In this work we study, design, and evaluate computational methods to support interpretation of statutory terms. We propose a novel task of discovering sentences for argumentation about the meaning of statutory terms. The task models the analysis of past treatment of statutory terms, an exercise lawyers routinely perform using a combination of manual and computational approaches. We treat the discovery of sentences as a special case of ad hoc document retrieval. The specifics include retrieval of short texts, specialized document types, (...) and, above all, the unique definition of document relevance provided in detailed annotation guidelines. To support our experiments we assembled a data set comprising 42 queries which we plan to release to the public in the near future in order to support further research. Most importantly, we investigate the feasibility of developing a system that responds to a query with a list of sentences that mention the term in a way that is useful for understanding and elaborating its meaning. This is accomplished by a systematic assessment of different features that model the sentences’ usefulness for interpretation. We combine features into a compound measure that accounts for multiple aspects. The definition of the task, the assembly of the data set, and the detailed task analysis provide a solid foundation for employing a learning-to-rank approach. (shrink)

This paper compares the four national electronic Identity Management Systems (eIDMS), which have been described in the previous chapters. The section Similarities and differences between four national eIDMS will highlight the differences between these systems conceived as socio-technical systems with regard to the eID itself, the eID cards as tokens, the authentication processes as well as the procedures for distribution and personalisation, the support provided for installing the technology and any provider-related regulation. The section A three-fold path dependency , according (...) to the conceptual framework presented in the introductory chapter to this special issue, compares the new electronic systems with the previous ones in each country, in order to assess the continuation or changes with regard to the organisational, technological and regulatory path of development. The following sections explain the differences between the paths chosen and the path-related changes by analysing the actor constellation of the institutional actors, in particular the policy field and the power structure, as well as the context in which the policy makers made their choices, looking at privacy and Staatsverständnis in particular. Finally the diffusion and usage of the eID function will be compared and analysed, discussing to what extent the new institution has made a contribution to solving the policy problem it was developed for, e.g. providing a stronger authentication in order to meet security concerns regarding e-government and e-commerce transactions and avoiding new privacy infringements. Using grounded theory, the explanations provided have the status of generalisations derived from the four cases. They have to be considered as hypotheses, which will be checked for other countries in the following papers of this special issue. The comparison of the four cases in this article shows a high degree of path dependency. Most of the differences between the new systems are just a continuation of differences between the previous systems although they are to solve the same problem and can draw on the same technologies. But most astonishing is the finding that these differences between the systems do not influence diffusion and use of the eID function in the respective countries. (shrink)

The paper explores the process of the Czech journalists setting the EU agenda in the media during the ‘hot phase’ of the Czech national parliament election campaigns in 2002, 2006, and 2010. Unlike most studies that concentrated on the media agenda in the European Parliament election campaigns, we focused on periods that were neither strictly key events nor routine, but that were more intensively covered by the media and simultaneously generated more influential political representation defining national political attitudes towards the (...) EU. Articles that referred to the EU during the ‘hot phase’ were content analyzed. The results suggest that in the Czech press, the EU agenda is less and less visible, and, moreover, that it is increasingly negatively framed and reduced to an economic agenda. (shrink)

The present paper attempts to look at on the genealogy of both shared intentionality and collective intentionality, comparing Michael Tomasello’s concept with Max Scheler’s threedimensional concept of intentionality: ens amans, ens volens, ens cogitans, as affective, conative, and cognitive intentionality. I focus on various forms of affective collective intentionality — Schelerian forms of sympathy — to show collective subjectivity from the whole spectrum of emotional intentionality, presented by Scheler’s example of parents standing over the corpse of a child. Even though (...) Tomasello’s works seem to empirically corroborate Scheler’s intuitions about the emotional genealogy of collective intentionality, they will differ in the horizons within they locate intentionality. In the case of the evolutionary psychology of Tomasello, we can talk about the horizon of cooperation, in the case of Scheler’s Scheler’s phenomenology of acts about the horizon of responsibility or co-responsibility, which gives intentionality its unique character. The similarities of both concepts concern the following pillars: 1) genealogy of intentionality covering the dimension of affective intentionality, conative intentionality, and the level of cognitive intentionality; 2) Imitation or, as Scheler would say, following someone. Because a person is recognized by the author of Formalism as an act, or a bundle of acts, the way to understanding and communication with another person is the maieutic coperformance of their acts — i.e., imitation. The maieutic co-execution of acts of others triggers the constitution process of a person, both on an individual and community level. We can speak, in the case of Tomasello, about the ontho- and sociogenetic function of co-executing acts or imitating; however, in the case of Scheler, we are dealing with the clearly axiological nature of such a constitution of both the individual and collective subjectivity ; 3) collaborative engagement as a driving force behind collective intentionality in one case in form of co-responsibility, a nature of a collective person ; in the other case in form of collaboration developing intentionality to various units of community life. A first comparison of the innovation processes of introducing electronic identities on a national level in Austria, Belgium, Germany and Spain, based on extensive expert interviews with key actors, has been amended by four more country reports from Denmark, Finland, Estonia and Sweden in order to check the validity of generalisations derived from the first four cases. The extended comparison with the four additional countries increases the variance between the eID systems in Europe by showing differing technical and organisational features, (...) such as purely software-based solutions, e.g. in Denmark, or complete outsourcing of the eIDMs, e.g. in Sweden. In the second part of the paper, the conceptual framework of the comparative study, a combination of path analysis, institutional actor theory and policy field analysis will be reflected. It has resulted in a fruitful approach allowing for the explanation of some, but by no means all, of the differences between the national eIDMs in Europe. (shrink)

The following thesis is an attempt to establish the communicative dimensions of silence. In it I put forward a thesis in the spirit of Martin Buber's philosophy of dialogue and Max Scheler's phenomenology of emotion, according to which true dialogue does not convey specific content, but modes of existence born of the experience of presence. This kind of normative transmission of existence makes communication a communion. Underlying tacit communication are various forms of affection, through which emotionality becomes one of the (...) main dimensions of communicating silence. (shrink)

This paper introduces the objectives and basic approach of a collaborative comparative research project on the introduction of national electronic Identity Management Systems (eIDMS) in Member States of the European Union. Altogether eight country case studies have been produced in two waves by researchers in the respective countries, which will be presented in the following articles in this special issue. The studies adopt a common conceptual framework and use the same terminology, which will be presented in this introduction, just as (...) the reasoning for the selection of the particular countries under investigation. The conceptual framework combines elements of actor centred institutionalism with path analysis, looking for path continuation, change or creation in the transition from the previous IDMS to an electronic one and explaining this as choices of actors in certain contexts. Information on the reasons for these choices in the first four cases has been collected from in depth interviews with key actors and in the four other cases from official documents. As the subject of this research is the transition of national identity management systems only countries have been included in which a national ID and a civil registry already exist before the introduction of the electronic elements, thus excluding the UK. Nowadays we are increasingly confronted with the fact of plurality. The result of plurality is relativism. Moral relativism is related to cultural plurality (both intercultural and intracultural) and the impossibility of universalising any of the two. Ethical relativism is associated with a plurality of ethical concepts and the impossibility of privileging any of these. “Ethical competence” refers to skills of possessing a particular ethical theory that allows one to navigate through the moral world.
