This paper sketches a theory of the reason‐giving force of well‐being that allows us to reconcile our intuitions about two of the most recalcitrant problem cases in population ethics: Jan Narveson's Procreation Asymmetry and Derek Parfit's Non‐Identity Problem. I show that what has prevented philosophers from developing a theory that gives a satisfactory account of both these problems is their tacit commitment to a teleological conception of well‐being, as something to be ‘promoted’. Replacing this picture with one according to which (...) our reasons to confer well‐being on people are conditional on their existence allows me to do better. It also enables us to understand some of the deep structural parallels between seemingly disparate normative phenomena such as procreating and promising. The resulting theory charts a middle way between the familiar dichotomy of narrow person‐affecting theories and totalist or wide‐person affecting theories in population ethics. (shrink)

What moral reasons, if any, do we have to ensure the long-term survival of humanity? This article contrastively explores two answers to this question: according to the first, we should ensure the survival of humanity because we have reason to maximize the number of happy lives that are ever lived, all else equal. According to the second, seeking to sustain humanity into the future is the appropriate response to the final value of humanity itself. Along the way, the article discusses (...) various issues in population axiology, particularly the so-called Intuition of Neutrality and John Broome’s ‘greediness objection’ to this intuition. Human oversight has become a key mechanism for the governance of artificial intelligence (“AI”). Human overseers are supposed to increase the accuracy and safety of AI systems, uphold human values, and build trust in the technology. Empirical research suggests, however, that humans are not reliable in fulfilling their oversight tasks. They may be lacking in competence or be harmfully incentivised. This creates a challenge for human oversight to be effective. In addressing this challenge, this article aims to make three contributions. (...) First, it surveys the emerging laws of oversight, most importantly the European Union’s Artificial Intelligence Act (“AIA”). It will be shown that while the AIA is concerned with the competence of human overseers, it does not provide much guidance on how to achieve effective oversight and leaves oversight obligations for AI developers underdefined. Second, this article presents a novel taxonomy of human oversight roles, differentiated along whether human intervention is constitutive to, or corrective of a decision made or supported by an AI. The taxonomy allows to propose suggestions for improving effectiveness tailored to the type of oversight in question. Third, drawing on scholarship within democratic theory, this article formulates six normative principles which institutionalise distrust in human oversight of AI. The institutionalisation of distrust has historically been practised in democratic governance. Applied for the first time to AI governance, the principles anticipate the fallibility of human overseers and seek to mitigate them at the level of institutional design. They aim to directly increase the trustworthiness of human oversight and to indirectly inspire well-placed trust in AI governance. (shrink)

The world is undeniably full of injustice. Many feel that much political philosophy is practically impotent and engaged instead in overly abstract theorising insufficiently sensitive to the realities of the world. One response to this concern is David Miller’s influential model of evidence-based political philosophy, which claims to be sensitive to empirical evidence from the social sciences, takes seriously people’s opinions, and defends the role of facts in grounding normative principles. Using various examples from the field of global justice, one (...) of Miller’s key areas of work, I show that Miller’s method is unconvincing on two levels. His theoretical argument for fact-dependence is flawed, and his practical argument for an opinion-sensitive political theory is either guilty of status quo bias or, in an attempt to escape it, becomes self-defeating. While the paper is primarily critical, I endeavour also to draw out the implications of my critiques for the role of the ‘real world’ in theorising. (shrink)

