Libertarian paternalism is a concept derived from cognitive psychology and behavioural science. It is behind policies that frame information in such a way as to encourage individuals to make choices which are in their best interests, while maintaining their freedom of choice. Clinicians may view their clinical consultations as far removed from the realms of cognitive psychology but on closer examination there are a number of striking similarities.

Interval temporal logics provide both an insight into a nature of time and a framework for temporal reasoning in various areas of computer science. In this paper we present sound and complete relational proof systems in the style of dual tableaux for relational logics associated with modal logics of temporal intervals and we prove that the systems enable us to verify validity and entailment of these temporal logics. We show how to incorporate in the systems various relations between intervals and/or (...) various time orderings. (shrink)

We introduce an Automatic Theorem Prover (ATP) of a dual tableau system for a relational logic for order of magnitude qualitative reasoning, which allows us to deal with relations such as negligibility, non-closeness and distance. Dual tableau systems are validity checkers that can serve as a tool for verification of a variety of tasks in order of magnitude reasoning, such as the use of qualitative sum of some classes of numbers. A new deduction system for deciding validity for the minimal decidable normal modal logic K is presented in this article. Modal logics could be very helpful in modelling dynamic and reactive systems such as bio-inspired systems and process algebras. In fact, recently the Connectionist Modal Logics has been presented, which combines the strengths of modal logics and neural networks. Thus, modal logic K is the basis for these approaches. Soundness, completeness and the fact that the system itself is a decision (...) procedure are proved in this article. The main advantages of this approach are: first, the system is deterministic, i.e. it generates one proof tree for a given formula; second, the system is a validity-checker, hence it generates a proof of a formula ; and third, the language of deduction and the language of a logic coincide. Logics of binary relations corresponding, among others, to the class RRA of representable relation algebras and the class FRA of full relation algebras are presented together with the proof systems in the style of dual tableaux. Next, the logics are extended with relational constants interpreted as point relations. Applications of these logics to reasoning in non-classical logics are recalled. An example is given of a dual tableau proof of an equation which is RRA-valid, while not RA-valid.

The book presents logical foundations of dual tableaux together with a number of their applications both to logics traditionally dealt with in mathematics and philosophy (such as modal, intuitionistic, relevant, and many-valued logics) and to various applied theories of computational logic (such as temporal reasoning, spatial reasoning, fuzzy-set-based reasoning, rough-set-based reasoning, order-of magnitude reasoning, reasoning about programs, threshold logics, logics of conditional decisions). The distinguishing feature of most of these applications is that the corresponding dual tableaux are built in a (...) relational language which provides useful means of presentation of the theories. In this way modularity of dual tableaux is ensured. We do not need to develop and implement each dual tableau from scratch, we should only extend the relational core common to many theories with the rules specific for a particular theory. (shrink)

DESCARTES’S PASSIONS OF THE SOUL AND THE CONTEMPORARY DISPUTE ABOUT THE NATURE OF EMOTION In my article I discuss the connection between the Cartesian theory of passions of the soul and the contemporary dispute between the cognitive and non-cognitive theories of emotions. Defenders of the cognitive theory of emotions identify emotions with judgments. On the other hand, non-cognitivists claim that emotions are feelings caused by changes in physiological conditions relating to the autonomic and motor functions. Both cognitivists’ and non-cognitivists’ approaches (...) meet serious problems. In the paper, I want to show that the Cartesian theory of passions can be considered an anticipation of contemporary views and a compromise between the cognitive and non-cognitive theories of emotions. Introduction: A general trend in the psychological literature suggests that guilt contributes to morality more than shame does. Unlike shame-prone individuals, guilt-prone individuals internalize the causality of negative events, attribute responsibility in the first person, and engage in responsible behavior. However, it is not known how guilt- and shame-proneness interact with the attribution of responsibility to others. -/- Methods: In two Web-based experiments, participants reported their attributions of moral culpability (i.e., responsibility, causality, punishment and decision-making) about morally ambiguous acts of (...) killing in different conditions. In Study 1 the vignettes were presented in the 1st person, while in Study 2 in the 3rd person. To test proneness to guilt and shame, we utilized the GASP scale, which differentiates between the affective and behavioral components of each emotion. Statistical analyses were performed in Matlab and R. -/- Results: We found that guilt- and shame-proneness were associated with the severity of attributions in both the first and the third person, but the effect was strong only in the guilt case (both subtypes) and shame-affect case, and not in the shame-behavior case. We call this the Moralizing Effect. -/- Discussion: We wonder whether our finding that guilt-prone people tend to attribute a higher degree of culpability to others is really consistent with the view that guilt motivates people to choose the “moral paths in life”. This echoes views about the harmful aspects of guilt, which have been expressed historically in philosophy, for example, by Friedrich Nietzsche. (shrink)

