The literature of the past century produced an historical reconstruction of statics theory applied to mechanical structures coinciding–starting with Le Mecaniche (1634) and Discorsi e dimostrazioni matematiche sopra a due nuove scienze (1638) by Galileo Galilei (1564–1642). Based on previous research (RP) and our historical and historiographical line of research [37], in this paper we briefly analyse Buonaiuto Lorini (1540–1611) Le Fortificationi ([1596] 1609) as a bridge between the science of weights and early mechanical science, including the graphical scale and (...) machines. This is a fundamental and advanced military fortification–engineering treatise with an evident important relationship between theory & practice, including designs–projects of both fortresses and machines, understood as tools, to manufacture them. Lorini also presents an excursus on how fortifications developed according to the advent of new artillery/weapons, comprising the crucial passage from the use of square to circular towers up to the description of modern fortresses in all their details, e.g., bulwarks and cavaliers, curtains, orillons, star–shaped plans. Basing on Archimedes’ (fl. 287–212 BCE) techniques (law of the lever) and Guidobaldo del Monte's (1545–1607; Le Mecaniche (1577–1581) he successfully engaged in advanced mechanical considerations. His position (at the end of the first chapter) on the distinction between the mathematician (scientist) and the mechanician (architect–engineer or even machine expert) is historiographically very interesting within the difference between abstract Euclidean geometry and the application of its contents to imperfect and heterogeneous reality. We discuss applications of our account of moral status grounded in person-rearing relationships: which individuals have higher moral status or not, and why? We cover three classes of cases: (1) cases involving incomplete realization of the capacity to care, including whether infants or fetuses have this incomplete capacity; (2) cases in which higher moral status rests in part on what is required for the being to flourish; (3) hypothetical cases in which cognitive enhancements could, e.g., help dogs achieve human-like cognitive (...) capacities. In attempting to provide protection to individuals and communities, childhood immunization has benefits that far outweigh disease risks. However, some parents decide not to immunize their children with some or all vaccines for reasons including lack of trust in governments, health professionals, and vaccine manufacturers. This article employs a theoretical analysis of trust and distrust to explore how twenty-seven parents with a history of vaccine rejection in two Australian cities view the expert systems central to vaccination policy and practice. Our (...) data show how perceptions of the profit motive generate distrust in the expert systems pertaining to vaccination. Our participants perceived that pharmaceutical companies had a pernicious influence over the systems driving vaccination: research, health professionals, and government. Accordingly, they saw vaccine recommendations in conflict with the interests of their child and “the system” underscored by malign intent, even if individual representatives of this system were not equally tainted. This perspective was common to parents who declined all vaccines and those who accepted some. We regard the differences between these parents—and indeed the differences between vaccine decliners and those whose Western medical epistemology informs reflexive trust—as arising from the internalization of countering views, which facilitates nuance. This experiment uses quantitative and qualitative measures to address the effect of two syllabus statements on academic misconduct: one based on prohibitions and one on academic integrity. Students expressed favorable attitudes toward the statements, showed an increase in guilt compared to a control group, but showed no decrease in intentions to cheat. Including only a standard academic misconduct statement in one's syllabus is not sufficient to alter behavior, which should be acknowledged by faculty.

