Alors qu'il est encore bien malaisé de porter un jugement éthique et juridique sur le développement des biotechnologies, chacun s'interroge sur la justification et les risques des techniques les plus récentes, les perspectives qu'elles ouvrent à l'homme, mais également leur compatibilité avec la dignité de la personne. Lors d'un colloque pluridisciplinaire et international organisé par (...) la Faculté de droit de Nancy, le Centre Juridique Franco-Allemand et le Groupe de recherche de droit médical de l'Université de la Sarre, juristes, philosophes et médecins se sont penchés ensemble sur ces questions essentielles. Leurs réflexions et les discussions qu'elles ont engendrées, à la lumière des sensibilités française et allemande, font l'objet du présent ouvrage. En langue française, les diverses contributions sont suivies d'un résumé en allemand. Les fulgurants progrès des biotechnologies offrent incontestablement à l'humanité des chances nouvelles. Mais face à des biologistes dont certains se prennent déjà pour Dieu, il devient d'une urgente nécessité de réaffirmer les Droits de l'Homme. Qu'il s'agisse de procréation médicalement assistée, de thérapie génique ou d'expérimentation sur l'homme, une conclusion s'impose : lorsqu'elle menace la dignité de la personne, la liberté de la Science doit être limitée. This article discusses the role of the mental in the analysis of criminal liablity. The relation between the general conditions for mens rea and those of criminal liability are considered. Claims made by John Gardner and Heike Jung are considered. Their suggestion that there is a hard and fast distinction between the principles of moral and criminal culapability are considered and shown to have some absurd conclusions.

BackgroundInnovations in technology have contributed to rapid changes in the way that modern biomedical research is carried out. Researchers are increasingly required to endorse adaptive and flexible approaches to accommodate these innovations and comply with ethical, legal and regulatory requirements. This paper explores how Dynamic Consent may provide solutions to address challenges encountered when researchers invite individuals to participate in research and follow them up over time in a continuously changing environment.MethodsAn interdisciplinary workshop jointly organised by the University of Oxford (...) and the COST Action CHIP ME gathered clinicians, researchers, ethicists, lawyers, research participants and patient representatives to discuss experiences of using Dynamic Consent, and how such use may facilitate the conduct of specific research tasks. The data collected during the workshop were analysed using a content analysis approach.ResultsDynamic Consent can provide practical, sustainable and future-proof solutions to challenges related to participant recruitment, the attainment of informed consent, participant retention and consent management, and may bring economic efficiencies.ConclusionsDynamic Consent offers opportunities for ongoing communication between researchers and research participants that can positively impact research. Dynamic Consent supports inter-sector, cross-border approaches and large scale data-sharing. Whilst it is relatively easy to set up and maintain, its implementation will require that researchers re-consider their relationship with research participants and adopt new procedures. (shrink)

Abstract This study was designed to investigate the factors affecting ethical practices of public relations professionals in public relations firms. In particular, the following organizational ethics factors were examined: (1) presence of ethics code, (2) top management support for ethical practice, (3) ethical climate, and (4) perception of the association between career success and ethical practice. Chinese mind-body exercises are positively associated with executive function, but their effects on EF, from synthesized evidence using systematic and meta-analytic reviews, have not been conducted. Therefore, the present systematic review with meta-analysis attempted to determine whether CMBEs affect EF and its sub-domains, as well as how exercise, sample, and study characteristics moderate the causal relationship between CMBEs and EF in middle-aged and older adults. Seven electronic databases were searched for relevant studies published from the inception of each database through (...) June 2020. Randomized controlled trials with at least one outcome measure of CMBEs on EF in adults of mean age ≥ 50 years with intact cognition or mild cognitive impairment and with or without chronic diseases were included. A total of 29 studies ultimately were included in this study. The results indicated that CMBEs improved overall EF, as well as its sub-domains of working memory and shifting. The beneficial effects of CMBEs on EF occurred regardless of type, frequency of group classes, session time, total training time, and length of the CMBEs, in addition to that more frequent participation in both group classes and home practice sessions resulted in more beneficial effects. The positive effects of CMBEs on EF were also demonstrated, regardless of participants mean age, sex, and cognitive statuses, health status, as well as training mode and study language. This review thus suggests that CMBEs can be used as an effective method with small to moderate and positive effects in enhancing EF, and that more frequent group classes and home practice sessions may increase these effects. However, certain limitations, including strictly design studies, limited ES samples for specific variables, and possible biased publications, required paying particular attention to, for further exploring the effects of CMBEs on EF. In the quest to build truly sustainable corporations and supply chains, we propose the moral responsibility theory of corporate sustainability and the moral responsibility theory of sustainable supply chain. Built from morality literature in philosophy, the view of corporations as moral agents in law, and analyses of corporate hypocrisy and its role in an organization’s and its members’ behaviors, our theories show how a truly sustainable corporation and its external supply chain could emerge. At the core, we believe that without (...) a sense of moral responsibility businesses throughout the supply chain will not be truly sustainable. In today’s highly globalized and fragmented business environments, corporations do businesses with external supply chain partners, and without the truly sustainable supply chain partners, they may not be able to achieve sustainability goals. Moreover, for such a supply chain to be truly sustainable, each member of the supply chain must also be truly sustainable. For each member of the supply chain to be truly sustainable, the individuals who work in a corporation must be truly sustainable as well. That is, a truly sustainable supply chain cannot be established without its member corporations’ and employees’ commitment to and successes in sustainability. This paper shows how business moral responsibility and corporate sustainability are closely intertwined. How these theories could be applied in the corporate and supply chain settings are discussed, and future research opportunities are presented. (shrink)

