This essay is part of a larger project exploring the extent to which the market paradigm might be usefully employed to explain and in some instances justify nonmarket institutions. The focus of the market paradigm in this essay is the relationship between the idea of a perfectly competitive market and aspects of both the rationality of political association and the theory of collective choice. In particular, this essay seeks to identify what connections, if any, exist between one kind of market (...) account of the rationality of political association and one kind of market-based social choice rule. The market theory of political association I intend to discuss I call “market contractarianism,” and the collective choice rule whose relation to it I intend to explore is the unanimity rule. Vantassel Eugene, OR: Resource, 2009. 232pp. $26.00In Dominion over Wildlife?, Stephen Vantassel, a scholar with professional experience in animal damage control, provides a substantive examination of the neglected subject of human–wildlife relations. For this, he is to be commended. Although ultimately disappointing, his argument (...) indicates that much work remains to be done in this area.Vantassel’s subtitle is somewhat misleading since he devotes the bulk of the book to a polemic against a small group he terms “Christian Animal Rights (CAR) activists”—especially Anglican theologian Andrew Linzey and his followers—who question the idea that God grants humans dominion over creation (“Dominionism”), including the moral right to manage, kill, and eat animals. “The critical question... is whether CAR activists are correct in their belief that Scripture exhorts us to adopt a vegetarian and non-violent stance toward animals” (14). Vantassel’s response is more exegetical than theological, and in the mode of conservative evangelical apologetics, he devotes chapters to refuting CAR activists’ appeals to the Old Testament (specifically the covenant of Creation, the narratives of the Fall and Noah, the sacrificial system, and passages that support humane treatment of animals); the New Testament (Christ’s concern for animals, a Christus Victor view of the atonement, and an Edenic eschatology); ethics (compassion, restraint, and stewardship); and science (a case study of whether trapping is unnecessarily cruel and environmentally irresponsible). Only in the final chapter does he propose his model of “Shepherdism,” which “avoids the negative stereotypes held against Dominionism, while upholding God’s decree that humans maintain their superintendence over animals” (160). Shepherdism centers on the principles that creation is “God’s property,” that humans are charged with being its caretakers, and that Christ is a model for behavior toward it. Vantassel insists that humans should treat wildlife humanely and not exterminate species.For Vantassel, theology is a matter of individuals—largely apart from church or tradition—reading an inerrant Bible to discern God’s commands. Likewise, ethics is a matter of individuals using reason to construct arguments that “stand on their own merits” and “may still be sufficient to persuade, if not compel, Christian behavior even if Scripture does not mandate the behavior” (99). This [End Page 193] is not the forum for criticizing these approaches, but they not only distance Vantassel’s argument from scholarship in the field—which he does not engage—but also make it unlikely that it will persuade those who do not read the Bible or view God in the same way. To note two examples, on the basis of Amos 4, he contends that “some environmental problems are caused not through our direct abuse of the land but through our disobedience, which God then punishes through sending environmental catastrophes” (165n13), and on the basis of Christ’s acceptance of fishing with nets (Luke 5:4), he contends that “Christians are permitted to not only eat animals, they may employ means to capture them that will cause pain and injury” (171). Indeed, as a lifelong hunter who shares Vantassel’s basic position, I found myself more sympathetic to the CAR activists’ arguments toward which he is frequently uncharitable; he associates them with Darwinism and feminist and liberation theologies, labels their hermeneutics “modernistic” for stressing narrative, and variously calls their ideas “absurd,” “incredulous,” and “strange.”Vantassel discusses a number of helpful statistics and studies, and he rightly points out the problems posed by factory farming, the disproportionate effects of environmental degradation on the poor, and the practical difficulties of vegetarianism. Exploring the rise and political significance of the free and open source software movement in the United States and Europe, Coding Freedom details the ethics behind hackers' devotion to F/OSS, the social codes that guide its production, and the political (...) struggles through which hackers question the scope and direction of copyright and patent law. In telling the story of the F/OSS movement, the book unfolds a broader narrative involving computing, the politics of access, and intellectual property. E. Gabriella Coleman tracks the ways in which hackers collaborate and examines passionate manifestos, hacker humor, free software project governance, and festive hacker conferences. Looking at the ways that hackers sustain their productive freedom, Coleman shows that these activists, driven by a commitment to their work, reformulate key ideals including free speech, transparency, and meritocracy, and refuse restrictive intellectual protections. Coleman demonstrates how hacking, so often marginalized or misunderstood, sheds light on the continuing relevance of liberalism in online collaboration. (shrink)