The current study explores the effects of a brief training program on complex problem solving (CPS) and dynamic decision making (DDM) performance in two computer-simulated tasks with different task characteristics, ChocoFine (N = 76) and WinFire (N = 99). Half of the participants in each simulation group received a brief training on 16 frequent CPS and DDM errors. We hypothesized that participants who received the training in errors would show better performance, report fewer errors, and show fewer behavioral errors compared (...) to those who did not receive the error training prior to the start of the simulated tasks. The results showed that participants in both training groups had better performance scores. Participants in the training condition reported fewer self-reported errors compared to the no-training group only in the ChocoFine simulation. Regarding behavioral errors, status-quo bias was related to weaker performance in both simulations. These findings have implications for leaders who are prone for the status-quo bias and for organizations which could implement trainings programs for DDM and CPS. (shrink)

An organization emits carbon dioxide (CO2) and other greenhouse gases (GHGs) through its daily operations, such as the electricity used to power its offices, manufacture products, and then fossil fuels used in vehicles to distribute them. This is referred to as an organization’s carbon footprint, and there is increasing stakeholder and regulatory pressure on management teams globally to reduce them. On other words, it is increasingly critical that the quantity of carbon dioxide and other greenhouse gases that a company is (...) releasing into the atmosphere can be accurately measured in order to ensure that is being reduced accordingly. The European Union Emissions Trading System (EU ETS) is the most crucial tool for decarbonizing Europe, but it has also become a money-making machine. States and financial investors earn; for the power industry, which pays for it, the worst thing is not the system’s presence but its instability. Huge price jumps make it impossible to plan budgets and investments sensibly. This paper provides an introduction to the EU’s Emissions Trading System. As such it provides a discussion of the historical and legal context in which the EU ETS developed and now operates. This article covers the various ways in which these market dynamics, regulatory requirements and stakeholder expectations have converged to make European carbon markets a critical topic for today’s analyst. The review tries to summarize the main topics covered by the book "Między redukcją a emergencją" by Robert Poczobut and also to highlight certain points that might be controversial to the philosophically-oriented reader. In particular, Poczobut's methodological claims regarding the boundary between natural sciences and philosophy of mind are brought under scrutiny. While the book presents a broad range of views on matters regarding emergence and reduction, especially with respect to the psychophysical problem, it remains to be proven that the (...) views presented by the author are in reality the most viable option that a philosopher of mind wishing to conform to scientific results has at her disposal. The review discusses the book The Origin of Concepts by Susan Carey, in which she presents three main theses — the innateness of some kind of conceptual representations, the presence of a qualitative change during conceptual development and the existence of a special learning mechanism that achieves that discontinuity called bootstrapping. The general reception of the work is positive. Minor doubts are presented regarding two claims: first, the speculation about the iconic format of core cognition representations, which seems to be (...) underdeveloped and slightly unclear, second, the claim that core cognition representations are innate, which seems to be insufficiently supported by empirical data presented. This article concerns the implementation of new EU Directives coordinating the procedures for awarding public contracts in European Union Member States. In a number of countries, including Poland, the process of their implementation (Directive 2014/24/eu of the European Parliament and of the Council of 26 February 2014 on public procurement; Directive 2014/25/eu of the European Parliament and of the Council of 26 February 2014 on procurement by entities operating in the water, energy, transport, and postal services sectors; Directive 2014/23/eu of (...) the European Parliament and of the Council of 26 February 2014 on the award of concession contracts) was delayed. In most cases, the modernization of EU regulations on public procurement required a thorough modification of national regulations in this respect. As a result of the introduction of the package of new Directives, the European Union public procurement market has undergone substantial changes. The need to adjust legal regulations to the changing political, social, and economic situations in a better way has resulted in the transposition of the modernized EU Directives concerning public procurement to the Polish legal system, affecting the final shape of the new Polish Public Procurement Law. The implementation of the package of new Directives has significantly affected the functioning of the Polish public procurement market. For the entities operating in this market, this means the necessity to expand their knowledge, so as to become familiar with the new legal solutions in this respect. (shrink)

