Although the notion of physician value neutrality in medicine may be traced back to the writings of Sir William Osler, it is relatively new to medicine and medical ethics. We argue in this paper that how physician value neutrality has been cashed out is often obscure and its defense not persuasive. In addition, we argue that the social/political implementation of neutrality, Political Liberalism, fails, and thus, PVN's case is weakened, for PVN's justification relies largely on the reasoning undergirding PL. For (...) these reasons, we conclude that PVN has no philosophical or ethical warrant and thus should be abandoned. We suggest that the physician present to her patients some type of statement or creed that would give them an idea of where she stands on important axiological issues and how these stands are cashed out clinically. This article critically assesses an account of religious liberty often associated with several legal and political philosophers: Ronald Dworkin, John Rawls, and Christopher Eisgruber and Lawrence Sager. Calling it the Religion as Comprehensive Doctrine approach (RCD), the author contrasts it with an account often attributed to John Locke and the American Founders Thomas Jefferson and James Madison, the Two Sovereigns approach (TS). He argues that the latter provides an important corrective to RCD’s chief weakness: RCD eliminates (or greatly (...) diminishes) from our vision those aspects of religious belief and practice that most conventional religious believers would consider essential to their faith. Supporters of Justificatory Liberalism (JL)—such as John Rawls and Gerard Gaus—typically maintain that the state may not coerce its citizens on matters of constitutional essentials unless it can provide public justification that the coerced citizens would be irrational in rejecting. The state, in other words, may not coerce citizens whose rejection of the coercion is based on their reasonable comprehensive doctrines (i.e., worldviews). Proponents of the legal recognition of same-sex marriage (SSM) usually offer some version of JL as the (...) most fundmental reason why laws that recognize marriage only if it is a union between one man and one woman are unjust. In this article I argue that the application of JL in support of legal recognition of SSM does not succeed because the issue under scrutiny—the nature of marriage—is deeply embedded in, and in most cases integral to, many (if not most) citizens’ reasonable comprehensive doctrines. Thus, I argue that because of the effects and consequences of the legal recognition of SSM, it results (or will result) in a violation of JL against dissenting citizens. (shrink)

Kennedy offers an account of the desacralization of politics in the West by critically examining the works of five central figures in the (...) Protestant Reformed tradition: John Calvin (1509–64), Richard Hooker (1554–1600), Johannes Althusius (1557–1638), Thomas Hobbes (1588–1679), and John Locke (1632–1705). He dedicates a chapter to each thinker. The core of Kennedy's thesis is that desacralization is the result of a shift in the way modern thinkers like Hobbes and Locke reimagined the nature of natural law. The medieval tradition, having found its fullest expression in the work of St. Thomas Aquinas, saw natural law as one of four different types of law: eternal law (the eternal plan of creation in the mind of God), natural law (the rational creature's participation in the eternal law), human law (civil laws that are derived from the natural law), and divine law (the Old and New Testaments). According to Kennedy, the eventual desacralization of politics was set in motion with the development of arguments for natural rights that relied on a natural law that was in [End Page 553] practice severed from eternal law. But in that case, our political institutions—which are founded on the natural law—are purely human constructions and thus entirely secular.The usual story is that the Protestant Reformation constituted the decisive break with the medieval tradition and that it was the political theology of the reformers and their immediate successors that made the secularization of politics nearly inevitable. Kennedy wants to push back against that story. He argues, quite convincingly, that Calvin, Hooker, and Althusius, all Reformed Protestants, were in continuity with their medieval predecessors. Although Calvin is often depicted by his contemporary followers—especially among American Evangelicals—as hostile to the natural law tradition, Kennedy marshals an impressive case that shows that classical natural law seemed almost second nature to Calvin. My own sense is that the confusion over Calvin is the result of his contemporary readers expecting him to use the vocabulary of an Aquinas or a Duns Scotus. But not finding that vocabulary, they conclude that he rejected the natural law. Kennedy dispels that confusion by showing that Calvin in fact was fully committed to the four types of law absent the technical jargon of medieval scholasticism.Hooker and Althusius, writes Kennedy, continue in that tradition, though with a bit of a twist that some argue portends to Hobbes and Locke. Hooker and Althusius use the language of contract to account for the origin of certain aspects of political life. But Kennedy insists that it is a mistake to interpret them as proto-contractarians (as one finds in Hobbes and Locke), for they still held that the natural law participates in the eternal law, and that any agreements employed in the service of political life are under the authority of, and guided by, the natural law. One could argue, then, that these "contracts," like constitutions and treaties, are nonstatutory manifestations of the human law, which is perfectly consistent with classical natural law. So like Calvin before them, Hooker and Althusius were, as Kennedy puts it, theistic political naturalists.Hobbes and Locke are a different story. According to Kennedy, they both defended desacralized views of politics, with Hobbes being the more extreme of the two. Novak himself. The topics themselves concern whether Jews and Christians worship the same God, suicide, natural law, Pope Pius IX, justice, the sanctity of human life, and supersessionism. Its contributors include senior scholars as well as those at the beginning of their careers. Each essay, arising from some aspect of Novak's vast corpus, is replied to by Novak himself. These replies are instructive, for they show a great teacher at work, responding with nuance and charity to criticisms and always moving the conversation forward in illuminative ways.Levering opens the volume with a contribution about Novak as a master of Jewish–Christian dialogue, indeed, "the greatest master of Jewish–Christian dialogue who has ever lived" (1). In time I was to find that Dawson's interpretation of cultural history made it possible to do this within the enlightening framework he provided.