With the development of the division of labor, the household has declined in importance as a unit of economic production. Yet even as the individual wage earner has assumed a central place in modern exchange economies, the household has still been seen as an important unit of distribution, in which wage earners provide for their non-income-producing family members. With the breakdown of the family in recent decades, however, the communal income-sharing function of the family has, in significant part, been taken (...) overby the state. In this essay, I examine this fundamental change in the structure of production and distribution in modern exchange economies. Going beyond this, I propose a new structure of markets–markets for rights to influence collective decision-making within a society. Background Biobanking and genomic research requires collection and storage of human tissue from study participants. From participants’ perspectives within the African context, this can be associated with fears and misgivings due to a myriad of factors including myths and mistrust of researchers. From the researchers angle ethical dilemmas may arise especially with consenting and sample reuse during storage. The aim of this paper was to explore these ethical considerations in the establishment and conduct of biobanking and genomic studies in Africa. (...) Methods We conducted a narrative synthesis following a comprehensive search of nine (9) databases and grey literature. All primary research study designs were eligible for inclusion as well as both quantitative and qualitative evidence from peer reviewed journals, spanning a maximum of 20 years (2000–2020). It focused on research work conducted in Africa, even if data was stored or analysed outside the region. Results Of 2,663 title and abstracts screened, 94 full texts were retrieved and reviewed for eligibility. We included 12 studies (7 qualitative; 4 quantitative and one mixed methods). Ethical issues described in these papers related to community knowledge and understanding of biobanking and genomic research, regulation, and governance of same by research ethics committees, enrolment of participants, types of informed consents, data collection, storage, usage and sharing as well as material transfer, returning results and benefit sharing. ca. Biospecimen collection and storage is given in trust and participants expect confidentially of data and results generated. Most participants are comfortable with broad consent due to trust in researchers, though a few would like to be contacted for reconsenting in future studies, and this would depend on whether the new research is for good cause. Sharing data with external partners is welcome in some contexts but some research participants did not trust foreign researchers. Conclusion Biobanking and genomic studies are a real need in Africa. Linked to this are ethical considerations related to setting up and participation in biobanks as well as data storage, export, use and sharing. There is emerging or pre-existing consensus around the acceptability of broad consent as a suitable model of consent, the need for Africans to take the lead in international collaborative studies, with deliberate efforts to build capacity in local storage and analysis of samples and employ processes of sample collection and use that build trust of communities and potential study participants. Research ethics committees, researchers and communities need to work together to work together to adapt and use clearly defined ethical frameworks, guidelines, and policy documents to harmonize the establishment and running of biobanking and genomic research in Africa. What should advocates of phenomenal intentionality say about unconscious intentional states? I approach this question by focusing on a recent debate between Tim Crane and David Pitt, about the nature of belief. Crane argues that beliefs are never conscious. Pitt, concerned that the phenomenal intentionality thesis coupled with a commitment to beliefs as essentially unconscious embroils Crane in positing unconscious phenomenology, counter-argues that beliefs are essentially conscious. I examine and rebut Crane’s arguments for the essential unconsciousness of beliefs, some of (...) which are widely endorsed. On the way I sketch a model of how belief states could participate in the stream of consciousness. I then consider Pitt’s position, arguing in reply, along Freudian lines, that we should posit not just dispositional but occurrent unconscious beliefs. This result, I argue, indeed requires advocates of phenomenal intentionality to posit unconscious qualia to fix these unconscious occurrent thoughts, and I defend the coherence of the notion of unconscious qualia against some common attacks. Ultimately, I claim, the combination of taking seriously the occurrent unconscious, and a commitment to phenomenal intentionality, should lead us to expand William James’s conception of the stream of consciousness to encompass, additionally, a stream of unconscious mental life—or, perhaps better, to posit a single partly conscious partly unconscious qualia-stream of mental goings-on. Might fiction help us to develop and advance new theories about the nature of consciousness? And might such theories, in turn, inform our understanding of the process of reading fiction? Three recent volumes—one by English critic and novelist, David Lodge; another by literary theorist, Alan Palmer; and a third by philosopher and (now) novelist, Dan Lloyd—raise these important, genre-bending questions, and they offer challenging if not always convincing answers to them. More generally, these volumes make valuable contributions to the fruitful cross-pollination that has developed between philosophers, scientists, literary theorists, and novelists who are interested in the nature of consciousness.Lodge's new collection of essays is called Consciousness and the Novel: Connected Essays, and like all