Interpretation has been a key theme in pragmatist aesthetics, but its centrality in neopragmatist thinking goes far beyond the field of art. Its influence extends into epistemology, ontology, and the philosophies of language, history, selfhood, and culture. Joseph Margolis devoted many articles and even an entire book to this topic, which he titled Interpretation Radical but Not Unruly. My critical examination of Margolis’s theory of interpretation shows how it is radical not only in terms of its (...) robust relativism. It is also radical in the etymological sense of “radical” as “forming the root” of his philosophical thought in general. The logic of interpretation that Margolis developed for aesthetics is the original, generative source of his relativism, but its influence and relativist logic then extended ever more widely and deeply into his themes of anti-essentialism, historicism, and flux that pervade his metaphysics of culture and philosophical anthropology. Although Barbara Boyd never puts it that (...) way, this is the essence of her argument. In her reading, this three-book collection of amatory elegies is the narrative of Ovid’s early career as a poet. This novel use of the genre—for literary autobiography—is one of the ways in which Ovid expands its boundaries. In Ovid’s Literary Loves Boyd intends to help readers appreciate the originality of the Amores, in part by showing in it the beginnings of that interest in redefining generic boundaries which in the past decade we have come to recognize, through the work of Stephen Hinds and others, as a hallmark of Ovid’s whole corpus.In her introduction, “The Isolation of Ovid’s Amores,” Boyd digests and assesses the current opinion about Ovid’s collection. Its “literary isolation” has resulted from the combined effects of the “generic fallacy” and what she calls the “progressive fallacy.” The latter (her own coinage) is the critical position which holds either that “what comes first is worst” or that “what comes last is worst” (5); accordingly, the Amores are early Ovid and hence inferior, and Ovid is the last of the elegists and hence inferior. As an antidote to the “generic fallacy” Boyd proposes James Zetzel’s “challenge of generic freedom,” itself the latest variation of Kroll’s “Kreuzung der Gattungen.” [End Page 468]Chapter 1, “Reused Language: Genre and Influence in the Interpretation of the Amores,” takes its point of departure from a comparison of the two propemptica Am. 2.11 and Propertius 1.8a. Boyd sets out “both to simplify and to clarify a method for reading imitation in the Amores” (19), and in doing so she makes a substantial contribution to the typology of imitation in Latin literature as a whole. She does this by bringing together two unlikely bedfellows, integrating G. P. Goold’s ideas about Ovid’s “formulae” and “instinctive” versification with G. B. Conte’s concepts of “poetic memory” and poetic language as “reused language.” She also employs Conte’s distinction between “exemplary model” (verbatim imitation) and “code model” (the system of generic rules familiar beforehand) and Richard Thomas’s preference for the term “reference” instead of “imitation.” For her purposes she distinguishes (30–31) between a “parallel,” which may “simply be a common topos” (30) rather than an actual imitation; a “formula,” which may be “a very precise mark of a poetic tradition” (30) without making a specific reference; and a “reference,” which is likely to engage with a whole tradition rather than simply allude to a single source. Recently, in responding to Redhead's ([1987], pp. 90-6) criticism that the Stapp 1 proof fails under an indeterministic interpretation of QM, Stapp [1989] (henceforth Stapp 2), has revised the logical structure (...) of his proof including its crucial locality assumption. Our main aim is to show that this revision is a step in the wrong direction because it faces two difficulties which undermine the resulting proof's significance (3.1) and validity (3. 2). We also clarify and extend the Stapp 1 proof (1. 1) with the aid of Lewis' analysis of counterfactuals (1. 2) and causal dependence (2. 2 and 2. 3). In so doing, we are able to identify two new defects in the Stapp 1 proof (1. 3 and 2. 1) in addition to corroborating Redhead's criticism (2. 2). Also, the additional assumptions which save the Stapp 1 proof's validity are detailed (2. 3) and some new difficulties for the determinist are pointed out by exploiting a slightly extended version of the proof (2. 4). In this article, we critically examine some of the ethical challenges and interpretive difficulties with possible future non-clinical applications of pediatric fMRI with a particular focus on applications in the classroom and the courtroom - two domains in which children come directly in contact with the state. We begin with a general overview of anticipated clinical and non-clinical applications of pediatric fMRI. This is followed by a detailed analysis of a range of ethical challenges and interpretive difficulties that trouble the (...) use of fMRI and are likely to be especially acute with non-clinical uses of the technology. We conclude that knowledge of these challenges and difficulties should influence policy decisions regarding the non-clinical uses of fMRI. Our aim is to encourage the development of future policies prescribing the responsible use of this neuroimaging technology as it develops both within and outside the clinical setting. (shrink)

