This is Thomas Aquinas's position in the seminal article on the natural law, Summa theologiae I-II, question 94, article (...) 2, where, citing Aristotle, he formulates the principle as, "One should not simultaneously affirm and negate." Lafter in the same article, Thomas offers a practical formulation of the same principle, "Good is to be done and pursued and evil avoided"; but in law, since it is contained in propositions (airmations and negations) as distinct from ideas regarding the pursuit of goods, the prior formulation is the more immediately relevant of the two.The book under review is important in that, by going through the legal history regarding abortion and related issues in a number of different countries—the United States, Canada, Italy, Spain, Poland, Ireland (Eire), Costa Rica, Argentina, Chile, Mexico, and Peru—it causes to emerge any number of times the realization that legislation and judicial decisions in favor of abortion "rights" invariably infect a legal system with contradictions and inconsistencies of various sorts. The present essay is, therefore, not your typical book review. Its objective is simply to list some of the legal contradictions and inconsistencies identified by the book's various authors as they describe the legal status of the unborn in their respective nations. [End Page 1323]William Saunders's very clear and comprehensive first chapter is entitled, "Judicial Interference in the Protection of Human Life in the United States: Actions and Consequences." In it, he describes, among other things, the Human Cloning Prohibition Act passed by the U.S. House of Representatives in 2003, which prohibited "any person or entity, public or private" from performing human cloning (23). He speaks also of a bill proposed in the U.S. Senate once the Human Cloning Prohibition Act had passed in the House of Representatives. This Senate bill (which was entitle, "The Human Cloning Ban and Stem Cell Research Protection Act") would have prohibited "any person or other legal entity" from conducting human cloning, even while allowing nuclear transplantation, which it defines as "transferring the nucleus of a human somatic cell into an oocyte from which the nucleus... ha[s] been... removed or rendered inert." The problem here, as Saunders explains, is that this latter definition "is the very definition of cloning" (25). In other words, in the same year, two pieces of legislation were considered in the Congress of the United States, both purporting to ban human cloning, one of which would have permitted what the other described (correctly) as human cloning and so prohibited.In the second chapter, "Whither United States Abortion Law?" by Gerard V. Bradley, discussed, among other things, is the inconsistency between the United States Supreme Court's pro-abortion decision Roe v. Wade and various laws, both state and federal, prohibiting feticide. Bradley says of the 2004 federal Unborn Victims of Violence Act that, "in pertinent part it says that 'whoever' 'causes the death of or bodily injury to,' a 'child who is in utero' is guilty of an offense apart from any accompanying offense against the woman carrying the child." The penalty for such an act is the same as would be imposed if the act were inflicted upon the unborn child's mother: if, for instance, the mother was killed. "A child in utero," reports Bradley, "is defined as a member of the species homo sapiens, at any stage of development, who is carried in the womb'" (37).The problem here is that prosecutable under this law are acts identical with those performed legally by abortionists. Bradley mentions two cases in which a woman's male partner—in one case the woman's husband—effected by stealth the abortion of her child. This authority is given to he Pope and to the Bishops in union with him. It is their duty to hand on the Christian message and keep it intact. The duty of the rest of the faithful is to follow this teaching. The Latin term used to express (...) this following is obsequium religiosum.1 This is not an easy term to translate into English but in general it has been taken to mean religious assent. The use of the word assent implies that it is the human intellect that is engaged. Following Church teaching is not just a matter of obedience to a superior or observance of law, that is, of acting in a manner in accord with some precept or legislation. Obedience and observance are basically a matter of the will and external execution of a command but do not necessarily imply intellectual engagement, at least on the level of assent. It is quite true that if obedience or observance are to be human acts at all, there must be an understanding of what is commanded. But it is possible to observe a law or command without agreeing with it. And it is execution primarily that obedience and observance of law call for. If one does what is commanded either by an authority or by law, he is fulfilling his basic obligation. He may or may not agree with the command