Pour autant, plaider montre toujours son utilité, non seulement (...) en matière pénale, mais aussi dans les procès civils. On assiste donc à une nouvelle conception de l’éloquence judiciaire, qu’on souhaite aussi persuasive que les discours d’hier : en quelque sorte, moins plaider pour mieux plaider… ce qui suppose en amont, un travail intensif de recherche, de préparation et une grande maîtrise de soi, non seulement intellectuelle, mais aussi physique. This paper deals with Plato's use ofpoikilosand cognates to describe democracy. It does not argue that Plato'sRepubliccontains empirical analyses of some contemporary event, but supposes that an historical reading of the book is possible and legitimate. Post Peloponnesian War Athenian society experienced profound socio-economic changes. Echoing the aristocratic élite's circumspect anxiety when faced with thenouveaux riches, Plato clearly regards obsessive greediness as one of the root causes of the corruption of any political system. Referring to democracy, the philosopher invents thehimation (...) poikilonor ‘embroidered coat of many colours' metaphor. By materializing the multifaceted concept ofpoikilia, this metaphor gives a single and palpable form to the principaltopoiof anti-democratic rhetoric: thehimation poikilonevokes the motley constitution of the Athenian regime, the tyrant's ostentatious opulence, aped by thedemos turannos, the inconstancy of thedemos, the deceitful character of democracy and, last but not least, its penchant for spectacles. A general model of problem‐solving processes based on misconception elimination is presented to simulate both impasses and solving processes. The model operates on goal‐related rules and a set of constraint rules in the form of “if (state or goal), do not (Action)” for the explicit constraints in the instructions and the implicit constraints that come from misconceptions of legal moves. When impasses occur, a constraint elimination mechanism is applied. Because successive eliminations of implicit constraints enlarge the problem space and have (...) an effect on planning, the model integrates “plan‐based” and “constraint‐based” approaches to problem‐solving behavior.Simulating individual protocols of Tower of Hanoi situations shows that the model, which has a proper set of constraints, predicts a single move with no alternative on about 61% of the movements and that protocols are quite successfully simulated movement by movement. Finally, it is shown that many features of previous models are embedded in the constraint elimination model. (shrink)

Historically, "Healing Methods" (HMS) have not been based on rational theories. Of the thousands of HMs that have arisen over the ages, only a small number survive today, drawing their power and longevity mostly from their superior ability to act as a placebo within the context of modern-day culture, rather than through any other mode of action.When it comes to HMs, Western scientific culture has not yet evolved beyond a pre-scientific stage (Fancher 1995). A scientific analysis of the part played (...) by practitioner/subject empathy and other emotional influences within the healing situation is needed. L'imagination se fonde sur une sorte d'« intuition » des objets mathématiques étudiés, mais cela n'a que très peu de contact avec ce qu'on appelle d'ordinaire l'« intuition » sensible, les objets mathématiques considérés étant le plus souvent l'aboutissement d'un long processus d'abstraction qui leur ǒte toute possibilité de représentation concrète. In this commentary, we propose to go further and ground the psychology of ownership solely in a cooperative logic. The predictions of bargaining theory, we argue, completely contradict the actual features of ownership intuitions. Ownership is only about the calculation of mutually beneficial, reciprocal contracts.

Na República Platão assume que a τέκνη é um fator fundamental para agregar as pessoas dentro de uma vida em comum e organiza as relações de modo que a cidade tenha o melhor sistema político possível, onde cada um exerce o ἒργον que lhe cabe. Para tanto o filósofo defende que a função exercida por cada membro da pólis esteja de acordo com a sua natureza. É a partir dessa premissa que se torna importante verificar dentro do texto platônico como (...) ele articula elementos importantes para defender tal pressuposto. Neste caso temos que verificar a relação da τέκνη com o ἒργον e da τέκνη com a ἐπιστήμη sem negligenciar como a τέκνη pode ser considerada algo que beneficia a cidade como um todo. La présente contribution analyse les deux risques auxquels sont confrontés l’administration pénitentiaire et son personnel, les surveillants notamment, dans leur lutte contre la radicalisation : le risque de la protection insuffisante de la société face à des conversions non repérées et susceptibles d’aboutir à des actes violents de type terroriste, d’une part, et, d’autre part, le risque du signalement systématique pouvant conduire au renforcement du sentiment de discrimination chez certains détenus et, paradoxalement, constituer un terrain favorable au développement de la (...) radicalisation violente. Pour dépasser ces deux risques, il est proposé, à partir de données de terrain, une application équilibrée du principe de précaution qui devrait reposer sur une meilleure formation des personnels par la pratique, entre autres, de l’interprétation croisée. Cet article se propose d’aborder la question de l’incarnation dans l’anthropologie philosophique de Ricœur en choisissant de faire porter ses analyses sur ces deux œuvres majeures que sont la Philosophie de la volonté et Soi-même comme un autre. Il défend la thèse selon laquelle la pensée ricœurienne de l’incarnation consiste pour l’essentiel à développer une analyse du corps propre comme médiation fragile, en s’efforçant d’articuler deux dialectiques complémentaires. Une première dialectique de l’acte et de la puissance exprime le caractère ontologique (...) et opérant de ce procès dynamique de médiation, tandis qu’une seconde dialectique de l’activité et de la passivité pointe les limites et la vulnérabilité de cette médiation. L’articulation de ces deux dialectiques constitutives de notre expérience de l’incarnation peut alors être lue ultimement comme une dialectique de la structure et de l’événement dont le caractère à la fois éthique et ontologique constitue le cœur de l’anthropologie philosophique ricœurienne. Partant de l'hypothèse selon laquelle l'élaboration d'une théorie générale de l'imagination constitue l'une des visées centrales de la philosophie ricoeurienne et l'un de ses legs les plus prometteurs, ce livre se propose de travailler à une genèse rigoureuse de cette philosophie de l'imagination, en s'appuyant principalement sur les trois oeuvres qui composent la Philosophie de la volonté. A travers une analyse des dialogues de Ricoeur avec Sartre, Nabert, Bachelard, Merleau-Ponty, Jaspers, Cassirer, Husserl et Heidegger autour de la question de l'imagination, (...) il s'agit de montrer comment cette première grande oeuvre philosophique ricoeurienne esquisse une théorisation très novatrice de la fonction poético-pratique de l'imagination - capable tout à la fois de poser les bases d'une réhabilitation générale de la fonction de l'imagination dans l'agir humain et d'initier une réflexion critique sur les usages méthodologiques de l'imagination dans le discours philosophique. Cette contribution cherche à déterminer les rapports entre anarchie et démocratie chez Proudhon en partant de la place qu’il accorde au conflit. La première partie revient sur la prise en compte de ce que Proudhon nomme antagonisme ou antinomie et sur les différents types de conflits qu’il range sous cette rubrique, qui est au centre de son projet d’ontologie sociale. La deuxième partie s’intéresse à un cas d’antinomie, à la fois limite et fondamental : celui de la différence sexuelle, qui (...) est désignée comme une antinomie tout en se voyant dénier le statut de rapport conflictuel. La dernière partie montre comment la prise en compte du conflit chez Proudhon conduit à une critique de la démocratie et à un projet positif désigné par le terme de fédéralisme. (shrink)