Although the central target of Donald Davidson's influential essay `On the Very Idea of a Conceptual Scheme' is the scheme/content distinction, Davidson also maintains that his argument undermines the thesis of incommensurability as advocated by Thomas Kuhn and Paul Feyerabend. It will be argued here that when Davidson's contentions are carefully disentangled and scrutinized, the elements needed to dismantle the scheme/content distinction are ones that do not subvert incommensurability, and the ones that are held to contravene incommensurability are implausible. Therefore, (...) it is shown that it is possible to be an incommensurabilist without holding on to any objectionable third dogma, and that the disrepute that the thesis of incommensurability has fallen into based on claims of semantic incoherence like those offered by Davidson is undeserved. Many in the philosophy of science heralded the thesis of incommensurability as a radical, intriguing, and powerfully informative conjecture about the history of science. This essay tries to reconnect a large segment of the philosophy of language, influenced to dismiss the thesis based on semantic qualms such as Davidson offers, with that segment of philosophy of science that still considers and utilizes the thesis of incommensurability as a powerful explanatory and elucidative tool. Dalālat al-lafẓī al-waḍʿī, is divided into three parts: mutābaqat, taẓam-mun and iltizām. Although there is an agreement among the scholars regar-ding the nature of the mutābaqat, which shows the conformity of the word to its meaning, the indication of taẓammun and iltizām includes certain controversial issues. Among these, some issues related to iltizām, which plays a central role in method and rhetoric, were discussed. Al-Bābertī who wrote al-şurūḥ [commentaries] on the main works that greatly influenced the ones written after him (...) in these two sciences, expressed his opinion on the controversial issues; especially on the issues related to iltizām. These are about whether a mental necessity (al-luzūm al-dhihnī) condition is sought for the rationality and realization of the obligatory indication. In this context, at the beginning of the article, firstly, a general information about dalālat will be given, and in the first part, how the dalālat is handled in works of Bābertī will be explained. Then, in the second part, controversial issues related to dalālat will be discussed; views of Bābertī on these will be revealed after the discussions of scholars are included, especially within the framework of the nature of iltizām. The study delves into the role of subjectivity in perception, facilitating the communication of opacity and historicity to the perceiving individual. Additionally, it scrutinizes the image interpretation process, drawing parallels to text interpretation and (...) highlighting the influence of personal biases and individuality in medical practice. By revisiting Husserl’s conceptualization of “image consciousness” and introducing the notion of “image theme”, the paper seeks to establish a theoretical framework for making sense of images within the context of technological interpretation. A key objective is to enhance the phenomenology of technology through a systematic analysis of medical imaging diagnosis, contributing to an expanded epistemological foundation for medical practice. The article recognizes that the construction of medical knowledge incorporates subjective elements, especially within a historical context. The interpretation of images involves both instrumental and expert interpretation, with human subjectivity playing a crucial role. Pronoun interpretation is often described as relying on a comprehender's mental model of discourse. For example, in some psycholinguistic accounts, interpreting pronouns involves a process of retrieval, whereby a pronoun is resolved by accessing information from its linguistic antecedent. However, linguistic antecedents are neither necessary nor sufficient for interpreting a pronoun, and even when an antecedent has been introduced in earlier discourse, there is little evidence for the retrieval of linguistic form. The current study extends our understanding of pronoun (...) interpretation by examining whether the semantics of antecedent expressions are retrieved from representations of past discourse. Participants were instructed to move displayed objects in a Visual World eye-tracking task. In some cases, the semantics of the antecedent were no longer viable after an instruction was completed (e.g., “Move the house on the left to area 12,” where the result was that a different house is now the leftmost one). In this case, retrieving antecedent semantics at the point of hearing a subsequent pronoun (“Now, move it…”) should entail a processing penalty. Instead, the results showed that antecedent semantics have no direct effect on interpretation, raising additional questions about the role that retrieval might play in pronoun interpretation. The object of the study is one of the significant manifestations of classical Chinese aesthetics - kunqu opera. The subject of the study is the foundations of the formation of this aesthetics in terms of both material and spiritual cultural practices, as well as to investigate its cultural centripetal role in the context of modern society. The relevance of the study is determined by the novelty of the approach, which involves examining the spiritual imagery of Kunqu opera through the prism (...) of analysing its material basis and interpreting the interaction between ‘materiality’ and ‘object form’ in the process of creating Kunqu opera. In addition, the relationship between Kunqu opera and Chinese classical aesthetics is explored. The aim of this study is to deeply analyse Kunqu opera as an important element of traditional Chinese culture in order to understand the extent to which Kunqu embodies the Chinese aesthetic tradition. A variety of methods including literature analysis, case study, historical and literary research. The article is divided into three main parts: the first part focuses on the material level, arguing that the physical presence in Kunqu opera serves as an important support for the formation of the performance system; the second part reveals