In this paper I discuss a recent exchange of articles between Hugh McLachlan and John Coggon on the relationship between omissions, causation, and moral responsibility. My aim is to contribute to their debate by isolating a presupposition I believe they both share and by questioning that presupposition. The presupposition is that, at any given moment, there are countless things that I am omitting to do. This leads both McLachlan and Coggon to give a distorted account of the relationship between causation (...) and moral or (as the case may be) legal responsibility and, in the case of Coggon, to claim that the law’s conception of causation is a fiction based on policy. Once it is seen that this presupposition is faulty, we can attain a more accurate view of the logical relationship between causation and moral responsibility in the case of omissions. This is important because it will enable us, in turn, to understand why the law continues to regard omissions as different, both logically and morally, from acts, and why the law seeks to track that logical and moral difference in the legal distinction it draws between withholding life-sustaining measures and euthanasia. Traditions and rituals play an important role in all facets of human behavior, and those connected with government tell us much about the society in which they are practiced. They point to the history, values, and self-image of the society, and any change in their content or practice reflects a revision of that status, a realignment of the self-image. Among the many traditions that had grown over the centuries and that both framed and shaped the activities and the image of (...) the Florentine government, those of the mensa of the Signoria were particularly significant. From the beginning of the Priorate in 1282, the mensa, the twice-daily communal meals held in the privacy of the Palace of the Signoria, had been conducted with a decorum that emphasized the way in which the executives of the government viewed themselves and their office. When alterations were made to some of these practices in the 1380s, they reflected fundamental changes in the self-perception of the members of the Signoria, and by extension of the city-state as a whole. The alteration on which I wish to focus involves the dinner music, a seemingly insignificant change but one that reflects a profound reorientation of cultural values. Some of the facts of the change have been reported previously in passing, but their significance has gone unnoticed until now. (shrink)

The Ontology for Biomedical Investigations (OBI) is an ontology that provides terms with precisely defined meanings to describe all aspects of how investigations in the biological and medical domains are conducted. OBI re-uses ontologies that provide a representation of biomedical knowledge from the Open Biological and Biomedical Ontologies (OBO) project and adds the ability to describe how this knowledge was derived. We here describe the state of OBI and several applications that are using it, such as adding semantic expressivity to (...) existing databases, building data entry forms, and enabling interoperability between knowledge resources. OBI covers all phases of the investigation process, such as planning, execution and reporting. It represents information and material entities that participate in these processes, as well as roles and functions. Prior to OBI, it was not possible to use a single internally consistent resource that could be applied to multiple types of experiments for these applications. OBI has made this possible by creating terms for entities involved in biological and medical investigations and by importing parts of other biomedical ontologies such as GO, Chemical Entities of Biological Interest (ChEBI) and Phenotype Attribute and Trait Ontology (PATO) without altering their meaning. OBI is being used in a wide range of projects covering genomics, multi-omics, immunology, and catalogs of services. OBI has also spawned other ontologies (Information Artifact Ontology) and methods for importing parts of ontologies (Minimum information to reference an external ontology term (MIREOT)). The OBI project is an open cross-disciplinary collaborative effort, encompassing multiple research communities from around the globe. To date, OBI has created 2366 classes and 40 relations along with textual and formal definitions. The OBI Consortium maintains a web resource providing details on the people, policies, and issues being addressed in association with OBI. (shrink)