For disciplines depending upon precise definitions and distinctions, students’ notes provide an avenue for student engagement with skill and content. Activities enliven the classroom, and those discussed here can also help students develop and exercise critical thinking skills through note-taking. Lecturing and experiential learning happen hand-in-hand when the instructor uses teaching about notes and note-taking as a method for critical engagement with class content. In this paper, I integrate research on the cognitive function of student note-taking with research on student (...) engagement—particularly, motivating student learning, engaging students with texts, lecture, or discussion, and promoting metacognition about learning practices—by arguing that the instructor who teaches and emphasizes student note-taking elevates note-taking to a method of student engagement and daily critical thinking practice; I discuss particular methods for supporting teaching note-taking, methods that promote active learning, student engagement, and student understanding (and could be utilized in a variety of classes). Because of the coronavirus pandemic, reminders of death are particularly salient. Although much terror management theory research demonstrates that people engage in defensive tactics to manage mortality awareness, other work shows that existential concerns can motivate growth-oriented actions to improve health. The present study explored the associative link between coronavirus anxieties, fear of death, and participants' well-being. Results, using structural equation modeling, found that increased mortality concerns stemming from COVID-19 were associated with heightened benefit finding from the pandemic. Increased benefit (...) finding, in turn, was related to higher life satisfaction, meaning in life, self-esteem, resilience, and vitality while also correlating negatively with depression and stress scores. There was no evidence for reverse mediation in that fear of mortality did not predict well-being through coronavirus worries. Overall, although many persons have experienced mental health concerns as a function of the COVID-19 pandemic, our findings demonstrate positive benefits that paradoxically follow in terms of an increased appreciation of life, improved relationships, and better health. In this article, the authors operationalize the intersection of gender and race in survey research. Using quantitative data from the Multi-City Study of Urban Inequality, they investigate how gender/racial stereotypes about African Americans affect Whites’ attitudes about two types of affirmative action programs: job training and education and hiring and promotion. The authors find that gender/racial prejudice towards Black women and Black men influences Whites’ opposition to affirmative action at different levels than negative attitudes towards Blacks as a group. Prejudice (...) toward Black women has a larger effect on Whites’ policy preferences than does prejudice toward Black men or Blacks in general. In future research, survey methodologists should develop better intersectional measures to further document these gender/racial attitudes. (shrink)

In the wake of the collapse of the Soviet bloc, it is timely to ask what continuing role, if any, the concept of sovereignty can and should play in the emerging "new world order." The aim of _Law, Power, and the Sovereign State_ is both to counter the argument that the end of the sovereign state is close at hand and to bring scholarship on sovereignty into the post-Cold War era. The study assesses sovereignty as status and as power and (...) examines the issue of what precisely constitutes a sovereign state. In determining how a political entity gains sovereignty, the authors introduce the requirements of de facto independence and de jure independence and explore the ambiguities inherent in each. They also examine the political process by which the international community formally confers sovereign status. Fowler and Bunck trace the continuing tension of the "chunk and basket" theories of sovereignty through the history of international sovereignty disputes and conclude by considering the usefulness of sovereignty as a concept in the future study and conduct of international affairs. They find that, despite frequent predictions of its imminent demise, the concept of sovereignty is alive and well as the twentieth century draws to a close. (shrink)

Background: Understanding is an important goal of the informed consent process in research. We sought to assess the interrater reliability (IRR) and concurrent validity of two measures of understanding in child and young adult subjects and their parents. Methods: We conducted a cross-sectional survey and interview-based study of children and young adults participating in a clinical trial for cancer, along with one parent per child or young adult subject. We estimated the IRR of the Semi-Structured Comprehension Interview (SSCI) and the (...) MacArthur Competence Assessment Tool for Clinical Research (MacCAT-CR). We also estimated concordance between the SSCI, the MacCAT-CR, and the Quality of Informed Consent (QuIC). Results: For our sample of 32 subjects (16 parent–child pairs), IRR estimates were high for total score on the SSCI (intraclass correlation coefficient [ICC] = 0.88, 95% confidence interval [CI] = 0.76–0.94), as well as on the understanding (ICC = 0.93, 95% CI = 0.86–0.97) and reasoning (ICC = 0.97, 95% CI = 0.94–0.98) subscales of the MacCAT-CR. IRR was lower for the appreciation subscale of the MacCAT-CR (ICC = 0.70, 95% CI = 0.47–0.84). Scores on the SSCI were strongly correlated with scores on the understanding subscale of the MacCAT-CR (Spearman's rho = 0.72, 95% CI = 0.48–0.85) and the QuIC (Spearman's rho = 0.66, 95% CI = 0.24–0.87). Mean administration time for the SSCI was 3.1 minutes (95% CI = 2.7–3.5 minutes). Conclusions: The SSCI is a valid and reliable measure of understanding for use with both pediatric and adult research participants. It is easy to administer and score consistently, even by nonprofessional raters. The SSCI is a promising tool for use by clinician-investigators to study, detect, and correct deficiencies in understanding among children, adolescents, and adults making decisions about research participation. Biomedical research is increasingly carried out in low- and middle-income countries. International consensus has largely been achieved around the importance of valid consent and protecting research participants from harm. But what are the responsibilities of researchers and funders to share the benefits of their research with research participants and their communities? After setting out the legal, ethical and conceptual frameworks for benefit sharing, this collection analyses seven historical cases to identify the ethical and policy challenges that arise in relation to (...) benefit sharing. A series of recommendations address possible ways forward to achieve justice for research participants in low- and middle-income countries. (shrink)

