This article examines the process for the eviction of tenants, which offers landlords a swift path for obtaining an eviction order against their tenants, as a case study exposing the politics of procedure. It shows that the PET is but one stage in a longstanding battle waged between two interest groups—landlords and tenants—involving both substantive law and procedural law. But while the story of their conflict over substantive law, fought in the parliament through the regular legislative process, is well-known, the (...) story of the procedural amendments, despite their immense impact, remains shrouded in mystery and is told here for the first time. The reason for that, we argue, is that despite the vast impact of procedure on substantive right, many in the Israeli legal system mistakenly view civil procedure rules as highly technical and neutral directives for the day-to-day operation of the litigation process. The conclusion from such a view is that rulemaking should be left to expert legal technicians and court administrators and that transparency mechanisms or public participation are to be avoided as unnecessary due to the costs and burdens they impose on the rulemaking process. The article concludes with a call for overhauling the rulemaking process in Israel. We argue that the secretive and opaque process is anathema to democracy. Bearing in mind that procedural rules are inevitably imbued with substantive values and have an enormous effect on the substantive rights of the citizenry, the rulemaking process should be radically altered to enable all interested parties to take part in the process, making it far more transparent and subject to public scrutiny in all its stages. In this paper the concept of supervenience is employed to explain the relationship between fitness as employed in the theory of natural selection and population biology and the physical, behavioral and ecological properties of organisms that are the subjects of lower level theories in the life sciences. The aim of this analysis is to account simultaneously for the fact that the theory of natural selection is a synthetic body of empirical claims, and for the fact that it continues to be (...) misconstrued, even by biologists, for a tautological system. The notion of supervenience is then employed to provide a new statement of the relation of Mendelian predicates to molecular ones in order to provide for the commensurability and potential reducibility of Mendelian to molecular genetics in a way that circumvents the theoretical complications which appear to stand in the way of such a reduction. The underdetermination of theory by evidence must be distinguished from holism. The latter is a doctrine about the testing of scientific hypotheses; the former is a thesis about empirically adequate logically incompatible global theories or "systems of the world". The distinction is crucial for an adequate assessment of the underdetermination thesis. The paper shows how some treatments of underdetermination are vitiated by failure to observe this distinction, and identifies some necessary conditions for the existence of multiple empirically equivalent global theories. The prescriptive force of methodological rules rests, I argue, on the acceptance of scientific theories; that of the most general methodological rules rests on theories in the philosophy of science, which differ from theories in the several sciences only in generality and abstraction. I illustrate these claims by reference to methodological disputes in social science and among philosophers of science. My conclusions substantiate those of Laudan except that I argue for the existence of transtheoretical goals common to all scientists and (...) concrete enough actually to have bearing on methodology. This book is nominally about linguistic representation. But, since it is we who do the representing, it is also about us. And, since it is the universe which we represent, it is also about the universe. In the end, then, this book is about everything, which, since it is a philosophy book, is as it should be. I recognize that it is nowadays unfashionable to write books about every thing. Philosophers of language, it will be said, ought to stick to (...) writing about language; philosophers of science, to writing about science; epis temologists, to writing about knowing; and so on. The real world, however, perversely refuses to carve itself up so neatly, and, although I recognize that the real w,orld is nowadays also unfashionable, in the end I judged that one might get closer to the truth of various matters by going along with it. So I have done so. lt was Wilfrid Sellars who initially convinced me of the virtues of this way of proceeding. At this point one normally says something like "The debt that this book owes him is immense". I would say it too, were it not to understate the case, From Wilfrid, I learned to think about things. If the upshot of my thinking tends, as it obviously does, to show a general con silience with the upshot of his, it is primarily because he is so very good at it - and he had a head start. (shrink)

This article argues that at least very many judgments of homology rest on prior attributions of selected‐effect (SE) function, and that many of the “parts” of biological systems that are rightly classified as homologous are constituted by (are so classified in virtue of) their consequence etiologies. We claim that SE functions are often used in the prior identification of the parts deemed to be homologous and are often used to differentiate more restricted homologous kinds within less restricted ones. Reductionism is a metaphysical thesis, a claim about explanations, and a research program. The metaphysical thesis reductionists advance (and antireductionists accept) is that all facts, including all biological facts, are fixed by the physical and chemical facts; there are no non-physical events, states, or processes, and so biological events, states and processes are “nothing but” physical ones. The research program can be framed as a methodological prescription which follows from the claim about explanations. Antireductionism does not dispute reductionism’s metaphysical claim, (...) but rejects the explanatory claim and so the methodological moral. To a first approximation what reductionists and antireductionists disagree about is whether explanations in functional biology can be or need to be explained by or completed or perhaps replaced by explanations in terms of molecular biology.i And this disagreement over the adequacy of explanations in functional biology drives a significant methodological disagreement with consequence for the research program of biology. A religious perspective concerning the use of animal and human derived drug ingredients has not thoroughly been investigated. The purpose of this study was to clarify which parts of the medical and surgical treatments offered in western world-hospitals that conflicts with believers of major religions.

In "Events and Causality" Mark Steiner argues that though Bertrand Russell was right to claim that the laws of physics do not express causal relations, nevertheless, Russell was wrong to suppose that therefore causality plays no role in physics. I argue that Steiner misses the point of Russell's argument for the first of these claims, and because of this Steiner's argument against the second fails to controvert it. Steiner fails to see that Russell's argument against causation, is in fact an (...) argument against the existence of causal directionality or asymmetry. Steiner gives no reason to suppose physical theory requires this asymmetry after all. (shrink)

Almost exactly ten years ago, the now extinct U.S. Congress, Office of Technology Assessment (OTA) released a major report -- The Electronic Supervisor: New Technology, New Tensions. This report describes a number of new technologies available to management in its ongoing search to ensure that labour performs its required job to management's rigid specifications. Social issues raised with respect to electronic monitoring included privacy, fairness, quality of working life, and stress-related illnesses. The study was also concerned with drug testing, genetic (...) screening, polygraph testing, as well as a variety of technologies for eavesdropping and monitoring. It seems to be appropriate to evaluate the analyses and recommendations made in the report and to extend the evaluation to current technologies. (shrink)

We concur with Cohen Kadosh & Walsh (CK&W) that representation of numbers in the parietal cortex is format dependent. In addition, we suggest that all formats do not automatically, and equally, access analog magnitude representation in the intraparietal sulcus (IPS). Understanding how development, learning, and context lead to differential access of analog magnitude representation is a key question for future research.

De gustibus non est disputandum. This maxim reflects a fundamental problem both for the study of markets and for the concern with morals. The problem is the intractability of tastes coupled with their indispensability for both positive and normative economics. Tastes are indispensable in positive microeconomic theory because, under the label ‘preferences,’ they, together with expectations, determine choice and behavior.
