Embodied Idealism argues that Maurice Merleau-Ponty's early thought - primarily as found in The Structure of Behavior and Phenomenology of Perception - stands as a form of transcendental idealism. This interpretation runs against the grain of much of the Merleau-Ponty scholarship, and opposing interpretations are not without support. Merleau-Ponty is at points highly critical of idealism in his early works. Also, his emphasis on embodiment would seem to run counter to the idealist view that the mental is central to reality. (...) Joseph Berendzen shows that these points can be accommodated within a transcendental idealist interpretation. Merleau-Ponty's overt criticisms of idealism are aimed at specific aspects of idealist theories that are not obligatory aspects of idealism in general. Rather, his critique is typically aimed at a specific version of intellectualist idealism associated with his teacher Léon Brunschvicg. In spite of his overt criticisms of idealism, Merleau-Ponty's early philosophy holds that our experience is inextricably structured by our minds. Furthermore, he holds that reality is ontologically dependent on the mind, yet in a manner that also allows for a sense in which reality is mind-independent. It is crucial to this interpretation that Merleau-Ponty's emphasis on embodiment leads to a unique view of embodied consciousness and subjectivity that supports a novel form of idealism, rather than motivating an anti-idealist position. Thus, his transcendental idealism is genuinely an embodied idealism. (shrink)

This paper raises a challenge for those who assume that corporate social responsibility and good corporate governance naturally go hand-in-hand. The recent spate of corporate scandals in the United States and elsewhere has dramatized, once again, the severity of the agency problems that may arise between managers and shareholders. These scandals remind us that even if we adopt an extremely narrow concept of managerial responsibility – such that we recognize no social responsibility beyond the obligation to maximize shareholder value – (...) there may still be very serious difficulties associated with the effective institutionalization of this obligation. It also suggests that if we broaden managerial responsibility, in order to include extensive responsibilities to various other stakeholder groups, we may seriously exacerbate these agency problems, making it even more difficult to impose effective discipline upon managers. Hence, our central question: is a strong commitment to corporate social responsibility institutionally feasible? In searching for an answer, we revisit the history of public management, and in particular, the experience of social-democratic governments during the 1960s and 1970s, and their attempts to impose social responsibility upon the managers of nationalized industries. The results of this inquiry are less than encouraging for proponents of corporate social responsibility. In fact, the history of public-sector management presents a number of stark warnings, which we would do well to heed if we wish to reconcile robust social responsibility with effective corporate governance. In this paper, I argue that Humean theories of moral motivation appear preferable to Kantian approaches only if one assumes a broadly foundationalist conception of rational justification. Like foundationalist approaches to justification generally, Humean psychology aims to counter the regress-of-justification argument by positing a set of ultimate regress-stoppers-in this case, unmotivated desires. If the need for regress-stoppers of this type in the realm of practical deliberation is accepted, desires do indeed appear to be the most likely candidate. But if this (...) foundationalist strategy is rejected, there is no longer any reason to suppose that all motivation must be traceable to some extra-rational incentive. This clears the way for a rehabilitation of the Kantian claim that reasons for action can take the form of categorical imperatives. To illustrate this thesis, I show how a conception of practical rationality that incorporates a contextualist model of justification can be developed that treats social norms as reasons for action, without assigning any mediating role to agent desires. a theory of action of this type eliminates the gap between moral obligation and action, and so articulates the fundamental Kantian intuition that acting on the basis of moral principle-and with disregard for self-interest-is just one way of acting rationally. When can a Bayesian investigator select an hypothesis H and design an experiment (or a sequence of experiments) to make certain that, given the experimental outcome(s), the posterior probability of H will be lower than its prior probability? We report an elementary result which establishes sufficient conditions under which this reasoning to a foregone conclusion cannot occur. Through an example, we discuss how this result extends to the perspective of an onlooker who agrees with the investigator about the statistical model (...) for the data but who holds a different prior probability for the statistical parameters of that model. We consider, specifically, one-sided and two-sided statistical hypotheses involving i.i.d. Normal data with conjugate priors. In a concluding section, using an "improper" prior, we illustrate how the preceding results depend upon the assumption that probability is countably additive. (shrink)

