Señalando la experiencia singular del acto de leer, este trabajo presenta la obra de un filósofo del derecho y psicoanalista francés: Pierre Legendre. A pesar de que tal proyecto pudiera constituir una empresa tan imposible como irritante, el propósito principal es resaltar un elemento que no suele observarse con frecuencia en la teoría del derecho: un recorrido por los diversos matices del inconsciente jurídico. El trabajo comienza con algunas referencias a su concepción particular del amor y del espectáculo como recursos (...) legales para dominar a los sujetos. Can one reject copyright law and be a qualified observer of its dispositives? This question was taken up by Bertolt Brecht in an intriguing essay concerning the litigation surrounding the film adaptation ofThe Threepenny Opera(1928). Brecht here develops an experimental observation around the nature of film adaptation and cultural production in copyright. While an experimental approach to law was in itself a subversive gesture, the specific legal process enabled him to expose the paradoxical ways in which the copyright system worked.

The third edition of Webster’s International Dictionary, first published in 1961, represented a novel approach to lexicography. It recorded the English language used in everyday life, incorporating colloquial terms that previous grammarians would have considered unfit for any responsible dictionary. Many were scandalized by the new lexicography. Trademark lawyers were not the most prominent of these critics, but the concerns they expressed are significant because they touched on the core structure of the trademark as a form of property in language. In the course of eavesdropping on everyday usage, Merriam-Webster’s lexicographers picked up on the use of trademarks as common nouns: “thermos” as a generic noun for any vacuum flask, “cellophane” as a term for transparent wrapping, and so on. If Webster’s Third were to be taken as sound evidence of the meaning of words, then the danger was that some of the most familiar marks in the USA would be judged “generic” in the legal sense, and would thereby cease to be proprietary. This article proposes an object properties approach to object perception. By thinking about objects as clusters of co-instantiated features that possess certain canonical higher-order object properties we can steer a middle way between two extreme views that are dominant in different areas of empirical research into object perception and the development of the object concept. Object perception should be understood in terms of perceptual sensitivity to those object properties, where that perceptual sensitivity can be explained in a manner consistent with (...) the graded representation approach adopted by some connectionist modellers. The object properties approach does justice to the differences between a perceptual system solving the binding problem, on the one hand, and genuinely perceiving objects, on the other, without running into the theoretical problems associated with treating young infants as 'little scientists'. Marko Jurjako’s article “Self-deception and the selectivity problem” (Jurjako 2013) offers a very interesting discussion of intentionalist approaches to self-deception and in particular the selectivity objection to anti-intentionalism raised in Bermúdez 1997 and 2000. This note responds to Jurjako’s claim that intentionalist models of self-deception face their own version of the selectivity problem, offering an account of how intentions are formed that can explain the selectivity of self-deception, even in the “common or garden” cases that Jurjako emphasizes.

This commentary on Jacob and Jeannerod’s Ways of Seeing evaluates the conclusions that the authors draw from the two visual systems hypothesis about the nature and phenomenology of visual experience.

