Philosophy of mind and cognitive science (e.g., Clark and Chalmers 1998; Clark 2010; Palermos 2014) have recently become increasingly receptive tothe hypothesis of extended cognition, according to which external artifacts such as our laptops and smartphones can—under appropriate circumstances—feature as material realisers of a person’s cognitive processes. We argue that, to the extent that the hypothesis of extended cognition is correct, our legal and ethical theorising and practice must be updated, by broadening our conception of personal assault so as to (...) include intentional harm towards gadgets that have been appropriately integrated. We next situate the theoretical case for extended personal assault within the context of some recent ethical and legal cases and close with some critical discussion. (shrink)

This paper reads Republic 583b-608b as a single, continuous line of argument. First, Socrates distinguishes real from apparent pleasure and argues that justice is more pleasant than injustice. Next, he describes how pleasures nourish the soul. This line of argument continues into the second discussion of poetry: tragic pleasures are mixed pleasures in the soul that seem greater than they are; indulging them nourishes appetite and corrupts the soul. The paper argues that Plato has a novel account of the ‘paradox (...) of tragedy’, and that the Republic and Philebus contain complementary discussions of tragic and comic pleasure. (shrink)

Defending Life is arguably the most comprehensive defense of the pro-life position on abortion - morally, legally, and politically - that has ever been published in an academic monograph. It offers a detailed and critical analysis of Roe v. Wade and Planned Parenthood v. Casey as well as arguments by those who defend a Rawlsian case for abortion-choice, such as J. J. Thomson. The author defends the substance view of persons as the view with the most explanatory power. The substance (...) view entails that the unborn is a subject of moral rights from conception. While defending this view, the author responds to the arguments of thinkers such as Boonin, Dworkin, Stretton, Ford and Brody. He also critiques Thomson's famous violinist argument and its revisions by Boonin and McDonagh. If affirmative action and other ethnicity-based social programs are justified, then J. Angelo Corlett believes it is important to come to an adequate understanding of the nature of ethnicity in general and ethnic group membership in particular. In Race, Racism, and Reparations, Corlett reconceptualizes traditional ideas of race in terms of ethnicity. As he makes clear, the answers to the questions "What is a Native American?" or "What is a Latino?" have important implications for public policy, especially for those programs (...) designed to address historic injustices and economic and social imbalances among different groups in our society. Having supplanted "race" with a well-defined concept of ethnicity, the author then analyzes the nature and function of racism. Corlett argues for a notion of racism that must encompass not only racist beliefs but also racist actions, omissions, and attempted actions. His aim is to craft a definition of racism that will prove useful in legal and public policy contexts. Corlett places special emphasis on the broad questions of whether reparations for ethnic groups are desirable and what forms those reparations should take: land, money, social programs? He addresses the need for differential affirmative action programs and reparations policies—the experiences of different ethnic groups vary greatly. Arguments for reparations to Native and African Americans are considered in light of a variety of objections that are or might be raised against them. Corlett articulates and critically analyzes a number of possible proposals for reparations. (shrink)

