William Jaworski shows how hylomorphism can be used to solve mind-body problems--the question of how thought, feeling, perception, and other mental phenomena fit into the physical world. Hylomorphism claims that structure is a basic ontological and explanatory principle, and is responsible for individuals being the kinds of things they are, and having the powers or capacities they have. From a hylomorphic perspective, mind-body problems are byproducts of a worldview that rejects structure, and which lacks a basic principle which distinguishes (...) the parts of the physical universe that can think, feel, and perceive from those that can't. Without such a principle, the existence of those powers in the physical world can start to look inexplicable and mysterious. Mereonominalism, holonominalism, and part-whole realism represent competing views on the metaphysics of parts and wholes. Mereonominalism claims that what parts exist is a function of the concepts we use in describing composite wholes. Holonominalism claims that what composite wholes exist is a function of the concepts we use in describing things that can qualify as parts. Part-whole realism claims that parts and wholes exist independent of our concepts. I argue that all three views face problems, but that the problem facing (...) part-whole realism can be solved by adopting a version of hylomorphism that takes its cue from Aristotle’s account of form. The multiple-realizability argument has been the mainstay ofanti-reductionist consensus in philosophy of mind for the past thirty years. Reductionist opposition to it has sometimes taken the form of the Disjunctive Move: If mental types are multiply-realizable, they are not coextensive with physical types; they might nevertheless be coextensive with disjunctionsof physical types, and those disjunctions could still underwrite psychophysical reduction. Among anti-reductionists, confidence is high that the Disjunctive Move fails; arguments to this effect, however, often leave something to be desired. (...) Philosophers and scientists are concerned with the why and the how of things. Questions like the following are so much grist for the philosopher’s and scientist’s mill: How can we be free and yet live in a deterministic universe?, How do neural processes give rise to conscious experience?, Why does conscious experience accompany certain physiological events at all?, How is a three-dimensional perception of depth generated by a pair of two-dimensional retinal images?. Since Belnap and Steel’s pioneering work on the (...) logic of questions, Van Fraassen has managed to apply their approach in constructing an account of the logic of why-questions. Comparatively little, by contrast, has been written on the logic of how-questions despite the apparent centrality of questions such as How is it possible for us to be both free and determined? to philosophical enterprise.1 In what follows I develop a logic for how-questions of various sorts including how-questions of cognitive resolution, how-questions of manner, how-questions of method, of means, and of mechanism. The hard problem of consciousness has held center stage in the philosophy of mind for the past two decades. It claims that the phenomenal character of conscious experiences—what it’s like to be in them—cannot be explained by appeal to the operation of physiological subsystems. The hard problem arises, however, only given the assumption that hylomorphism is false. Hylomorphism claims that structure is a basic ontological and explanatory principle. A human is not a random collection of physical materials, but an individual (...) composed of physical materials with a structure that accounts for what it is and what it can do—the powers it has. What is true of humans is true of their activities as well. The latter are not random physiological changes, but structured ones: we engage in them by coordinating the ways our parts manifest their powers. Structured activities include perceptual experiences. Consequently, everything about a perceptual experience, including its phenomenal character, can be explained by describing the perceiver’s perceptual subsystems, the powers of those subsystems, and the coordination that unifies their activities into the activity of the perceiver as a whole. Conscious experiences thus fit unproblematically into the natural world—just as unproblematically as the phenomenon of life. Even exponents of the hard problem of consciousness agree that there is no hard problem of life. Consequently, if hylomorphism is true, there can be no hard problem of consciousness. To insist that there is such a problem, then, is implicitly to reject hylomorphism. The concept of consciousness that motivates the hard problem is as much a theoretical construct, therefore, as the concept of life that motivates an obstinate vitalist. (shrink)