how the material components of the performance infiltrate the spiritual aesthetic, while the formation of the opera's aesthetics is influenced by Chinese philosophical thought and lyrical culture, using comparative analysis; the final part emphasises the cultural independence and the cultural identity of the opera's performers. The results of the study demonstrate that classical Chinese aesthetics act as the ‘spiritual core’ of Kunqu opera, reflecting traditional Chinese values, ethics and philosophy, which in turn influences the structure of the works, performance style, music and text requirements, as well as plot moves and stage design. Heritability is routinely interpreted causally. Yet, what such an interpretation amounts to is often unclear. Here, I provide a causal interpretation of this concept in terms of range of causal influence, one of several causal dimensions proposed within the interventionist account of causation. An information-theoretic measure of range of causal influence has recently been put forward in the literature. Starting from this formalization and relying upon Woodward’s analysis, I show that an important problem associated with interpreting (...) heritability causally, namely the locality problem, amounts, at least partly, to a low invariance and low stability between the genotype/environment and the phenotype of individuals. In light of this, I plead for a causal interpretation of heritability that takes the notions of Woodward’s invariance and stability into consideration. In doing so, I defuse naive causal interpretations of heritability. (shrink)

The aim of this article is to determine how can new interpretations of old institutes change the status of the taxpayers and tax administrators and to suggest what can the Ministry of Finance do to solve the problem – it can try setting a uniform interpretation of tax institutes. It deals with two findings of the Constitutional Court of the Czech Republic concerning two institutes described in Tax Administration Act: time-limits for tax assessment and tax inspection; and one finding (...) of the Highest Administrative Court concerning local taxes. Court interpretation is only one of several possibilities of interpretation. Continental system of law differs from the Anglo-American system and we should search for information in the acts, and court practice should be used only alternatively. (shrink)

Such discussions are anything but idle. They affect what historians and others say about the past, and, in doing so, they influence the construction of social policies in the present. The cultural and temporal context that any archaeologist is a part of will necessarily bias the way in which he or she interprets material remains. While interpretation is a crucial part of the archaeological process, the preconceived notions an archaeologist may hold can colour their interpretation of the society in question. Through examples such as the excavations at Knossos in Crete, the effect such biases can have on archaeological interpretation and discourse is studied.

Introduction. The Chinese language, unlike Russian, has several terms, denoting different statuses of Chinese migrants, but there is no term such as “diaspora”. These features are interpreted by the authors along the lines of social ontology as independent sociological concepts, constructing particular migrant groups. The article’s oobjective is to show their internal coherence and correlation with the notion of “diaspora” as well as to outline the difficulties and problems occurring as the result of the interaction between researchers dealing with the (...) topic. The relevance of the study stems from the fact that researchers have paid little attention to differences in national academic discourses that are meanwhile very important because intercultural differences can only be negotiated if there is an understanding of what they are. With regard to diaspora discussions, this understanding has yet to be developed. The article shows that in diaspora studies there is a language barrier, which at the moment is currently an impassable obstacle for authors who write about the diaspora in different languages.Methodology and sources. To work on the article, the authors used a discursive analysis of academic texts on Chinese migration and Chinese migrants, as well as dictionaries and official documents such as the Large Chinese-Russian Dictionary, the Tsihai Dictionary (辞海 ci hai – Sea of words), the Large Russian Encyclopedia, State Council resolutions, and Chinese legislation.Results and discussion. The treatment of 10 terms replacing the notion of “diaspora” in Chinese language is disclosed. The authors describe characteristic features of each group. It is illustrated that there is a linguistic asymmetry, as a result of which the European notion of “diaspora” receives specific connotations when translated into Chinese that cannot account all the features of this community, thus in the Chinese academic discourse the substitution with the most important from the translator and editor's point of view equivalent (the situation “instead of diaspora”) is made.Conclusion. It is concluded that in Chinese, through translation, the author expresses important features of the migrant community, emphasising either its closeness, or its distance to the “diaspora” status. Background: Respectful care is central to ethical codes of practice and optimal patient care, but little is known about the influences on and challenges in communicating respect. Research question: What are the intra- and inter-personal influences on nurses’ communication of respect? Research design and participants: Semi-structured interviews with 12 hospital-based UK registered nurses were analysed using interpretative phenomenological analysis to explore their experiences of communicating respect to patients and