The new critical edition of the works and correspondence of Jeremy Bentham is being prepared and published under the supervision of the Bentham Committee of University College London. In spite of his importance as jurist, philosopher, and social scientist, and leader of the Utilitarian reformers, the only previous edition of his works was a poorly edited and incomplete one brought out within a decade or so of his death. Eight volumes of the new Collected Works, five of correspondence, and (...) three of writings on jurisprudence, appeared between 1968 and 1981, published by the Athlone Press. Further volumes in the series since then are published by Oxford University Press. Frankfurt-type examples seem to show that agents can be morally responsible for their actions and omissions even if they could not have done otherwise. Fischer and Ravizza's influential account of moral responsibility is largely based on such examples. I examine a problem with their account of responsibility in cases where we fail to act. The solution to this problem has a surprising and far reaching implication concerning the construction of successful Frankfurt-type examples. I argue, contra Dreier, Blackburn, and others, that there are no morally neutral metaethical positions. Every metaethical position commits you to the denial of some moral statement. So, for example, the metaethical position that there are no moral properties commits you to the denial of the moral conjunction of 1) it is right to interfere violently when someone is wrongly causing massive suffering and 2) it is wrong to interfere violently when only non-moral properties are at stake. First, the familiar Principle of Alternative Possibilities says that we cannot be morally responsible for what we do unless we could have done otherwise. Accepting this principle, incompatibilists have then argued that there is no room for such alternative possibilities in a deterministic world. Creepiness and the emotion of the creeps have been overlooked in the moral philosophy and moral psychology literatures. We argue that the creeps is a morally significant emotion in its own right, and not simply a type of fear, disgust, or anger (though it shares features with those emotions). Reflecting on cases, we defend a novel account of the creeps as felt in response to creepy people. According to our moral insensitivity account, the creeps is fitting just when its object (...) is agential activity that is insensitive to basic moral considerations. When, only when, and insofar as someone is disposed to such insensitivity, they are a creep. Such insensitivity, especially in extreme forms, raises doubts about creeps’ moral agency. We distinguish multiple types of insensitivity, respond to concerns that feeling the creeps is itself objectionable, and conclude with a discussion of epistemic issues relating to the creeps. Early to mid-nineteenth-century America experienced a cultural fascination with oneness or monism--the notion that individuals are not separate from divinity but, rather, that the individual soul is an incarnation of the universal soul. Everything is one. This buzz of monism was traceable in part to translations of the Vedas by Indian philosopher Rammohun Roy and found some of its fullest expression in the work of Ralph Waldo Emerson and Walt Whitman. This oneness tradition is what animates Jeremy David Engels--not (...) only because we can't understand Emerson, Whitman, and other American philosophers without it, but because Engels thinks this tradition offers a way of thinking and acting that can meet the ethical challenges of everyday democracy in the present. The Ethics of Oneness is not only a brilliant study of the centrality of the Bhagavad Gita in the philosophy of Emerson and Whitman and a compelling reception history of the Gita in America, it is also a constructive project of moral and political philosophy intended to open possibilities for the present. If the lessons of oneness are taken to heart, Engels thinks, it ispossible to counter the pervasive, problematic American ideals of separation, competition, hierarchy, exclusion, and domination. Having the emotion of pride requires taking oneself to stand in some special relation to the object of pride. According to agency accounts of this pride relation, the self and the object of pride are suitably related just in case one is morally responsible for the existence or excellence of the object of one's pride. I argue that agency accounts fail. This argument provides a strong prima facie defence of an alternate account of pride, according to which the self and (...) the object of pride are suitably related just in case one's relation to the object of pride indicates that one's life accords with some of one's personal ideals. I conclude that the pride relation, though distinct from the relation of moral responsibility, is nonetheless a relation of philosophical interest that merits further attention. (shrink)