The problem of mental causation epitomizes problems in the metaphysics of mind. Tyler Burge once suggested that it could be solved by taking ordinary explanatory practice more seriously. Jaegwon Kim criticized this suggestion: a solution to the problem requires a workable metaphysics of mental causation, and taking ordinary explanatory practice seriously falls short of providing that. Burge replied by gesturing toward a metaphysics that takes mental and physical causation to be different, noncompeting forms of causation. But what does it mean (...) for there to be different forms of causation? How are they identified and distinguished? And what ensures that mental and physical causation are different and noncompeting? I attempt to answer these questions by appeal to hylomorphism, a metaphysical framework that takes structure to be a basic ontological and explanatory principle. I argue that hylomorphism enables us to develop Burge’s basic insights into a workable metaphysics of mental causation that solves the problem. (shrink)

Powers often depend on structures. It is because of the eye’s structure that it confers the power of sight; destroy that structure, and you destroy the power. I sketch an antireductive yet broadly naturalistic account of the relation between powers and structures. Powers, it says, are embodied in structures. When applied to philosophy of mind, this view resembles classic emergentist theories. I nevertheless argue that it differs from them in crucial respects that insulate it from the problems that beset them (...) – including the problem of emergence and the problem of mental causation. Dual-attribute theories are alleged to face a problem with mental causation which commits them to either epiphenomenalism or overdetermination – neither of which is attractive. The problem, however, is predicated on assumptions about psychophysical relations that dual-attribute theorists are not obliged to accept. Descartes developed a compelling characterization of mental and physical phenomena which has remained more or less canonical for Western philosophy ever since. The greatest testament to the power of Cartesian thinking is its ubiquity. Even philosophers who are critical of post-Cartesian anthropology (philosophers,for instance, who are self-professed exponents of one or another form of hylomorphism) nevertheless tacitly endorse Cartesian assumptions. Part of what leads to this strange inconsistency is that by and large philosophers no longer know what a non-Cartesian anthropology (...) looks like. I discuss some commitments characteristic of post-Cartesian philosophy of mind, and present an alternative conception of psychological phenomena more consistent with a hylomorphic framework. The purpose of the paper is to rethink the role of actuality in the branching model of possibilities. We investigate the idea that the model should be enriched with an additional factor—the so-called Thin Red Line—which is supposed to represent the single possible course of events that gets actualized in time. We believe that this idea was often misconceived which prompted some unfortunate reactions. On the one hand, it suggested problematic semantic models of future tense and and on the other, (...) it provoked questionable lines of criticism. We reassess the debate and point to potential pitfalls, focusing on the semantic dimension of the Thin Red Line theory. Our agenda transcends the semantics, however. We conclude that semantic considerations do not threaten the Thin Red Line theory and that the proper debate should be carried in the domain of metaphysics. (shrink)

Joseph Heath lumps in quotas and protectionist measures with cartelization, taking advantage of information asymmetries, seeking a monopoly position, and so on, as all instances of behavior that can lead to market failures in his market failures approach to business ethics. The problem is that this kind of rent and rent seeking, when they fail to deliver desirable outcomes, are better described as government failure. I suggest that this means we will have to expand Heath’s framework to a market and (...) government failures approach. I then try to defuse objections that as a government failure, rent seeking may not appear relevant to what managers ought to do. Solving this conceptual issue will also give us an excuse to revisit a separate conceptual issue: the normatively thick conception of “rent” and rent seeking behavior that some use. This normatively thick conception is problematic, I argue, and I offer the beginnings of a novel, normatively neutral conception that is useful for our purposes in making the ethics of rent and rent seeking behavior more than a merely trivial exercise. This paper is an evaluation of John Locke's labour theory of property. Section I sets out Locke's labour view. Section II addresses several possible objections, including against the conceptual coherence of Locke's argument, against the metaphysical implications of his view, as well as foundational criticisms of the moral significance of labour and of my relations with objects that are grounded in labour under certain conditions and circumstances. I attempt to address each of these criticisms in a Lockian spirit, which will (...) require strange metaphysical moves. The final Section raises further objections that are more significant because they cannot be squared with the labour view. (shrink)