Each year thousands of individuals enrol in clinical trials as healthy volunteers to earn money. Some of them pursue research participation as a full-time or at least a part-time job. They call themselves professional or semiprofessional guinea pigs. The practice of paying healthy volunteers raises numerous ethical concerns. Different payment models have been discussed in literature. Dickert and Grady argue for a wage-payment model. This model gives research subjects a standardised hourly wage, and it is based on an assumption that (...) research participation is morally indistinguishable from other forms of unskilled labour. In this paper, I will challenge this assumption. I will argue that human guinea pigging has particular characteristics which taken together make it significantly different from other forms of labour. Participation in research is skill-independent. Healthy volunteers are valuable not because they are skilful persons, but because they are human bodies. The role of research volunteers is mainly passive. They are not asked to produce goods or deliver services. They are paid for enduring unpleasant, painful and risky interventions performed by investigators. Research volunteering involves inherent risks and uncertainties, and subjects have little or no control over their minimisation and materialisation. I conclude that participation in clinical research is a specific kind of activity. It is more like renting out one’s body to strangers, than working. Thus, research participation should not be treated on par with other forms of employment. (shrink)

Health research ethics training is highly variable, with some researchers receiving little to none, which is why ethical frameworks represent critical tools for ethical deliberation and guiding responsible practice. However, these documents' voluntary and abstract nature can leave health researchers seeking more operationalised guidance, such as in the form of checklists, even though this approach does not support reflection on the meaning of principles nor their implications. In search of more reflective and participatory practices in a pandemic context with distance (...) learning, this study explored whether co-design could support engagement and reflection on ethical principles amongst early-stage health researchers. In a pilot test using the Swiss Personalized Health Network's ethical framework for Responsible Usage of Personal Data in Health Research as a case study, we engaged health researchers to design visuals of four ethical principles. In two online workshops, participants (N = 10, N = 8) completed activities such as individual reflection, collaborative ideation, sketching, prototyping, discussion, and feedback. Our analysis shows that the co-design process helped foster in-depth engagement and reflection on the meaning and relevance of the SPHN ethical principles. Participants reported enjoying the experience, and most felt that visuals could motivate engagement with ethical frameworks. This study demonstrates the feasibility of a participatory, design-oriented approach to promote engagement with research ethics among early-career health researchers and highlights key challenges and lessons learned. In doing so, it lays the foundation for future research to investigate the impact of design-oriented, participatory learning to foster reflection and deliberation in ethics education. (shrink)

Reigning regulatory frameworks for biomedical research impose on researchers and research ethics committees an obligation to protect research participants from risks that are unnecessary, disproportionate to potential research benefits, and non-minimized. Where the research has no potential to produce results of direct benefit to the subjects and the subjects are unable to give consent, these requirements are strengthened by an additional condition, that risks should not exceed a certain minimal threshold. In this article, I address the question of whether there (...) should be limits of permissible risks in non-therapeutic research involving competent and healthy subjects. Some commentators argue that competent and informed individuals should have a right to participate even in extremely risky research and that research ethics committees should never reject studies because they are too dangerous. To use David Shaw's expression, competent volunteers should have ‘a right to participate in high-risk research’. I argue that this idea is ill-founded, as it does not take into account the social mission and complex collaborative nature of research practice as well as the inequity of power between researchers and subjects. Imposition of limits on permissible risks for healthy volunteers is justified by the need to protect research enterprise and the need to protect the weaker party, namely the subjects. Also, I suggest that the best way to set boundaries on research risks is to leave the judgment of risk acceptability to research ethics committees. (shrink)

Ses interrogations concernent l'homme, confronté à l'Histoire, en proie au doute sur le Moi aussi bien que sur les religions.