This paper seeks to determine the relationship between anarchy and democracy in Proudhon’s thought, considering the place of the conflict in this autor. The first part exposes what Proudhon names antagonism and antinomy in his social ontology and the different sorts of conflicts this ontology takes into account. The second part focuses on a case of antinomy, that is at the same time a basic and a borderline case : sexual difference, that Proudhon considers as an antinomy, but not as (...) a conflict. The last part shows how this theory of conflictuality leads to a criticism of democracy and to a positive federalist project. (shrink)

Pp. 182. DM 24.50) For Fichte scholars this closely argued and well organized study of the foundations of Fichte's Wissenscha/tslehre is simply a must. American philosophers generally, however, will not become Fichte enthusiasts after reading this book. But this is not the fault of the authoress, but of Fichte. The key question which Dr. SchiJssler raises is, What role does realism play in Fichte's transcendental idealism? With this question in mind she examines Fichte's "foundation of the entire theory of science" of 1794-1795 and related matters, and the "theory of science" of 1804, together with the lecture of 1813. As Fichte originally saw the task of philosophy it was to explain theoretical, i.e., scientific, consciousness in terms of its own foundation. In 1804, however, the task was conceived as presentation of absolute truth; and in 1813, Fichte tried to understand the theory of science as a theory of appearances. Dr. Schfissler's thesis is that all three approaches are necessary; that, in fact, the changes in Fichte's conception of what a theory of science is or ought to be are grounded in the nature of transcendental philosophy itself. The book is not something one reads for relaxation; its sustained and detailed arguments militate against that. But it is a highly illuminating study, and well worth the effort of careful analysis. W. H. WE~mSTBR Florida State University The Manifold in Perception. Theories of Art.from Kant to Hildebrand. By Michael Pedro. (Oxford: Clarendon Press, 1972. Oxford-Warburg Studies) This is a survey of theories of art of Kant, Schiller, Herbart, Hildebrand, Schopenhauer and Fiedler. One may question the value of a re-statement of this sort, over simply another reading of the works of the authors themselves. Pedro's answer may be found in the Preface and again in a more extended statement in the conclusion. "German aesthetic theory from Kant through to the end of the nineteenth century seemed to contain valuable critical ideas quite absent from contemporary philosophical writing." Pedro's attempt has been to "re-locate notions in current use, like 'aesthetic detachment', within the sustained systematic discourse of which they were once part. This seemed a way both of uncovering a number of assumptions which have been constraining writing on art for some time, and of clarifying a number of crucial insights of earlier theorists." The author's account is almost entirely expository, its negative critical questions being limited almost exclusively to Herbart. Yet even here, when the author indicates that Herbart's theory of mind "exhibits certain very basic logical difficulties," he adds that 538 HISTORY OF PHILOSOPHY "they are difficulties which have a particular importance in the discussion of art.... " Podro's clarification is largely made through the asking of questions which the authors themselves did not ask and then suggesting answers to these questions in the light of what the authors did say. The two chapters on Schiller form the core of the book. Schiller's theory of art and aesthetic education of man is placed as central to Podro's account of an aesthetic tradition beginning with Kant and ending with Fiedler. The "tradition" detailed in Podro's book is described as having two underlying assumptions. The first was that any account of art must indicate distinctive or at least characteristic uses of our perception, uses which if not exclusive to art are at least necessary to it, and which are seen in art in a particularly striking way.