associated influences. Ethical considerations: The study was approved by the Institutional ethics (...) board and National Health Service Trust. Findings: Three interconnected superordinate themes were identified: ‘private self: personal attitudes’, ‘outward self: showing respect’ and ‘reputational self: being perceived as respectful’. Respectful communication involved a complex set of influences, including attitudes of respect towards patients, needs and goals, beliefs around the nature of respectful communication, skills and influencing sociocultural factors. A tension between the outward self as intended and perceived presented challenges for nurses’ reputational self as respectful, with negative implications for patient care. Discussion: The study offers an in-depth understanding of intra- and inter-personal influences on communicating respect, and sheds light on challenges involved, helping provide practical insights to support respectful care. Conclusion: Findings stress the need for improved conceptualisations of respect in healthcare settings to formally recognise the complex attitudinal and socially constructed nature of respect and for appropriate professional training to improve its communication. In this paper, we examine whether affect influences higher level cognitive processes. We review research on the effect of emotion on interpretation, judgement, decision making, and reasoning. In all cases, we ask first whether there is evidence that emotion affects each of these processes, and second what mechanisms might underlie these effects. Our review highlights the fact that interpretive biases are primarily linked with anxiety, while more general mood-congruent effects may be seen in judgement. Risk perception is also affected (...) by negative and positive affect. Research shows complex effects of emotion on decision making and reasoning, with emotion sometimes hindering normatively correct thinking and sometimes promoting it. There are also important effects of emotion on reasoning style. We discuss key differences between the effects of incidental affect (feeling states not related to the semantic contents of the cognitive task) and integral affect (where the feeling state is caused by or linked to the contents of the cognitive task). In the conclusion, we suggest that focusing on some of the constituent mechanisms involved in interpretation, judgement, decision making and reasoning provides a way to link some of the diverse findings in the field. Nietzsche's perspectivism claims that every view is only one view. This claim raises serious self-referential difficulties: if Nietzsche's view is not to refute itself, then any argument offered on its behalf must be merely perspectival, but no such reasons would be convincing to Nietzsche's dogmatic opponents. This dissertation takes a historical approach, arguing that Nietzsche's perspectivism is a development and transformation of Kant's transcendental idealism. Our perspectival notions, like the Kantian categories, are conceptual resources that we bring to experience to (...) organize it. Nietzsche does not accept Kant's transcendental interpretation of our conceptual scheme, however. He offers arguments against the claims to necessary knowledge on which Kant's transcendental approach is based, and also against the coherence of the notion of the thing in itself, which Kant shares with traditional metaphysical realism. These arguments have the force of "internal reasons" against Kant and the realist; they are given from within Nietzsche's own perspective, but they appeal to cognitive standards which Nietzsche shares in common with his dogmatic opponents. They therefore count as reasons in favor of perspectivism, even within the terms of the alternative perspectives, despite the fact that they make no claim to universal, aperspectival validity. Nietzsche can thereby avoid the self-referential difficulties facing his argument. This interpretation also allows Nietzsche to develop "theory-internal" conceptions of truth and objectivity. These conceptions are found to provide a better account of our cognitive practices than the traditional, externalist alternatives. (shrink)

In recent years, we have been observing the phenomenon of an emerging scientific field: _digital transformation research_ (DTR). Due to the diversity and complexity of its object of research digital, transformation is not effectively researchable if confined to the boundaries of individual disciplines. In the light of Scientific/Intellectual Movement theory (Frickel and Gross 2005 ), we wonder how interdisciplinarity could and should be mobilized to further advance the development of the field of DTR. To answer this question, we (a) need (...) to understand how interdisciplinarity is conceived and (b) how it is considered in research practice by researchers in the emerging field. This is important, as scientists’ application of interdisciplinarity will highly influence an emerging field, shape its growth, consolidation as well as its academic establishment. We conducted six group discussions with 26 researchers from different disciplines and career levels (PhD students, postdocs, professors). The discussions were studied with a structuring qualitative content analysis. The results reflect the vagueness of the concept of interdisciplinarity. Interdisciplinarity is largely conceived as multidisciplinarity. Further, the interviewees mentioned more challenges than opportunities when it comes to interdisciplinary DTR. The present study widens the scientific understanding about how researchers of different career levels perceive, learn, and practice interdisciplinarity in DTR. It further provides valuable indications of how interdisciplinary research in an emerging field can be profitably shaped for practice. (shrink)