This paper argues that, while there is a difference between personal and sub-personal explanation, claims of autonomy should be treated with scepticism. It distinguishes between horizontal and vertical explanatory relations that might hold between facts at the personal and facts at the sub-personal level. Noting that many philosophers are prepared to accept vertical explanatory relations between the two levels, I argue for the stronger claim that, in the case of at least three central personal level phenomena, the demands of explanatory (...) adequacy require postulating horizontal explanatory relations. The Catechism (...) of the Catholic Church notes: "In order to leave them a pledge of this love, in order never to depart from his own and to make them sharers in his Passover, [Christ] instituted the Eucharist as the memorial of his death and Resurrection, and commanded his apostles to celebrate it until his return; 'thereby he constituted them priests of the New Testament'" (§1337). This recent formulation positively reworks a famous Tridentine canon: "If any one should say that by the words, 'Do this in memory of me,' Christ did not establish the apostles as priests, or that he did not ordain them and others as priests to offer his Body and Blood, let him be anathema."1 That the Council of Trent found it necessary to clarify this doctrine by anathematizing the contrary certainly testifies to the controversial nature of this Catholic position in wake of the Reformation; yet, the Council Fathers' [End Page 723] position—as is so often the case with dogmatic pronouncements—is not a simple articulation of an uncontroversial yet implicit belief held within the Catholic communion.With regard to the second point: after some decades of scholarly doubt,2 Aquinas's composition of Corpus Christi's poetic texts seems to be better appreciated by laity and scholars alike,3 many of whom find in the beloved hymns commonly sung at adoration and Eucharistic processions a beautiful and edifying distillation of St. Thomas's teaching on the Blessed Sacrament. However, the place of the Corpus Christi liturgy within the historical development of Aquinas's own thoughts on the priesthood and Eucharist is perhaps less acknowledged.4 The aesthetic and spiritual appeal of the hymns, [End Page 724] compounded by their frequent usage, may tend to obscure the importance of the historical context which informs Aquinas's unique compositional, poetic, and doctrinal directions. Hidden behind the impressiveness of the saint's artistic execution, I argue, lies a parallel to the well-developed doctrinal synthesis of priesthood and Eucharist articulated in Summa contra gentiles [SCG] IV. In what follows, I examine excerpts from the sequence for Mass Lauda Sion Salvatorem and matutinal hymn Sacris solemniis to show how, already in the Orvieto period (1261–1265), Aquinas laid the foundations for sacramental doctrines expressed with more precision not only in the two Summae, but in the dogmatic teaching of the Council of Trent on the relationship between the Eucharist and Holy Orders. I will also highlight the unique and even innovative nature of Aquinas's positions by way of contrast with St. Bonaventure's sacramentology.5 I will conclude by offering some reflections, drawn from Aquinas's synthetic treatment of Eucharist and Holy Orders, on the inseparability of priestly renewal and Eucharistic revival.From the Sentences Commentary to the Summa theologiaeIn his commentary on the Sentences of Peter Lombard (the Scriptum), Aquinas, like his contemporaries, follows the broad tradition in locating the institution of the Eucharist at the Last Supper.6 This point is rightfully uncontroversial on account of its clear biblical background,7 and is repeated by the Angelic Doctor in Summa theologiae [ST] III.8 However, in the Scriptum, Aquinas links the institution of the Eucharist with the institution of the priesthood, saying that Christ "gave priestly power with regard to its principal act before the Passion at the Last Supper, when he said, in Matthew 26:26, 'take and eat,' to which Luke 22:19 adds 'Do this in commemoration of me.' Partindo do pressuposto de que a teoria social elaborada por Habermas em muito se assemelha àquela construída por M. Weber, procedeu-se a um estudo comparativo com a intenção de identificar as formas pelas quais Weber e Habermas elaboraram o conceito de compreensão, ao mesmo tempo em que e o elegeram, cada um a seu modo, como instrumento metodológico adequado às dificuldades da produção de conhecimento científico nas Ciências Sociais. Tanto para Weber, como para Habermas, o conhecimento nas Ciências Sociais não (...) consegue escapar das influências diretas da subjetividade do cientista, como também não é capaz de se proteger das contingências histórico-culturais aos quais inevitavelmente toda ação humana está vinculada. Por isso, fundamentados em suas próprias razões, tanto Weber quanto Habermas apontam a compreensão como a forma possível de conhecimento, o que implica a renúncia às pretensões explicativas e à produção de teorias gerais de fundamentação última, que são típicas das ciências convencionais. Assuming that the social theory developed by Habermas is very similar to that constructed by M. Weber, this article performs a comparative study with the intention of identifying the ways in which Weber and Habermas built the concept of understanding. Both authors chose this concept, each in his own way, as a methodological tool appropriate to the difficulties of the production of scientific knowledge in the social sciences. As much for Weber as for Habermas, knowledge in the social sciences cannot escape the direct influences of the subjectivity of the scientist, as it also cannot protect itself from the historical and cultural contingencies to which every human action is inevitably linked. Therefore, based on their own reasons, both Weber and Habermas point to understanding as the possible form of knowledge, which implies the renunciation of the explanatory pretensions and general theories of ultimate foundations typical of the conventional sciences. In the final chapters of this first book tackles the critical of the theological discourse and thus, the problem of the ineffable name of maximum et minimum absolutum . Hence the purpose of this work is the further on cusan’s evaluation of language problem as it shows through treatment of the theological discourses and divine names that emerge from them, in light of the way of docta ignorantia. El artículo presenta los resultados de una investigación sobre la violencia política en Perú y su actual incidencia en la crisis de legitimidad de las instituciones políticas democráticas. La metodología empleada supone la revisión documental y el tratamiento de otras fuentes sobre las múltiples maneras como el conflicto armado debilitó la credibilidad en los mecanismos y estamentos democráticos. Se presentan elementos concluyentes sobre la continuidad, durante y después del conflicto, de la desigualdad, la frustración en la búsqueda de la verdad (...) y justicia ante la violación de los derechos humanos como causas de la crisis e inestabilidad política en Perú. El artículo permitirá concluir con la grave crisis de gobernabilidad que atraviesa el país, que se traduce en prácticas corruptas que paralizan su desarrollo económico, marcando el paso de una crisis económica a una crisis política: un puente que une los años 1992 a 2018 y que deja como saldo una pérdida generalizada de confianza en la clase política y en las instituciones del poder público en Perú. La reciente muerte de Pierre Legendre (1930-2023), tras una vida dedicada al estudio de la estructura jurídica de Occidente, permite una evaluación de su importante obra ya concluida. Este ensayo solo quiere identificar el núcleo de su teoría de Occidente en una específica esquizofrenia entre la mentalidad jurídica romana, de estructura patriarcal, y su cruce con la religión cristiana, de aspiración mundial y potencialmente anómica. El resultado ofrece ese especial desequilibrio permanente de Europa, su pulsión expansiva, su incapacidad para mirar (...) su propia contradicción interna. En este sentido, se considera la obra de Legendre como fundamental desde el punto de vista de una genealogía de la razón imperial europea. (shrink)

Diante dessa proposta, a memória episódica (de eventos que alguém viveu) pode se tornar um desafio para essa abordagem da cognição humana especialmente porque parece intuitivo que memórias representam os eventos passados. Neste artigo, esse problema será abordado a partir da discussão acerca de como a linguagem humana molda a memória episódica. The article provides an analysis of the work of Francisco Solano Constâncio (1777–1846), a Portuguese author who lived in Paris for most of his life. He had a very colourful and diversified career, which included the practice of medicine, political agitation, scientific journalism, diplomacy, linguistics, history, and the popularisation of political economy. As far as this last aspect is concerned, Constâncio is particularly well known for his translation into French of the famous works written on political economy by David Ricardo (...) and Thomas Malthus. He was also a very active editor of learned journals published in Paris in the 1820s, in which he discussed and criticised the writings of Jean-Baptiste Say and Simonde de Sismondi, among others. The article shows that Constâncio's sound knowledge of political economy was a basic condition for his critical acceptance of abstract theoretical principles and general policies that could not be applied to the study of national economic realities and specific social problems.
