Open-mindedness enjoys widespread recognition as an intellectual virtue. This is evident, among other ways, in its appearance on nearly every list of intellectual virtues in the virtue epistemology literature.1 Despite its popularity, however, it is far from clear what exactly open-mindedness amounts to: that is, what sort of intellectual orientation or activity is essential to it. This paper examines the claim made by certain virtue epistemologists that intellectual character virtues like fair-mindedness, open-mindedness and intellectual courage merit an important and fundamental role in epistemology. I begin by considering whether these traits merit an important role in the analysis of knowledge. I argue that they do not and that in fact they are unlikely to be of much relevance to any of the traditional problems in epistemology. This presents a serious challenge for virtue epistemology. Recently, debate over whether health care providers should have a protected right to conscientiously refuse to offer legal health care services—such as abortion, elective sterilization, aid in dying, or treatments for transgender patients—has grown exponentially. I advance a modified compromise view that bases respect for claims of conscientious refusal to provide specific health care services on a publicly defensible rationale. This view requires health care providers who refuse such services to disclose their availability by other providers, as well as to (...) arrange for referrals or facilitate transfers of care. This requirement raises the question of whether providers are being forced to be complicit in the provision of services they deem to be morally objectionable. I conclude by showing how this modified compromise view answers the most significant objections mounted by critics of the right to conscientious refusal and safeguards providers from having to offer services that most directly threaten their moral integrity. Anti-racist education within the Academy holds the potential to truly reflect the cultural hybridity of our diverse, multi-cultural society through the canons of knowledge that educators celebrate, proffer and embody. The centrality of Whiteness as an instrument of power and privilege ensures that particular types of knowledge continue to remain omitted from our curriculums. The monopoly and proliferation of dominant White European canons does comprise much of our existing curriculum; consequently, this does impact on aspects of engagement, inclusivity and belonging (...) particularly for Black, Asian and Minority Ethnic (BAME) learners. This paper explores the impact of a dominant Eurocentric curriculum and the Decolonising the Curriculum agenda within higher education and its influence upon navigating factors such as BAME attainment, engagement and belonging within the Academy. This paper draws on a Critical Race Theory (CRT) theoretical framework to centralize the marginalized voices of fifteen BAME students and three academics of colour regarding this phenomena. Aspects examined consider the impact of a narrow and restrictive curriculum on BAME students and staff and how the omission of diverse histories and multi-cultural knowledge canons facilitates marginalization and discriminatory cultures. The purpose of this study was to validate the Korean version of the Student-Athletes’ Motivation toward Sports and Academics Questionnaire using exploratory structural equation modeling. A total of 412 South Korean collegiate student-athletes competing in 27 types of sports from 13 different public and private universities across South Korea were analyzed for this study. ESEM statistical approach was employed to examine the psychometric properties of SAMSAQ-KR. To assess content validity, the SAMSAQ-KR was inspected by a panel of content subject experts. (...) The Athletic Identity Measurement Scale was used to obtain convergent validity. The results of this study illustrated that the SAMSAQ-KR appears to be a robust and reliable instrument. (shrink)

“Libertarian paternalism” aims to harness cognitive biases in order to improve prudential decision-making. Some critics have objected that libertarian paternalism is wrongly manipulative. I argue that this objection is mostly unsuccessful. First, I point out that some strategies endorsed by libertarian paternalists can help people to better appreciate reasons. Second, I develop an account of manipulation according to which an agent manipulates her target by worsening the target’s deliberative position. The means of influence defended by libertarian paternalists—for instance, the judicious (...) use of default rules—are not manipulative in this way. (shrink)