This paper argues that the principles of spiritual traditions provide normative ‘standards of goodness’ within which practitioners evaluate meaningful work. Our comparative study of practitioners in the Buddhist and Quaker traditions provide a fine-grained analysis to illuminate, that meaningfulness is deeply connected to particular tradition-specific philosophical and theological ideas. In the Buddhist tradition, meaningfulness is temporal and rooted in Buddhist principles of non-attachment, impermanence and depending-arising, whereas in the Quaker tradition, the Quaker testimonies and theological ideas frame meaningfulness as eternal. Surprisingly, we find that when faced with unethical choices and clashes between organizational normativity and spiritual normativity, Buddhist practitioners acknowledge the temporal character of meaningfulness and compromise their moral values, whereas in contrast, Quaker practitioners morally disengage from meaningless work. Our study highlights how normative commitments in different spiritual traditions can influence different levels of adaptability in finding work meaningful and stresses the central importance of normative commitments in meaningful work. Our study concludes with practical implications and future pathways for inter-disciplinary research. (shrink)

When faced with an ambiguous pronoun, comprehenders use both multimodal cues and linguistic cues to identify the antecedent. While research has shown that gestures facilitate language comprehension, improve reference tracking, and influence the interpretation of ambiguous pronouns, literature on reference resolution suggests that a wide set of linguistic constraints influences the successful resolution of ambiguous pronouns and that linguistic cues are more powerful than some multimodal cues. To address the outstanding question of the importance of gesture as a (...) cue in reference resolution relative to cues in the speech signal, we have previously investigated the comprehension of contrastive gestures that indexed abstract referents – in this case expressions of personal preference – and found that such gestures did facilitate the resolution of ambiguous statements of preference. In this study, we extend this work to investigate whether the effect of gesture on resolution is diminished when the gesture indexes a statement that is less likely to be interpreted as the correct referent. Participants watched videos in which a speaker contrasted two ideas that were either neutral or moral acceptable). A gesture to the left or right side co-occurred with speech expressing each position. In gesture-disambiguating trials, an ambiguous phrase was accompanied by a gesture to one side or the other. In gesture non-disambiguating trials, no third gesture occurred with the ambiguous phrase. Participants were more likely to choose the idea accompanied by gesture as the stimulus speaker’s preference. We found no effect of scenario type. Regardless of whether the linguistic cue expressed a view that was morally charged or neutral, observers used gesture to understand the speaker’s opinion. This finding contributes to our understanding of the strength and range of cues, both linguistic and multimodal, that listeners use to resolve ambiguous references. (shrink)

We used social network analysis to examine a theoretical model exploring why, and under what circumstances, the perpetrators’ ostracizing behaviors are accurately perceived by the target employees. In turn, these perceptions of ostracism lead to the target employees’ counterproductive work behaviors. Adopting perspectives from both perpetrators and targets, we directly measured the ostracizing behaviors by all potential perpetrators and perceived workplace ostracism by target employees. We integrate Social information processing theory and conservation of resource theory to propose a moderated mediation (...) model, and found that employees who have a high level of need to belong are more likely to capture coworkers’ ostracizing behaviors, and those with low political skill are more likely to engage in counterproductive work behavior as their reaction to perceived workplace ostracism. This paper presents a study of the effect of working memory load on the interpretation of pronouns in different discourse contexts: stories with and without a topic shift. We discuss a computational model (in ACT‐R, Anderson, 2007) to explain how referring expressions are acquired and used. On the basis of simulations of this model, it is predicted that WM constraints only affect adults' pronoun resolution in stories with a topic shift, but not in stories without a topic shift. This (...) latter prediction was tested in an experiment. The results of this experiment confirm that WM load reduces adults' sensitivity to discourse cues signaling a topic shift, thus influencing their interpretation of subsequent pronouns. (shrink)

Models for truth in fiction must be able to account for differing versions and interpretations of a given fiction in such a way that prevents contradictions from arising. I propose an analysis of truth in fiction designed to accommodate this. I examine both the interpretation of claims about truth in fiction (the ‘Interpretation Problem’) and the metaphysical nature of fictional worlds and entities (the ‘Metaphysical Problem’). My reply to the Interpretation Problem is a semantic contextualism influenced by (...) Cameron (2012), while my reply to the Metaphysical Problem involves an extension and generalisation of the counterpart-theoretic analysis put forth by Lewis (1978). The proposed analysis considers interpretive context as a counterpart relation corresponding to a set of worlds, W, and states that a sentence φ is true in interpretive context W iff φ is true at every world (w∈W). I consider the implications of this analysis for singular terms in fiction, concluding that their extensions are the members of sets of counterparts. In the case of pre-existing singular terms in fiction, familiar properties of the corresponding actual-world entities are salient in restricting the counterpart relation. I also explore interpretations of sentences concerning multiple fictions and those concerning both fictional and actual entities. This account tolerates a plurality of interpretive approaches, avoiding contradictions. (shrink)

