As practiced, medicine bumps along with the rest of us, doing its level best to cope with the contingencies of this often heartbreaking world. Yet it's a commonplace that much of medicine's self‐image, and a good deal of its cultural heft, come from its connection with the natural sciences and, what's more, from a picture of science that has a touch of the transcendental, highlighting the unmatched rigor of its procedures, its exacting rationality, and the reliability of its results.In contrast, (...) the very idea of “queer” carries with it a little taste of the uncanny. What we're inclined to label queer resists understanding, not so much because it's too complicated, but because it tends to be too slippery to capture neatly in our conceptual nets—that queer ache in your side, for instance, or your partner's queer notion of doing laundry. The outmoded use of “queer,” as a way to refer disparagingly to gay people, carried similar uncanny connotations: the unnatural, the perverse.One might think, then, that the reclamation of “queer” as an umbrella term referring to the lesbian, gay, bisexual, and transgender spectrum has a pleasing depth to its irony—not only does it wrench the customary direction of evaluation conveyed by the word from condemnation to celebration, but it also hints that what you find comprehensible depends a good deal on who you are and where you're standing. What from the perspective of many heterosexual and cisgendered people may seem opaque, exotic, threatening—erotic love directed toward someone with the same kind of body you have, lives lived in ways that challenge the immutability of birth‐assigned gender—are to LGBT folk not uncanny at all, but as familiar as breathing.I like this conceit, but alas, it is too simple. Though there are good arguments against physician participation in executions, physicians should be allowed to make their own decisions about whether they will participate, and professional medical organizations should not flatly destroy the careers of those who do.

In the United Nations' Universal Declaration of Human Rights a quite large number of things are said to be ‘human rights’ and though in that Declaration the term ‘inalienable’ is not used to describe the rights in question it has been so used by commentators—at least with respect to some of the rights enumerated. I shall forgo asking the prior question as to whether any such thing as a human right exists and ask simply whether any such thing as an (...) inalienable right exists. On the usual account of moral reasoning, social science is often seen as able to provide “just the facts,” while philosophy attends to moral values and conceptual clarity and builds formally valid arguments. Yet disciplines are informed by epistemic values—and bioethics might do well to see social scientific practices and their attendant normative understandings about what is humanly important as a significant part of ethics generally.

We agree with van der Pijl et al that the question of how to ensure consent is obtained for procedures which occur during labour and childbirth is vitally important, and worthy of greater attention.1 However, we argue that the modified opt-out approach to consent outlined in their paper may not do enough to protect the choice and agency of birthing people. Moreover, while their approach reflects a pragmatic attempt to facilitate legal clarity and certainty in this context, this is not (...) necessarily responsive to the messy realities of decision-making during labour (and beyond). We outline some of our concerns with their proposals and demonstrate how these illuminate some broader, longstanding tensions around consent and medical law. The authors place significant focus on the particularities of labour, outlining six ways in which maternity care is ‘unlike the usual healthcare setting’ (van der Pijl M et al,1p4). We support the need for attentiveness to these particularities and the problematic nature of consent in this context. Recent scholarly attention on the possible ‘political, ethical and theoretical implications and meanings of birthing embodiment’ (Chadwick R,2p2) has invited more nuanced conversation about consent, agency and decision-making during labour. However, while recognising the embodied particularities of labour, we must also avoid essentialising the differences of labouring bodies and thereby reinforcing exclusionary norms of consent. Over the past two decades, the competency movement has been gathering momentum internationally within the ranks of professional nursing. It can be argued that this momentum is in response to government initiatives aimed at improving consistency in workforce training and accreditation, and fostering national and international portability of qualifications. At the same time, the competency movement has provided the opportunity for regulators, service providers and government to develop mechanisms to reconstitute competent nurses as accountable, self‐regulating subjects and to monitor this (...) transformation in particular ways. The ways in which competencies have been taken up to do this transforming work in Canada are unique and deserving of some detailed description and analysis.We argue that Canadian nursing regulatory authorities have chosen to view competence as the rehearsal of ethical attributes consonant with the professional role,as opposed to the enactment of skilled conduct. As a result, reflective practices rather than skill and knowledge have become the cornerstone of nursing competency formulation and review. We argue that this distinctly Canadian approach to competency serves three ends. First, it privileges the ‘attribute’ element of the nursing competency model and side steps the ever‐problematic ‘nursing knowledge’ issue; second, self‐surveillance by nurses shifts the onus for professional development from industry to the individual; and third, it concedes responsibility for skill assessment by the regulatory authorities to industry control, leaving employers free to determine skill base and skill mix requirements for practice. Finally, we argue that the reflective component of the regulatory framework for Canadian nurses radically fails as a tool for auditing quality and assessing competency. Rather, it functions as a governmental practice that furthers the deregulatory and economic rationalist aims of the Canadian health reform agenda. (shrink)