Although Eugen Fink often reflected upon the role religion, these reflections are yet to be addressed in secondary literature in any substantive sense. For Fink, religion is to be understood in relation to “play,” which is a metaphor for how the world presents itself. Religion is a non-repetitive, and entirely creative endeavor or “symbol” that is not achieved through work and toil, or through evaluation or power, but rather, through his idea of play and “cult” as the imaginative distanciation from (...) a predictable lifeworld. This paper describes Fink’s understanding of religion and its most relevant aspects found in Spiel als Weltsymbol. The paper is organized into five sections—1: An introduction to his phenomenological approach in general, and description of the role of “play”; 2: investigations into the relation between play and world; 3: a description of his phenomenology of religion; 4: engagements in the idea of cult-play and the sacred sphere, and 5: reflection on his idea of the play of God. :Empirical work has shown that patients and physicians have markedly divergent understandings of treatability statements in the context of serious illness. Patients often understand treatability statements as conveying good news for prognosis and quality of life. In contrast, physicians often do not intend treatability statements to convey improvement in prognosis or quality of life, but merely that a treatment is available. Similarly, patients often understand treatability statements as conveying encouragement to hope and pursue further treatment, though this may not be (...) intended by physicians. This radical divergence in understandings may lead to severe miscommunication. This paper seeks to better understand this divergence through linguistic theory—in particular, H.P. Grice’s notion of conversational implicature. This theoretical approach reveals three levels of meaning of treatability statements: the literal meaning, the physician’s intended meaning, and the patient’s received meaning. The divergence between the physician’s intended meaning and the patient’s received meaning can be understood to arise from the lack of shared experience between physicians and patients, and the differing assumptions that each party makes about conversations. This divergence in meaning raises new and largely unidentified challenges to informed consent and shared decision making in the context of serious illness, which indicates a need for further empirical research in this area. Thomas Aquinas presents an account of human immortality and bodily resurrection intended to be both faithful to Christian Scripture and metaphysically sound as following from the Aristotelian view of human nature. One central question is whether a human person persists between death and resurrection by virtue of her soul, given Aquinas’s hylomorphic account of human nature and assertion that a human person is not identical to her soul. Robert Pasnau contends that only a part of a person exists between death (...) and resurrection; whereas Eleonore Stump argues that a person substantially exists, albeit deficiently, during the interim period as composed of, but not identical to her soul. The Chacoan road system is an understudied aspect of a very unique culture in New Mexico. The extensive roads present important evidence to the social structure of the Chaco people. A few theories have been presented about the reason for the roads, such as economic, administrative and religion. This paper argues that the roads were used for military purposes, because the roads provided quick access to all satellite townships in the region.

I examine here whether reliability is a defining feature of (moral or intellectual) virtues. I argue (1) that reliability is not a defining feature of a virtue where virtues are conceived (as they often are) as “personal excellences,” but (2) that there is another (also intuitive and familiar) conception of a virtue according to which reliability is a defining feature. I also argue (3) that even on the former conception, a certain rational belief pertaining to reliability is essential and (4) (...) that reliability itself, while not a defining feature of a virtue thus conceived, nevertheless is a concomitant of it. Most people believe that it is permissible to kill a nonresponsible threat, or someone who threatens one's life without exercising agency. Defenders of this view must show that there is a morally relevant difference between nonresponsible threats and innocent bystanders. Some philosophers, including Jonathan Quong and Helen Frowe, have attempted to do this by arguing that one who kills a bystander takes advantage of another person, while one who kills a threat does not. In this paper, I show that the (...) proposals offered by Quong and Frowe have unacceptable implications. I then argue that those who claim that nonresponsible threats may be killed face a dilemma generated by the possibility of a stationary threat, or someone who endangers another person's life without moving. Unless we arbitrarily distinguish between stationary and moving nonresponsible threats, it is unclear how the permission to kill nonresponsible threats is to be explicated. I conclude that nonresponsible threats are not legitimate targets of self-defence. (shrink)

According to one prominent account of intellectual humility, it consists primarily of a disposition to “own” one’s intellectual limitations. This account has been criticized for neglecting the _interpersonal _dimensions of intellectual humility. We expect intellectually humble persons to be respectful and generous with their interlocutors and to avoid being haughty or domineering. I defend the limitations-owning account against this objection. I do so in two ways: first, by arguing that some of the interpersonal qualities associated with intellectual humility are qualities (...) expressive of virtues _other_ than intellectual humility; and second, by arguing that, when properly described, the kind of limitations-owning characteristic of intellectual humility in fact is robustly interpersonal. The result is a considerably broader and richer notion of the limitations the owning of which is characteristic of intellectual humility. (shrink)

In addressing bioethical issues at the beginning of human life, such as abortion, in vitro fertilization, and embryonic stem cell research, one primary concern regards establishing when a developing human embryo or fetus can be considered a person. Thomas Aquinas argues that an embryo or fetus is not a human person until its body is informed by a rational soul. Aquinas's explicit account of human embryogenesis has been generally rejected by contemporary scholars due to its dependence upon medieval biological data, (...) which has been far surpassed by current scientific research. A number of scholars, however, have attempted to combine Aquinas's basic metaphysical account of human nature with current embryological data to develop a contemporary Thomistic account of a human person's beginning. In this article, I discuss two recent interpretations in which it is argued that a human person does not begin to exist until a fetus has developed a functioning cerebral cortex. (shrink)

Commentary on re-opening dialogue between theological and secular voices in bioethics.