given. In other words intellectual assent is not in itself the response called for by this kind of authority. In fact, intellectual assent as such is not and cannot be required by law. The distinction between temporal lobe and diencephalic amnesia is of limited value in that a common feature of anterograde amnesia is damage to part of an comprising the hippocampus, the fornix, the mamillary bodies, and the anterior thalamic nuclei. This view, which can be traced back to Delay and Brion (1969), differs from other recent models in (...) placing critical importance on the efferents from the hippocampus via the fornix to the diencephalon. These are necessary for the encoding and, hence, the effective subsequent recall of episodic memory. John Woods' The Logic of Fiction, now thirty-five years old, is a ground-breaking event in the establishment of the semantics of fiction as a stand-alone research programme in the philosophies of language and logic. There is now a large literature about these matters, but Woods' book retains a striking freshness, and still serves as a convincing template of the treatment options for the field's key problems. The book now appears in a second edition with a new Foreword by Nicholas (...) Griffin and an extended bibliography covering the period 1969-2009. As Griffin notes in his Foreword, it is "surprising on looking back to discover how little was written on the semantics of fiction before John Woods' The Logic of Fiction was published in 1974. Currently in the United Kingdom, anyone donating gametes has the status of an open-identity donor. This means that, at the age of 18, persons conceived with gametes donated since April 1, 2005 have a right to access certain pieces of identifying information about their donor. However, in early 2015, the UK Parliament approved new regulations that make mitochondrial donors anonymous. Both mitochondrial donation and gamete donation are similar in the basic sense that they involve the contribution of gamete materials to (...) create future persons. Given this similarity, this paper presumes that both types of donor should be treated the same and made open-identity under the law, unless there is a convincing argument for treating them differently. I argue that none of the existing arguments that have been made so far in favor of mitochondrial donor anonymity are convincing and mitochondrial donors should therefore be treated as open-identity donors under UK law. This essay criticizes John Norton's 2010 defense of the thesis that “all induction is local.” Norton's local inductions are bound, if cogent, to involve general principles, and the need to accredit these general principles threatens to lead to all the usual problems associated with the ‘problem of induction’. Norton, in fact, recognizes this threat, but his responses are inadequate. The right response involves not induction but a sophisticated version of hypothetico-deduction. Norton's secondary thesis—that if there is a general account (...) of cogent scientific reasoning, then it is certainly not the one supported by personalist Bayesians—is also criticized. (shrink)

The article takes up a range of issues concerning knowledge of language in response to recent work of Rey, Smith, Matthews and Devitt. I am broadly sympathetic with the direction of Rey, Smith, and Matthews. While all three are happy with the locution ‘knowledge of language’, in their different ways they all reject the apparent role for a substantive linguistic epistemology in linguistic explanation. I concur but raise some friendly concerns over even a deflationary notion of knowledge of language. Against (...) Devitt I have more serious worries. The latter half of the paper seeks further clarification of Devitt’s realism and raises concerns over its ability to reflect the shape and content of linguistics. (shrink)

Managers have the primary role responsibility to protect and promote the economic viability of their organizations. Utilizing a formula that demonstrates the inherently unstable nature of economic systems, I argue that managers are sometimes morally required to make adjustments that result in harming people who work for them in order to reestablish the equilibrium necessary to remain viable. The question of who is going to be harmed and how this harm is morally justified is the focal point of this paper. (...) I argue that utilizingtraditional methods associated with our common morality cannot solve the issue of who is going to be harmed, and that the traditionalmethods for reestablishing equilibrium promote a distribution of harm that cannot be justified from a rationally defensible moral pointof view. Utilizing the constraint of impartiality and the concept of the health of the organization, I argue that an equal distribution of harmamong everyone affected by the decision is the only one that is rationally defensible. This book addresses one of the fundamental topics in philosophy: the relation between appearance and reality.