of the criticism he has written since the late eighties, this volume is intended for a general audience, not for [End Page 299] literary theorists. The title essay, "Consciousness and the Novel," is a revised version of the Richard Ellman Lectures in Modern Literature that Lodge gave at Emory University in 2001, and the other nine essays, all previously published, cover such topics as Howards End; the novels of Evelyn Waugh; The Letters of Kingsley Amis; Martin Amis's memoir, Experience; and the relationship between literature and criticism. I will focus on "Consciousness and the Novel."Lodge's thesis in this essay is that novels play an essential role in our exploration of the nature of human consciousness. This thesis is certainly true, but it is also entirely banal. Much more interesting is what Lodge says in support of it. He argues that because of the unique representative possibilities of the novel, conscious experiences can be represented more effectively in novels than they can be in scientific writing. Taken literally, as an assertion about the relative representational power of novels and scientific discourse, this is extremely implausible. However, taken more loosely—as an invitation to those of us interested in consciousness to take a closer look at the ways conscious experiences are represented in novels—Lodge's claim is sensible and appealing. I will consider the literal reading of Lodge's claim first and then turn to the looser one.It is undoubtedly true that, as a whole, novelists devote more energy to representing conscious experiences than writers of scientific discourse do. However, science writers can use whatever techniques best serve their aims, including the aim of describing conscious experiences, so there is no reason to think that conscious experiences can, in principle, be represented more effectively in novels than in broadly scientific discourse. Given that Lodge discusses such creative science writers as Antonio Damasio, Daniel Dennett, and Steven Pinker in the course of his essay, it is surprising and disappointing to find him caricature scientific writing in the following way: "science... is a third-person discourse. The first-person pronoun is not used in scientific papers. If there were any hint of qualia in a scientific paper... it would be edited out" (p. 11). Qualia are the supposedly subjective qualitative aspects of conscious experiences. How the plucked string of a cello sounds to you; how the rotting fish in the garbage smells to you; and how it feels for you to inch down into the smooth, almost-too-hot water of a perfect bubble bath—these are all (supposedly) examples of qualia. Lodge is simply mistaken when he says that there is no hint of qualia in scientific writing. There is no consensus about whether qualia can be explained scientifically. In this paper I first examine two important assumptions underlying the argument that physicalism entails panpsychism. These need unearthing because opponents in the literature distinguish themselves from Strawson in the main by rejecting one or the other. Once they have been stated, and something has been said about the positions that reject them, the onus of argument becomes clear: the assumptions require careful defence. I believe they are true, in fact, but their defence is a large project that cannot begin (...) here. So, in the final section I comment on what follows if they are granted. I agree with Strawson that --broadly -- 'panpsychism' is the direction in which philosophy of mind should be heading; nevertheless, there are certain difficulties in the detail of his position. Notwithstanding its phenomenological appeal, physicalists have tended to shun the notion that we are ‘acquainted’ with our mental states in consciousness, due to the fact that the acquaintance relation seems mysterious, irreducible, and consequently unnatural. I propose a model of conscious experience based on the idea of ‘mental quotation’, and argue that this captures what we want from acquaintance but without any threat to naturalism. More generally the chapter embodies a complaint that reductionists seem unable to look past the representation (...) relation to do the implementing of consciousness, and a call for theorists to investigate other relations to model our connection to our conscious states, like the constitution/part-whole relationship. Could there be a power world? That is to say, could there be a world consisting of nothing but dispositional properties? If there couldn't be, then, obviously, the actual world is not such a world. That is one reason why answering this question is important. However, even if one thinks it is already obvious that the actual world is not a power world, answering this question is still important, because whether there could be a power world depends, in part, on (...) whether all the properties in a world could be dispositional . It also depends on whether dispositional properties require nondispositional bases. Could water solubility, for example, be a brute feature of salt, or must this disposition be explicable in terms of some further, nondispositional property that salt also possesses? Answering these questions about the nature of properties is clearly essential to arriving at a plausible ontology of the actual world. (shrink)

We explore the relationship between jurisprudential theories pertaining to the nature of law and semantic and metasemantic theories pertaining to the meaning of ‘law’ in the wake of Dworkin’s notorious Semantic Sting argument in Law’s Empire (HUP 1986). Along the way we delineate various aspects of the semantic and metasemantic underpinnings of ‘law’ as an artifact term and advance the general methodological point that jurisprudential inquiry is only negligibly constrained by the findings of semantic and metasemantic inquiry.