A recent paper by Jakl, Jung and Pultr succeeded for the first time in establishing a very natural link between bilattice logic and the duality theory of d-frames and bitopological spaces. In this paper we further exploit, extend and investigate this link from an algebraic and a logical point of view. In particular, we introduce classes of algebras that extend bilattices, d-frames and N4-lattices to a setting in which the negation is not necessarily involutive, and we study corresponding logics. Sein Denken reicht in viele Bereiche der Philosophie und der Wissenschaften, der geistigen Kultur und der Alltagswelt hinein. Dieser Band verfolgt das Ziel, den Philosophen Georg Simmel (wieder) zu entdecken. Krishnachandra's re-articulation of Kant's transcendental system challenges Kant's conceptualization of 'apperceptive self' conceived as a logical function which is as well the precondition of all our knowledge claims. In Kant's framework, though this "unity of consciousness" is projected as a principle, which undertakes a foundational role as 'apperceptive I', it is capacitated with merely a logical function. Krishnachandra disagrees with Kant's reduction of function of the "self" to a logical process. This reduction would render knowledge of the "self" to be (...) an inferential knowledge, thus making this derivation analogous to the proofs of the transcendental conditions of understanding and sensibility through the logical process of deductions. Krishnachandra's question is: whether this equation established between logical function of 'apperception' and the "self" will suffice to establish the "certitude" of knowledge claims. This is the first task Krishnachandra addresses in his work, Studies in Kant which is elucidated in the following section of this paper. Further, we will see how Krishnachandra’s exploration into the dynamics of this problem leads him to alternatively foreground the "unity", which is much sought by Kantian scholars, between the theoretical and the practical domains of Reason. This chapter explores Rainer Forst’s justification-centric view of nondomination toleration. This view places an idea of equal respect and a corresponding requirement of reciprocal and general justification at the core of non-domination toleration. After reconstructing this view, this chapter addresses two issues. First, even if this idea of equal respect requires the limits of non-domination toleration to be drawn in a manner that is equally justifiable to all affected people, equal justifiability should not be understood in terms of Forst’s requirement (...) of reciprocal and general acceptability. Second, for the equal justifiability of relevant constraints to ensure non-domination outcomes, discursive equality must be understood in substantive, purchase-sensitive terms. This means that a justification-centric view of non-domination toleration stands or falls with the participation value of what it regards as the standards of justification. This places reasonably contested matters of value at the heart of such views. (shrink)