Canadian children’s literature rarely depicts characters labelled with intellectual disabilities, yet when it does it often remains mired in stereotypes that recycle prevalent myths and misconceptions. Even as more recent literature attempts to push back against such stereotypes, it nevertheless predominantly remains caught in these dangerous representational repertoires. This article offers a brief history of Canadian literary depictions of intellectual disability and a critique of the Canadian publishing spheres. Through a critical analysis of Lorna Schultz Nicholson’s book Fragile Bones, we (...) discuss the limits of representation of intellectual disability in children’s fiction. We also offer a critique of the ableist publishing climate in Canada and suggest that structural barriers prevent disabled writers from entering the literary marketplace on an equal playing field. These barriers to publishing lead to the vast underrepresentation of disabled authors and the misrepresentation of disability in general and intellectual disability in particular in Canadian children’s literature. This paper is dedicated to the first universities and mendicant schools, where thousands of students began to converge during the thirteenth century. Logic played an unpreceded role in basic and higher education. A “Parisian logical model” of education was shaped at the University of Paris, adopted by mendicant Orders in their schools of logic, diffused in all disciplines, and progressively spread in Southern Europe. Medieval education became heavily based upon logical, and even “logician” practices, with the “syllogization” of exegetical, disputational, (...) and evaluation practices.The notion of logical skill conveniently captures this unique situation for the discipline of logic, as well as the way medieval thinkers conceived of logic as a universal, transdisciplinary method, a natural operation of the mind, a modality of knowledge, the very form of teaching and graduating, a “habitus,” a technique and a science.The divisions of Aristotelian logic, the “artificial logic,” were for the first time naturalized and projected on the very structure of human mind, which was thereby “logicalized” and ascribed a “natural logic.” A strong anthropological dimension was bestowed on logic. The discipline of logic was deemed a necessary instrument in the philosophical “perfection” and the Christian “reparation” of man as an intellectual creature by a group of logically skilled, professional philosophers and theologians, whereas men deprived of logical education were described as “logically disabled,” and stuck into inferior forms of humanity.The world of medieval intellectual elites displayed a variety of social uses of logic, beyond academic circles, especially in the performance of pastoral duties. The possible historical records of the social usefulness of logic are explored: for students, the majority in medieval universities, who left university without a degree, but with a solid logical education, for ordinary mendicant friars, dedicated to preaching and confession, who frequented logical schools, and for members of the parish clergy sent to the faculties of arts. In the recent literature on explanation in biology, increasing attention is being paid to the connection between design explanation and mechanistic explanation, viz. the role of design principles and heuristics for mechanism discovery and mechanistic explanation. In this paper we extend the connection between design explanation and mechanism discovery by prizing apart two different types of design explanation and by elaborating novel heuristics that one specific type offers for mechanism discovery across species. We illustrate our claims in terms of two (...) lines of biological research on the biological advantages of organismal traits, one on the eye-size of giant squid, the other on foraging habits of specific bat species. We argue that this research illustrates useful heuristics for mechanism discovery across species, viz. reasoning strategies to infer likely mechanisms for a certain biological role based on assessments of the environmental conditions in which the role is performed efficiently and less or in-efficiently. We bring out the novel features of our analysis in terms of a comparison with mechanistic approaches to mechanism discovery, amongst which graph-theoretical ones, and by comparing the different types of design explanation and the discovery heuristics they support. In this paper we assess the explanatory role of idealizations in ‘design explanations’, a type of functional explanation used in biology. In design explanations, idealizations highlight which factors make a difference to phenomena to be explained: hypothetical, idealized, organisms are invoked to make salient which traits of extant organisms make a difference to organismal fitness. This result negates the view that idealizations serve only pragmatic benefits, and complements the view that idealizations highlight factors that do not make a difference. This (...) analysis in particular strengthens the perspective that idealizations are means to highlight difference making factors, and identifies a novel, more direct role for idealizations in doing so. It thus offers a novel argument why in some explanatory contexts idealizations are in-eliminable. (shrink)

