Aspects of the world are normative in as much as they or their existence constitute reasons for persons, i.e. grounds which make certain beliefs, moods, emotions, intentions or actions appropriate or inappropriate. Our capacities to perceive and understand how things are, and what response is appropriate to them, and our ability to respond appropriately, make us into persons, i.e. creatures with the ability to direct their own life in accordance with their appreciation of themselves and their environment, and of the (...) reasons with which, given how they are, the world presents them. An explanation of normativity would explain the various puzzling aspects of this complex phenomenon. In particular it would explain how it is that aspects of the world can constitute reasons for cognitive, emotive, and volitional responses; how it is that we can come to realise that certain cognitive, emotional or volitional responses are appropriate in various circumstances, and inappropriate in others; and how it is that we can respond appropriately. This paper examines a central aspect of the relations between duration and quality of life by considering the moral right to voluntary euthanasia, and some aspects of the moral case for a legal right to euthanasia. Would widespread acceptance of a right to voluntary euthanasia lead to widespread changes in attitudes to life and death? Many of its advocates deny that, seeing it as a narrow right enabling people to avoid ending their life in great pain or total dependence, or (...) a vegetative state. I argue that the right cannot cogently be conceived as a narrow right, confined to very limited circumstances. It is based on the value of having the normative power to choose the time and manner of one's death. Its recognition will be accompanied by far reaching changes in culture and attitudes, and these changes will enrich people's life by enabling them to integrate their death as part of their lives. The underlying problem addressed by Pope Benedict XVI’s first encyclical is how the modern state usurped and perverted the Church’s charitable enterprises. The Church invented public schools, hospitals, and family services and ran them for a millennium as the “better half” of Christendom’s aristocratic, oligarchic, and democratic regimes. Beginning in the sixteenth century, however, and culminating in today’s social justice movement, the Church’s institutions of discerning love have been supplanted by political agencies, operating on the basis of universal and homogenous (...) justice. This robbed the Church of its visible moral authority, metastasized the political administration, and corrupted both the charity and its recipients. In challenging Marxist theorists to confront the radical rebirth at the core of the fascist revolution, Roger Griffin has carried fascist studies to a new and valuable plateau. Likewise, David D. Roberts’s elaboration of Griffin’s model offers a provocative and fruitful avenue to rethink fascist political culture. This article seeks to advance the dialogue to the next level by considering what an international approach can add to these primarily nationalist interpretations of generic fascism. Drawing on examples from the history of (...) the United States, I argue that fascism is a fundamentally cosmopolitan process and that it needs to be placed on a broader continuum with the histories of slavery, racism and nationalism. Patients who are imminently dying sometimes experience symptoms refractory to traditional palliative interventions, and in rare cases, continuous sedation is offered. Samuel H. LiPuma, in a recent article in this Journal, argues that continuous sedation until death is equivalent to physician-assisted suicide/euthanasia based on a higher brain neocortical definition of death. We contest his position that continuous sedation involves killing and offer four objections to the equivalency thesis. First, sedation practices are proportional in a way that physician-assisted suicide/euthanasia is not. (...) Second, continuous sedation may not entirely abolish consciousness. Third, LiPuma’s particular version of higher brain neocortical death relies on an implausibly weak construal of irreversibility—a position that is especially problematic in the case of continuous sedation. Finally, we explain why continuous sedation until death is not functionally equivalent to neocortical death and, hence, physician-assisted suicide/euthanasia. Concluding remarks review the differences between these two end-of-life practices. (shrink)

This article examines the phenomenological structures of the homo temporalis filtered through Augustine's illuminating, if unsystematic, insights on temporality and the imago Dei. It situates such a phenomenological interpretation of the Augustinian self in view of current interpretations that polarize or split the Augustinian self into an either/or scheme—either an “interior” self or an “exterior” self. Given this imbalance, the article suggests that a phenomenological evaluation of Augustine brings to light how interior and exterior spheres are deeply integrated. The article (...) elaborates this position by contending that the self's temporal streaming within the exterior world‐horizon is inescapable because it reflects basic constituents of a self created by God which is nevertheless capable of contemplating a God who transcends time. This seeming paradox is resolved by recourse to what is described as the “double entry” of the self. The temporal streaming of the self in the world‐horizon is porous to the eternal inwardly ; the eternal entry is thus interior and analyzable in terms of a non‐reflective self‐awareness on display in Augustine's De Trinitate; and finally Augustine's understanding of the temporality of faith indicates how the self of faith can be lived in light of Heidegger's emphasis on the future and Husserl's emphasis on the past. The literature on time perception is discussed. This is done with reference both to the ''cognitive-timer'' model for time estimation and to the subjective experience of apparent duration. Three assumptions underlying the model are scrutinized. I stress the strong interplay among attention, arousal, and time perception, which is at the base of the cognitive-timer model. It is suggested that a multiplicative function of two key components (the number of subjective time units and their size) should predict apparent duration. Implications for (...) other cognitive domains are drawn, and in particular an analogy is suggested between apparent duration and apparent movement. (shrink)