"The Federalist" is commonly read as an exemplar of political realism. However, alongside Publius' arguments against the enthusiastic imagination --its tendency to inflame the passions, betray the intellect, and subvert political authority--are formative appeals to the imagination 's role in reconstituting the public authority shaken during the postrevolutionary years. This essay explores three central aspects of Publius' restorative appeal to the imagination : the appeal to the public veneration required for sustaining political authority across time; the strategies for shifting citizen (...) loyalty from the state and local level to that of a newly energized federal government; and the rhetorical elicitation of the public's imagination in aestheticized portrayals of Providential nationality. These aspects of Publius' argument make up the core of "The Federalist's aesthetics of rule. In each instance, Publius invokes the imagination as a heteronomic support to navigate familiar dilemmas of democratic self-authorization. (shrink)

Response to human head transplant proposal and pertinent personal identity questions.

Most opponents of paternalism agree that autonomy does not protect substantially impaired choices. Yet this common anti-paternalist view faces serious problems. First, I argue that it threatens to justify nearly all beneficial intervention, since all imprudent choices are impaired. Attempts to avoid this problem yield other implications that anti-paternalists would reject. Second, I argue that anti-paternalists have no convincing way of showing that impaired choices, such as those produced by emotional distress, are not protected by autonomy. In light of these (...) problems, we should likely accept a hard paternalist view--one that permits intervention simply in virtue of the consequences. (shrink)

Tu analiziram njegovo sodelovanje pri tem dogodku in pri predhodni kampanji Nacionalne obrambe, opirajoč se pri tem tako na biografijo Edith Thomas kot na Rosslova lastna posthumna dela. Prevladujoča domneva, da je Rossla motivirala lastna ambicioznost, ki naj bi bila pogubna za usodo komune in nasprotujoča njenim revolucionarnim egalitarnim načelom, se na (...) podlagi obstoječih dokazov zdi poenostavljena. Še več, takšni domnevi lahko nasprotujemo z interpretacijo komune in državljanske vojne v Franciji kot drame, še posebej če se navežemo na dela Jeana-Pierra Vernanta in Pierra Vidala-Naqueta o grški tragediji. An exploration of the connections between law, science, and truth, this paper argues that ‘truth’ is an evolving, rather than fixed, concept. It is a human creation, and the processes, or standards, by which it has been evaluated have changed over time. Currently knowledge production is anchored in the natural sciences but reproduced and validated by philosophical rationalisation. There are two problems with this technique of knowledge verification (or ‘veridiction’). First, the natural sciences are not, in fact, practiced according to (...) their ideal forms; and second, the Queen of Sciences, physics, underwent two fundamental paradigm shifts in the early nineteenth century. General relativity and quantum theory entered the scene, sending ripples throughout science, and the social sciences. These changes too have been slowly absorbed by philosophy, giving rise in part to the postmodernist and deconstructivist movements. I chart this gradual evolution of truth and knowledge production in physics and in law and analyse the resistance it has faced from both classical law and classical physics. Finally I argue that this resistance could be overcome, if legal theory, and especially legal positivism, would embrace a more accurate and up-to-date understanding of the science it purports to examine and emulate. The National Science Foundation's (NSF) role in, and influence on, the National Nanotechnology Initiative (NNI) can best be understood through an examination of the NSF's history. Because of the NSF's weakened position at its founding in 1950 and obstacles faced throughout its history, the NSF developed a discursive strategy that focuses on making a causal link between support for basic science and societal benefits, and an operational strategy focused on growing its constituency through infrastructural support. In the Bayesian framework, a language learner should seek a grammar that explains observed data well and is also a priori probable. This paper proposes such a measure of prior probability. Indeed it develops a full statistical framework for lexicalized syntax. The learner's job is to discover the system of probabilistic transformations (often called lexical redundancy rules) that underlies the patterns of regular and irregular syntactic constructions listed in the lexicon. Specifically, the learner discovers what transformations apply in the language, (...) how often they apply, and in what contexts. It considers simpler systems of transformations to be more probable a priori. Experiments show that the learned transformations are more effective than previous statistical models at predicting the probabilities of lexical entries, especially those for which the learner had no direct evidence. This paper develops the outlines of a pragmatic, adaptive management-based approach toward the control of invasive nonnative species (INS) through a case study of Kings Bay/crystal River, a large artesian springs ecosystem that is one of Florida’s most important habitats for endangered West Indian manatees (Trichechus manatus). Building upon recent critiques of invasion biology, principles of adaptive management, and our own interview and participant–observer research, we argue that this case study represents an example in which rigid application of invasion biology’s (...) a␣priori imperative to minimize INS has produced counterproductive results from both an ecological and social standpoint. As such, we recommend that INS control in Kings Bay should be relaxed in conjunction with an overall program of adaptive ecosystem management that includes meaningful participation and input from non-institutional stakeholders. However, we also note that adaptive management and INS control are by no means mutually exclusive, in Kings Bay or elsewhere. Instead, we suggest that adaptive management offers a means by which INS control efforts can emerge from—and be evaluated through—ongoing scientific research and participatory dialogue about the condition of specific places, rather than non-contextual assumptions about the harmfulness of INS as a general class. Blindsight is a hot topic in philosophy, especially in discussions of consciousness. Here I critically examine various attempts to bring blindsight to bear on debates about qualia -- the raw constituents of consciousness. I argue that blindsight does not unequivocally support any particular theory of qualia. It does, however, vindicate the view that there are qualia, despite arguments -- most notably by Daniel Dennett -- to the contrary.