Remote monitoring of implantable cardioverter defibrillator (ICD) patients links patients wirelessly to the clinic via a box in their bedroom. The box transmits data from the ICD to a remote database accessible to clinicians without patient involvement. Data travel across time and space; clinicians can monitor patients from a distance and instantly know about cardiac events. Based on ethnographic fieldwork in two Danish hospitals, this article explores the configuration of the wireless ICD patient by following a number of patients through (...) hospitalisation, implantation, in-clinic follow-up, and remote monitoring. Wireless therapy, we argue, scripts the patient as data. In high-tech clinical encounters, data are enacted as extensions and copies of the patient, and even proxies that, in patients’ experiences, may turn into identity thieves. In illuminating the multiple positions that data take in such clinical encounters and in patients’ experiences we discuss the ambiguities that arise when patients go wireless. (shrink)

In this paper, we offer an introduction to case study research in the social sciences. We begin with a discussion of the definition of case study research. Next, we point to various purposes that case study research may serve in the social sciences and then turn to outline the main philosophical issues raised by case study research. Finally, we briefly present the papers in this special issue.

We discuss how the Arab Spring is a reflection of the resiliency of the human rights regime. In order to accomplish this, we explore the extent to which the Arab Spring represents norm diffusion among Middle East and North Africa states. Specifically, we examine the cases of Tunisia, Egypt, and Bahrain and consider how economic and demographic changes created space for human rights discourse in these countries. We find that, in the case of MENA states, the Arab Spring represents significant (...) pressure from below. Access to new forms of social media allowed civil society to organize, publicize, and protest relatively efficiently. Social media expanded the potential role of individuals and created newly empowered latent human rights activists who emerged as leaders of the norm diffusion process. The resulting diffusion of human rights norms in the Arab region represents one of the most significant expansions of the human rights regime since the regime’s inception. (shrink)

In the recent methodological individualism-holism debate on explanation, there has been considerable focus on what reasons methodological holists may advance in support of their position. We believe it is useful to approach the other direction and ask what considerations methodological individualists may in fact offer in favor of their view about explanation. This is the background for the question we pursue in this paper: Why be a methodological individualist? We start out by introducing the methodological individualism-holism debate while distinguishing two (...) forms of methodological individualism: a form that says that individualist explanations are always better than holist accounts and a form that says that providing intervening individualist mechanisms always makes for better explanations than purely holist ones. Next, we consider four lines of reasoning in support of methodological individualism: arguments from causation, from explanatory depth, from agency, and from normativity. We argue that none of them offer convincing reasons in support of the two explanatory versions of individualism we consider. While there may well be occasions in which individualists’ favorite explanations are superior, we find no reason to think this always must be the case. (shrink)

Although performance pressure has desirable consequences, there is evidence that it can produce unintended outcomes as employees tend to engage in dysfunctional and unethical behaviors to meet performance goals. Thus, the process through which employees think and behave unethically under performance pressure deserves more research attention. This study goes beyond the stress-appraisal perspective and investigates whether and when performance pressure influences individual work mindsets and behaviors from a moral reasoning perspective. Specifically, we contend that performance pressure is related to employee (...) expediency through moral decoupling. We further hypothesize dialectical thinking and moral identity to be the boundary conditions of the proposed relationships. Analyses of data from a field study in three waves provide support for most of the hypotheses. In particular, we find that moral decoupling accounts for additional variance after we control for the stress-appraisal effect of performance pressure on employee expediency. The study offers several contributions to the literature on performance pressure and unethical behavior. (shrink)

