk such as climate change. In this article, I critically examine Peter Unger's arguments for the claim that there is a duty to cause physical harm to oneself and others in order to save lives. This includes discussion of his view that when the method of cases involves several rather than merely two options our intuitive judgements support his radical thesis. In conclusion, I consider his attempt to reconcile his claims with common sense moral judgements.

I investigate how theoretical assumptions, pertinent to different perspectives and operative during the modeling process, are central in determining how nature is actually taken to be. I explore two different models by Michael Turelli and Steve Frank of the evolution of parasite-mediated cytoplasmic incompatility, guided, respectively, by Fisherian and Wrightian perspectives. Since the two models can be shown to be commensurable both with respect to mathematics and data, I argue that the differences between them in the (1) mathematical presentation of (...) the models, (2) explanations, and (3) objectified ontologies stem neither from differences in mathematical method nor the employed data, but from differences in the theoretical assumptions, especially regarding ontology, already present in the respective perspectives. I use my "set up, mathematically manipulate, explain, and objectify" (SMEO) account of the modeling process to track the model-mediated imposition of theoretical assumptions. I conclude with a discussion of the general implications of my analysis of these models for the controversy between Fisherian and Wrightian perspectives. (shrink)

Cracks in the liberal international order (LIO) have been occurring since its very formation. Yet, some international relations scholarship frames the narrative about imminent threats to the LIO as if such threats were new. From a postcolonial vantage point, this essay contends that mainstream theorizing about international order is problematically Eurocentric and develops a three-pronged argument. In the first place, the essay argues for understanding order as a command or as an imposition. Order as a command renders visible power (...) disparities, injustices, and inequalities of the international order as seen by actors from below. Second, the essay leans on Edward Said's contrapuntal reading method to show that experiences of order are plural rather than singular or universal. Third, the essay argues that from a postcolonial perspective, the opposite of order is not chaos or volatility but rather agency or the authorship to be a rule maker. A full picture of order as imposition requires understanding how togetherness and sameness are modes for Global South actors to find collective unity to resist the injustices and inequalities of the LIO. Many philosophers accept that, as well as having a right that others not harm us, we also have a right that others not subject us to a risk of harm. And yet, when we attempt to spell out precisely what this ‘right against risk imposition’ involves, we encounter a series of notorious puzzles. Existing attempts to deal with these puzzles have tended to focus on the nature of rights – but I propose an approach that focusses instead on the (...) nature of risk. The key move is to distinguish two different ways in which to conceptualise the risk that a given action presents – one of which is linked to the notion of probability and the other to the notion of normalcy.