Is the exemplar of modern ethical theory estranged from their intimates because the motive of duty dominates their motivational psychology? While this challenge against modern ethical theory is familiar, I argue that with respect to a certain strand of Kantian ethical theory, it does not so much as make sense. I explain the content and functional role of the motive of duty in the psychology of the moral exemplar, stressing in particular how that motive shapes and informs the content of (...) others, including those characteristic of intimacy. I argue that to the extent that a subject does not integrate their motive of duty with their other motives, their moral and intimate relationships are compromised, and on the same grounds, because intimate relationships are interpersonal relationships and the motive of duty just is the motive to respect another person as a separate person. Much of the philosophical attention directed to pride focuses on the normative puzzle of determining how pride can be both a central vice and a central virtue. But there is another puzzle, a descriptive puzzle, of determining how the emotion of pride and the character trait of pride relate to each other. A solution is offered to the descriptive puzzle that builds upon the accounts of Hume and Gabriele Taylor, but avoids the pitfalls of those accounts. In particular, the emotion (...) and the trait correspond to two employments of personal ideals: personal ideals as standards of self-assessment and personal ideals as practical guides in one’s deliberation and related activities. What is the function of morality—what is it all about? What is the basis of morality—what explains our moral agency and patiency? This essay defends a unique Kantian answer to these questions. Morality is about securing our independence from each other by giving each other equal discretion over whether and how we interact. The basis of our moral agency and patiency is practical reason. The first half addresses objections that this account cannot explain the moral patiency of beings who are (...) not also moral agents such as infantile, elderly, and infirm human beings and the other animals who are not moral agents. The second half argues that this account is preferable, on grounds of consistency with the basic Kantian account of the function and content of morality, to the familiar account of our moral patiency, popular especially though not exclusively with contemporary Kantians, in terms of the value of humanity. Essentially everyone agrees that the outlawing of slavery, or the beginning of women’s suffrage, or the defeat of Nazism constitute paradigmatic examples of moral progress in human history. But this consensus belies a deep division about the nature of moral progress more generally, a consequence of the foundational differences among and within normative traditions regarding the nature and scope of the ‘moral’ in moral progress. This essay proposes that philosophers might nonetheless converge on a working definition of moral progress by (...) identifying a proxy property that reliably tracks moral progress, but which does not purport to be coextensive with the philosophically-relevant property. The aim of this essay is to identify this proxy property with emerging empirical measures of population welfare, and to show why this indicator of moral progress can garner overlapping consensus from a variety of normative traditions. In recent years, philosophers and psychologists have resurrected a debate at the intersection of metaphysics and moral psychology. The central question is whether we can conceive of moral agents as deterministic systems unfolding predictably and inevitably under constant laws without psychologically damaging the pro-social attitudes and moral emotions that grease the wheels of social life. These concerns are sparked by recent experiments documenting a decline in the ethical behavior of participants primed with deterministic metaphysics. But this literature has done little (...) to sway most contemporary philosophers who have instead emphasized determinism's positive social impact in motivating more compassionate responses to social deviance. This article presents the case for a middle position. It argues that the ?deterministic conception of human action? (the DCA) is likely to have a dual impact on human moral psychology. On one hand, the DCA is likely to mollify one of our species? least admirable tendencies involving retributive moral anger, while concomitantly exacerbating one of our worst, namely our tendency toward moral apathy. This article begins with an overview of this emerging interdisciplinary debate, offers the evidence for a middle position, and concludes with suggestions for mitigating the negative social impact of deterministic metaphysics. Research that examines unethical interpersonal treatment has received a great deal of attention from scholars and practitioners in recent years due to the remarkable impact of mistreatment in the workplace. However, the literature is incomplete because we have an inadequate understanding of insubordination, which we define as “subordinates’ disobedient behaviors that intentionally exhibit a defiant refusal of their supervisors’ authority.” In our study, we integrate social exchange theory and the advantageous comparison component of moral disengagement within the integrative model of (...) experiencing and responding to mistreatment at work. Then, we explain why subordinates disengage from moral control as they balance experiencing abusive supervision with perpetrating insubordination within negative supervisor–subordinate social exchange relationships. In Studies 1–4, we validate a five-item