Collingwood’s aim in The Principles of Art is “to answer the question: What is art?” (p. 1) The answer Collingwood offers to that question, that art is the expression of emotion, has become notorious for its implausibility. I consider one objection against this theory, namely that it is unclear what is rendered art by this definition: for it sometimes appears to define art too broadly, containing all utterances and gestures; but at other times to define art too narrowly, excluding much (...) of what we intuitively consider art. -/- I argue that this objection is mistaken, because it is founded upon a misunderstanding of the sort of project in which Collingwood is engaged. I propose a new reading, via his philosophical methodology, under which ‘art’ is differentially rather than binarily realisable. According to this new reading, art is something found in every human experience or activity, but to a greater or lesser extent. I close by suggesting one reason why Collingwood’s project under this reading is more philosophically interesting than it is under the standard reading, namely that it can give a better account of borderline cases of art. Asylum has become a highly charged political issue across developed countries, raising a host of difficult ethical and political questions. What responsibilities do the world's richest countries have to refugees arriving at their borders? Are states justified in implementing measures to prevent the arrival of economic migrants if they also block entry for refugees? Is it legitimate to curtail the rights of asylum seekers to maximize the number of refugees receiving protection overall? This book draws upon political and ethical theory (...) and an examination of the experiences of the United States, Germany, the United Kingdom and Australia to consider how to respond to the challenges of asylum. In addition to explaining why asylum has emerged as such a key political issue in recent years, it provides a compelling account of how states could move towards implementing morally defensible responses to refugees. Hind Swaraj is Mahatma Gandhi's fundamental work. Not only is it key to understanding his life and thoughts, but also the politics of South Asia in the first half of the twentieth century. Celebrating 100 years since Hind Swaraj was first published in a newspaper, this centenary edition includes a new Preface and Editor's Introduction, as well as a new chapter on 'Gandhi and the 'Four Canonical Aims of Life''. Artificial Neural Networks have reached “grandmaster” and even “super-human” performance across a variety of games, from those involving perfect information, such as Go, to those involving imperfect information, such as “Starcraft”. Such technological developments from artificial intelligence (AI) labs have ushered concomitant applications across the world of business, where an “AI” brand-tag is quickly becoming ubiquitous. A corollary of such widespread commercial deployment is that when AI gets things wrong—an autonomous vehicle crashes, a chatbot exhibits “racist” behavior, automated credit-scoring processes (...) “discriminate” on gender, etc.—there are often significant financial, legal, and brand consequences, and the incident becomes major news. As Judea Pearl sees it, the underlying reason for such mistakes is that “... all the impressive achievements of deep learning amount to just curve fitting.” The key, as Pearl suggests, is to replace “reasoning by association” with “causal reasoning” —the ability to infer causes from observed phenomena. It is a point that was echoed by Gary Marcus and Ernest Davis in a recent piece for theNew York Times: “we need to stop building computer systems that merely get better and better at detecting statistical patterns in data sets—often using an approach known as ‘Deep Learning’—and start building computer systems that from the moment of their assembly innately grasp three basic concepts: time, space, and causality.” In this paper, foregrounding what in 1949 Gilbert Ryle termed “a category mistake”, I will offer an alternative explanation for AI errors; it is not so much that AI machinery cannot “grasp” causality, but that AI machinery (qua computation) cannot understand anything at all. This article returns to a philosophical conundrum that has troubled feminist theory since the topic of sexual violence has been taken seriously, what I call the problem of the “heteronormative sexual continuum”: how sexual assault and hegemonic heterosex are conceptually and politically related. I continue my response to the work of Nicola Gavey, who has argued for the existence of a “gray area” of sexual interactions that are ethically questionable without rising to the category of sexual assault, but whose analysis (...) did not explicitly articulate what these two categories share or what distinguishes them from each other. After summarizing Gavey's position, I summarize my previous articulation of the common ground between instances of sexual assault and examples of sexual interactions in the “gray area.” I then develop a theoretical account of how the two categories differ, arguing that the victim's agency plays different roles in the two types of interactions. Both the fact of that distinction—that we are capable of providing a philosophical account of the difference between sexual interactions that fall into the gray area and those that constitute sexual assault—and its particular content are crucial for the development of a tenable feminist sexual ethics. This paper provides a philosophical analysis of the Price equation and its role in evolutionary theory. Traditional models in population genetics postulate simplifying assumptions in order to make the models mathematically tractable. On the contrary, the Price equation implies a very specific way of theorizing, starting with assumptions that we think are true and then deriving from them the mathematical rules of the system. I argue that the Price equation is a generalization-sketch, whose main purpose is to provide a unifying (...) framework for researchers, helping them to develop specific models. The Price equation plays this role because, like other scientific principles, shows features as abstractness, unification and invariance. By underwriting this special role for the Price equation some recent disputes about it could be diverted. (shrink)