The foundational conviction of contemporary liberal thought is that all persons possess equal moral worth and are entitled to equal concern and respect by others. At the same time, nation states, as the primary organs of our collective self-governance, frequently pursue policies that are strikingly partial towards the interests of compatriots over those of foreigners. A common strategy for justifying this national partiality is to view it as grounded in associative obligations that we incur by standing in special relationships with (...) our fellow citizens. For instance, according to familiar arguments from ‘fair play’, voluntarily partaking in and benefiting from cooperative relationships with our fellow citizens gives us reciprocal obligations to maintain these social institutions and care for needy compatriots. By contrast, we do not have corresponding associative obligations towards foreigners. I maintain that such arguments from associative obligations face an important stumbling block. I argue for the following “Boundary Principle”, according to which we cannot appeal to special relationships amongst members of a group to justify an attitude of partiality towards them unless the boundaries of this group, and the fact that they exclude other persons from membership, can also be justified. If this is right, arguments from associative obligations, by themselves, are necessarily incomplete. Most modern states severely limit the scope of economic migration, and thereby prevent many would-be contributors to the collective enterprises of affluent societies from entering into those special relationships with us that would give rise to associative obligations on our part. Not only are would-be immigrants excluded from the benefits that participation in the cooperative schemes of affluent nation-states would itself confer; in addition, the fact that they do not stand in such cooperative relationships with us is then appealed to in order to justify the fact that we assign significantly less weight to their interests in the formulation of state policy. The upshot of my discussion is not that a defense of national partiality in terms of associative obligations cannot succeed. It is rather that a successful defense of national partiality in these terms is more closely tied to the question whether principled restrictions can be placed on immigration than most political philosophers have hitherto assumed. Im "System der Sittenlehre" fand Fichtes praktische Philosophie im direkten Anschluß an die Wissenschaftslehre von 1794 ihre vollendete Gestalt. Fichtes theoretischer Ansatz bietet den bis heute einzigen methodisch konsistenten Versuch einer Letztbegründung des Sollens als Beweis der sittlichen Freiheit des Einzelnen.

Die erst im Juli 1980 gefundene, bis dahin gänzlich unbekannte Kolleghandschrift von Krause aus dem Wintersemester 1798/99 erweitert den Wissensstand um die Entwicklung der Philosophie Fichtes zwischen den Jahren 1795 und 1800 in einem erheblichen Maße und markiert eine Zäsur: Fichte scheidet die Philosophie nicht mehr in Theorie und Praxis, sondern faßt sie als eine, als Philosophie überhaupt.