Moral philosophers are fond of the dictum “ought implies can” and even deontologists normally admit the need to take account of consequences in the design of social institutions. Too often, however, philosophers fail to take advantage of the knowledge provided by the social sciences about the constraints and consequences of alternative forms of social organization. By discussing ideals in abstraction from the problems of institutionalization, they fail at least to see some of the important consequences and costs of a proposed (...) ideal, and sometimes they fail even to understand the ideal itself. We begin this response by discussing the selfishness axiom and the importance of the preferences, beliefs, and constraints framework as a way of modeling some of the proximate influences on human behavior. Next, we broaden the discussion to ultimate-level (that is evolutionary) explanations, where we review and clarify gene-culture coevolutionary theory, and then tackle the possibility that evolutionary approaches that exclude culture might be sufficient (...) to explain the data. Toward a Metaphysics of Culture provides an initial, minimal, and original analysis of the concept of uniquely enlanguaged cultures of the human world and of the distinctive metaphysical features of whatever belongs to the things of that world: preeminently, persons, language, actions, artworks, products, history, practices, institutions, and norms. Emphasis is placed on the artifactual and hybrid nature of persons, naturalistic and post-Darwinian evolutionary considerations, and the bearing of the account on a range of disputed inquiries largely centered on the (...) relationship between physical nature and human culture and between the natural and human sciences. The schema offered lays a foundation for a closer analysis of the human mind, cognition, interpretation, nomologicality, normativity, intentionality, realism, and related matters. The central thesis advances the heterodox notion, congruent with post-Darwinian studies in paleoanthropology, that the human person is a natural artifact, a functional transform of the primate members of Homo sapiens, by way of a complexly intertwined biological and encultured evolution, primarily dependent on the invention, transmission, and mastery of true language and the novel hybrid abilities that that makes possible. If we can save the lives of only one of multiple groups of people, we might be inclined simply to save whichever group is largest. We may worry, though, that automatically saving the largest group fails to take each saveable individual sufficiently into account, offering some of these individuals no chance at all of being rescued. Still wanting to give larger groups higher chances of survival, we may then say that we ought to employ a proportionally weighted lottery to determine (...) which group to save. In this paper, I argue that this would be a mistake. Given the most plausible way of specifying it, the weighted-lottery view itself fails to treat each saveable individual with equal moral respect. The Bush administration's military war on terrorism is a blunt, ineffective, and unjust response to the threat posed to innocent civilians by terrorism. Decentralized terrorist networks can only be effectively fought by international cooperation among police and intelligence agencies representing diverse nation‐states, including ones with predominantly Islamic populations. The Bush administration's allegations of a global Islamist terrorist threat to the national interests of the United States misread the decentralized and complex nature of Islamist politics. Undoubtedly there exists a “combat fundamentalist” (...) element within Islamism. But the threat posed to U.S. citizens by Islamist terrorism neither necessitates nor justifies as a response massive military invasions of other nations. Not only does the Bush administration's war on alleged “terrorist states” violate the doctrine of just war, but in addition these wars arise from a new, unilateral, imperial foreign‐policy doctrine of “preventive wars.” Such a doctrine will isolate the United States from international institutions and long‐standing allies. The weakening of these institutions and alliances will only weaken the ability of the international community to deter terrorism. (shrink)