The majority of traditional students enrolled at most colleges and universities are a part of what has been termed the Millennial Generation, also known as Generation Y, which typically describes the group of individuals born in most of the 1980s and 1990s. This cohort’s life has been shaped by corporate scandals, economic instability, and worldwide tragedies. Concurrently, business ethics has become a popular topic in the news within the last 2 decades due to the increase in the number of high-profile (...) business scandals. Unfortunately, this trend has also been accompanied by an increased number of reported incidents of academic dishonesty at many major universities. Two underresearched factors that may be related to academic dishonesty and cheating behavior are religiosity and spirituality. This article attempts to shed more light on the relationship between religious beliefs and unethical behavior, with a focus on millennial college students. It is posited that religiosity and spirituality influence an individual’s attitudes, views, decisions, and ultimately behaviors. The results of this study indicate that religiosity but not spirituality is a predictor of students’ attitudes toward cheating and cheating behavior. (shrink)

Over the past decade, support for reexamining and reconsidering the U.S. model of ethics review for protocols involving research with humans has grown, particularly for studies involving participants from multiple locales and organizations. The HMO Research Network received an infrastructure-building contract in 2004 that enabled us to evaluate issues in multi-institutional IRB review, examine possible changes, and propose a new model. We conducted key informant interviews and held meetings with IRB personnel, administrators, and researchers, eventually resulting in networkwide agreement to (...) pilot an alternative model of IRB review for minimal-risk, data-only studies that only entailed use of computerized data from our network sites. This article describes the organizational and interpersonal processes that led to the successful establishment of this alternative model, to inform other research consortia considering new multisite review models. SUMMARYThe Machiavellian Moment was largely responsible for establishing what remains the dominant understanding of American Revolutionary ideology. Patriots, on this account, were radical whigs; their great preoccupation was a terror of crown power and executive corruption. This essay proposes to test the whig reading of patriot political thought in a manner suggested by Professor Pocock's pioneering first book, The Ancient Constitution and the Feudal Law. The whig tradition, as he taught us, located in the remote Saxon past an ‘ancient constitution’ (...) of liberty, in which elected monarchs merely executed laws approved by their free subjects in a primeval parliament. This republican idyll, whigs believed, was then tragically interrupted by the Norman Conquest of 1066, which introduced feudal tenures and monarchical tyranny. Did patriot theorists accept this narrative? The answer, I shall argue, is strikingly mixed. By the early 1770s, appeals to the ‘ancient constitution’ had become less common in patriot writing. And by the end of the 1770s, many patriots had absorbed a completely different understanding of the feudal past—one pioneered by Royalist historians of the seventeenth century and then adapted by Scottish historians of the eighteenth. This shift reflects a broader transformation in patriot political and constitutional theory. (shrink)

This paper explores why ethical issues associated with mental illness have been generally neglected in the literature and texts of the discipline of bioethics. I argue that the reasons for this are both philosophical and structural, involving the philosophical framework of principlism in bioethics, in particular the privileging of the principle of autonomy, and the institutional location and disciplinary boundaries of bioethics as a profession. Other contributing factors include developments outside of bioethics, in medicine and law and in the delivery (...) patterns and funding sources of mental health services, and above all the pervasive stigma that attaches to mental illness. My goal is to show both how the attention bioethics could bring would benefit this neglected area of health care, and why attending to the issues surrounding mental illness would benefit bioethics in meeting its professional obligations as the public voice on matters of ethical significance in health care. The "grassroots turn" in bioethical discussions about justice in allocation of health care resources has attracted a great deal of support; in the absence of a convincing theory of justice in rationing, democratic decisionmaking concerning priority setting emerges with a kind of inevitability. Yet there remain suspicions about this approach – most importantly, worries about the socially corrosive impact of explicit, public decisionmaking that in effect sets a price on the lives of persons. These worries have been quieted, particularly by (...) the work of Leonard Fleck, but not altogether stilled. I explore more sympathetically the ideals to which concerns about public rationing somewhat dimly respond, and suggest constraints on priority setting discussions which might accommodate those ideals rather better.