Unter den Versuchen Fichtes, sein Denken allgemeinverständlich darzustellen, zählt diese 1800 erschienene Schrift zu den inhaltlich abgerundetsten und aufschlußreichsten; bei den Zeitgenossen stieß sie jedoch auf vehemente Kritik, Hegel sah in ihr gar einen besonders illustrativen Text für den Aufweis der Haltlosigkeit der von Fichte in der Wissenschaftslehre vertretenen Position einer auf das Ich als Tathandlung gegründeten Philosophie. Darum vermag allein schon die Lektüre von Fichtes Bestimmung des Menschen und ihrer kritischen Rezeption in Hegels Glauben und Wissen einen Einblick in (...) die Gründe zu vermitteln, warum bis ins 20. Jahrhundert die Philosophie Fichtes weitgehend als ein merkwürdiger Mosaikstein auf dem Wege "Von Kant bis Hegel" oder, im Hinblick auf den "Endpunkt" dieses Wegs wohl genauer, in der "Entwicklung des Spinozismus" betrachtet wurde. Deutlich wird einer neuen Lektüre aber auch, wieviel noch zu tun bleibt, um die wichtigen Erkenntnisse, die im Deutschen Idealismus auf so getrennten Bahnen gewonnen wurden, im Blick auf die gemeinsamen Grundprobleme einer "Ersten Philosophie" ohne Rückfall in die traditionellen Feindbilder wahrzunehmen und kritisch in die pluralistische Diskussion heutigen Philosophierens einzubringen. The objective of this article is to present an overview, based on the most recent specialist research, of Neoplatonist developments in the Cologne tradition of the later Middle Ages, with specific reference to a unique Proclian commentary presented by the German Albertist Dominican, Berthold of Moosburg (ca. 1300–1361). Situating Berthold in the post-Eckhart Dominican crisis of the 1340s and 1350s, his rehabilitating initiative of presenting this extensive (nine-volume) commentary on the Neoplatonist Proclus Lycaeus’ (412–485) Elements of Theology in his Expositio (...) super Elementationem theologicam Procli, the only of its kind from the Middle Ages, is contextualised with reference to Berthold’s discursive indebtedness to his Dominican predecessors, Albert the Great (ca. 1200–1280), Ulrich of Strasbourg (ca. 1220–1277) and Dietrich of Freiberg (ca.1250 – ca.1310), as well as two Dutch-Cologne successors, the Albertist Heymeric of Camp (1395–1460) and the Carthusian Thomist Denys de Leeuwis (1402–1471). Berthold’s unique contribution to the philosophical discourse of the Middle Ages is indicated therein that the Expositio provided a synthesis of the late Medieval version of Neoplatonism and contemporaneous German–Dominican theories. By contextualising the work of his Cologne predecessors and successors in the broad idea-historical landscape of antiquity and Neoplatonism, the article argues that Berthold succeeded in linking the Neoplatonic legacy with Cologne Albertism and provided an impetus for the overall consolidating ability of the Cologne tradition. By juxtaposing Berthold and his Expositio with the more conventional legacies of Ulrich, Dietrich, Heymeric and Denys, this exceptional Latin-Western intellectual tradition from Cologne is expanded and enriched with regard to its notable Neoplatonic contributions to philosophy in the later Middle Ages. This article responds to a critical research challenge in Medieval philosophy scholarship regarding the internal periodisation of the register. By arguing the case for ‘post-scholasticism’ as an internal period indicator (1349–1464, the era between the deaths of William of Ockham and Nicholas of Cusa), defined as ‘the transformation of high scholasticism on the basis of a selective departure thereof’, the article specifies a predisposition in the majority of introductions to and commentaries in Medieval philosophy to proceed straight from 1349 to (...) 1464, understating 115 years of pertinent Medieval philosophical discourse. It is argued that in the modern account of Medieval philosophy, this understatement is manifested in either a predating of Renaissance philosophy to close the gap between 1349 and 1464 as far as possible or in proceeding straight from 1349 to Renaissance philosophy. The article presents five unique philosophical themes from this delicate period, indicating that ‘post-scholasticism’ was indeed a productive period in late Medieval philosophy, which should not be bypassed as an inconsequential entrance to Renaissance philosophy. The period 1349–1464 should accordingly be appreciated for its idiosyncratic contributions to the history of ideas in the late-14th and early-15th centuries, with reference to the political intensification of the via moderna, the pivotal separation of philosophy and theology and the resulting independence of the natural sciences, in res critique of institutions, transforming pragmatics and the rise of philosophical materialism. Contribution: This article contributes to methodological development in Medieval philosophy by responding to a critical research challenge regarding the internal periodisation of the later Middle Ages. Arguing the case for ‘post-scholasticism’ as an internal period indicator (1349 to 1464 in Medieval philosophy, the article presents unique philosophical themes from the period, indicating that it was a productive stage in late Medieval philosophy which should not be bypassed as an inconsequential entrance to Renaissance philosophy. Transgender people have among the highest rates of suicide attempts of any group in society, driven strongly by the perception that they do not belong in the sex of their physical body. Gender reassignment surgery is a procedure that can change the transgender person’s physical body to accord with their gender identity. The procedure raises important ethical and distributive justice concerns, given the controversy of whether it is a cosmetic or medical procedure and the economic costs associated with performing the (...) procedure. This paper argues that there is a strong case for funding GRS as a matter of clinical necessity and justice. This paper will be divided in four key sections: First, the state of transgender health will be outlined, including the role of GRS and common objections to it. Second, a number of common objections to GRS will be analysed at the outset and shown to be unconvincing. Third, a constructive argument will be advanced, arguing that publicly funded GRS is clinically necessary, cost-effective, and demanded by principles of justice. Fourth, the paper will briefly discuss moralistic biases and why we demand a higher burden of justification for funding GRS compared with other analogous procedures. (shrink)