This paper refers to the 700th anniversary of the death of Dante Alighieri in commemoration of which Pope Francis released a special apostolic letter highlighting the genius and significance of the Italian poet. We should praise his genius, the Pope writes, because it is he who was able to express, much better than most of the others, the depth of the mystery of God and His love. The Commedia is the fruit of deep religious inspiration. This is why Francis repeats (...) after Benedict XV – „Dante is our own!” Why is it so? Because there breathes in Alighieri the devotion that we too feel and his faith resonates with ours. Dante’s work continues to be a meaningful and valid exemplar for Christ’s followers. However, in today’s pop culture Dante is mainly seen through his depiction of hell – the artistically described eternal punishment. The truth about hell which Dante made the subject of his narrative does not find acceptance even between Christians. Many people are really outraged and scandalized because hell is for them the symbol of sadism and distorted image of God – a vengeful tyrant who condemns human souls to eternal perdition. But hell is present in the biblical message. The early Church Fathers spoke of hell in their sermons, wrote about it in treatises, disputed the dwelling place of the condemned souls, the position of Satan and other demons, and the imminence of God’s judgement. In this way in the Catholic dogmatic theology consolidated the truth of the reality of hell and eternal punishment. This was also in accord with the views of the prominent medieval theologians. Therefore, why the ancient and well-known truth about hell is rejected today as outrageous and Dante’s vision does not gain recognition? The heart of the matter is the understanding of the idea of justice and atonement. In their denial expressed through the notion of the empty hell and rejection of eternal punishment for angels’ and people’s sins, we have to do with misunderstanding of the significance of human intellect and will. The refusal to accept responsibility for our free choices entails the uninhibited rejection of seriousness of our earthly life. If we believe that our fate, and what is more, out eternal fate – the salvation or damnation – depends on what we were able to do in our lifetime, Dante’s poetic vision strongly illustrates this standpoint. The power of free will is deeply and inalienably present in The Comedy’s stanzas. In the Dante’s poem the essence of hell lies in the ultimate rejection of the goal that man longs to achieve from his very nature – the happiness which is the union with the infinite Good – God, the Creator and the Redeemer of the world. How is it possible? It happens due to the existence of free will which is innate to all people and no one can deprive them of it or minimise it. This rejection of the sublime happiness is the result of human free decision – the condemned did not say to God: “Thy will be done!” but “my will be done!”. The existence of hell becomes the guarantee of human dignity, the evidence that a perfectly Good and Omnipotent God treats the man whom He had created seriously and preserves him for the eternity in the same state in which he wanted to remain in his earthly life. Wir beenden unsere Überlegungen. Bei der Frage nach der Würde des Menschen benutzten wir die Worte Pascals, um das zu verdeutlichen, was die "Größe" des Menschen ausmacht. Es war der Hinweis auf die Beziehung des Menschen zur absoluten Transzendenz. Eher unbesprochen blieb die gewissermaßen andere Seite des Menschen, die Pascal als dessen "Elend" bezeichnet. Diese Ausklammerung bedeutet jedoch nicht, daß wir diese Seite nicht zur Kenntnis nehmen. Der Grund für die Ausklammerung lag in der Absicht, dem Thema der Größe und (...) Würde des Menschen zu folgen. Mehr denn je vielleicht wird heute vom "Elend" des Menschen gesprochen. Mehr denn je will man heute den Menschen gänzlich verstehen und rechtfertigen durch das, was den Menschen bloß mit dieser Welt verbindet. Man wird also viel mehr den Blick auf das richten müssen, was die Größe des Menschen ausmacht. Denn, wird diese Größe des Menschen nicht erkannt oder verkannt, geht diese Größe in der Tat dem Menschen verloren. Dann finden auch die im Leben des Menschen geltenden Regeln ihre Begründung nicht mehr in der Erkenntnis dessen, was das eigentliche und wahre Ziel des Lebens ist, und seine Verwirklichung wird unmöglich. It is often said that the Constitution does not interpret itself, that we are in need of a theory of interpretation for constitutions. This need has led to a flourishing literature on constitutional interpretation. Statutes, also, stand in need of a theory of interpretation, and that obvious need has led to a robust literature on that subject. What is said too infrequently is that Supreme Court rulings do not interpret themselves, that we are in need of a theory of interpretation (...) for rulings. In this essay, I assess the question of what is an appropriate doctrine of ruling interpretation by applying the arguments of the living constitutionalists to Supreme Court rulings. Contemporary proponents of a progressive doctrine of interpretation for constitutions—variously called the ‘living tree,’ ‘living force,’ or ‘living constitution’ doctrines of interpretation—appear to embrace two theses. The first thesis, which we can call the ‘progressive thesis,’ is the view that the Supreme Court ought to ensure that our highest laws are in compliance with contemporary values. The second thesis is the ‘doctrine of judicial supremacy’ which maintains that all lower judicial and non-judicial actors are to accept and adhere to the rulings of the Supreme Court.I argue that these two theses—the progressive thesis and the doctrine of judicial supremacy—are in tension with one another. Embracing the second thesis requires abandoning the first, while embracing the first thesis requires abandoning the second. Contemporary living constitutionalism, as defended by prominent advocates like Chief Justice Beverly McLachlin, Justice Ian Binnie, Australian Justice Michael Kirby, legal scholar Peter Hogg, and others, is incoherent. In the end, those who embrace the progressive thesis must rely on the claim that the Supreme Court ought to have a monopoly on the use of progressive interpretation, and that lower courts and non-judicial actors must use originalist methods for interpreting the text of Supreme Court rulings. To make this argument, the advocates of progressive constitutional interpretation must be advocates of originalism—not half-hearted supporters, but enthusiastic, full-on supporters, however much they may, elsewhere in their writings, condemn originalism as a practically-flawed, unworkable, or unenlightened method of interpretation. Open peer commentary on the article “Negotiating Between Learner and Mathematics: A Conceptual Framework to Analyze Teacher Sensitivity Toward Constructivism in a Mathematics Classroom” by Philip Borg, Dave Hewitt & Ian Jones. Upshot: While I appreciate sensitive teaching approaches to students’ learning mathematics using Grid Algebra software, I am unconvinced that the approaches described are constructivist in nature. To make further progress along the lines described by the authors a clearer articulation of its constructivist foundations is needed.