measure of insubordination and demonstrate its content, convergent, discriminant, criterion-related, and predictive validity. In Study 5, we demonstrate that there is a positive indirect effect of abusive supervision on insubordination through negative social exchange relationship quality that strengthens for subordinates who perceive higher levels of supervisors’ task performance than others. Overall, our study advances the conversation in the business ethics literature by creating a solid conceptual, empirical, and theoretical foundation for a cohesive program of insubordination research that meaningfully builds on prior findings in unethical interpersonal treatment research. Many authors have argued that emotions serve an epistemic role in our moral practice. Some argue that this epistemic connection is so strong that creatures who do not share our affective nature will be unable to grasp our moral concepts. I argue that even if this sort of incommensurability does result from the role of affect in morality, incommensurability does not in itself entail relativism. In any case, there is no reason to suppose that one must share our emotions and (...) concerns to be able to apply our moral concept successfully. Finally, I briefly investigate whether the moral realist can seek aid and comfort from Davidsonian arguments to the effect that incommensurability in ethics is in principle impossible, and decide that these arguments are not successful. I conclude that the epistemic role our emotions play in moral discourse does not relativize morality. (shrink)

Many response-dependence theorists equate moral truth with the generation of some affective psychological response: what makes this action wrong, as opposed to right, is that it would cause (or merit) affective response of type R (perhaps under ideal conditions). Since our affective nature is purely contingent, and not necessarily shared by all rational creatures (or even by all humans), response-dependence threatens to lead to relativism. In this paper, I will argue that emotional responses and moral features do not align in (...) the way predicted by the response-dependence theorist who wishes to tie morality to emotional affect. I further argue that since response-dependence accounts that tie morality to any sort of affect (be it an emotion, a desire, a desire to desire, or so on) cannot explain the objectivity and universality of morality; and since we do not need a psychological response to play a truth-constituting role in morality in order to explain the normativity or content of morality, we should reject such response-dependence accounts. Si Bentham, en effet, a consacré l'essentiel de ses travaux à des projets de réforme de la société anglaise de son temps par le biais de la codification des lois, il n'a cessé d'enrichir cette réflexion par des emprunts faits à d'autres disciplines, dans lesquelles il était également passé maître, telles la morale, la (...) psychologie, la logique, la théorie du langage, l'économie ou la politique. Cette pensée, à la fois plurielle et ambiguë (est-elle conservatrice, réformiste, révolutionnaire ou utopique? est-elle descriptive, explicative ou normative?), révèle aujourd'hui son étonnante actualité. Il est peu de thèmes juridiques contemporains qui ne trouvent en effet leur place dans l'œuvre de Bentham : ainsi les questions de l'utilité, de la balance des intérêts, de la constitution d'une science du droit et d'une logique déontique; ainsi les concepts de système juridique, de codification, de déontologie, de contrôle social, d'opinion publique et de majorité politique. This paper provides a new analysis and critique of Rawlsian public reason’s handling of the abortion question. It is often claimed that public reason is indeterminate on abortion, because it cannot say enough about prenatal moral status, or give content to the (allegedly) political value which Rawls calls ‘respect for human life’. I argue that public reason requires much greater argumentative restraint from citizens debating abortion than critics have acknowledged. Beyond the preliminary observation that fetuses do not meet the criteria (...) of political personhood, I contend, public reasoners may say nothing about prenatal moral status. Indeed, respect for human life (as distinct from respect for persons) is not, I show, a genuine political value, whose interpretation lies within public reason’s remit. This fact does not, however, prevent deliberators from drawing determinate conclusions regarding the law of abortion. Instead, I show, public reason has radically permissive implications for the legal regulation of feticide, inclining heavily towards the view that abortion should be allowed with little or no qualification, right until birth. I end by giving grounds for thinking that, even if the argumentative restraint which public reason enjoins over prenatal moral status does not generate indeterminacy, it is nonetheless objectionable. In place of Tomasello's explanation for the source of moral obligation, we suggest that it develops from the concern for others already implicit in the human developmental system. Mutual affection and caring make the development of communication and thinking possible. Humans develop as persons within such relationships and this develops into respect and moral obligation.