This paper discusses the announcement by a team of researchers that they identified a genetic influence for a range of “antisocial” behaviours in the New Zealand Māori population (dubbed the “warrior gene”). The behaviours included criminality, violence, gambling and alcoholism. The reported link between genetics and behaviour met with much controversy. The scientists were described as hiding behind a veneer of supposedly “objective” western science, using it to perpetuate “racist and oppressive discourses”. In this paper we examine what went (...) wrong in the dissemination of the research. We chose as our framework the debate around the “internal/external” responsibilities of scientists. Using this discourse we argue that when the researchers ventured to explain their research in terms of social phenomena, they assumed a duty to ensure that their findings were placed “in context”. By “in context”, we argue that evidence of any genetic influence on behavioural characteristics should not be reported in isolation, but instead presented alongside other environmental, cultural and socio-economic influences that may also contribute to the studied behaviour. Rather than imposing a new obligation on scientists, we find this duty to contextualise results is in keeping with the spirit of codes of ethics already in place. Lessons from the “warrior gene” controversy may assist researchers elsewhere to identify potential areas of conflict before they jeopardise research relationships, or disseminate findings in a manner that fuels misleading and/or potentially discriminatory attitudes in society. The present article deals with the translations of Hebrew and non Hebrew but presented as Hebrew anthroponyms and oikonyms in the work of Konstantin Konstenechki “Treatise of Letters” dating back to the first decade of the 15th century. Up to this moment excluding Jagić the researchers have not pay significant attention to this part of work and according to common opinion Konstantin did not know Hebrew language. However the careful language and textological analysis indicates that a big part of the (...) translations of names and words loaned from the Old and New Testaments are identical or stay close to the etymologies including in the modern dictionaries and other are result of phonetic comparison to Aramaic. There are also translations influenced by Midrashes and the works of Philo of Alexandria. (shrink)

Twenty years ago, Slobodan Milosevic uttered a sentence which was afterwards repeated in the literature about the Yugoslav tragedy innummerable times. The sentence "Niko ne sme da vas bije" was directed to the Serb demonstrators in Kosovo. In this text, the author analyzes the ways this sentence was translated in factional literature and shows that different versions, apart from being different lexically and semantically, influence the political interpretation and understanding of the Yugoslav conflict. This text poses another, maybe (...) even more important question: are unprecise and wrong translations of Milosevic's words a proof of what Georg Johannesen claimed - that faction is fiction.. Pre dvadeset godina Slobodan Milosevic je izgovorio jednu recenicu koja je ponavljana nebrojeno puta u literaturi o jugoslovenskoj tragediji. Ta recenica je izgovorena u neposrednom kontaktu sa demonstrantima srpske nacionalnosti na Kosovu i glasi "Niko ne sme da vas bije". U ovom tekstu autor istrazuje nacine na koje je ova recenica prevodjena u strucnoj literaturi i/ili faktivnoj prozi i pokazuje kako njene razlicite verzije, osim sto se odlikuju velikim jezickim i semantickim razlikama, usmeravaju politicko tumacenje i razumevanje jugoslovenskog konflikta. The 1951 Convention Relating to the Status of Refugees and the 1967 Protocol Relating to the Status of Refugees embody fundamental provisions of refugee law. However, since the adoption of these documents the world has changed dramatically and the laws are not developing fast enough in order to catch up with dynamically changing contemporary situations. The application and interpretation of definition of a refugee was developed through traditional practice of Western states, which was influenced by two world wars and (...) the Cold War, when refugees from Africa or Asia were uncommon. The Qualification Directive specifically aims at ensuring that the member states apply common qualification criteria for persons who need international protection in line with the 1951 Convention Relating to the Status of Refugees. The author supports the statement that the Qualification Directive in principle aims at bringing back under the definition of refugee those, who have been left outside of its scope during the last decades as a result of the restrictive interpretation and application of the definition of refugee. This paper investigates how unsupervised machine learning methods might make hermeneutic interpretive text analysis more objective in the social sciences. Through a close examination of the uses of topic modeling—a popular unsupervised approach in the social sciences—it argues that the primary way in which unsupervised learning supports interpretation is by allowing interpreters to discover unanticipated information in larger and more diverse corpora and by improving the transparency of the interpretive process. This view highlights that unsupervised modeling does not eliminate (...) the researchers’ judgments from the process of producing