Jules Coleman, one of the world's most influential philosophers of law, here expounds his recent views on a range of important issues in legal theory. Coleman offers for the first time an explicit account of the pragmatist method that has long informed his work, and takes on the views of highly respected contemporaries such as Ronald Dworkin and Joseph Raz.

Conscious mental qualities, aka phenomenal qualities, are seemingly a leading factor in much of our behaviour. Pains make us recoil from painful stimuli, itches make us scratch, feelings of anger sometimes make us shout, visually perceiving red leads us to halt at stop lights, and so on. To relinquish this claim about the efficacy of conscious mental qualities would mean surrendering a major component of our everyday, intuitive self-conception; hence, the claim enjoys considerable prima facie plausibility. Unconscious mental qualities, however, (...) have been posited by a mere handful of philosophers historically, and are nowadays almost universally rejected. Via a case study of ‘restless legs syndrome’, I argue that there is a hitherto unnoticed cost to this prevailing rejection of unconscious mental qualities: the causal efficacy of conscious mental qualities is threatened. In fact, I argue, we face a dilemma: To endorse epiphenomenalism about conscious mental qualities, or to posit unconscious mental qualities. Since it is so plausible that conscious mental qualities are causally efficacious, this reasoning constitutes an argument for unconscious mental qualities. Moving beyond the sensory case, I explain how analogous reasoning might apply to other mental faculties where phenomenal qualities seem causally involved: notably, emotions and mental imagery. The claim that distant simultaneity with respect to an inertial observer is conventional arose in the context of a space-and-time rather than a spacetime ontology. Reformulating this problem in terms of a spacetime ontology merely trivializes it. In the context of flat space, flat time, and a linear inertial structure (a purely space-and-time formalism), we prove that the hyperplanes of space for a given inertial observer are determined by a purely spatial criterion that depends for its validity only on the (...) two-way light principle, which is universally regarded as empirically verified. All (empirically determined) “spacetime” entities, such as the conformal structure or light surface equation, are used in a purely mathematical manner that is independent of and hence isneutral with respect to the ontological status that is ascribed to them. In this regard, our criterion is significantly stronger than thespacetime criterion recently advanced by D. Malament, which appeals explicitly to the conformal orthogonality of spacetime vectors and to the invariance of the conformal-orthogonal structure of spacetime under the causal automorphisms of spacetime. Once the hyperplanes of space for a given inertial observer have been determined by our empirical and purely spatial criterion, the following holds: there exists one and only one $\vec \varepsilon $ -synchronization procedure, namely the standard procedure proposed by Einstein, such that the planes of common time are thesame as the nonconventional hyperplanes of space for the inertial observer. It follows that our criterion provides an empirical even if indirect method for determining that the one-way speed of light is the same as the average two-way speed of light. In addition, two inertial observers that are not at rest with respect to each other necessarily havedifferent hyperplanes of space, and consequently their respective spatial views cannot be encompassed in a single three-dimensional space. Hence, our purely spatial criterion provides an empirical motivation for adopting the more comprehensive spacetime ontology. (shrink)

In 'The duty to miscegenate', I harness John Stuart Mill's 19th century theory of social freedom to explain and to dismantle contemporary racialised and gendered injustice. In the first chapter—Social stigmatisation: 'a social tyranny'—I argue that persons racialised-and-gendered-as-black-women were, in the past, unjustly stigmatised by legal penalties against 'miscegenation' and are still, today, unjustly stigmatised by white male avoidance of cross-racial marriage and companionship. In the second chapter—Encounters that count: 'a foundation for solid friendship'—I argue that we can dismantle this (...) stigmatisation, by engaging in regular and frequent cross-racial commensality with persons racialised-and-gendered-as-black-women. In the third chapter—White right: 'a right to avoid'—I argue that, although we have a right to avoid commensal encounters with others, we do not have a right to avoid persons we racialise as black. On the contrary, we have a duty to encounter them, on terms of equality and intimacy. (shrink)

This paper examines the problems that may arise, particularly for military personnel, when the requirements of doing one's duty seem to come into conflict with the demands of loyalty. This conflict is especially problematic because loyalty is often seen, especially by serving military personnel, as the highest of military virtues. The paper introduces a categorisation of ethical issues into two main types, which are referred to as ‘ethical dilemmas’ and ‘tests of integrity’ which is then used to clarify the issues (...) involved when duty and loyalty come into conflict. It is argued that a true understanding of loyalty and disloyalty means that the demands of loyalty can never legitimately override a genuine duty to follow orders. (shrink)
