Principles of distributive justice are normative principles designed to guide the allocation of the benefits and burdens of economic activity.

Using philosophical and theological reflection, this book explores the rational grounding for Christian faith, inquiring into the basis for believing the Christian revelation, and using the answers to give an account of Christian faith itself. Setting the discussion in the context of the history of views on revelation, Divine Faith makes an original contribution to historiography and draws out hitherto unnoticed affinities between Catholic and Protestant thought. Re-examining the question from the beginning by asking how it is that the Christian (...) revelation is made, Lamont then looks at the fundamental philosophical issues concerning the nature of knowledge and the reasonableness of belief in testimony that are crucial to an understanding of Christian belief. Through theological considerations on the relations of grace and the church, and new advances in the philosophy of belief in testimony and how God speaks to communicate the Christian religion, this book offers an original and powerful account of the nature of Christian belief. The concept of cultural capital has been increasingly used in American sociology to study the impact of cultural reproduction on social reproduction. However, much confusion surrounds this concept. In this essay, we disentangle Bourdieu and Passeron's original work on cultural capital, specifying the theoretical roles cultural capital plays in their model, and the various types of high status signals they are concerned with. We expand on their work by proposing a new definition of cultural capital which focuses on cultural and (...) social exclusion. We note a number of theoretical ambiguities and gaps in the original model, as well as specific methodological problems. In the second section, we shift our attention to the American literature on cultural capital. We discuss its assumptions and compare it with the original work. We also propose a research agenda which focuses on social and cultural selection and decouples cultural capital from the French context in which it was originally conceived to take into consideration the distinctive features of American culture. This agenda consists in 1) assessing the relevance of the concept of legitimate culture in the U.S.; 2) documenting the distinctive American repertoire of high status cultural signals; and 3) analyzing how cultural capital is turned into profits in America. Many have argued that individuals should receive income in proportion to their contribution to society. Others have believed that it would be fairer if people received income in proportion to the effort they expend in so contributing, since people have much greater control over their level of effort than their productivity. I argue that those who believe this are normally also committed, despite appearances, to increasing the social product — which undermines any sharp distinction between effort- and productivity-based distributive proposals. (...) However, effort-based proposals do emphasise more the importance of people having control over factors affecting their income. The second set of problems I consider is how to implement policies which hold true to this emphasis. I show that there are major problems with the accuracy of using any objective criteria to measure the level of effort a person is expending. Moreover, once any such criteria are employed the problem of ‘moral hazard’arises because people modify their behaviour in such a way as to maximise their income while minimising their effort. This violates the original motivation for using effort. Because of this and other empirical considerations, I argue that productivity may well be a better criterion on which to distribute income even if one is motivated by the same concerns which have prompted effort-based proposals. Introduction: Healthcare practitioners have a legal, ethical and professional obligation to obtain patient consent for all healthcare treatments. There is increasing evidence which suggests dissonance and variation in practice in assessment of decision-making capacity and consent processes. Aims: This study explores healthcare practitioners’ knowledge and practices of assessing decision-making capacity and obtaining patient consent to treatment in the acute generalist setting. Methods: An exploratory descriptive cross-sectional survey design, using an online questionnaire, method was employed with all professional groups invited via (...) email to participate. Data were collected over 3 months from July to September 2015. Survey content and format was reviewed by the liaison psychiatry team and subsequently contained five sections (demographics, general knowledge and practice, delirium context, legal aspects and education/training). Descriptive, univariate and bivariate analysis of quantitative data and qualitative content analysis of qualitative data were undertaken. Ethical considerations: The study was approved by the institutional Human Research and Ethics Committee and informed consent was taken to be provided by participants upon completion and submission of the de-identified survey. Results: In total, 86 participants engaged the survey with n = 24, exiting at the first consent question. Almost two-thirds of respondents indicated that all treatments required patient consent. Knowledge of consent and decision-making capacity as legal constructs was deficient. Decision-making capacity was primarily assessed using professional judgement and perceived predominantly as the responsibility of medical and psychology staff. A range of patient psychological and behavioural symptoms were identified as indicators requiring assessment of decision-making capacity. Despite this, many patients with delirium have their decision-making capacity assessed and documented only sometimes. Uncertain knowledge and inconsistent application of legislative frameworks are evident. Many participants were unsure of the legal mechanisms for obtaining substitute consent in patients with impaired decision-making capacity and refusing treatment. Conclusion: The legal context of decision-making capacity and consent to treatment appears complex for healthcare practitioners. Professional, ethical and legal standards of care in this context can benefit from structured education programmes and supportive governance processes. An understanding of why ‘duty of care’ is being used as a framework within the context of impaired decision-making capacity is warranted, alongside a review of the context of Duty of Care within health policy, guidance and faculty teaching. This integrative review aims to provide a synthesis of research findings of health-care professionals’ knowledge, attitudes and behaviours relating to patient capacity to consent to or refuse treatment within the general hospital setting. Search strategies included relevant health databases, hand searching of key journals, ‘snowballing’ and expert recommendations. The review identified various knowledge gaps and attitudinal dispositions of health-care professionals, which influence their behaviours and decision-making in relation to capacity to consent processes. The findings suggest that there is tension between (...) legal, ethical and professional standards relating to the assessment of capacity and consent within health care. Legislation and policy guidance concerning capacity assessment processes are lacking, and this may contribute to inconsistencies in practice. (shrink)