Decision-making regarding treatment for newborns with disabilities in resource-poor settings is a difficult process that can put parents and caregivers in conflict. Despite several guidelines that have helped to clarify some of the medical decision-making in Ghana, there is still no clear consensus on the specific moral criteria to be used. This article presents the case of a mother who expressed her wish that her child with Down syndrome should not have been resuscitated at birth. It explores the ethical issues (...) at stake in both her misgivings about the resuscitation and her unwillingness to consider surgical repair of an atrioventricular (AV) canal defect. Knowing that children born with Down syndrome are able to pursue life’s goals, should our treatment of complete AV canal defect in such children be considered morally obligatory, even in resource-poor settings like Ghana? It has been suggested that water and social values were divorced in modernity. This paper argues otherwise. First, it demonstrates the historical link between ethics and politics using the case of American water governance. It engages theories regarding state-centric water planning under ‘high modernism’ and the claim that water was seen as a neutral resource that could be objectively governed. By developing an alternate view from the writings of early American water leaders, J.W. Powell and W.J. McGee, the paper (...) offers a way to understand the project of state-centred governance without the claim that water falls to the latter half of a society/nature dualism. Second, the paper reviews how the emerging ‘water ethics’ discourse helps organise both the ethical and legal norms at play within contemporary political shifts towards decentralised governance. The review identifies how McGee's early influence may warrant more attention, both in terms of water governance and environmental ethics. The paper concludes by arguing that, given the arguments presented, success in decentralising water governance turns not only on political considerations, but also on fairly ordering normative claims as part of fostering and extending the reach of coordinated water governance. *This work is no longer under development* Two major themes in the literature on indicative conditionals are that the content of indicative conditionals typically depends on what is known;1 that conditionals are intimately related to conditional probabilities.2 In possible world semantics for counterfactual conditionals, a standard assumption is that conditionals whose antecedents are metaphysically impossible are vacuously true.3 This aspect has recently been brought to the fore, and defended by Tim Williamson, who uses it in to characterize alethic necessity by (...) exploiting such equivalences as: A⇔¬A A. One might wish to postulate an analogous connection for indicative conditionals, with indicatives whose antecedents are epistemically impossible being vacuously true: and indeed, the modal account of indicative conditionals of Brian Weatherson has exactly this feature.4 This allows one to characterize an epistemic modal by the equivalence A⇔¬A→A. For simplicity, in what follows we write A as KA and think of it as expressing that subject S knows that A.5 The connection to probability has received much attention. Stalnaker suggested, as a way of articulating the ‘Ramsey Test’, the following very general schema for indicative conditionals relative to some probability function P: P = P 1For example, Nolan ; Weatherson ; Gillies. 2For example Stalnaker ; McGee ; Adams. 3Lewis. The plausibility of this characterization will depend on the exact sense of ‘epistemically possible’ in play—if it is compatibility with what a single subject knows, then can be read ‘the relevant subject knows that p’. In his article, Vsevolod Ladov poses an important question – might paradoxes admit of a uniform solution? As an answer, I propose looking at an approach in which it is argued that we must recognize the truth predicate as merely analogous to a vague predicate. The proponents of this approach (V. McGee, J. Tappenden, H. Field, G. Priest and D. Hyde) insist that there is a structural relation between sorites paradoxes and self-reference paradoxes and that they should have a (...) unified solution. Mathematical realism is the doctrine that mathematical objects really exist, that mathematical statements are either determinately true or determinately false, and that the accepted mathematical axioms are predominantly true. A realist understanding of set theory has it that when the sentences of the language of set theory are understood in their standard meaning, each sentence has a determinate truth value, so that there is a fact of the matter whether the cardinality of the continuum is א2 or whether there are (...) measurable cardinals, whether or not those facts are knowable by us. This paper provides a new rationale for equating brain death with the death of the human organism, in light of well-known criticisms made by Alan D Shewmon, Franklin Miller and Robert Truog and a number of other writers. We claim that these criticisms can be answered, but only if we accept that we have slightly redefined the concept of death when equating brain death with death simpliciter. Accordingly, much of the paper defends the legitimacy of redefining death against objections, before (...) turning to the specific task of defending a new rationale for equating brain death with death as slightly redefined. Tarski and Mautner proposed to characterize the "logical" operations on a given domain as those invariant under arbitrary permutations. These operations are the ones that can be obtained as combinations of the operations on the following list: identity; substitution of variables; negation; finite or infinite disjunction; and existential quantification with respect to a finite or infinite block of variables. Inasmuch as every operation on this list is intuitively "logical", this lends support to the Tarski-Mautner proposal.