The first part of the paper characterises two new non-extensional functors: functor of counterfactual implication and functor of causal implication. The latter functor was used by Arthur W. Burks in his early considerations on the construction of a system of the logic of causal propositions, the formal inscription of conditional propositions in the colloquial language and the language of empirical sciences. The second part traces down the mutual relations between the functors of counterfactual implication, causal implication, material implication and strict (...) implication. Special attention is paid to the fact that causal implication implies material implication (a converse relationship does not occur), and strict implication implies causal implication (a converse relationship does not occur). A person who is liable to defensive harm has forfeited his rights against the imposition of the harm, and so is not wronged if that harm is imposed. A number of philosophers, most notably Jeff McMahan, argue for an instrumental account of liability, whereby a person is liable to defensive harm when he is either morally or culpably responsible for an unjust threat of harm to others, and when the imposition of defensive harm is necessary to avert the threatened unjust (...) harm. Others may favour a purely noninstrumental account of liability: one that looks only to the past behaviour of the potentially liable person. We argue that both views are vulnerable to serious objections. Instead we develop and defend a new view of liability to defensive harm: the pluralist account. The pluralist account states that liability to defensive harm has at least two bases. First, if an attacker is morally or culpably responsible for an unjust attack then he has forfeited what we call his agency right, and in doing so he has made himself partially liable to defensive harm. Whether the attacker is fully liable to defensive harm depends, however, on whether the imposition of defensive harm would infringe a different right held by the attacker: his humanitarian right. Humanitarian rights are rights to be provided with urgently needed resources or to be protected from serious harms when others can do so at reasonably low cost. We argue the pluralist account avoids the objections to which the instrumental and noninstrumental views are vulnerable, coheres with our intuitive reactions in a wide range of cases, and sheds new light on the way different rights combine to determine a person's liability to suffer harm. How leaders and managers respond to not knowing is highly relevant given the complex, ambiguous, and chaotic business environment of the twenty-first century. Drawing on the literature from a variety of disciplines, the paper explores the dominant, unfavorable conceptualization of not knowing. The authors present some potential ethical implications of a negative view of not knowing and suggest how organizations would benefit from identifying any unhelpful aspects of the culture that may encourage unethical, undesirable, and/or hasty actions in situations of (...) not knowing. The paper specifically illustrates how patience, courage, honesty, integrity, and humility are integral to negative capability in the contexts of not knowing. Finally, the paper calls for deeper inquiry into the role of virtue ethics in preparing managers and leaders for not knowing and urges organizations to embrace negative capability in not knowing rather than engaging in damaging delusion. Rather than focus on effects, the isolatable and measureable outcomes of events and interventions, the papers assembled here offer different perspectives on the affective dimension of the meaning and politics of human/non-human relations. The authors begin by drawing attention to the constructed discontinuity between humans and non-humans, and to the kinds of knowledge and socialities that this discontinuity sustains, including those underpinned by nature-culture, subject-object, body-mind, individual-society polarities. The articles presented track human/non-human relations through different domains, including: humans/non-humans in history (...) and animal welfare science (Fudge and Buller); the relationship between the way we live, the effects on our natural environment and contested knowledges about ‘nature’ (Whatmore); choreographies of everyday life and everyday science practices with non-human animals such as horses, meerkats, mice, and wolves (Latimer, Candea, Davies, Despret). Each paper also goes on to offer different perspectives on the human/non-human not just as division, or even as an asymmetrical relation, but as relations that are mutually affective, however invisible and inexpressible in the domain of science. Thus the collection contributes to new epistemologies/ontologies that undercut the usual ordering of relations and their dichotomies, particularly in that dominant domain of contemporary culture that we call science. Indeed, in their impetus to capture ‘affect’, the collection goes beyond the usual turn towards a more inclusive ontology, and contributes to the radical shift in the epistemology and philosophy of science’s terms of engagement. Who was truly capable of experiencing pain? In this article, I explore ideas about the distribution of bodily sensitivity in patients from the early nineteenth century to 1965 in Anglo-American societies. While certain patients were regarded as “truly hurting,” other patients’ distress could be disparaged or not even registered as being “real pain.” Such judgments had major effects on regimes of pain-alleviation. Indeed, it took until the late twentieth century for the routine underestimation of the sufferings of certain groups of (...) people to be deemed scandalous. Often the categorizations were contradictory. For instance, the humble status of workers and immigrants meant that they were said to be insensitive to noxious stimuli; the profound inferiority of these same patients meant that they were especially likely to respond with “exaggerated” sensitivity. How did physicians hold such positions simultaneously? Pain-assignation claimed to be based on natural hierarchical schemas, but the great Chain of Feeling was more fluid than it seemed. (shrink)