evidence for social scientific theories. The paper shows this by distinguishing between two prevalent attitudes toward topic modeling, i.e., topic realism and topic instrumentalism. Under neither can modeling provide social scientific evidence without the researchers’ interpretive engagement with the original text materials. Thus the unsupervised text analysis cannot improve the objectivity of interpretation by alleviating the problem of underdetermination in interpretive debate. The paper argues that the sense in which unsupervised methods can improve objectivity is by providing researchers with the resources to justify to others that their interpretations are correct. This kind of objectivity seeks to reduce suspicions in collective debate that interpretations are the products of arbitrary processes influenced by the researchers’ idiosyncratic decisions or starting points. The paper discusses this view in relation to alternative approaches to formalizing interpretation and identifies several limitations on what unsupervised learning can be expected to achieve in terms of supporting interpretive work. Yet “many others” did not fit into those two groups, for a large contingent of bishops favorable to religious liberty nonetheless sought to undergird the juridical reasoning for the right with an ontological foundation.David L. Indeed, they argue that the other voices—the “French” or “ontological” school comprised of bishops such as Alfred Ancel and Karol Wojtyła—provide the true key to DH’s meaning and significance. Accompanying Schindler’s and Healy’s essays are conciliar texts charting the origin and influence of this ontological school: the six conciliar drafts, the oral and written interventions of Wojtyła, and an oral intervention of Ancel. These texts, transcribed from the Acta Synodalia Sacrosancti Concilii Oecumenici Vaticani II (AS), have been translated by Patrick T. Brannon, S.J., and Michael Camacho. Also included is a side-by-side comparison of the third and sixth drafts that displays the changes made to the juridical position in response to the ontological school.Schindler’s 170-page essay, “Freedom, Truth, and Human Dignity: An Interpretation of Dignitatis Humanae on the Right to Religious Freedom,” is the heart of the work. Schindler recapitulates in a fresh way themes from his prior analyses of liberalism and Murray. In section 1, he summarizes how Wojtyła’s interventions influenced the evolution of DH such that Murray’s juridical approach became subordinated to an emphasis on truth as the foundation and telos of freedom. Section 2 outlines Murray’s postconciliar objections to DH’s final version, namely, that it assumes that the American juridical approach leads to relativism and that its insistence on truth as religious liberty’s foundation undermines the universality of the right by degrading the liberty of those in error. To the first, Schindler replies (in section 3) that Murray’s juridical approach necessarily entails what Servais Pinckaers, O.P., called the “freedom of indifference,” Murray’s denials of relativism notwithstanding. The problems of the influence of the second generation of myths on the consciousness of man and society are considered. The study is conditioned by the growing influence of the latest political and social myths, which are created on the basis of archetypes that formed the cultural foundations of modern civilisations. Crisis situations in society, when individuals in society are unable to explain the events taking place from the point of view of reason, intensify irrational factors in the (...) interpretation of existence, which actualises the appeal to the philosophical understanding of modern mythogenesis.The study shows that the creators of second-generation myths (newer myths that use the archetypes of first-generation myths) can have a different impact on society. By creating social myths, they can either help an individual to identify with a particular culture, social group, etc., contribute to unifying society, stabilising it and mobilising people’s efforts to achieve common goals, or lead to intolerance towards other groups in society. Destructive myth-making can be used by certain groups to destabilise and divide society.Based on a study of the impact of modern myth-making on the consciousness of individuals and society, the author concludes that the destructive influence of second-generation myths can only be countered if individuals are better acquainted with the history, culture, customs and traditions of other nations, which will allow them to rationally explain the content of myths. A philosophical understanding of the content of myths helps to be critical of their content, to understand the hidden meanings of their symbols, and to recognise in whose interests certain views and concepts are imposed. This paper provides a brief overview and critique of the dominant objectivist understanding and use of illness narrative in Enlightenment (scientific) medicine and ethics, as well as several revisionist accounts, which reflect the evolution of this approach. In light of certain limitations and difficulties endemic in the objectivist understanding of illness narrative, an alternative phronesis approach to medical ethics influenced by Charles Taylor’s account of the interpretive nature of human agency and language is examined. To this end, the account of (...) interpretive medical responsibility previously described by Schultz and Carnevale as "clinical phronesis" (based upon Taylor’s notion of "strong" or "radical evaluation") is reviewed and expanded. The thesis of this paper is that illness narrative has the ability to benefit patients as well as the potential to cause harm or iatrogenic effects. This benefit or harm is contingent upon how the story is told and understood. Consequently, these tales are not simply "nice stories," cathartic