An increasing number of drugs removed from the market because of unacceptable toxicity raises concerns regarding preapproval testing of drug safety. In the present paper it is postulated that the non-inferiority type of trial should be abandoned in favor of the superiority trial with active controls and less stringent (p<0.1, both for efficacy and toxicity) statistics. This approach will increase sensitivity of detection of drug-induced adverse effects at the expense of increasing false positive results regarding the difference in efficacy between (...) the tested and reference drug. Such a move will increase the protection of future patients. In addition, the proposed design is far more acceptable from the clinical (e.g. no need to specify the statistically expected “unimportant” number of deaths) and ethical points of view, as well as being favored by the strong incentive of involved parties. In the second part of this paper arguments are presented in favor of the hypothesis that placebo (still used in some superiority trials) does not induce adverse effects. The assertion that placebo may induce adverse effects is probably biased by the nature of the clinical experiment. Such a conclusion is supported by studies indicating that placebo-induced adverse effects are disease — and treatment — specific. The modification of clinical trials according to the proposed changes may increase the trials’ sensitivity at detecting adverse effects of drugs. (shrink)

In this presentation, principles of ethics are confronted with the desire of the inventor to make a profit. To this end the presentation is focused on patent protection. Patents should guarantee the return of an inventor’s investment and profit and, on the other side, ensure availability — by patent disclosure — of the invention for the society when the patent terminates. Recent patent applications made by inventors are infringing this principle and societies are paying an unexpected price for these practices. (...) Hylomorphism claims that structure is a basic ontological and explanatory principle; it accounts for what things are and what they can do. My goal is to articulate a metaphysic of hylomorphic structure different from those currently on offer. It is based on a substance-attribute ontology that takes properties to be powers and tropes. Hylomorphic structures emerge, on this account, as powers to configure the materials that compose individuals.