Some of the most powerful persons today are those most successful at convincing others they have the greatest claim to victimhood. This new, socio-political shift marks the rise of what recently has been called “victimhood culture.” This article addresses how certain Christian theological views on God’s wrath, along with differing appropriations of the church’s collective victimhood both have played significant roles in generating a “culture war of victimhood”—a mode of conflict in which individuals and parties fight for the status of (...) being the most socially oppressed and marginalized, especially for the purpose of gaining power. To better understand this collective intentionality of victimhood, the article provides a multidisciplinary exploration into recent works in sociology of religion, anthropology, and historical theology. In Heidegger’s last seminar, which was in Zähringen in 1973, he introduces what he called a “phenomenology of the inconspicuous”. Despite scholars’ occasional references to this “approach” over the last 40 years, this approach of Heidegger’s has gone largely under investigated in secondary literature. This article introduces three different, although not necessarily conflicting ways in which these sparse references to inconspicuousness can be interpreted: The a priori of appearance can never be brought to manifestation, and the unscheinbar is interwoven with (...) the scheinbar as an active characteristic or form of “hiddenness”, therefore making inconspicuousness inherent within all phenomenology. Or, there is now a particular step or reduction within phenomenology that involves one’s being attuned to the various modes of potential hiddenness, of which “inconspicuousness” is a particular character trait. Or there are particular, unique, and specific phenomena that give themselves “inconspicuously,” and there is also thus a corresponding, particular phenomenology in which one must engage in order to gain some kind of access to these specific things’ phenomenal strata. This paper introduces Heidegger’s “phenomenology of the inconspicuous” most especially in his last seminar in Zähringen in 1973, engages related references to unscheinbar in his 1942/1943 Seminar on Parmenides, and then puts forward an interpretation of what these somewhat ambiguous references could mean when contextualized according to Heidegger’s overall interests. This essay brings these references to light, and puts forward a proposal as to what kind of phenomenology Heidegger was–somewhat inconspicuously–referring. (shrink)

Članek ponovno odpira razpravo o recepciji dela Louisa Althusserja v teoriji in kritiki kulture v luči nedavnih angleških prevodov posthumnih del tega francoskega filozofa, vključno z nedokončanim Sur la reproduction, ki vsebuje tudi spis »Ideologija in ideološki aparati države«. Izmed marksističnih mislecev njegove generacije ni bil nihče v tolikšni meri tarča očitkov teoreticizma in političnega odpadništva kot prav Althusser, kar Rancière opisuje kot »althusserjansko zanikanje političnih učinkov«. Članek predstavi pregled zgodovinskih teženj in nasprotnih teženj, ki jih najdemo v Althusserjevih spisih (...) med »dolgimi šestdesetimi«, in trdi, da ne smemo podcenjevati vloge teorije in teoretikov v prid osvobajajočih praks maja 1968, ampak moramo Althusserjev domnevni teoreticizem misliti v kontekstu politično motiviranih teoretskih bojev in rivalstev, ki so določali »politiko njegovega časa«. V zaključku opažamo, da bi preusmeritev pozornosti k tem bojem lahko pripeljala do drugačnega pojmovanja vloge teorije po letu ‘68. (shrink)

This paper reviews Benjamin Noys’ recent attempt in Malign Velocities: Accelerationism and Capitalism to mount a critique of accelerationism. The book, persuasive in certain respects, bypasses the institutional dynamics of accelerationism’s theoretical progenitors, viz. Nick Land and the Cybernetic Culture Research Unit of Warwick University, and instead portrays it as a “defeatist strategy” of the post-’68 conjuncture of “Deleuzian Thatcherism.” Such portrayal is debatable to the extent that it exhibits a questionable appropriation of “theory” in the strict sense of the (...) term; a term the paper attempts to define with reference to Matthew Arnold, Louis Althusser and Gilles Grelet.