John and Mary have fully consensual sex, but they do not want to have a child, so they use contraception with the intention of avoiding pregnancy. Unfortunately, although they used the contraception in the way in which it is supposed to be used, Mary has become pregnant. The couple decides to have the baby, whom they name ‘Ernie’. Now we fill in the story a bit. The universe is causally deterministic, and 30 years later Ernie performs some action A and (...) thereby brings about event E. We also stipulate that Ernie meets plausible compatibilist conditions for acting freely . That is, we suppose that there are no uncontroversially freedom- and responsibility-undermining conditions present in the context in which Ernie performs A, and, further, that Ernie meets plausible compatibilist conditions for acting freely. Let us say, for example, that one adopts the theory according to which the freedom-relevant condition on moral responsibility is that the agent exhibits ‘guidance control’ of his action and . On this approach, one acts freely in so far as one acts from one's own, suitably reasons-responsive mechanism. We can then simply stipulate that, in the relevant context, Ernie acts from his own, suitably reasons-responsive mechanism . If one prefers a different set of compatiblist-friendly conditions for acting freely, one can simply stipulate that Ernie meets them; indeed, the plausible compatibilist-friendly conditions seem to be compatible with each other, and thus Ernie could presumably meet all of them in the relevant context. ABSTRACT This paper argues that striving is a cardinal virtue in sport and life. It is an overlooked virtue that is an important component of human happiness and a source of a sense of dignity. The human psychological capacity for striving emerged as a trait for addressing the entropic features of our existence, but it can be engaged and used for other purposes. Sport is one such example. Sport appears exceptional in being designed specifically to test and display our capacities (...) to strive. Although striving is connected to pursuit of excellence in sport, it supports a more democratic conception of the value of sport than achievement-oriented perfectionist accounts. (shrink)

This article argues that, despite their distance across the colonial divide, a creolizing reading of Frantz Fanon and Paul Ricœur can yield valuable insights into decoloniality. Tracing their shared philosophical concerns with embodied phenomenology, social ontology and recognition, I argue that their respective accounts of sociogeny and hermeneutics can be productively read together as describing a shared end of mutual recognition untainted by racism or coloniality – a ‘new skin’ for humanity, as Fanon describes it. More specifically, Fanon contributes to (...) Ricœur an understanding of how divergences in social location can be overcome through liberatory action that posits a new logic of sociality; likewise, Ricœur provides Fanon with an account of how liberatory horizons are produced through this praxis, based on the imaginative connection between ideology and utopia. This article concludes by arguing that these congruent methodological and normative concerns can be read together to concretize – and potentially actualize – the utopic end of liberatory struggle in mutual recognition through fashioning this new skin. Head transplantation fits within the broader conceptual space occupied by transhumanists and others who seek to extend the lives of human beings indefinitely. It is reasonable to reflect on whether, under what circumstances, and in what ways human immortality would be good. In this paper, I disambiguate the ways in which immortality might be considered a human good and then argue that immortality is neither necessary nor sufficient condition for objective meaning in life. Neorepublicanism holds that domination is the foremost political evil. More, it claims to be able to address today’s most pressing issues. It follows that neorepublicanism should, then, speak to questions of migration, membership, and domination. However, this is not the case. Some critical voices inspired by the idea of non-domination arrive at interesting critiques of migration, membership, and domination, but their answers are often partial and in some ways problematic. They are also largely ahistorical. The contemporary paucity of neorepublican reflections (...) on migration contrasts sharply with its centrality in republican history. In the US, from the colonial period until late into the 19th century, some republicans understood the domination of migrants and citizens as conjoined concerns. They developed a robust account of the relationship between domestic domination and exclusionary migration regimes. They conceptualized the republic as a global asylum where membership is based on volitional allegiance, and they vigorously defended the right of aliens to expatriate. Those ideas were ultimately defeated by aristocratic, oligarchic, and statist forces. This article explicates that history through a genealogical account of what I call ‘insurgent republicanism’. The article then returns to contemporary theorization to diagnose its limitations, continuities, and potentials as seen from the perspective of the insurgent republican tradition. (shrink)

This book is about the influence of varying theological conceptions of contingency and necessity on two versions of the mechanical philosophy in the seventeenth century. Pierre Gassendi and René Descartes both believed that all natural phenomena could be explained in terms of matter and motion alone. They disagreed about the details of their mechanical accounts of the world, in particular about their theories of matter and their approaches to scientific method. This book traces their differences back to theological presuppositions they (...) inherited from the Middle Ages. Theological ideas were transformed into philosophical and scientific ideas which led to the emergence of different styles of science in the second half of the seventeenth century. (shrink)