Conceived as a solution to clinical dilemmas, and now required by organizations for hospital accreditation, ethics committees have been subject only to small-scale studies. The wide use of ethics committees and the diverse roles they play compel study. In 1999 the University of Pennsylvania Ethics Committee Research Group (ECRG) completed the first national survey of the presence, composition, and activities of U.S. healthcare ethics committees (HECs). Ethics committees are relatively young, on average seven years in operation. Eighty-six percent of ethics (...) committees report that they play a role in ongoing clinical decision making through clinical ethics consultation. All are engaged in developing institutional clinical policy. Although 4.5% of HECs write policy on managed care, 50% of HEC chairs feel inadequately prepared to address managed care. The power and activity of ethics committees parallels the composition of those committees and the relationship of members to their institutions. The role of ethics committees across the nation in making policies about clinical care is greater than was known, and ethics committees will likely continue to play an important role in the debate and resolution of clinical cases and clinical policies. This is not an overly ambitious paper. What I would like to do is to take a thesis that most people would regard as wildly implausible, and convince you that it is, in fact, false. What's worse, the argument I shall give is by no means airtight, though I hope it's reasonably convincing. The thesis has to do with the fuzzy boundaries of terms that refer to familiar middle-sized objects, terms like ‘Kilimanjaro’ and ‘the tallest mountain in Africa.’ It is (...) intuitively clear that Kilimanjaro has a fuzzy boundary, so that there are some clods of earth at the base of the mountain for which there isn't anything, either in our practices in using the word ‘Kilimanjaro’ or in the facts of geography, that determines an answer to the question whether the clod is a part of Kilimanjaro. That reference is inscrutable is demonstrated, it is argued, not only by W. V. Quine's arguments but by Peter Unger's "Problem of the Many." Applied to our own language, this is a paradoxical result, since nothing could be more obvious to speakers of English than that, when they use the word "rabbit," they are talking about rabbits. The solution to this paradox is to take a disquotational view of reference for one's own language, so that "When I use 'rabbit,' I (...) refer to rabbits" is made true by the meaning of the word "refer." The reference relation is extended to other languages by translation. The explanation for this peculiarly egocentric conception of semantics-questions of others' meanings are settled by asking what I mean by words of my language-is to be found in our practice of predicting and explaining other people's behavior by empathetic identification. In 1992, the Joint Commission on the Accreditation of Healthcare Organizations (JCAHO) passed a mandate that all its approved hospitals put in place a means for addressing ethical concerns.Although the particular process the hospital uses to address such concernsmay vary, the hospital or healthcare ethics committee (HEC) is used most often. In a companion study to that reported here, we found that in 1998 over 90% of U.S. hospitals had ethics committees, compared to just 1% in 1983, and that many (...) have some and a few have sweeping clinical powers in hospitals. In a first major study, the UK’s Royal Society found that 76% of people in the UK are in favour of therapeutic germline genomic editing to correct genetic diseases in human embryos, but found there was little appetite for germline genomic editing for non‐therapeutic purposes. Assuming the UK and other governments acted on these findings, can lawmakers and policymakers coherently regulate the use of biomedical innovations by permitting their use for therapeutic purposes but prohibiting their use for enhancement purposes? This (...) paper examines the very common claim in the enhancement literature that the therapy v enhancement distinction does little meaningful work in helping us think through the ethical issues, a claim that has significant implications for these lawmakers and policymakers who may wish to regulate genomic editing techniques to reflect the findings of this important study. In 1944, Martin Crowe, a Catholic priest, wrote a doctoral dissertation titled The Moral Obligation of Paying Just Taxes. His dissertation summarized and analyzed 500 years of theological and philosophical debate on this topic, much of which took place in Latin. Since Crowe’s dissertation, not much has been written on the topic of tax evasion from an ethical perspective, with a few exceptions. In 1998 and 1999, a few articles were published on the ethics of tax evasion in the Journal (...) of Accounting, Ethics & Public Policy. An edited book on this topic was published in 1998. The present paper summarizes, updates and expands on Crowe’s work and the other more recent work that has been published on this topic. Three basic views on the ethics of tax evasion have emerged over the centuries. This article presents and critiques those three views and raises some questions about points that have not yet been explored in the literature. (shrink)