Critical response to John Rawls's The Law of Peopleshas been surprisingly harsh) Most of the complaints centre on Rawls's claim that there are no obligations of distributive justice among nations. Many of Rawls's critics evidently had been hoping for a global application of the difference principle, so that wealthier nations would be bound to assign lexical priority to the development of the poorest nations, or perhaps the primary goods endowment of the poorest citizens of any nation. Their subsequent disappointment reveals (...) that, while the reception of Rawls's political philosophy has been very broad, it has not been especially deep. Rawls has very good reason for denying that there are obligations of distributive justice in an international context. (shrink)

The paper offers a new account of the rule of law, revising my previous view, and criticising some alternatives. It focuses on the rule of law's aim to avoid arbitrary government, and on its relation to the essential functions of government. The rule of law requires that government action will manifest an intention to protect and advance the interests of the governed. The tendency to test outcomes that are predicted by our current theory (the confirmation bias) is one of the best-known biases of human decision making. We prove that the confirmation bias is an optimal strategy for testing hypotheses when those hypotheses are deterministic, each making a single prediction about the next event in a sequence. Our proof applies for two normative standards commonly used for evaluating hypothesis testing: maximizing expected information gain and maximizing the probability of falsifying the current hypothesis. This analysis rests on two assumptions: (a) that people predict the next event in a sequence in a way that is consistent with Bayesian inference; and (b) when testing hypotheses, people test the hypothesis to which they assign highest posterior probability. We present four behavioral experiments that support these assumptions, showing that a simple Bayesian model can capture people's predictions about numerical sequences (Experiments 1 and 2), and that we can alter the hypotheses that people choose to test by manipulating the prior probability of those hypotheses (Experiments 3 and 4). Most parents lie to their children. They do it for fun, as a method of behaviour control, and to protect children from what they consider to be dangerous truths. At the same time, most parents bring their children up with the message that honesty is a virtue and that lying is usually wrong. How should our practice and our preaching be reconciled? In this paper, I examine the ethics of parental lies. Most philosophers who have written on the ethics of (...) deception have focused on deception of and by autonomous adults. I therefore begin by surveying this literature. Contemporary philosophers have given three types of reason to explain what makes lying wrong (when it is wrong): negative consequences, breaches of trust, and interference with autonomy. I briefly analyze what constitutes a breach of trust and identify four factors that affect how bad a breach is. I then explicate how lying can constitute a wrongful interference with autonomy. A long-running debate concerns whether lying is ethically different than other forms of deception. I argue—briefly—that we do not need to resolve this debate in order to evaluate parental deception. Armed with a framework for what makes lying to autonomous adults wrongful, I turn to the special case of parental lying. Since the parent-child relationship is typically very close, lying to one’s child is a relatively serious breach of trust. This is exacerbated in the case of serious lies that implicate the parent-child relationship or the child’s identity. On the other hand, at least for young children, concerns about autonomy are less significant than for autonomous adults. I close by applying my analysis, along with data on the consequences of parental deception, to different types of parental lie. I argue that lying to one’s child is more rarely justified than is commonly thought, and delineate the circumstances in which it can be justified. (shrink)