We can have credences in an infinite number of propositions—that is, our opinion set can be infinite. Accuracy-first epistemologists have devoted themselves to evaluating credal states with the help of the concept of ‘accuracy’. Unfortunately, under several innocuous assumptions, infinite opinion sets yield several undesirable results, some of which are even fatal, to accuracy-first epistemology. Moreover, accuracy-first epistemologists cannot circumvent these difficulties in any standard way. In this regard, we will suggest a non-standard approach, called a relativistic approach, to accuracy-first (...) epistemology and show that such an approach can successfully circumvent undesirable results while having some advantages over the standard approach. BackgroundAttention deficit hyperactivity disorder is clinically diagnosed; however, quantitative analysis to statistically analyze the symptom severity of children with ADHD via the measurement of head movement is still in progress. Studies focusing on the cues that may influence the attention of children with ADHD in classroom settings, where children spend a considerable amount of time, are relatively scarce. Virtual reality allows real-life simulation of classroom environments and thus provides an opportunity to test a range of theories in a naturalistic and (...) controlled manner. The objective of this study was to investigate the correlation between participants’ head movements and their reports of inattention and hyperactivity, and to investigate how their head movements are affected by different social cues of different sensory modalities.MethodsThirty-seven children and adolescents with and without ADHD were recruited for this study. All participants were assessed for diagnoses, clinical symptoms, and self-reported symptoms. A virtual reality-continuous performance test was conducted under four conditions: control, no-cue, visual cue, and visual/audio cue. A quantitativecomparison of the participants’ head movements was conducted in three dimensions using a head-mounted display in a VR classroom environment. Task-irrelevant head movements were analyzed separately, considering the dimension of movement needed to perform the VR-CPT.ResultsThe magnitude of head movement, especially task-irrelevant head movement, significantly correlated with the current standard of clinical assessment in the ADHD group. Regarding the four conditions, head movement showed changes according to the complexity of social cues in both the ADHD and healthy control groups.ConclusionChildren and adolescents with ADHD showed decreasing task-irrelevant movements in the presence of social stimuli toward the intended orientation. As a proof-of-concept study, this study preliminarily identifies the potential of VR as a tool to understand and investigate the classroom behavior of children with ADHD in a controlled, systematic manner. This paper aims to clarify the impact of destructive leadership on team innovation performance. It also explores the relevant conditions that maximize the above relationship. Specifically we examine how intra-team conflict organizational diversity moderate the relationship between destructive leadership team innovation performance. Finally the three-way interaction between destructive leadership intra-team conflict organizational diversity is analyzed for the worst conditions to maximize the negative effect of destructive leadership on team innovation performance. This paper used a cross-sectional design with questionnaires administered to (...) 87 teams with 479 team members working in Korean manufacturing service firms. It applied a hierarchical regression analysis to test the hypothesized relationships including three-way interaction effect among destructive leadership intra-team conflict organizational diversity on team innovation performance. This paper provided empirical insights about how destructive behaviors of team leader hindered team innovation performance. The three-way interaction effects also revealed that the higher the levels of both intra-team conflict organizational diversity the greater the negative effect of destructive leadership on team innovation performance. This paper demonstrates how team leaders’ behavior team organizational conditions result in discouraging overall innovation outcomes. This paper contributes to the innovation leadership literatures by identifying possible leadership type hindering innovation performance at team level the specific conditions their dynamic interaction strengthening the negative effect of destructive leadership on team innovation performance. This book investigates the different meanings and logics that the notion of qi/gi has acquired within the East Asian traditions in order to understand the diversity of these traditions. More specifically, this work focuses on investigating how the notion was understood by traditional Chinese and Korean philosophers.

Introduction: Congenital myasthenic syndromes refer to a heterogenic group of neuromuscular transmission disorders. CMS-subtypes are diverse regarding exercise intolerance and muscular weakness, varying from mild symptoms to life-limiting forms with neonatal onset. Long-term follow-up studies on disease progression and treatment-response in pediatric patients are rare.Patients and Methods: We analyzed retrospective clinical and medication data in a cohort of 32 CMS-patients including the application of a standardized, not yet validated test to examine muscular strength and endurance in 21 patients at the (...) last follow-up. Findings obtained in our cohort were compared with long-term follow-up studies of CMS-cohorts from the literature by considering the underlying molecular mechanisms. Outcomes of CMS-ST were compared to results of normal clinical assessment.Results: Thirty-two pediatric patients with defects in eight different CMS-genes were followed by a median time of 12.8 years. Fifty-nine percentage of patients manifested with first symptoms as neonates, 35% as infants. While 53% of patients presented a reduced walking distance, 34% were wheelchair-bound. Even under adequate therapy with pyridostigmine and 3,4-diaminopyridine, CHAT-mutations led to the progression of muscular weakness partly in combination with persistent respiratory and bulbar symptoms. RAPSN, CHRND, and CHRNB1 patients with neonatal manifestation, early respiratory problems, and bulbar symptoms showed a good and maintained treatment response. CHAT and CHRNE patients required higher PS dosages, whereas RAPSN patients needed a lower mean dosage at the last follow-up. The benefits of short-term medication and long-term progression of symptoms were highly dependent on the specific genetic defect. CMS-ST was carried out in 17/21 patients, determined affected muscle groups including bulbar and ocular symptoms, some of which were not reported by the patients.Conclusions: Our findings and comparison with the literature- suggest a better treatment-response and less severe progression of symptoms present in patients suffering from mutations in CMS-genes directly associated with receptor deficiency, while patients with defects leading to synaptopathy and presynaptic defects tend to have worse outcomes. Assessment of affected muscular groups and clinical symptoms by CMS-ST may be a useful tool for optimal therapeutic management of the patients, especially for future clinical studies. (shrink)