gestures, or mere supplements to scientific procedures and decision making, as suggested by the objectivist approach. Rather, they open the agent to meanings that provide a context for explanation and evaluation of illness episodes and therapeutic activities. This understanding provides indicators (guides) for right action. Hence, medical responsibility as clinical phronesis involves, first, the patient and provider’s coformulation and cointerpretation of what is going on in the patient’s illness narrative, and second, the patient and provider’s response to interpretation of the facts of illness and what they signify–not simply a response to the brute facts of illness, alone. The appeal to medical responsibility as clinical phronesis thus underscores the importance of getting the patient’s story of illness right. It is anticipated that further elaboration concerning the idea of clinical phronesis as interpretive illness narrative will provide a new foundation for medical ethics and decision making. (shrink)

Tombs of the kings of the Western Han dynasty often contain burial items that are related to the material culture of the Eastern Eurasian Steppe. These artifacts are usually interpreted in a general sense, for instance as a sign for the fascination of the Han elite with the exotic. A closer analysis of relevant finds, however, shows different strategies of dealing with foreign influences. While the exchange with the empire’s northern neighbors is evidenced through goods for which identical excavated parallels (...) from the steppe exist, the royal tombs of the Han also contained items that resemble and reference steppe motifs and objects but were clearly produced locally and for local consumers. Especially the latter type of artifacts can thus not simply be interpreted as the passive byproduct of exchange relations. Instead, we have to acknowledge that design, production, and usage of these objects were based on conscious decisions. Based on the insight that objects always have a social function, this article argues that the Han elite not only appropriated steppe influences and motifs but also strategically produced and integrated them into their world in order to redefine, enhance, and strengthen their position within their social framework. Constitution is an exclusive legal document, and its interpretation is a process – a continuous work of explanation of its content, the end and qualitative perfection of which may only be considered taking into account the limits of intellectual potential of the particular time. The interpretation of constitution is a permanent process, which is influenced and determined by plenty of conceptual factors. Firstly the supreme juridical power of the constitution as well as its integrity determines the opportunities of (...) its interpreter and applier. Integrity of the constitution is considered to be the legal, philosophical, logical integrity of its norms, which determines an obligation of its interpreter to perceive this legal act as an integral unit, i.e. not only as a catalogue of particular values, but also as a balance of these values. All the constitutional expressis verbis provisions are equal in its’ juridical power, that is why they do not negate each other, on the contrary – each of them only complement others’ content. Besides, it is important to mention that exceptional juridical power of the constitution determines its interpretational self-sufficiency. Constitution can not be interpreted invoking the content of the acts of lower juridical power. (shrink)

This paper conducts a deep analysis of the religious elements manifested in Ming and Qing dynasty (...) porcelain artworks, exploring how these elements articulate religious devotion, mirror cultural practices, and influence artistic transformations. Through detailed appreciation and interpretation of three exemplary cases—Yongle blue and white entwined flowers, Jiajing blue and white road Fu Yunhe large plate, and a blue and white seawater river cliff pattern three-legged furnace—this study reveals how these works serve as conduits for spiritual reflection and cultural transmission. Each piece not only embodies the religious and philosophical zeitgeist of its era but also highlights the dynamic interplay between art and societal evolution, thus underscoring the multifaceted roles ancient religious art plays in perpetuating cultural heritage, enchanting viewers with its artistic allure, and reflecting broader social transformations. To reduce ambiguity across a conversation, interlocutors reach temporary conventions or referential precedents on how to refer to an entity. Despite their central role in communication, the cognitive underpinnings of the interpretation of precedents remain unclear, specifically the role and mechanisms by which information related to the speaker is integrated. We contrast predictions of one-stage, original two-stage, and extended two-stage models for the processing of speaker information and provide evidence favoring the latter: we show that both stages are sensitive (...) to speaker-specific information. Using an experimental paradigm based on visual-world eye tracking in the context of a referential communication task, we look at the moment-by-moment interpretation of precedents and focus on the temporal profile of the influence of the speaker and linguistic information when facing ambiguity. We find two clearly identifiable moments where speaker-specific information has its effects on reference resolution. We conclude that these two stages reflect two distinct cognitive mechanisms, with different timings, and rely on different representational formats for encoding and accessing information about the speaker: a cue-driven memory retrieval process that mediates language processing and an inferential mechanism based on perspective-taking abilities.
