Philosophers debate the death of philosophy as much as they debate the death of God. Kant claimed responsibility for both philosophy's beginning and end, while Heidegger argued it concluded with Nietzsche. In the twentieth century, figures as diverse as John Austin and Richard Rorty have proclaimed philosophy's end, with some even calling for the advent of "postphilosophy." In an effort to make sense of these conflicting positions—which often say as much about the philosopher as his subject—Isabelle Thomas-Fogiel undertakes the (...) first systematic treatment of "the end of philosophy," while also recasting the history of western thought itself. Thomas-Fogiel begins with postphilosophical claims such as scientism, which she reveals to be self-refuting, for they subsume philosophy into the branches of the natural sciences. She discovers similar issues in Rorty's skepticism and strands of continental thought. Revisiting the work of late-nineteenth and early-twentieth-century philosophers, when the split between analytical and continental philosophy began, Thomas-Fogiel finds both traditions followed the same path—the road of reference—which ultimately led to self-contradiction. This phenomenon, whether valorized or condemned, has been understood as the death of philosophy. Tracing this pattern from Quine to Rorty, from Heidegger to Levinas and Habermas, Thomas-Fogiel reveals the self-contradiction at the core of their claims while also carving an alternative path through self-reference. This volume contains twenty-two papers dedicated to ancient and medieval representations of justice, from the Septuagint to Thomas of Aquinas. It explores over a long historical period the evolution of various aspcts of this notion, understood as an individual virtue and as an ethical ideal, but also as a political value embodied in laws, rules, and institutions. In particular, it examines how early Christian authors, relying on biblical meanings of justice, have modified the conceptual framework and socio-political practices bound to (...) this idea. To demonstrate the contribution of Christian literature, considered here from Tertullian to Fulgentius Ferrandus, notions of justice from the bible and antiquity shall be studied followed by their medieval intellectual posterity. To what extent does this tradition of thought testify to a renewal of perceptions of justice, divine as well as human, and of injustice? How has it influenced representations of justice in the medieval world, whether expressed in academic treatises or in fiction? As knowledge creation quickly gains importance for globally active corporations, we attempt to combine the advantages of the Stakeholder View with those of the SECI model by Nonaka and Takeuchi. In order to support the mental processes of the stakeholders, we use so-called topic maps to transform implicit into explicit knowledge and to visualize it. The preliminary propositions are illustrated by the case study of Swiss Re.

In this paper, we study the impact of CEO and board gender diversity on the risk management decisions of 179 U.S. Real Estate Investment Trusts (REITs) during the 2001–2018 period. Using a bottom-up analysis on the properties in REIT portfolios, we find significant risk reduction associated with gender-diverse REIT leadership. We document that REITs with a woman CEO, in combination with more women on the board, display less active trading and a longer hold period for assets. In addition, REITs with (...) more gender-diverse leadership are more geographically focused, which for REITs is considered a lower risk investment strategy. Finally, REITs with more gender-diverse leadership are more actively investing in environmentally sustainable real estate. We conclude that gender diversity in real estate firms carries real-life implications for U.S. cities, given their key role as developers, owners, and operators of the built world. (shrink)

Data-driven technologies have come to pervade almost every aspect of business life, extending to employee monitoring and algorithmic management. How can employee privacy be protected in the age of datafication? This article surveys the potential and shortcomings of a number of legal and technical solutions to show the advantages of human rights-based approaches in addressing corporate responsibility to respect privacy and strengthen human agency. Based on this notion, we develop a process-oriented model of Privacy Due Diligence to complement existing frameworks (...) for safeguarding employee privacy in an era of Big Data surveillance. In a thought-provoking paper, Schuklenk and Smalling argue that no right to conscientious objection should be granted to medical professionals. First, they hold that it is impossible to assess either the truth of conscience-based claims or the sincerity of the objectors. Second, even a fettered right to conscientious refusal inevitably has adverse effects on the rights of patients. We argue that the main problem with their position is that it is not derived from a broader reflection on the meaning and (...) implications of freedom of conscience and reasonable accommodation. We point out that they collapse two related but distinct questions, that is, the subjective conception of freedom of conscience and the sincerity test. We note that they do not successfully show that the standard norm according to which exemption claims should not impose undue hardship on others is unworkable. We suggest that the main reason why arguments such as no one is forced to be a medical professional are flawed is that public norms should not constrain citizens to choose between two of their basic rights unless it is necessary. In fine, Schuklenk and Smalling, who see conscience claims as arbitrary dislikes, sell freedom of conscience short and forego any attempts at balancing the competing rights involved. We maintain the authors neglect that most of legal reasoning is contextual and that the blanket restriction of healthcare professionals' freedom of conscience is disproportionate. (shrink)