Wilfrid Sellars’s ethical theory was rich and deeply innovative. On Sellars’s view, moral judgments express a special kind of shared intention. Thus, we should see Sellars as an early advocate of an expressivism of plans and intentions, and an early theorist of collective intentionality. He supplemented this theory with a sophisticated logic of intentions, a robust theory of the categorical validity of normative expressions, a subtle way of reconciling the cognitive and motivating aspects of moral judgment, and much more— all (...) within a strict nominalism that preserves Sellars’s commitment to naturalism. The Ethics of Wilfrid Sellars offers the first systematic treatment of this sadly neglected aspect of Sellars’s work and demonstrates that his ethical theory— just like his more widely discussed epistemology— has much to contribute to current debates. Most philosophers endorse our epistemic practice of evaluating beliefs and methods of inquiry as justified or unjustified, rational or irrational; far fewer, though, think our practice of moral evaluation is viable. I contend that this difference in attitude toward epistemic and moral practice reveals an underlying double standard. I argue that the standards set by influential moral anti-realist arguments are not met by our practices of epistemic justification, and that the adoption of these standards would therefore force us to abandon (...) such things as the distinction between rational and irrational arguments, science and pseudoscience, and the like; hence, these standards are too stringent, and ought not be adopted. In addressing J. L. Mackie's charge that moral properties would have to be queer things in virtue of their "to-be-doneness", I argue that epistemological properties are no less queer, and give a positive account of the connection between moral judgment and moral motivation that avoids the worry. I then turn to Gilbert Harman's argument that moral facts neither figure in the best causal explanations, nor are reducible to causally efficacious facts. I concede this, but argue that the same is true of epistemic and social facts, and that pragmatic reasons justify our continued participation in such discourse. I next address the contention that the constitutive role of emotion in moral discourse renders morality problematically local. I argue that emotion plays no constitutive role in morality, serving only evidential and epistemological functions which entail no incommensurability. Finally, I borrow from recent accounts of normativity to suggest that all normative discourse is of a piece, and that there is no in principle distinction between moral, epistemological, semantic, and other types of normative discourse. This suggests that these sorts of discourse all stand and fall together, and that morality is therefore just as hardy as epistemology and the like. (shrink)

My aim in this article is programmatic. I argue that understanding perceptual experience on the model of perceptual affordances allows us to acknowledge the centrality of embodiment to moral phenomenology, on the one hand, and to see more transparently the place of the emotions in the moral life, on the other. I suggest some means by which moral perception, construed as the perception of moral affordances, might be cultivated.

One main moral concerns methodology: Lagrangian mechanics provides a level of description of phenomena which has been largely ignored by philosophers, since it falls between their accustomed levels---``laws of nature'' and ``models''. Another main moral concerns ontology: the ontology of Lagrangian mechanics is both more subtle and more problematic than philosophers often realize. The treatment of Lagrangian mechanics provides an introduction to the subject for philosophers, and is technically elementary. (...) Robert Burton noted out in The Anatomy of Melancholy (1621), the melancholic condition was commonly taken to be "a kind of dotage without fever, having for his ordinary companions fear and sadness, without any apparent occasion."2 The presence of a pervasive and unreasonable sense of fear and sorrow invariably solicited the melancholic label. Indeed, melancholic emotions were the primary substance of melancholic dotage; the ravings of the melancholically mad and their frequent obsession with a single idea were often driven by an overwhelming feeling of fear and sorrow.3The concept of melancholy as a mental disorder involving these specific emotions had coalesced under the gaze of medical observation in ancient Greece, and the melancholic condition was thought by many medical theorists of classical [End Page 583] antiquity to be caused by a physiological surfeit of black bile, the Greek word for which was melancholia.4 Western medicine, profoundly influenced by the Greek medical tradition, continued to diagnose and treat melancholic disturbance as a physical distemper well into the nineteenth century. Yet the kind of mental anguish which early medical observers labeled melancholic bore a striking resemblance to forms of emotional disorder whose point of origin was thought to be the mind itself. Various traditions of classical moral philosophy sought to treat disorders of the mind that unchecked emotion could create primarily by directing, ordering, and