The question of whether AI systems such as robots can or should be afforded moral agency or patiency is not one amenable either to discovery or simple reasoning, because we as societies constantly reconstruct our artefacts, including our ethical systems. Consequently, the place of AI systems in society is a matter of normative, not descriptive ethics. Here I start from a functionalist assumption, that ethics is the set of behaviour that maintains a society. This assumption allows me to exploit the (...) theoretical biology of sociality and autonomy to explain our moral intuitions. From this grounding I extend to consider possible ethics for maintaining either human- or of artefact-centred societies. I conclude that while constructing AI systems as either moral agents or patients is possible, neither is desirable. In particular, I argue that we are unlikely to construct a coherent ethics in which it it is ethical to afford AI moral subjectivity. We are therefore obliged not to build AI we are obliged to. Conferring legal personhood on purely synthetic entities is a very real legal possibility, one under consideration presently by the European Union. We show here that such legislative action would be morally unnecessary and legally troublesome. While AI legal personhood may have some emotional or economic appeal, so do many superficially desirable hazards against which the law protects us. We review the utility and history of legal fictions of personhood, discussing salient precedents where such fictions resulted in abuse or incoherence. We (...) conclude that difficulties in holding “electronic persons” accountable when they violate the rights of others outweigh the highly precarious moral interests that AI legal personhood might protect. Social learning is a source of behaviour for many species, but few use it as extensively as they seemingly could. In this article, I attempt to clarify our understanding of why this might be. I discuss the potential computational properties of social learning, then examine the phenomenon in nature through creating a taxonomy of the representations that might underly it. This is achieved by first producing a simplified taxonomy of the established forms of social learning, then describing the primitive capacities (...) necessary to support them, and finally considering which of these capacities we actually have evidence for. I then discuss theoretical limits on cultural evolution, which include having sufficient information transmitted to support robust representations capable of supporting variation for evolution, and the need for limiting the extent of social conformity to avoid ecological fragility. Finally, I show how these arguments can inform several key scientific questions, including the uniqueness of human culture, the long lifespans of cultural species, and the propensity of animals to seemingly have knowledge about a phenomenon well before they will act upon it. In this paper the author challenges the prevailing view that contemporary writing in the medical humanities is serving the needs of the various health care disciplines. The current medical humanities literature assumes that physicians are the appropriate target group. This is most notably the case within health care ethics literature. There appears to be an unexamined assumption that physician-centric approaches to clinical ethical decision-making are the standard by which appropriate ethical practice is judged. The author challenges this assumption and addresses (...) the problems that this approach engenders. The medical humanities literature appears to reinforce hierarchical, patriarchal arrangements which are themselves not morally neutral. (shrink)

Joanna Demers argues that Houellebecqs apocalypse can be understood as a system analogous to Hegels, and interrogates the ethics of such a system.

This discussion consists of five sections, beginning with a pair of citations marking up a politics of inclusion, and exclusion in philosophical discussion. The second section, focusing on the first part of this essay’s title, ‘Phenomenological futures in dispute’, locates three inflections of the notion of the future, in the context of an encounter between phenomenology and Marxism. The third section proposes two rewritings of the subtitle, in terms of thematics, as opposed to using proper names as indices for theoretical (...) orientations. The first rewriting retrieves Heidegger’s notions of tradition, as both transmission and inheritance. This opens up a givenness of a futural horizon to alternating versions of futures; the second rewriting then offers modes of evaluating these alternating futures, in a contestation between a patriarchal, a differentiated, and a neutral mode of transmission. A fourth section raises some further questions of methodology, indicating the manner in which a rethinking of religion and of theology returns within phenomenology. In an inconclusive summary, the paper returns to the point of departure, the first version of a relation of non-relation, in a disputed connection to be set out between philosophy, a politics of exclusion, and psychoanalytical accounts of political investment. The paper seeks to locate a relation of non-relation, both in the failed encounters between Jacques Derrida and Jean-Luc Nancy, with respect to phenomenology and its futures, and in the re-emergence, as non-relation, of the formative function within phenomenology of religious precursors, preconditions and commitments.