Genetic discrimination is becoming an increasingly important problem in the United States. Information acquired from genetic tests has been used by insurance companies to reject applications for insurance policies and to refuse payment for the treatment of illnesses. Numerous states and the United States Congress have passed or are considering passage of laws that would forbid such use of genetic information by health insurance companies. Here we argue that much of this legislation is severely flawed because of the difficulty in (...) distinguishing genetic from nongenetic tests. In addition, barring the use by insurance companies of a genetic test but not a nongenetic test (conceivably for the same multifactorial disease) raises issues of fairness in health insurance. These arguments suggest that ultimately the problems arising from genetic discrimination cannot be solved by narrowly focused legislation but only by a modification of the entire health care system. The issue of the conventionality of geometry is considered in the light of the special theory of relativity. The consequences of Minkowski's insights into the ontology of special relativity are elaborated. Several logically distinct senses of "conventionalism" and "realism" are distinguished, and it is argued that the special theory vindicates some of these possible positions but not others. The significance of the usual distinction between relativity and conventionality is discussed. Finally, it is argued that even though the spatial metric within (...) an inertial reference frame is euclidean, it is impossible to define unique objects which can serve as the relativistic surrogates of the spatial points of classical geometry. In the first place, Hans Albert is famous as the spokesperson of Karl Popper’s critical rationalism in the German-speaking world. This is chronologically a bit odd, given that Popper’s first vintage, his Logik der Forschung, appeared in German in 1935 and that his The Open Society and Its Enemies of 1945 appeared in German in 1958. Yet Albert did much to earn this fame: his decades-long indefatigable response to criticisms of Popper’s views in the post-war German philosophical literature and his (...) constant contrast between Popper’s critical rationalism and competing views that were popular in Germany at the time. This essay is concerned with some of Michel Foucault's writings on art. The author talks about the analyses of painting Foucault conducted during the period in which Foucault was developing the philosophical methodology known as archaeology. Despite archaeology's strong epistemological orientation, that methodology gives rise to a form of seeing that suspends the imperatives for the production of meaning that accrue around works of art. Some of the consequences of this suspension are explored in the final section of this essay (...) where the author describes archaeology as giving rise to an artistic‐philosophical thought that operates outside of the bounds of truth and falsity. The author contends that it is particularly well suited for approaching the artistic products created during and after the breakup of mimesis, the European cultural paradigm that articulated strong connections between art – considered as representation – and reality. The sudden collapse of the Communist states in Eastern Europe during the autumn of 1989 is now history. The transformation of the world in 1989 has been reported and commented on through analyses of the political, economic, and social state of affairs that led to one of the most surprising events of the 20th century. However, in many ways this story has been only partially told. This is because of a lack of attention paid to the vital role that the (...) Christian churches played in that transformation. This article seeks to remedy that omission through a brief history of the period. The author utilizes an array of secondary and primary sources in the writing of this history. He was also an observer of most of the revolutions of Eastern Europe and interviewed a number of participants in the dramatic events of 1989. (shrink)

The film Young Adult offers a striking example of vanity and its entanglement with other vices. Mavis Garry is prompted to return to her home town to woo a married, former beau out of vanity: an overweening desire to be admired for her appearance and authorship. Vanity involves wishing to be seen possessing something valuable that others lack and bestowing excessive attention on it, as in Mavis’s repeated physical preening and buffing. Because comparison is central to vanity, it contributes to (...) Mavis’s envy. Vanity also encourages her arrogance by inflating Mavis’s distorted view of her self-worth. At the film’s climax, Mavis’s defects are publicly witnessed, producing in her the salutary moral experience of shame. However, Mavis’s incipient self-awareness and shame are dissipated by a few words from a fawning fan, as the undertow of vanity pulls Mavis beneath the clarity of the moral sensibility that was momentarily evoked by shame. This article views the confrontation between pragmatism and Kant’s Critical undertaking as very possibly the single most consequential agon of contemporary philosophy, given the utter irreconcilability of their respective ways of addressing the concerns of First Philosophy, with regard to the enabling conditions of cognitive realism. Pragmatism favors an informal, fluxive, “instrumentalist” form of empiricism, impossible to complete, opposed to any and all the ontic and epistemic fixities of Kant’s Rationalism. Reason (Vernunft) cannot be more than a fiction. Kant has (...) no supporting criterion of realism. The article proposes an empirical criterion of the distinctive (given) “duality” of sensory “appearings” and “appeareds” (that is, objects) as yielding a plausible “cognitive faculty” (involving “reasoning”—inference, for instance—but not Vernunft) that, in accord with the drift of evolutionism and Aristotle, readily extends to languageless animals as well as humans.