BackgroundDelirium is highly prevalent in the general hospital patient population, characterized by acute onset, fluctuating levels of consciousness, and global impairment of cognitive functioning. Mental capacity, its assessment and subsequent consent are therefore prominent within this cohort, yet under-explored.AimThis study of patients with delirium sought to determine the processes by which consent to medical treatment was attempted, how capacity was assessed, and any subsequent actions thereafter.MethodA retrospective documentation review of patients identified as having a delirium for the twelve months February (...) 2013 to January 2014 was undertaken. Inclusion and exclusion criteria were used; demographic and descriptive data collected. A total of n=1153 patients were identified with n=310 meeting inclusion criteria.ResultA random sample of one hundred patients were subsequently reviewed. One third of patients had documentation relating to consent, while four patients had documentation relating to capacity. Median delirium duration was three days, with treatment refusal occurring in twenty-two patients and “duty of care” being used as an apparent beneficent related treatment framework in twelve patients.ConclusionsWhile impaired decision-making was indicated, the review was unable to indicate what patient characteristics flag the need for capacity assessment. Documentation relating to consent processes appeared deficient for this cohort. (shrink)

This article presents a remarkable cache of five Attic curse tablets, four of which are published here for the first time. Excavated in situ in a pyre-grave outside the Athenian Long Walls, the texts employ very similar versions of a single binding curse. After situating the cache in its archaeological context, all texts are edited with a full epigraphic commentary. A discussion then follows, in which the most striking features of the texts are highlighted: in addition to the peculiar “first (...) four-year period” that the curses were meant to outlast, and the unparalleled term κυνωτόν, these texts are unusual in that they preserve over a full line of dactylic hexameter. The metrical formulae, combined with the presence of deictic language, may suggest that parts of the archetype curse underpinning these texts once circulated orally, in performative ritual contexts. The cache affords a singular glimpse into the process of curse-creation around 400 BCE, especially the ways in which a curse-writer could customize a fixed template spell to suit a client’s needs and circumstances. These tablets illuminate the shadowy process behind the creation of Athenian curse tablets, and the growing traffic in “magic” by the end of the fifth century BCE. (shrink)