Résumé Cet article vise à réexaminer le « scepticisme » de Marius Victorinus, tel que l’avait défini Pierre Hadot, en s’appuyant principalement sur le Commentaire sur le De inventione. On constate que Marius Victorinus y infléchit le propos de l’Arpinate ; dans cet ouvrage antérieur à sa conversion, la condamnation sans appel de l’opinion, liée au monde des hommes, englobe le dogme chrétien ; Victorinus intègre certains motifs sceptiques à un propos globalement influencé par le néoplatonisme porphyrien. Dans un second (...) temps, une comparaison est menée avec la réfutation du scepticisme par Augustin dans le Contra Academicos, écrit en 386. Même si l’on ne peut en tirer de conclusions fermes sur une influence de Victorinus, la comparaison entre ces deux œuvres sur les questions liées aux thèmes de la connaissance, sur les notions de probable, de vrai et de vraisemblable montrent des choix opposés, témoignant d’une réception différente des concepts cicéroniens en la matière. Avec sa succession de bouleversements institutionnels, le dix-septième siècle anglais fut un fabuleux terrain d'expérimentation et de réflexion politique d'où surgirent les grandes théories modernes. A cette période, philosophes et acteurs engagés tentèrent de penser, avec une acuité particulière liée aux événements (guerres civiles, régicide, république, dictature), les tensions inhérentes au pouvoir, tout à la fois perçu comme contraignant, tyrannique et libérateur. Quatre d'entre eux ont été retenus : Thomas Hobbes (1588-1679), le théoricien de l’absolutisme, James Harrington (1611-1677), le républicain (...) classique, Algernon Sidney (1623-1683), le martyr whig, John Locke (1632-1704), le père du libéralisme. Le propos de l’ouvrage est de montrer que, par-delà leurs différences, ces quatre penseurs partagent une approche qui constitue le socle commun d’une théorie de l’Etat moderne. Leur doctrine s’affranchit de l’exercice utopique comme de la théorie de la raison d’Etat et se conçoit comme une anatomie du corps politique. Par un examen minutieux des textes, l’auteur cherche à s’écarter de l' interprétation trop « idéologique » sans doute accentuée par les combats de l’histoire. Elle met en évidence un objet philosophique commun aux quatre auteurs, que l’on retrouve au cœur de toute conception moderne du pouvoir. (shrink)

