In Between Facts and Norms, Jürgen Habermas works out the legal and political implications of his Theory of Communicative Action (1981), bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more. The introduction by William Rehg succinctly captures the special nature of the work, (...) noting that it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. Finally, the work frames and caps these arguments with a bold proposal for a new paradigm of law that goes beyond the dichotomies that have afflicted modern political theory from its inception and that still underlie current controversies between so-called liberals and civic republicans. The book includes a postscript written in 1994, which restates the argument in light of its initial reception, and two appendixes, which cover key developments that preceded the book. Hegel has had a remarkable, yet largely unremarked, role in Canada's intellectual development. In the last half of the twentieth-century, as Canada was coming to define itself in the wake of World War Two, some of Canada's most thoughtful scholars turned to the work of G.W.F. Hegel for insight. Hegel and Canada is a collection of essays that analyses the real, but under-recognized, role Hegel has played in the intellectual and political development of Canada. The volume focuses on the generation (...) of Canadian scholars who emerged after World War Two: James Doull, Emil Fackenheim, George Grant, Henry S. Harris, and Charles Taylor. These thinkers offer a uniquely Canadian view of Hegel's writings, and, correspondingly, of possible relations between situated community and rational law. This article contains reflections on the further structural transformation of the public sphere, building on the author’s widely-discussed social-historical study, The Structural Transformation of the Public Sphere, which originally appeared in German in 1962 (English translation 1989). The first three sections contain preliminary theoretical reflections on the relationship between normative and empirical theory, the deliberative understanding of democracy, and the demanding preconditions of the stability of democratic societies under conditions of capitalism. The fourth section turns to the implications of digitalisation (...) for the account of the role of the media in the public sphere developed in the original work, specifically to how it is leading to the expansion and fragmentation of the public sphere and is turning all participants into potential authors. The following section presents empirical data from German studies which shows that the rapid expansion of digital media is leading to a marked diminution of the role of the classical print media. The article concludes with observations on the threats that these developments pose for the traditional role of the public sphere in discursive opinion and will formation in democracies. (shrink)

This anthology brings together for the first time, in revised or new translation, ten essays that present the main concerns of Jürgen Habermas's program in formal pragmatics. Jürgen Habermas's program in formal pragmatics fulfills two main functions. First, it serves as the theoretical underpinning for his theory of communicative action, a crucial element in his theory of society. Second, it contributes to ongoing philosophical discussion of problems concerning meaning, truth, rationality, and action. By the "pragmatic" dimensions of language, Habermas means (...) those pertaining specifically to the employment of sentences in utterances. He makes clear that "formal" is to be understood in a tolerant sense to refer to the rational reconstruction of general intuitions or competences. Formal pragmatics, then, aims at a systematic reconstruction of the intuitive linguistic knowledge of competent subjects as it is used in everyday communicative practices. His program may thus be distinguished from empirical pragmatics--for example, sociolinguistics--which looks primarily at particular situations of use. The intuitive Variety of Evidence Thesis states that, ceteris paribus, more varied evidence for a hypothesis confirms it more strongly than less varied evidence. Recent Bayesian analyses have raised serious doubts in its validity. Claveau suggests the existence of a novel type of counter-example to this thesis: a gradual increase in source independence can lead to a decrease in hypothesis confirmation. I show that Claveau’s measure of gradual source independence suffers from two unsuspected types of inconsistencies. I hence put forward (...) a more natural measure of gradual source independence which is not plagued by inconsistencies. Claveau’s counter-examples to the variety of evidence thesis disappear with the measure I suggest. I hence argue that my measure is preferable and that this thesis does at least not seem to be troubled by Claveau’s arguments. (shrink)

This article reports on an empirical qualitative study on applying a Philosophy for Children (P4C) modeled science story to support the teaching of basic science process skills of classification, observation, and inference to a group of fifth-grade science students. The science story was written to model the skills for the children. From individual interviews with a focus group of 10 students, the findings show that the story modeled the understanding of classification, observation, and inference skills for the children as well (...) as encouraged reflection on the meaning of inference. The majority of the students identified with the fictional characters, particularly regarding traits such as cleverness and inquisitiveness, and with the learning context of the story. Implications for the theory and practice of P4C are discussed. (shrink)

Varied evidence for a hypothesis confirms it more strongly than less varied evidence, ceteris paribus. This epistemological Variety of Evidence Thesis enjoys long-standing widespread intuitive support. Recent literature has raised serious doubts that the correlational approach of explicating the thesis can vindicate it. By contrast, the eliminative approach due to Horwich vindicates the Variety of Evidence Thesis but only within a relatively narrow domain. I investigate the prospects of extending the eliminative approach to a larger domain by considering a larger (...) class of sensible explications of evidential variety. For a large subclass class of such explications I show how to construct cases in which the less diverse body of evidence for a hypothesis confirms more strongly. I hence argue that these prospects are dire since the eliminative approach widely fails to vindicate the thesis. (shrink)