Insider trading has received a bad name in recent decades. The popular press makes it sound like an evil practice where those who engage in it are totally devoid of ethical principles. Yet not all insider trading is unethical and some studies have concluded that certain kinds of insider trading are actually beneficial to the greater investment community. Some scholars in philosophy, law and economics have disputed whether insider trading should be punished at all while others assert that it should (...) be illegal in all cases. This paper explores the nature of insider trading and analyzes the issues to determine the positive and negative aspects of insider trading, and how policy should be changed. The best hope would be for studies to be made that isolate the individuals or groups who are fraudulently harmed by insider trading. If any such groups exist, then clearly worded legislation could be passed to prevent any fraud from being committed against these individuals and groups, while allowing non-fraudulent transactions to be completed without fear of prosecution. Until it can be clearly determined that someone is fraudulently harmed by insider trading, there should be no law or regulation restricting the practice, since such restrictions violate individual rights and will likely have a negative market reaction. Deflationists about truth embrace the positive thesis that the notion of truth is useful as a logical device, for such purposes as blanket endorsement, and the negative thesis that the notion doesn’t have any legitimate applications beyond its logical uses, so it cannot play a significant theoretical role in scientific inquiry or causal explanation. Focusing on Christopher Hill as exemplary deflationist, the present paper takes issue with the negative thesis, arguing that, without making use of the notion of truth conditions, (...) we have little hope for a scientific understanding of human speech, thought, and action. For the reference relation, the situation is different. Inscrutability arguments give reason to think that a more-than-deflationary theory of reference is unattainable. With respect to reference, deflationism is the only game in town. (shrink)

This paper examines the recent prominent view in medical ethics that withdrawing life-sustaining treatment is an act of killing. I trace this view to the rejection of the traditional claim that withdrawing LST is an omission rather than an act. Although that traditional claim is not as problematic as this recent prominent view suggests, my main claim is that even if we accepted that withdrawing LST should be classified as an act rather than as an omission, it could still be (...) classified as letting die rather than killing. Even though omissions are contrasted with acts, letting die need not be, for one can let die by means of acts. The remainder of the paper is devoted to establishing this claim and addresses certain objections to it. (shrink)

The common view is that insider trading is always unethical and illegal. But such is not the case. Some forms of insider trading are legal. Furthermore, applying ethical principles to insider trading causes one to conclude that it is also sometimes ethical. This paper attempts to get past the hype, the press reports, and the political grandstanding to get to the truth of the matter. The author applies two sets of ethical principles – utilitarianism and rights theory – in an (...) attempt to determine when, and in what circumstances, insider trading is ethical. The views of Henry Manne, an early proponent of insider trading, are critically examined, as are the major arguments against insider trading. Is insider trading good for the company if it is used as a form of executive compensation which makes it possible to pay lower salaries than would otherwise be the case? Does insider trading cause the stock market to work more efficiently? If insider trading does increase efficiency, is that sufficient to call for its total legalization, or are there other things to be considered? Several arguments against insider trading have been put forth over the last few decades but there are problems with all of them. One of the main arguments is the fairness argument. The problem with this argument is that different people have different definitions of unfairness. A closely related argument is the level playing field argument, which advocates wider dissemination of information so that it is less asymmetric. One problem with the level playing field argument is that it is better applied to sporting competitions than to trading in information. Some economists argue that forcing the disclosure of nonpublic information can actually result in more harm than good and must necessarily involve the violation of property rights. Other arguments examined in this chapter include the fiduciary duty argument, the problem of outside traders, the misappropriation doctrine and the restrictions that insider trading laws place on freedom of speech and press. The article concludes by setting forth some principles or guidelines to determine when insider trading should be punished and when it should not. (shrink)

Over the past few decades, a body of research has developed examining the academic dishonesty of university and college students. While research has explored academic dishonesty amongst American criminal justice and policing students, no research has specifically focused on investigating the dynamics and correlates of academic dishonesty amongst Australian criminology students. This study drew upon data obtained from a survey of 79 undergraduate criminal justice and policing students studying at an Australian university. Overall, the results suggest that male gender, viewing (...) academic dishonesty as less serious and holding justifications for engaging in this type of behaviour were significant predictors of self-reported academic dishonesty. The findings suggest that more proactive strategies need to be implemented by universities to prevent student involvement in academic dishonesty. (shrink)