“Hylomorphism” has recently become a buzzword in metaphysics. Kit Fine, Kathryn Koslicki, and Mark Johnston, among others, have argued that hylomorphism provides an account of parthood and material constitution that has certain advantages over its competitors. But what exactly is it, and what are its implications for an account of what we are? Hylomorphism, I argue, is fundamentally a claim about structure. It says that structure is a basic ontological and explanatory principle. I argue that hylomorphism is compatible with physicalism, (...) and also with substance dualism, and epiphenomenalism. The most interesting kinds of hylomorphism nevertheless reject these views. I describe one such hylomorphic theory. It is an empirically well-warranted theory, I argue, one based on work in biology and biological subdisciplines such as neuroscience. (shrink)

In this paper, I discuss, as carried out by Gaven Kerr, a reconstruction of Aquinas’s argument for the existence of God from his work De Ente et Essentia. My analysis leads to complementing Kerr’s proposal with the following elements: a summarization of the presented argument in a more formal manner; a specification of the main presuppositions of the Thomistic conception of existence; a drawing of attention to the fact that the essence–esse composition is a borderline case of the array of (...) potency–act compositions; a distinguishing of the empirical and speculative interpretations or versions of Aquinas’s argument; a clarification of what is the Divine exception from the essence–esse composition; a distinguishing of the three models of participation and a defence of the moderate model. I regard the following two issues to be of key importance for the argument under discussion: the relation between the Aristotelian compositional model and the Platonic model of participation as well as the defence of the Thomistic conception of the essence–esse composition. The first part of the paper is a reminder of fundamental results connected with the adequacy problem for sentential logics with respect to matrix semantics. One of the main notions associated with the problem, namely that of the degree of complexity of a sentential logic, is elucidated by a couple of examples in the second part of the paper. E.g., it is shown that the minimal logic of Johansson and some of its extensions have degree of complexity 2. This is (...) the first example of an exact estimation of the degree of natural complex logics, i.e. logics whose deducibility relation cannot be represented by a single matrix. The remaining examples of complex logics are more artificial, having been constructed for the purpose of checking some theoretical possibilities. (shrink)

In a recently published paper, Patrick Todd (2016, 'Future contingents are all false! On behalf of a Russellian open future') advocates a novel treatment of future contingents. On his view, all statements concerning the contingent future are false. He motivates his semantic postulates by considerations in philosophy of time and modality, in particular by the claim that there is no actual future. I present a number of highly controversial consequences of Todd’s theory. Inadequacy of his semantics might indirectly serve as (...) an argument against the philosophical view underpinning his proposal. (shrink)

We present the results of research carried out as a part of the project “Current Controversies about Human Origins: Between Anthropology and the Bible”, which focused on the supposed conflict between natural sciences and some branches of the humanities, notably philosophy and theology, with regard to human origins. One way to tackle the issue was to distribute a questionnaire among students and teachers of the relevant disciplines. Teachers of religion and the natural sciences (biology, chemistry, and physics) and students of (...) theology, philosophy, and the natural sciences (specializing in biology and/or anthropology) were asked to answer eleven questions concerning the perception of the conflict between evolutionism and creationism, the definitions of creation and evolution, the existence of a human spiritual element, and the ways of interpreting the Bible, especially the first chapters of the book of Genesis. In the paper we present and analyze selected results of this questionnaire. Among interesting findings there are the following: 1) the opinion concerning the relationship between evolutionism and creationism largely depends on the respondent’s general attitude toward religion, and not on their field of study or teaching expertise, which runs contrary to the received view attributing the opinion of the conflict between science and religion to people’s educational or professional background; 2) The conflict is far more pronounced in the group of nonbelievers. This distinguishes Poland from other countries, notably the United States, where the majority of people with strong religious beliefs seem to maintain that there is a conflict between the natural sciences and religion; 3) literal understanding of the Bible was rejected by vast majority of the respondents, including those who insist on the ‘conflict view’, which seems to make the situation in Poland again quite different from that in some other countries; 4) Unsophisticated understanding of creation positively correlates with the ‘conflicting view’ on the one hand, while, on the other, erroneous understanding of the basics of the theory of evolution appears to have its bearing on too optimistic vision of certain coherence between religion and science. We suggest some hypotheses to explain these and other results of the questionnaire. (shrink)