Purpose As data-driven tools increasingly shape our life and tech ethics crises become strikingly frequent, data ethics coursework is urgently needed. The purpose of this study is to map the field of data ethics curricula, tracking relations between courses, instructors, texts and writers, and present a proof-of-concept interactive website for exploring these relations. This method is designed to be used in curricular research and development and provides multiple vantage points on this multidisciplinary field. Design/methodology/approach The authors use data science methods (...) to foster insights about the field of data ethics education and literature. The authors present a semantic, linked open data graph in the Resource Description Framework, along with proof-of-concept analyses and an exploratory website. Its framework is open-source and language-agnostic, providing the seed for future contributions of code, syllabi and resources from the global data ethics community. Findings This method provides a convenient means of exploring an overview of the field of data ethics’ social and textual relations. For educators designing or refining a course, the authors provide a method for curricular introspection and discovery of transdisciplinary curricula. Research limitations/implications The syllabi the authors have collected are self-selected and represent only a subset of the field. Furthermore, this method exclusively represents a course’s assigned literature rather than a holistic view of what courses teach. The authors present a prototype rather than a finished product. Originality/value This curricular survey provides a new way of modeling a field of study, using existing ontologies to organize graph data into a comprehensible overview. Context In France, a new payment for performance (P4P) scheme for primary care physicians was introduced in 2009 through the ‘Contract for Improving Individual Practice’ programme. Its objective was to reduce healthcare expenditures while enhancing improvement in guidelines' observance. Nevertheless, in all countries where the scheme was implemented, it raised several concerns in the domain of professional ethics. Objective To draw out in France the ethical tensions arising in the general practitioner's (GP) profession linked to the introduction of P4P. Method (...) Qualitative research using two focus groups: first one with a sample of GPs who joined P4P and second one with those who did not. All collective interviews were recorded and fully transcribed. An inductive analysis of thematic content with construction of categories was conducted. All the data were triangulated. Results All participants agreed that conflicts of interest were a real issue, leading to the resurgence of doctor's dirigisme, which could be detrimental for patient's autonomy. GPs who did not join P4P believed that the scheme would lead to patient's selection while those who joined P4P did not. The level of the maximal bonus of the P4P was considered low by all GPs. This was considered as an offense by non-participating GPs, whereas for participating ones, this low level minimised the risk of patient's selection. Conclusion This work identified several areas of ethical tension, some being different from those previously described in other countries. Three experiments were conducted in order to validate 56 musical excerpts that conveyed four intended emotions (happiness, sadness, threat and peacefulness). In Experiment 1, the musical clips were rated in terms of how clearly the intended emotion was portrayed, and for valence and arousal. In Experiment 2, a gating paradigm was used to evaluate the course for emotion recognition. In Experiment 3, a dissimilarity judgement task and multidimensional scaling analysis were used to probe emotional content with no emotional labels. The (...) results showed that emotions are easily recognised and discriminated on the basis of valence and arousal and with relative immediacy. Happy and sad excerpts were identified after the presentation of fewer than three musical events. With no labelling, emotion discrimination remained highly accurate and could be mapped on energetic and tense dimensions. Zipf famously stated that, if natural language lexicons are structured for efficient communication, the words that are used the most frequently should require the least effort. This observation explains the famous finding that the most frequent words in a language tend to be short. A related prediction is that, even within words of the same length, the most frequent word forms should be the ones that are easiest to produce and understand. Using orthographics as a proxy for phonetics, we test (...) this hypothesis using corpora of 96 languages from Wikipedia. We find that, across a variety of languages and language families and controlling for length, the most frequent forms in a language tend to be more orthographically well‐formed and have more orthographic neighbors than less frequent forms. We interpret this result as evidence that lexicons are structured by language usage pressures to facilitate efficient communication. (shrink)

We develop a model of ideals-based accountability which we have witnessed at work in several long-thriving family businesses. The owners and managers of these firms eschew individualism and materiality in the pursuit of ethical ideals such as supporting democracy and bettering the human condition. Although accountability is to these ideals, not for outcomes such as profitability or even reputation, IBA has resulted in outstanding reputations for some firms. We characterize IBA according to its missions, leadership, culture, and stakeholder relationships. We (...) also contrast it with traditional forms of accountability and differentiate IBA from related stakeholder, stewardship, and CSR perspectives. Finally, we examine its manifestations within five long-lived family enterprises, in the process generating propositions to advance the concept. (shrink)

Social and environmental ratings provided by social rating agencies are multidimensional. The first goal of our paper is to identify a small number of independent and relevant socially responsible (SR) dimensions reflecting a firms’ coherent posture toward social issues. We put forward that these dimensions are not exactly the same as the ESG ones (Environment, Social, and Governance). Using the six sub-ratings provided by the Vigeo rating agency, we perform a principal component analysis and we highlight three main independent SR (...) dimensions related to (1) business stakeholders (employees, customers, and suppliers), (2) societal stakeholders (environment and society), and (3) financial stakeholders (stockholders and debt holders). The second objective of our paper is to explore the link between stock returns and these three SR dimensions. Our most notable finding is that for each SR dimension, investors ask for an additional risk premium when they accept to hold non-socially responsible stocks. The cost of equity is thus lower for SR firms. The average premium over the period 2003–2010 is larger for the components “business stakeholders” and “financial stakeholders” than for the component “societal stakeholders.” The premium for this last component has only existed since the end of 2008. Since that time, environment and community involvement have become important risk factors strongly considered by investors. For the three dimensions, investors notably penalize large non-social firms and reward small social firms. (shrink)