In contrast to most literature on cosmopolitanism, which focuses on its elite forms, this article analyzes how ordinary people bridge racial boundaries in everyday life. It is based on interviews with 150 non-college-educated white and black workers in the United States and white and North African workers in France. The comparison of the four groups shows how differences in cultural repertoires across national context and structural location shape distinct anti-racist rhetorics. Market-based arguments are salient among American workers, while arguments based (...) on solidarity and egalitarianism are used by French, but not by American, workers. Minority workers in both countries employ a more extensive toolkit of anti-racist rhetoric as compared to whites. The interviewed men privilege evidence grounded in everyday experience, and their claims of human equality are articulated in terms of universal human nature and, in the case of blacks and North Africans, universal morality. Workers' conceptual frameworks have little in common with multiculturalism that occupies a central place in the literature on cosmopolitanism. We argue that for the discussion and practice of cosmopolitanism to move forward we should shift our attention to the study of multiple ordinary cosmopolitanisms. (shrink)

The paper corrects misrepresentations of Aquinas's understanding of divine simplicity, argues that the reasons he gives for divine simplicity are persuasive ones, and suggests how Aquinas's account of the Trinity can be used to explain how God can be said to exist necessarily. It gives an account of Aquinas's conception of form and individualised form, and shows how Plantinga's criticism of Aquinas's position on divine simplicity rests on a misunderstanding of Aquinas's notion of form. It describes and makes the case (...) for Aquinas's argument that God must be absolutely simply because he is the uncaused cause of all effects, and any real composition in things constitutes an effect. It shows that Brian Davies is mistaken in claiming that Aquinas does not hold God's existence to be logically necessary. It applies Frege's conception of existence to Aquinas's account of God's simplicity and his psychological analogy for the Trinity, in order to explain how God's existence can coherently be said to be logically necessary. Traditional courtship norms delineate distinct gendered behaviors for men and women based on the model of a dominant, breadwinning male and a passive, dependent female. Previous research shows, however, that as women have increased their access to earned income, there has been a rising ideological and behavioral commitment to egalitarian relationships. Drawing on in-depth interviews with 38 college-educated women, this article explores how women negotiate these seemingly contradictory beliefs in order to understand how and why gendered courtship conventions persist even (...) as heterosexual romantic relationships become more egalitarian. My findings show that while the women reference essentialist beliefs about men’s “nature” to explain their commitment to courtship conventions, they draw on narratives of choice, individualism, and personal autonomy to assert that the symbolic gendering of courtship will not interfere with their desire for an egalitarian marriage. However, women’s behaviors and narratives reinforce notions of gender difference, potentially providing support for other forms of gender inequality. (shrink)