This paper will develop the concept of semiogenesis – a process of novel sign generation – and how instances of this process, such as agency, relate to their built environment and beyond. Section two will build on Hoffmeyer’s discussion of swarms, specifically the idea of overlapping swarms and its manifestation in the creation of termite mounds, in order to introduce three types of structure. Building upon this real-world example explored in section two, the third section will present a heuristic for (...) semiogenesis: a neuromorphic dynamic system model grounded in information and thermodynamic theory. Through the lens of this heuristic model, the penultimate section will more rigorously characterize the similarities and differences between termite and human agency in their respective built milieus. The author identifies the structure of Sharon Street's skeptical challenge to non-naturalist, normative epistemic realism as an argument that NNER is liable to reliability defeat and then argues that Street's argument fails, because it itself is subject to reliability defeat. As the author reconstructs Street's argument, it is an argument that the normative epistemic judgments of the realist could only be probabilistically sensitive to normative epistemic truths by sheer chance. The author then recaps Street's own naturalist translation of normative epistemic (...) judgments into purely descriptive, contingent probability statements, and argues that, on her own terms, the reasoning that leads her to rationally believe in evolutionary theory could only be probabilistically sensitive to the relevant purely descriptive, contingent probabilities by sheer chance. The author's argument is addressed to Street, but it applies to all evolutionary naturalist accounts of epistemic rationality. The author explains how his argument differs from Plantinga's Evolutionary Argument Against Naturalism and shows how it avoids the objections to Plantinga's EAAN. The author closes with the outline of an explanation of how evolution could have made human reasoning probabilistically sensitive to metaphysically necessary normative epistemic standards, even though those standards did not exert and, indeed, could not have exerted any kind of causal influence on the evolutionary process. Origin of life on earth transpired once and from then on, it emerges as an endless eternal process. Matter and energy are constants of the cosmos and the hypothesis is that the origin of life is a moment when these constants intertwined or interacted. Energy from the cosmos interacted with inorganic matter to support matter with retention of this riveted energy, as energy to be circulated within the primitive channelized structures to conserve energy by the materialization of the proton homeostasis (...) mechanisms developed from the obtainable inorganic matter. The driver for these processes as we now confirm, exists in the quantum world and through quantum phenomenal processes could have combined these constants to create the magic of life. Primitive earth was a chemical reactive system that triggered a macromolecular evolution by means of open thermodynamic systems, driven by cyclic gradients of temperature, electromagnetic radiation and chemical potentials which sustained life and proto-consciousness in the first life forms driven by the quantum processes. The origin of life is always an intriguing topic but the purpose for finding the cause should never be inclined towards obliterating it; for if that is the case, the further we seek, the farther it will go. Every action, touch, utterance, and look, every listening, taste, smell, and feel is a living question; but it is no ordinary propositional one-by-one question, rather it is a plenisentient sensing and probing non-propositional enquiry about how our world is, in its present continuous sense, and in relation to how we anticipate its becoming. I will take this assumption as my first premise and, by using the notion of enkinaesthesia, I will explore the ways in which an agent’s affectively-saturated co-engagement with (...) its world establishes patterns of co-articulation of meaning within the anticipatory affective dynamics and the experiential entanglement necessary for expedient action and adaptation. In advancing this thesis I will reject the minimalist notions of embodiment by amplifying and extending the claims made by the most radical of the embodied mind theories. Crucially, I will offer a new wave of embodiment theory which has at its core the radical extension of sensorimotor affect into the life and being of other agents where their experience is for us both direct and immediate. While my own philosophical views are largely in keeping with my mentor, Dallas Willard, nevertheless, I find his conception of the human person puzzling, hard to specify precisely, and prima facie contradictory in a few places. Dallas's central goal in formulating his anthropology was to develop a model that shed light on, allowed for deeper insight into, and fostered interest in spiritual formation, especially the role of the body in spiritual maturation. I share this goal, and agree with most of (...) his model. But in what follows, I will make more precise what his views were, try to clear up what, prima facie, seem to be contradictions in his theory, and, finally, recommend an alternative that captures the central concerns Dallas had for his own position. Thus, I will lay out a few general points of Dallas's ontology, provide a description of his philosophical/theological anthropology, along with two problems that seem to be present, and offer a slightly adjusted alternative to his position that accomplishes his main goal in a way with which I believe he would be satisfied. Clear and careful thinking is an indispensable aid in the pursuit of answers to the difficult ethical question faced by clinicians, patients, and families. In this issue of The Journal of Medicine and Philosophy devoted to issues in clinical ethics, the authors engage in this enterprise by reflecting on morally good medical decision making, conscientious objection, presumed consent in organ donation, the permissibility of surrogate decision making, and the failure of legislative limits on the scope of euthanasia in Belgium.