Frequently, historical comparisons are asymmetrical in the sense that they investigate one case carefully while limiting themselves to a mere sketch of the other case which serve as comparative reference point. The debate on the German Sonderweg and the rich historical literature originating from this debate can serve as examples. This article reconstructs the pros and cons within this controversial debate, reports its results and puts it into a broader historical context. It analyzes the comparative logic implied by the Sonderweg (...) thesis and argues that the interpretation of modern German history in the sense of a Sonderweg can only be maintained if related to the question why Germany turned fascist and totalitarian in the interwar period while other societies did not, and if Western countries are selected as units of comparison. The choice of comparative reference points turns out to be decisive and partly dependent on normative priorities and conventions. The article points to dangers and opportunities inherent in asymmetrical comparison. (shrink)

The maximum entropy principle is widely used to determine non-committal probabilities on a finite domain, subject to a set of constraints, but its application to continuous domains is notoriously problematic. This paper concerns an intermediate case, where the domain is a first-order predicate language. Two strategies have been put forward for applying the maximum entropy principle on such a domain: applying it to finite sublanguages and taking the pointwise limit of the resulting probabilities as the size n of the sublanguage (...) increases; selecting a probability function on the language as a whole whose entropy on finite sublanguages of size n is not dominated by that of any other probability function for sufficiently large n. The entropy-limit conjecture says that, where these two approaches yield determinate probabilities, the two methods yield the same probabilities. If this conjecture is found to be true, it would provide a boost to the project of seeking a single canonical inductive logic—a project which faltered when Carnap's attempts in this direction succeeded only in determining a continuum of inductive methods. The truth of the conjecture would also boost the project of providing a canonical characterisation of normal or default models of first-order theories. Hitherto, the entropy-limit conjecture has been verified for languages which contain only unary predicate symbols and also for the case in which the constraints can be captured by a categorical statement of quantifier complexity. This paper shows that the entropy-limit conjecture also holds for categorical statements of complexity, for various non-categorical constraints, and in certain other general situations. (shrink)

Bringing together writings on united Germany, this volume addresses the consequences of German history, the challenges and perils of the post-Wall era, and Germany's place in contemporary Europe. The author argues that 1945 - not 1989 - was the crucial turning point in German history.

Objective Bayesians hold that degrees of belief ought to be chosen in the set of probability functions calibrated with one’s evidence. The particular choice of degrees of belief is via some objective, i.e., not agent-dependent, inference process that, in general, selects the most equivocal probabilities from among those compatible with one’s evidence. Maximising entropy is what drives these inference processes in recent works by Williamson and Masterton though they disagree as to what should have its entropy maximised. With regard to (...) the probability function one should adopt as one’s belief function, Williamson advocates selecting the probability function with greatest entropy compatible with one’s evidence while Masterton advocates selecting the expected probability function relative to the density function with greatest entropy compatible with one’s evidence. In this paper we discuss the significant relative strengths of these two positions. In particular, Masterton’s original proposal is further developed and investigated to reveal its significant properties; including its equivalence to the centre of mass inference process and its ability to accommodate higher order evidence. Entwicklungen in diesen beiden Bereichen haben somit stets Auswirkungen sowohl auf die anderen Knoten als auf das Beziehungsgeflecht als Ganzes. Ingenieur- und Naturwissenschaften sind als ars humana zudem stets eine Form menschlicher Handlung. Damit werden sie zu einem Schlüsselproblem der theoretischen und praktischen Philosophie. Denn der Mensch, seine Handlungen und seine Eingliederung in die Gesellschaft stehen ebenso wie die Natur und die (...) Kultur seit jeher im Zentrum philosophischer Untersuchungen. Die Philosophie vermag diese beiden Wissenschaftsbereiche zu fundieren und kritisch zu begleiten. Philosophie, Ingenieur- und Naturwissenschaften haben das Vermögen, sich gegenseitig zu befruchten. In Anbetracht der humanen, sozialen und ökologischen Probleme des 21. Jhds. ist die fachbereichsübergreifende und partnerschaftliche Zusammenarbeit dieser drei Schlüsselbereiche unabdingbar. Sie ist eine nicht hintergehbare Grundbedingung aller Entwicklungen, die den Anspruch erheben, nachhaltig zu sein und damit dem normativen Leitziel folgen, heutigen und zukünftigen Generationen bedingungslos ein menschenwürdiges Leben zu ermöglichen. Ingenieure und Naturwissenschaftler können dabei einen wesentlichen Beitrag leisten. Die folgenden zehn Thesen begründen die Bedeutung einer an Nachhaltigkeit orientierten philosophischen Grundbildung von Ingenieuren und Naturwissenschaftlern. (shrink)