Hill, John In a previous article, I broached the subject of priesthood as style, along the lines taken by Christoph Theobald and other contemporary French theologians.1 In that article I argued for a priestly style that fitted in with Theobald's vision of the Christian life as apprenticeship to Christ's own style of hospitable and eschatological messianism, and that also addressed current charges of clericalism and infantilism. Americans are greatly concerned about the number of our troops killed in battle--100,000 dead in World War I; 300,000 in World War II; 33,000 in the Korean War; 58,000 in Vietnam; 4,500 in Iraq; over 1,000 in Afghanistan--and rightly so. But why are we so indifferent, often oblivious, to the far greater number of casualties suffered by those we fight and those we fight for? This is the compelling, largely unasked question John Tirman answers in The Deaths of Others. (...) Between six and seven million people died in Korea, Vietnam, and Iraq alone, the majority of them civilians. And yet Americans devote little attention to these deaths. Other countries, however, do pay attention, and Tirman argues that if we want to understand why there is so much anti-Americanism around the world, the first place to look is how we conduct war. We understandably strive to protect our own troops, but our rules of engagement with the enemy are another matter. From atomic weapons and carpet bombing in World War II to napalm and daisy cutters in Vietnam and beyond, we have used our weapons intentionally to kill large numbers of civilians and terrorize our adversaries into surrender. Americans, however, are mostly ignorant of these facts, believing that American wars are essentially just, necessary, and "good." Tirman investigates the history of casualties caused by American forces in order to explain why America remains so unpopular and why US armed forces operate the way they do. CROSBY, III Franciscan University of Steubenville Steubenville, Ohio I PROPOSE TO explore the idea that persons do not exist as replaceable specimens of or as mere instances of an ideal or type, but rather exist in some sense for their own sakes, each existing as incommunicably his or her own.1 I undertake this study in the conviction that the incommunicability of (...) persons is profoundly characteristic for them precisely as persons, and has a major role to play in any philosophy of the person. And there is an entirely different reason which attracts me to this subject. I think that most of what I have to say here can find acceptance across a broad spectrum of philosophical positions. At a time when thinkers are increasingly suspicious of universally valid truth about man, when many of them think that a vision of man is proper only to some tradition and valid only within that tradition and not beyond it, one can offer a salutary challenge to one's contemporaries by showing a centrally important truth about persons which, as I say, can be accepted by philosophers coming from the most various points of view. Suppose that you were to minimalize the death of someone by saying that at least the human species did not die with him or her, as if the immortality of the species more than compensated for the mortality of this individual : everyone understands that you would thereby radically depersonalize the deceased. Again, everyone understands that if you treat people having excellences as if they were replaceable specimens of those excellences, then you lose your grip on them as persons. But why is this? Why is personhood driven out of human beings as soon as their species-membership, or their particular excellences, are thought to predominate in them? What is that incommunicability of each person which is obscured as soon as persons are thought to be only specimens? One commonly thinks that this aspect of personal selfhood has been recognized only in modern thought; in fact it was recognized already by St. Thomas Aquinas. John Turri gives an example that he thinks refutes what he takes to be “G. E. Moore's view” that omissive assertions such as “It is raining but I do not believe that it is raining” are “inherently ‘absurd'”. This is that of Ellie, an eliminativist who makes such assertions. Turri thinks that these are perfectly reasonable and not even absurd. Nor does she seem irrational if the sincerity of her assertion requires her to believe its content. A commissive counterpart (...) of Ellie is Di, a dialetheist who asserts or believes that The Russell set includes itself but I believe that it is not the case that the Russell set includes itself. Since any adequate explanation of Moore's paradox must handle commissive assertions and beliefs as well as omissive ones, it must deal with Di as well as engage Ellie. I give such an explanation. I argue that neither Ellie's assertion nor her belief is irrational yet both are absurd. Likewise neither Di's assertion nor her belief is irrational yet in contrast neither is absurd. I conclude that not all Moore-paradoxical assertions or beliefs are irrational and that the syntax of Moore's examples is not sufficient for the absurdity found in them. (shrink)

In this essay, I examine selected narratives in the Rājataraṅgiṇī that invoke a specific practice of suicide by starvation, what is referred to as prāya, prāyopaveśa, and/or prāyopaveśana. Commonly attested in the legal literature as well as in the epics, prāya is normally deployed there to redress financial grievances, to force debtors to pay their due. The use of the practice in the Rājataraṅgiṇī is often quite different from this, however: Kalhaṇa suggests that Brahmins, and others, engaged in the fast-unto-death (...) not only to redress their own grievances, but also the grievances of others. In particular, Kalhaṇa presents prāya as a tool used to compel Kashmiri kings to conform to the dharmaśāstric strictures of good government, to promote policies favoring not only Brahmins but also other, non-Brahmin subjects. The existence of such a form of the fast-unto-death is significant, for it signals a potentially unselfish use of caste, however imperfectly and corruptly the Rājataraṅgiṇī shows it to have been applied: by threatening their own deaths and promising thereby the karmic and social consequences of brahminicide, Brahmins sought to compel those sovereigns who pursued their own narrow interests to better serve the common good. That this is so raises a trio of vital concerns regarding the nature of the fast and its modern legacies, and the nature of royal succession, on the one hand, and on the other, the proper role of social and political elites in premodern South Asia. This paper evaluates the recent trend to renounce the similarity approach to counterfactuals in favor of the older metalinguistic theory. I try to show, first, that the metalinguistic theory cannot work in anything like its present form (the form described by many in the last decade who claim to be able to solve Goodman''s old problem of cotenability). This is so, I argue, because the metalinguistic theory requires laws of nature of a sort that we (apparently) do not have: current (...) physical theory cannot underwrite the metalinguistic theory. Second, I draw from the first point a motivation for the similarity approach, a motivation based on theoretical considerations apart from the standard ones of pretheoretical intuition. (shrink)