This collection of papers investigates the most recent debates about individualism and holism in the philosophy of social science. The debates revolve mainly around two issues: firstly, whether social phenomena exist sui generis and how they relate to individuals. This is the focus of discussions between ontological individualists and ontological holists. Secondly, to what extent social scientific explanations may and should, focus on individuals and social phenomena respectively. This issue is debated amongst methodological holists and methodological individualists. -/- In social (...) science and philosophy, both issues have been intensively discussed and new versions of the dispute have appeared just as new arguments have been advanced. At present, the individualism/holism debate is extremely lively and this book reflects the major positions and perspectives within the debate. Questions concerning the aims and aspirations, criteria of success and even proper delineation of the subject matter of theories of law have given rise to some of the most intractable and contentious debates in contemporary legal philosophy. In this article, I outline my vision of the remit and character of legal philosophy, with particular emphasis on the methodological approach with which I am most concerned in my own work, and which I refer to here as ‘indirectly evaluative legal philosophy’. I (...) do so partly in response to some vehement criticisms of, and, in my view, significant mischaracterisations of, IELP and cognate approaches to theorising about law, which feature in some recent jurisprudential debates. My position supports a pluralistic methodological outlook which emphasises disciplinary and sub-disciplinary complementarity as an alternative to the febrile adversarialism sometimes afflicting our discipline. Broadly speaking, an entity has moral status if and only if it or its interest matters morally for its own sake. Some philosophers, who think of moral status in terms of duties and rights owed to an entity, allow that moral status can come in degrees, with only some beings having status of the highest degree – that is, full moral status (FMS). We critically review the competing accounts of what qualifies one for FMS. Some accounts demand cognitive sophistication, which (...) excludes many children, while others are inclusive of children but fail by (a) putting children morally on a par with most animals (experiencing subject of a life), (b) invoking criteria of dubious moral relevance (potentiality, membership in a biological species), or (c) not securing impartial moral status (special relationships). This paper discusses the so-called non-interference assumption (NIA) grounding causal inference in trials in both medicine and the social sciences. It states that for each participant in the experiment, the value of the potential outcome depends only upon whether she or he gets the treatment. Drawing on methodological discussion in clinical trials and laboratory experiments in economics, I defend the necessity of partial forms of blinding as a warrant of the NIA, to control the participants’ expectations and their strategic interactions (...) with the experimenter. In recent years regenerative agriculture has attracted growing attention as a means to improve soil health and farmer livelihoods while slowing climate change. With this attention has come increased policy support as well as the launch of private sector programs that promote regenerative agriculture as a form of carbon farming. In the United States many of these programs recruit primarily in regions where large-scale commodity production prevails, such as the Great Plains. There, a decades-old regenerative agriculture movement is growing rapidly, (...) but not due to the incentives offered by companies’ carbon programs. On the contrary, farmers are adopting regenerative practices to cut their dependence on corporate agrochemical inputs and expertise, and to thereby achieve technology sovereignty. These practice changes often strain farmers’ existing social relationships while drawing them into new and previously neglected ones, including the more-than-human relations necessary for building soil health. These new relationships and the knowledge they generate may in turn lead farmers to think differently about their own autonomy. These findings provide insight into farmers’ skepticism of private sector carbon farming programs, and highlight the value of attention to the multiple types of relationship change that accompany and facilitate regenerative transitions. The argument from multiple realization is currently considered the argument against intertheoretic reduction. Both Little and Kincaid have applied the argument to the individualism-holism debate in support of the antireductionist holist position. The author shows that the tenability of the argument, as applied to the individualism-holism debate, hinges on the descriptive constraints imposed on the individualist position. On a plausible formulation of the individualist position, the argument does not establish that the intertheoretic reduction of social theories is highly unlikely. Nonetheless, (...) the reductive project may run into other potential obstacles. For this reason, it is concluded that the prospect of intertheoretic reduction is uncertain rather than unlikely.