There are many views about the structure of concepts, a plausible one of which is the theory-theory. Though this view is plausible for concrete concepts, it is unclear that it would work for abstract concepts, and then for moral concepts. The goal of this paper is to provide a plausible theory-theory account for moral concepts and show that it is supported by results in the moral psychology literature. Such studies in moral psychology do not explicitly contend for the theory-theory of (...) moral concepts, but I demonstrate that they actually do provide evidence for the use of theory knowledge at times in moral categorization and decision-making. In philosophy of cognitive science, I newly show that there is evidence that the theory-theory does apply to some moral concepts. (shrink)

There is the widely held view that quantum physics differs fundamentally from classical physics regarding measurements. In order to prepare the ground for settling this question we discuss the consequences it has for classical physics if one includes measurement in the theory. After explaining the terms measurement and error it is argued that every measurement can be reduced to a measurement of length and/or number. Additionally to the wellknown statistical and systematical errors we introduce the concept of classical uncertainty which (...) states that every measurement of a physical quantity _A_ carries a finite inaccuracy Δ_A_. Hence it is transempirical to assign an infinite decimal number to a measurement. This implies that, also in classical physics, only probabilistic predictions are possible and that we need ensembles for the empirical testing of theoretical predictions. Furthermore we rebut the claim that in classical physics measurements can be performed without any disturbance of the system under investigation. Finally we state that by including measurements in the theory itself classical physics like quantum physics can be formulated as an indeterministic theory. Likewise both theories can be formulated deterministically if measurements are excluded from the theory. _German_ Gemäß einer weit verbreiteten Sichtweise gibt es hinsichtlich der Messung in der Quantenphysik und in der klassischen Physik einen grundlegenden Unterschied. Um einer Klärung dieser Frage den Boden zu bereiten, versuchen wir für die klassische Physik die Folgen zu diskutieren, die sich ergeben, wenn man die Messung in die Theorie mit einbezieht. Zunächst wird dafür argumentiert, dass jede Messung auf eine Längenbzw. Zählmessung zurückzuführen ist. Wir führen zusätzlich zu den bekannten Arten von Messfehlern – statistischen und systematischen Fehlern – das Konzept der klassischen Messunschärfe ein, das abbildet, dass jede Messung einer Messgröße _A_ mit einer endlichen Ungenauigkeit Δ_A_ behaftet sein muss. Dies bedeutet insbesondere, dass die Angabe von nichtendlichen Dezimalzahlen für Messwerte transempirisch ist. Die Betrachtung der Messfehler führt zu der Folgerung, dass auch in der klassischen Physik nur mehr Wahrscheinlichkeitsaussagen getroffen werden können und Messungen an Ensembles zur empirischen Bestätigung theoretischer Vorhersagen nötig sind. Außerdem wird die Behauptung entkräftet, in der klassischen Physik seien im Prinzip Messungen möglich, die den Zustand eines Systems nicht stören. Abschließend stellen wir heraus, dass durch Einbeziehung der Messung in die Theorie die klassische Physik wie die Quantenphysik als indeterministischen Theorie formuliert werden kann, ebenso wie beide ohne Einbeziehung der Messung deterministisch formuliert werden können. Some critics nowadays are calling for the development of a transracial or “color-blind” society. They claim that the current focus on multiculturalism is causing undue social conflict. In general, these critics want to promote an absolute culture that provides a universal standard for assimilation. The problem with this approach to maintaining social order is that diversity is undermined, along with key elements of democracy. What is needed, instead, is an image of society that does not require unquestioned assimilation in order (...) to insure solidarity. In this way, the democratization of culture can be promoted.