Both, bioconservatives and bioliberals, should seek a discussion about ideas of human perfection, making explicit their underlying assumptions about what makes for a good human life. This is relevant, because these basic, and often implicit ideas, inform and influence judgements and choices about human enhancement interventions. Both neglect, and polemical but inconsistent use of the complex ideas of perfection are leading to confusion within the ethical debate about human enhancement interventions, that can be avoided by tackling the notion of perfection (...) directly. In the recent debates, bioconservatives have prominently argued against the ‘pursuit of perfection’ by biotechnological means. In the first part of this paper, we show that—paradoxically—bioconservatives themselves explicitly embrace specific conceptions of human perfection and perfectionist assumptions about the good human life in order to argue against the use of enhancement technologies. Yet, we argue that the bioconservative position contains an untenable ambiguity between criticising and endorsing ideas of human perfection. Hence, they stand in need of clarifying their stance on human perfection. In the second part of the paper, we ask whether bioliberals in fact (implicitly) advocate a particular conception of perfection, or whether they are right in holding that they do not, and that discussing perfection is obsolete anyway. We show that bioliberals also rely on a specific idea of human perfection, based on the idea of autonomy. Hence, their denial of the relevance of perfection in the debate is unconvincing and has to be revised. (shrink)

The recognition of capitalism as a core component of modernity has often led to conflation of the two categories; this happens to critics as well as defenders of capitalism, and it reflects their shared but only partly acknowledged premises. A tendency to interpret capitalism as a self-contained system has strongly affected the debate on its historical significance; this reductionistic approach could be adapted to different ideological stances as well as to changing views of capitalism's long-term trajectory. The notion of a (...) `spirit of capitalism', in the sense of cultural sources essential to the constitution (and arguably also to the continuity) of the capitalist order, has been one of the most important correctives to economic determinism and reductionism, but it has proved difficult to link this dimension to other aspects of the problematic. The article surveys the contributions of Weber, Sombart, Castoriadis and - most recently - Luc Boltanski and Eve Chiapello to this debate. The last section then discusses the work of Fernand Braudel and suggests that it could serve to reformulate the problematic of capitalism in more multidimensional terms. (shrink)

This article, by analysing, annotating en interpreting the most recent research in all relevant departments, provides a fresh and updated overview of the Neoplatonic metaphysics of Pseudo-Dionysius (ca. 500). After providing an introduction to Dionysius’ metaphysics in terms of the contributions of Middle Platonism and Neoplatonism, the article explores his broader philosophical system. A number of traits that are uniquely Dionysic-metaphysical, are eventually isolated: the interpretation of transcendence as bound to immanence; the affirmation of God’s transcendence in the world (that (...) is, a metaphysics of ‘creation as teophany’; following E.D. Perl); the radical transcendence and simultaneous radical immanence of God (that is, God as ‘Beingness’); fundamental restrictions of language and the analogical ‘Naming’ of God; creation as a system of dialectical symbols about God; the analogical participation of the subject in creation; and unification (reditus, the ‘flowing of things back to God’). These traits are utilised to reappraise the metaphysics of Nicholas of Cusa (1401–1464) in a subsequent article. (shrink)

Luck egalitarianism has come under a lot of criticism for its apparent harshness towards negligent victims of voluntary actions (the harshness objection) and its inability to respond to morally-acceptable voluntary acts that lead to disadvantage (the discrimination objection). This paper surveys a series of responses in the luck egalitarian literature, showing that for the most part each one is unable to respond, on its own, to the crux of the objections. These responses often face a dilemma: Either they must bite (...) the bullet on the objections to retain their luck egalitarian commitments, or they must propose a reply to the objection that diverges from their core luck egalitarian principles. In this paper, I advance a preliminary framework for grounding luck egalitarian theories of justice based upon a two-level model and what I shall call the Fact of Inherent Normativity. Two-level luck egalitarianism makes fundamental rights and basic needs de facto insensitive to responsibility at the first level, while retaining the scope for responsibility for the distribution of second-level goods. The account remains distinctly luck egalitarian, while leaving scope for the consideration of rights, respect, and a host of other morally relevant considerations within the luck egalitarian framework. Luck egalitarianism, properly understood as a two-level theory, can successfully respond to objections against its harshness and propensity to discriminate. (shrink)

There are eleven known manuscripts of Hobbes’s Elements of Law. As they divide on textual grounds into two groups, they are effectively two separate editions, employing two different texts. While two of the manuscripts apparently were Hobbes’s working copies, it also seems clear that he never definitively established the text of the Elements. There are reasons for thinking it unlikely that, as has been suggested, Hobbes intended the work to influence debate in the Short Parliament. More likely, he hoped his (...) patron, Newcastle, would transmit his principles to the monarch and his chief advisors. (shrink)