This conception is at odds with some contemporary understandings of the way in which such teachings are historically conditioned. I will argue that these conceptions are mistaken, and state what I think to be (...) the correct understanding of the historical conditioning of dogma. I Possession of the Catholic faith is usually understood to involve belief in the doctrines infallibly taught by the Catholic Church, so that outward profession of, and inward assent to, those doctrines, whether explicit or implicit, is a necessary condition for being a Catholic. I do not intend to discuss which particular doctrines are infallibly taught, or how exactly one determines that a doctrine is infallibly taught. I will simply assume that there are such doctrines, and that it is possible to determine that they are infallibly taught, and go on to ask the question, What does acceptance of these doctrines consist in? (The simpler expression "teachings of the Church" will be used to mean "infallible teachings of the Church" in the rest of this paper.) Whatever can be described as true, or as false, is a proposition. ii) the meanings of meaningful sentences. Different sentences can mean the same thing; for instance, the English sentence "Snow is white" and the French sentence "La neige est blanche" mean the same thing. Jennifer Bird-Pollan has recently argued that Nozickians are wrong to oppose the estate tax. Promising to argue from within the Nozickian framework, she presses the fundamental point that the estate tax does not violate anyone’s rights: neither the deceased nor their would-be heirs can claim a right to any holdings subject to the estate tax. This paper shows that Bird-Pollan’s discussion fails on three fronts. First, she frequently misinterprets Nozick, and thus does not defend the estate tax from a Nozickian (...) perspective. Second, even if Bird-Pollan is correct in denying that the deceased and their potential heirs have a right to the holdings in question, it does not follow that the estate tax is licit, because Nozickians can oppose it on other grounds. For example, Nozickians may hold that the enforcement of the estate tax will violate other rights people have. The government’s preemptive claims to holdings subject to estate taxes, along with the force required to enforce those claims, are unjustified. The crucial premise motivating these conclusions is the Nozickian denial that our current state possesses the authority to enforce the estate tax. This is the third front on which Bird-Pollan’s argument fails: she must show that Nozickians ought to believe government has the moral authority to enforce the estate tax, yet she makes no effort to do so. The paper considers the objections to Christianity raised by David Lewis, which accuse Christians of immorality on the grounds of their worshipping a monstrous being who punishes finite evils by the infinite punishment of hell. It distinguishes between the objection that God is a monster because such punishment would be unjust, and the objection that even if damnation is just, God is a monster because he wills or allows the dreadful evil of hell by creating beings that can be justly (...) damned. It asserts that Aquinas’s defence of the traditional Christian doctrine of hell provides an answer to this objection. The traditional doctrine is that those who die having committed serious sins for which they have not repented will be punished by endless mental and physical suffering in hell. Aquinas argues that the endless punishment of the damned is just because the damned endlessly and freely choose evil, and that it is good because the punishment of impenitentsinners, while bad for the sinners, is good absolutely speaking. The basis for his claim that the damned freely choose evil forever is his understanding of practical reason as ultimately motivated by a choice of a particular kind of life to live, and his view that all motivations that are independent of practical reason have a physical basis. The basis for his claim that the punishment of the damned is a good thing absolutely considered is his teleological view of good and evil. In recent years, countries have begun to establish ministries of transitional justice as part of political transitions from authoritarianism to democracy or from conflict to peace. This may reflect a broader historical trend in the administration of TJ, which has evolved from isolated offices within a particular ministry to ad hoc cross-ministry coordinating bodies to the establishment of dedicated ministries. The reasons for the establishment of specific ministries to pursue TJ, what we call ministerialization, have not attracted scholarly attention. This (...) article explores the causes and likely consequences of this development. In particular, it applies international relations, comparative politics, and public policy theories to explain the phenomenon. Contrary to some TJ literature that is concerned about hegemonic transnational discourse, international actors have played little to no role in shaping how TJ is bureaucratically managed. Rather, based upon fieldwork in Solomon Islands and Tunisia, the article concludes that ministerialization has been the result of domestic policy entrepreneurship. For TJ ministries to become a norm, however, more transnational actors will need to be convinced of the benefits of such an institutional arrangement. (shrink)

Gordon Barnes accuses Robert Nozick and Eric Mack of neglecting, in two ways, the practical, empirical questions relevant to justice in the real world.1 He thinks these omissions show that the argument behind the Wilt Chamberlain example—which Nozick famously made in his seminal Anarchy, State, and Utopia—fails. As a result, he suggests that libertarians should concede that this argument fails. In this article, we show that Barnes’s key arguments hinge on misunderstandings of, or failures to notice, key aspects of the (...) entitlement theory that undergirds Nozick’s and Mack’s work. Once the theory is properly understood, Barnes’s challenges fail to undermine the Chamberlain example, in particular, and the entitlement theory, in general. (shrink)