correcting the thought of the sufferer. Where the melancholic condition displayed qualities of the emotions as these were represented and analyzed by moral philosophers it was viewed as susceptible to philosophical treatment and insight.5Early modern English writers, no less than classical writers, thought it appropriate to apply to cases of melancholy therapies derived from the philosophic endeavor to define and achieve peace of mind. Burton argued explicitly in The Anatomy of Melancholy for the rightful authority of the philosophical "physician of the soul" in the treatment of melancholy; and the conceptual similarity of melancholy to moral diseases of the soul which provided the basis for this authority is evidenced in the works of several seventeenth-century moralists, as well as in the writings of the influential seventeenth-century physician and natural philosopher Thomas Willis on melancholy and the passions. Willis noted that melancholic emotions were structured and caused by the judgments of the mind rather than by the force of physiological dysfunction alone. His recognition of the importance of the mental aspects of melancholy provided the basis for his prescription of moral therapies for the government of the mind in addition to therapies for the body. Moreover, his writing on the passion of grief displays the ability of moral philosophical language to represent melancholic-like states as problems of the moral life, to be engaged through rational meditation and control.The importance of moral philosophy in understanding and treating melancholy has been largely ignored in current scholarship in the history of psychiatry and madness, which has concentrated on early modern medical concepts of mental disorder that traced its origins to the body. The historian of psychiatry and "madness" Roy Porter has, for instance, referred to Willis's medical writings as evidence for the "thoroughgoing somatic grounding of disorders of thought, feeling and behavior" that he alleged to have dominated the era's medical [End Page 584] conceptualization and treatment of madness.6 While Michel Foucault insightfully noted that Willis's ostensibly chemical account of the nature of melancholy was in fact "a phenomenology of the melancholic experience," he dismissed out of hand the relevance of classical moral philosophical language to the early modern treatment of madness, asserting the complete absence of moral treatments of madness until the end of the eighteenth century.7 In analyzing Willis's writing he thus failed to note the broader moral philosophical... Steven M. Cahn presented a fascinating and recalcitrant puzzle. Imagine that you own stock in a company that has undertaken an immoral course of action. Most people believe that selling the stock is the right thing to do. But if you sell the stock, you thereby abet the buyer in an immoral course of action, namely the buyer’s coming to own tainted stock. Is principled divestiture possible? If so, what are the moral grounds on which principled divestiture stands? These questions (...) have proven difficult. Cahn answered many attempted replies to his puzzle. In this journal, Saul Smilansky also attempted to answer the divestiture puzzle. Smilansky concluded, “Attempting to divest by offering the stock for sale is, however, morally problematic. It is problematic because it involves the bad faith of putting something forward as morally acceptable while claiming it to be morally tainted.” Smilansky continued, “One needs to get rid of the stock and take it off the market at the same time, i.e., make it impossible for others to purchase the stock.” Smilansky thereby implies that one should destroy the stock. However, Cahn had already replied to this move, noting that destroying one’s stock would increase the moral culpability of other owners. (shrink)

This essay overcomes the division between “principled” and “strategic” approaches to nonviolence studies by demonstrating that ethical analysis is key to understanding movement strategy. I show how the moral phenomenologies of Martin Luther King Jr. and Emmanuel Lévinas, figures usually treated by scholars of principled nonviolence, possess genuine insight for nonviolent strategists. With reference to each thinker and supporting evidence from the #BlackLivesMatter movement, I argue that nonviolent resistance makes a moral appeal through the medium of the body to the (...) conscience of those bearing witness. Analysis of the way King combined moral reflection and strategic action recovers his legacy for the pragmatic tradition of social thought, while Lévinas's theory of the face offers additional considerations for nonviolent practitioners aiming for moral transformation at the local level. Studies that elucidate the complex moral dynamics by which nonviolent movements either succeed or fail will make the field a greater asset to practitioners. (shrink)

Strong arguments support the notion that much of modern bioethics is a result of appropriation rather than strict application of traditional moral philosophy. Nevertheless, it is important to recognize these sources and approaches associated with them, even when working with appropriated theories, since traditional ethical theory does and should influence modern bioethics.