Coe writes, “I challenge any native English speaker to avoid thinking of the word ‘twelve’ when looking at ‘12,’ or an Italian to avoid the utterance ‘dodici’ when going through the same performance.” 1 I accept the challenge, and claim that I have done just that. What shall the reply be—“I should not have (...) done so?” One suspects that linguists confuse theoretical problems about writing and reading with the experience itself.The nature of reading and writing is difficult to understand because on the one hand it seems to involve a complex of conventional marks, but on the other hand these marks seem capable of being understood independently of their relationship to speech or to things. One can claim, of course, that the competent reader works under an illusion: meaning comes to a script through spoken language, through a deep-structured language, through concepts, or through the way the neurons work in the brain. Without denying that the written word enters into many relations, I want to make a case that the history of writing shows that we have crafted marks into meanings and, therefore, that a text is meaningful on the level of the script itself.Before proceeding, I want both to clarify my use of the term “script,” and to give the basic outline of this essay. Studies on writing frequently distinguish among writing systems, scripts, and orthographies. Writing system is the most general of these terms. For example, the alphabet forms one writing system, and Chinese characters another. A script is a particular form of writing system; examples are the Roman alphabetic script and the Greek alphabetic script. An orthography is the way a particular language uses a script; for example, the way the English or [End Page 47] French languages use the Roman alphabetic script. In the concrete, however, there are only orthographies, and without wishing to challenge the traditional distinction, I will frequently interchange script and orthography.The first part of the essay is a discussion of my perspective on writing. My perspective is a substantive part of my case about writing, and I will clarify it at some length. Then I will examine some of the steps that led to our ability to read and write fluently. I will be recommending that in reading histories about writing, we view speech merely as a mediation through which written marks are crafted into meanings. My claim is that every artifact, indeed, every thing, needs to be correctly “read” in order to be used, and that the invention of an elegant system of writing lifts this readability from its specific materiality. For example, to use a fork properly one must be able to read this use in the fork. Language lifts this readability from the matter of the fork, the silver or stainless steel, and makes the readability itself an object.IRecall the last time you were engrossed while reading a novel. Most likely, you were not concerned with questions about the meaning of meaning or the difference between meaning and signification. But did your engaged reading and writing involve an inner speech and, if it did, how did you recognize homonyms, for example the difference between there and their? I suspect that only a small part of our vocabulary is acquired by vocalization. But more importantly, I want to question whether writing must be related to speech to be understood.Frank Smith has persistently questioned the belief that reading must involve vocalizations, and he has criticized the notion that the best way to proceed with reading instruction is by mapping speech onto print. There is, However, One very important class of decision problems which is not discussed by professor jeffrey--Problems concerned with decisions about strategies for using information. The principal task of this paper is to point out some questions which arise in attempting to deal with these decision problems within jeffrey's theory. Rats and mice are very much more likely to be experimented on today in biomedical research than dogs, cats, or primates. Rats and mice, however, are explicitly excluded from the federal Animal Welfare Act's protections against animal pain and suffering in a research setting. This paper is a response to an invitation to reflect on how medical and scientific researchers should think about the rats and mice they use, in light of ongoing legal developments in the human-animal relationship. The invitation (...) was extended by the Michigan Society for Biomedical Research, an organization for the promotion of biomedical research and defense of the use of animals in research. It was extended to a teacher of Animal Law at the University of Michigan Law School who was serving as the non-scientist member from the University on the University's Institutional Animal Care and Use Committee. Considerations to which attention is directed include developments in experimentation on humans paralleling and connected with developments in experimentation on animals, developments in the science of animals beyond the biomedical field, general movements in the legal treatment of animals that are not the outcome of conflicts between animal activists and research institutions, and the importance of attitude as a focus in any regulation of experimentation, animal or human. Heinrich Heine had not only many places of residence during his years in Germany, but he also made numerous journeys throughout Europe. Thus, during his time in France, he got to know the country substantially better and furthermore he would have liked to undertake a detour to Spain. Since his student days, Spain was for him as a German Jew the epitome of a Jewish- Christian-Islamic symbiosis despite many differences and difficulties. He slipped into the role of the Moors to (...) express his own outsider role within the German Christian majority society. Heine admired the great Jewish achievements and remained critical of Christian claims, although he had become a Protestant after being baptized at the end of his law studies. His tragedy Almansor, poems from the Buch der Lieder, texts in prose and epic poems from the Parisian years as well as in his literary bequest and above all the last collection of poems called Romanzero with their moving “Spanish” texts, namely the stories about Jews, Christians and Muslims, are the most important poetic evidences of religious coexistence and its problems.