Matt Zwolinski argues that libertarians “should see the Basic Income Guarantee (BIG)—a guarantee that all members will receive income regardless of why they need it—as an essential part of an ideally just libertarian system.” He regards the satisfaction of a Lockean proviso—a stipulation that individuals may not be rendered relevantly worse off by the uses and appropriations of private property—as a necessary condition for a private property system’s being just. BIG is to be justified precisely because it prevents proviso violations. (...) We deem Zwolinski’s argument a “Direct Proviso-Based Argument” for BIG. We argue that because this sort of argument for the BIG is in tension with other principles libertarians within the Lockean tradition hold dear, specifically prohibitions on seizing legitimately held property and forcing individuals to labor, the Direct Proviso-Based Argument fails. Courtship conventions are premised on widespread and deeply held cultural beliefs that men and women need and want different things from their romantic relationships. Yet queer relationships challenge the notion of distinct gendered behaviors in romantic relationships, and queer people often explicitly seek to undermine conventional relationship practices. Using interview data from 40 LGBTQ-identified respondents, I examine how queer people negotiate culturally dominant gendered dating and courtship practices. My findings show that, rather than replicate heterosexual norms, respondents actively reject them, (...) seeking new and more egalitarian ways of building romantic relationships. Significantly, the narratives drawn on to justify egalitarian dating practices are similar to those used in their committed relationships. Respondents emphasized egalitarian, flexible, and non-gendered care work in committed relationships, indicating that how people date may potentially set the stage for the dynamics in their relationships. The importance placed on these alternative norms in queer communities, however, contradicts respondents’ assertions that they can create relationships free from cultural constraints, demonstrating how emerging norms can breed their own pressures for conformity. Peter Geach has claimed that St. Thomas Aquinas's first and second ways are instances of composition arguments, which argue from the parts of a thing having a property to the whole thing having that property. Such arguments are not universally valid, but are valid fr some properties. The paper examines composition arguments and the literature on them, and argues that a valid composition argument can be given for the existence of an uncaused cause of all effects.

The paper considers the criticisms that Eleonore Stump has made of Richard Swinburne's account of Christian's revelation, as set out in his book "Revelation: From Metaphor to Analogy." It argues that Stump's criticisms of Swinburne's theory of biblical interpretation are misguided, but that her criticism of his deistic picture of revelation contains a crucial insight. Direct theories of revelation, which see God as communicating propositions directly to believers, are superior to deistic ones, which see God as communicating propositions only to (...) an original group who then hand on the propositions to everyone else. Stump's suggested alternative to a deistic picture is flawed. A better theory would result from incorporating Swinburne's account of the Church into a direct theory, and holding that God communicates propositions directly to believers in the teaching of the Church. This position combines the insights to be found in Stump and Swinburne, while avoiding their mistakes. (shrink)

In this article I defend the claim that subsidies for university education should be substantially reduced. The normative justification for this conclusion derives from a theory of distributive justice called the Compensation Theory of Income Justice, which is most easily understood as a normative version of the positive economic theory of compensating differentials. Relying on the distinction between incentives and economic rents, and after considering two ‘received opinions’ about why large income differentials exist in modern societies, I note that substantial (...) portions of above-average incomes are likely to be artificial monopoly rents, rather than incentives or natural monopoly rents. Under the Compensation Theory of Income Justice the earning of artificial monopoly rents is not justified. Since subsidisation of university education fees increases lifetime artificial rents, the theory would recommend such subsidies be substantially reduced. I defend this conclusion against objections, the most notable of which is the view that university subsidies help to improve equality of opportunity to university education. I explain how it is possible to maintain the laudable aim of providing equality of opportunity while reducing the subsidisation and, as a consequence, the lifetime artificial rents. (shrink)

In the mainstream of Latin trinitarian theology during the Middle Ages, the Divine Persons were described as subsistent relations. This conception of the persons is commonly held to this day among Roman Catholic theologians. In this paper the author examines the conception, as it is presented by St.-Thomas Aquinas, in the light of philosophical advances that have been made in our knowledge of the nature of relations. The author argues that these advances make it impossible to accept Aquinas's position that (...) the Persons are subsistent relations, although the do not rule out the possibility of their being distinguished from one another by the relations that exist between them. The paper considers Renee Descartes’ assertion that believing that God exists because the Bible says so, and believing that what the Bible says is true because God says it, involves circular reasoning. It argues that there is no circularity involved in holding these beliefs, and maintains that the appearance of circularity results from an equivocation. It considers a line of argument that would defend the rationality of holding these beliefs, but does not try to prove its soundness.