This article reflects on the author's modest experience as an expert witness in two trials: Osheroff vs. Greenspan (1983), and In the Matter of Baby K (1994). Bioethicists' expertise as scholar-teachers and consultants on particular issues merits qualification by judges as expert witnesses. The article argues that a different kind of expertise – strong moral advocacy – is required to be an effective expert witness. The major lessons of expert witnessing for the author concern the demands and strains on the (...) bioethicist's role as scholar, teacher, and consultant. The Baby K case is analyzed in some detail, due to its importance for bioethics, ethics consultation, and the testimony of bioethicists on either side of the case. Rules of thumb are offered to guide decisions as to choices regarding expert witnessing, as well as a discussion of the interaction of law and bioethics. (shrink)

Measurement realism, the view that measurement targets quantitative attributes and that not all attributes are quantitative, has come under attack both from metrologists and philosophers. In this paper, I take a close look at two influential arguments against measurement realism: the argument from obsolescence and the argument from coordination. I concede that these arguments do challenge the epistemological position traditionally taken by measurement realists, but argue that the metaphysical core of measurement realism survives the challenge posed by these arguments. Prof. Alberto Urquidez, in an important recent article that appears in different form in his book, Redefining Racism, offers an informed, sustained, careful, multi-pronged, and sometimes original critique of the volitional analysis of racism, which I have proposed in a series of articles over the past two dozen years. Here I expand and improve VAR’s analysis of paternalistic racists and their beliefs, clarify its ‘infection’-model’s explanation of racism’s spread and variety, and lay out what it is for something to be (...) ‘characteristically’ racist, an understanding that I then use to offer a unified account of the way in which both certain physical objects and certain abstract objects can properly be called racist. Identifying and engaging some presuppositions behind Urquidez’s social, political, and moral criticisms of VAR, I respond to complaints from him and others, showing that VAR’s content is neither politically conservative nor dependent on religious doctrine, and point out that race theory would in fact profit from taking more seriously and internalizing the Christian morality of most African-Americans. The reception history of the French Revolution in France and England is well documented among Anglophone scholars; however, the debate over the Revolution in Germany is much less well known. Fichte's Contribution played an important role in this debate. Presented here for the first time in English, Fichte's work provides a distinctive synthesis of Locke's "possessive individualism," Rousseau's general will, and Kant's moral philosophy. This eclectic blend results in an unusual rights theory that at times veers close to a form (...) of anarchism. Written in 1792–93, just before Fichte moved to Jena to develop his philosophical system in a series of works—above all the Wissenschaftslehre of 1794—the Contribution provides invaluable insight into Fichte's early development. In addition, Fichte's work predates much of Kant's political philosophy, and can shed light on the rich dialogue in German political thought in the 1790s. (shrink)

In the summer of 1979, a group of experts on law, medicine, and ethics assembled in Siracusa, Sicily, under the auspices of the International Commission of Jurists and the International Institute of Higher Studies in Criminal Science, to draft guidelines on the rights of persons with mental illness. Sitting across the table from me was a quiet, proud man of distinctive intelligence, William J. Curran, Frances Glessner Lee Professor of Legal Medicine at Harvard University. Professor Curran was one of the (...) principal drafters of those guidelines. Many years later in 1991, after several subsequent re-drafts by United Nations Rapporteur Erica-Irene Daes, the text was adopted by the U.N. General Assembly as the Principles for the Protection of Persons with Mental Illness and for the Improvement of Mental Health Care. This was the kind of remarkable achievement in the field of law and medicine that Professor Curran repeated throughout his distinguished career. (shrink)
